Al-Muqaronah: Jurnal Perbandingan Madzhab adalah jurnal ilmiah yang diterbitkan oleh Jurusan Perbandingan Mazhab, Sekolah Tinggi Ilmu Syariah Darussalam Bermi sejak tahun 2022 (versi online). Jurnal ilmiah ini mengkhususkan pada kajian pemikiran hukum Islam atau perbandingan hukum umum yang memuat karya-karya ilmiah yang berkaitan dengan pemikiran di bidang hukum, baik hukum umum (positif) maupun hukum Islam. Keberadaan Al-Muqaronah tentunya sangat penting dalam menggali, memperkaya, dan mengembangkan pemikiran dan teori hukum baik itu Hukum Islam maupun Positif.. Dengan demikian, Al-Muqaronah akan memberikan kontribusi positif dalam memperkaya khazanah pemikiran di bidang hukum, baik hukum Islam maupun hukum positif. Jurnal ini berupaya menyajikan berbagai hasil penelitian terkini, baik konseptual-doktrinal maupun empiris, di lapangan. Redaksi “Al-Muqaronah: Jurnal Perbandingan Madzhab” menyambut baik kontribusi berupa artikel yang akan diterbitkan setelah melalui mekanisme seleksi naskah, double-blind peer-review, dan proses editing. Al-Muqaronah: Jurnal Perbandingan MAdzhab dan Hukum terbit dua kali setahun pada bulan Juni dan Desember. Redaksi mengundang para ahli hukum Islam, ulama, peneliti dan ahli hukum untuk menulis atau menyebarluaskan hasil penelitian yang berkaitan dengan isu-isu hukum Islam serta hukum positif. Abstract

Tujuan penulisan artikel ini untuk menelisik lebih jauh bagaimana praktek pembagian harta warisan anak perempuan pada masyarakat suku Mbojo yang berada di Desa Nipa Kecamatan Ambalawi Kabupaten Bima. Pembagian harta warisan pada masyarakat Bima sangat mengedepankan asas hukum Islam yang dianggap sebagai pedoman utama untuk menyelesaikan persoalan warisan. Namun disisi lain juga justru persoalan warisan menjadi salah satu aspek yang menimbulkan perselisihan yang berimbas pada rusaknya hubungan kekeluargaan. Berangkat dari pernyataan tersebut maka hasil yang diperoleh dari  penulisan artikel ini adalah masyarakat Desa Nipa dalam pembagian harta warisan mereka menganut sistem bagi rata dan atas kepatuhan terhadap kedua orang tua semasih hidup sampai meninggal dunia, sistem yang dipakai masyarakat Desa Nipa ini sangat  berpengaruh pada praktik pembagian harta warisan nantinya. Pelaksanaan pembagian warisan pada masyarakat Desa Nipa, menggunakan sistem hukum adat istiadat secara turun temurun dan berdasarkan musyawarah/mufaakat yang dilaksanakan oleh masyarakat setempat. Dalam pewarisan harta warisan jatuh seluruhnya ke tangan pihak anak perempuan sedangkan ahli waris dari pihak Bapak dan ibu tidak mendapatkan harta warisan.

Abstract

The results of this research show that the perception of male and female employees at the Subdistrict Office regarding the five-day working day provision is that all of them say that they dominate the families of male and female employees at the Sekotong Subdistrict Office to support their families even though they have to work up to five working days, this It can be seen from the jobs of husband and wife whose income is different. Looking at the results of interviews conducted by researchers, the perceptions of male and female employees regarding the five-day working day provisions in the Sekotong Subdistrict Office environment are more focused because they have to follow regulations that must be obeyed and work also because of economic factors. The impact of marriages carried out while still working has positive and negative implications for household harmony. It has positive implications, namely the creation of a harmonious family and more enthusiasm in carrying out daily activities (earning a living) because marriage is carried out with careful planning, full of responsibility, honesty, and mutual understanding within the family, developing the principles of deliberation, openness to each other, respecting each other, plus the husband support his wife's career. Meanwhile, the negative implications are that the family is not in harmony, because they have to work from morning to evening, even longer than office hours because they have to complete unfinished office work. There is no time for family, lack of communication and lack of love for wife and children and seeing the weak economic condition of the family. Apart from that, if a husband and wife both work from morning to evening, problems will arise in the family, such as lack of attention, lack of communication between wife and children and lack of togetherness (staying overnight).

The form of muamalah transaction that is often carried out by the Sasak tribe community, especially the people of South Kuripan Village, Kuripan West Lombok is the tradition of the ngerampek sadoh (Wage) system, this tradition of the ngerampek sadoh (Wage) system has been going on for a long time, and has even become a tradition that has been passed down from generation to generation until now. This. The discussion in this research concerns the sadoh system of farm workers in the "ngerampek" tradition in Kuripan Selatan Village, Kuripan District, West Lombok, NTB and what is the Maqhasid Syari'ah Perspective on the sadoh system of farm workers in the ngerampek tradition in Kuripan Selatan Village, Kuripan District, West Lombok, NTB. Sadoh System (Wages) in the Ngerampek Tradition in Kuripan Selatan Village, Kuripan, West Lombok, the rental period for agricultural labor services in the ngerampek tradition does not have clear time provisions for mu'jir and musta'jir, only the rental period for services is until the end of the harvest (conditional), wages depending on the harvest, if the harvest is 9 quintals then the wages are 1 quintal, the wages depend on the harvest location, if the location is difficult then the wages are a lot, otherwise the wages are small, wages are based on a piece rate or batch system and depend on the harvest, and if viewed from the perspective of maqâ?id syari'ah then The wage system in this ngerampek tradition has legal consequences which are detailed as follows: the rental period for agricultural labor services and wages depending on the harvest that apply in this tradition are permitted because in the custom what is seen is that its existence is carried out for the sake of maintaining ?aruriyyatil khamsah and achieving benefit between both parties, while the wage system depends on the harvest and wages with a piece rate or bangketan system and depending on the harvest are prohibited in order to prevent conflict (sadd al-?ari'ah)

Abstract

This writing aims to analyze the cencept of the rule of law in perspective philosopical, social, and political for a just and prosperous Indonesia through inspection and rearrangement of laws and regulations to create order laws and regulations be taking into account the general principles and hierarchy of invitation, reforming the legal structure through institusional strengthening with increase the profesionalism of law enforcers. The research method used in this writing is a descriptive study that describes the rule of law in a philosopical, social, and political perspective for Indonesia fair prosperous. The rule of law philosopically, the law must be in accordance with the system, theory, principles, functions and objectives of law. The sosiological aspect of the law emerged from the aspirations of the community so that it is accepted and obeyed by the community. Meanwhile, from a political perspective, the law must be made by the goverment an independent state and not a colonial legacy.

Abstract

Children who violate the law or commit criminal acts are greatly influenced by several other factors outside the child, such as relationships, education, playmates and so on. Because criminal acts committed by children are generally a process of imitating anything influenced by negative actions from adults or those around them. Abstract

This study was conducted to determine the political Islam of Indonesia position in the world, it could become a center for world peace. Cause of the socio - political situation of Islam has recently faced what is called a real and inevitable paradox, accompanied by its status as the largest religion in Indonesia. In previous era, Islam managed to come out as a winner with a very real labeling and Islamic identity, other forces were unable to stem it, avoiding fear of defeat, let alone groups. But in reality, none of them last. In the socio - political dynamics of Indonesia, it turns out that Islamic politics is not necessarily easy to be a winner in political contestation in the case area and legal dimensions of Indonesia. This study is qualitative - descriptive based on field research, with historical approaches and political sociology. In conclusion, the Islamic ummah in Indonesia must be able to re-construct, re-solve and re-contextualize Indonesia's socio - political transformation. The exclusive nature of Indonesian Islam will in fact make it worse off because it is unable to withstand all changes. If the nature of inclusion becomes the main identity of Indonesian Muslims as a whole, political Islam in Indonesia will become the center of peace in the world. No country is as complex as Indonesia, in which various ethnicities, races, cultures, languages, religions and so on. But what other countries worry about Indonesia is in fact disproved. Indonesia has been able to survive until now with various differences, this is because of the Islamic figures in Indonesia. Although sometimes or even often religious issues are played only to gain power.

Abstract

Abstrak The discussion on the subject of gender in family law has been discussed more and more in light of both acamedic and gender activist? male views, and it is rarely asked for a famale?s opinion. Based on these studies the research in this article probes the famale?s view. Given how: the current reality in the field that demonstrates women?s lives in urban areas with her few public duties, wether their involvement in the public domain coincided with her understanding of gender. Based on the pheemona in this thesis has at least two questions, namely how the view of urban Muslims about the gender relations of husband and wife and what is behind the emergence of the view of urban Muslimah. The results of the study are: First, the background of the emergence of the thoughts and views of Jemaahn Yayasan Rumpun Nurani Foundation on the gender relations of husband and wife is at least influenced by three factors, namely religious understanding, science and knowledge, and social and cultural factors formed from personal experience. Second, Jamaah Pengajian Yayasan Rumpun Nurani considers that husband and wife relationships in the family do not have a fundamental difference between husband and wife. In terms of domestic labor division and decision-making is done flexibly, but for the fulfillment of family needs, it is entirely the husband's responsibility. Abstract

Kontroversi pernyataan Ahok yang menyinggung surat Al-Maidah ayat 51 di Kepulauan Seribu, menimbulkan reaksi luar biasa dari sebagian umat Islam di Indonesia dengan melakukan beberapa kali aksi demontrasi besar-besaran menuntut Ahok untuk dipenjarakan karena telah menistakan ayat Al-Qur’an dan Menghina ulama. Majelis Ulama Indonesia sebagai pemegang otoritas tertinggi dalam menentukan fatwa atau pendapat yang diajukan oleh orang Islam mengeluarkan fatwa bahwa Ahok telah menistakan agama Islam dan harus diproses secara hukum. Ketika perintah larangan memilih pemimpin non muslim sebagai pemimpin muslim dalam surat Al-Maidah ayat 51, bisa dikatakan bahwa terdapat “ketidak adilan” Allah dalam menentukan boleh tidaknya muslim dipimpin oleh non muslim. Jika hal ini diterapkan di negara yang konstitusi utamanya merujuk pada Al-Qur’an dan Hadits, maka hal ini tidak menjadi persoalan. Dalam konteks Indonesia, pluraitas agama tidak bisa dipungkiri, semua agama bisa hidup berdampingan di bawah pancasila dan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Dari penjelasan nahi, ‘aam, khas dan musytarak yang terdapat pada surat Al-Maidah ayat 51 lebih menunjukkan pelarangan kepada orang-orang mukmin untuk tidak menjadikan orang-orang Yahudi dan Nasrani sebagai teman setia atau membuat persekutuan dengan mereka. Karena ayat ini diturunkan kepada Nabi Muhammad ketika para orang Yahudi membangkang kepadanya. Ketika Nabi mengajak mereka yang membangkang untuk bertaubat dan memeluk Islam, justru mereka menantang untuk berperang. Maka penjelasan tentang surat Al-Maidah ayat 51 yang selama ini dipahami oleh sebagian umat Islam tentang larangan menjadikan Yahudi dan Nasrani sebagai pemimpin kurang tepat. Pada dasarnya ayat ini sebagai himbauan untuk tidak menjadikan Yahudi dan Nasrani yang mengolok-olok agama Islam dijadikan sebagai sekutu. Kata Kunci: Metode Bayani, Penafsiran, Kemimpinan

Abstract

Abstrak Ath-Thufi tampil beda dalam mengidentifikasi kedudukan maslahah dalam ajaran Islam. Ath-Thufi cenderung melandaskan konstelasi maslahah pada superioritas akal pikiran manusia. Bagi Ath-Thufi, visi akal lebih obyektif dalam memposisikan kriteria maslahah ketimbang antagonisme nash antara satu dengan yang lainnya.Pandangan ath-Thufi nampaknya bertitik tolak dari konsep maqasid at-tasyri' yang menegaskan bahwa hukum Islam disyari'atkan untuk mewujudkan dan memelihara maslahat umat manusia. Konsep ini telah diakui oleh para ulama dan oleh karena itu mereka memformulasikan suatu kaidah yang cukup populer, “Di mana ada maslahat, di sana terdapat hukum Allah.” Karena begitu pentingnya maqasid al-syariah tersebut, para ahli teori hukum menjadikan maqasid al-syariah sebagai salah satu kriteria (di samping kriteria lainnya) bagi mujtahid yang melakukan ijtihad. Adapun inti dari konsep maqasid al-syariah adalah untuk mewujudkan kebaikan sekaligus menghindarkan keburukan atau menarik manfaat dan menolak mudharat, istilah yang sepadan dengan inti dari maqasid al-syari'ah tersebut adalah maslahat, karena penetapan hukum dalam Islam harus bermuara kepada maslahat. Ada dua disampaikan kesimpulan yang dapat diambil dalam tulisan ini yaitu; Pertama, Kemajuan pengetahuan, ilmu, teknologi, bahkan filsafat (termasuk logika) pada masa sekarang, sekiranya dibandingkan dengan keadaan di masa kejayaan umat Islam terdahulu, telah terjadi secara sangat besar, mencengangkan, bahkan fundamental. Untuk itu dalam mengambil suatu ketetapan hukum melalui penelaran istishlahi harus bisa menyeimbangkan antara penalaran (akal) dan sumber hukum Islam (Al-Qur’an dan Hadist). Kedua, Berhati-hatilah apabila menggunakan penalaran istishlahi dengan mengedepankan nalar (akal), karena sebebas-bebasnya suatu penalaran maka harus dipertimbangkan dengan bijak sehingga kita bisa menjadi manusia yang tidak hanya berakal tapi juga berakhlak yang baik. Abstract

This research examines the phenomenon of legal pluralism in the context of plural societies, where ethnic, religious and cultural diversity pose challenges and opportunities in the application of diverse legal systems, including customary law, religious law and national law. Therefore, this study aims to identify and understand the interaction between these legal systems, identify the challenges that arise, and explore harmonisation strategies to support social integration and justice. The methodology used is descriptive-analytic qualitative research based on desk research to understand the dynamics of legal pluralism and use Maslahah theory as an analytical lens. The results showed that the challenges faced by pluralistic societies towards the growing legal pluralism are the birth of conflicts between norms, access to justice, and the need for legal reform. The efforts needed to achieve harmonisation of legal pluralism are by conducting dialogue between stakeholders, inclusive legal education, and adaptation to social change. The Maslahah analytical framework provides an essential perspective in evaluating harmonisation efforts, with a focus on creating social welfare and preventing harm. This research contributes to the legal literature by providing insights into how plural societies can overcome the challenges of legal pluralism and create a legal system that is fair, inclusive and responsive to the diversity of society.
