Hukum Inovatif : Jurnal Ilmu Hukum Sosial dan Humaniora dengan e-ISSN : 3046-5680, p-ISSN : 3046-6148 adalah jurnal yang ditujukan untuk publikasi artikel ilmiah yang diterbitkan oleh Pusat riset dan Inovasi Nasional, Lembaga Penelitian dan Pengabdian Masyarakat Lembaga Pengembangan Kinerja Dosen. Jurnal ini memuat kajian-kajian di bidang ilmu hukum dan Sosial Politik baik secara teoritik maupun empirik. Fokus jurnal ini tentang kajian-kajian hukum perdata, hukum pidana, hukum tata negara, hukum internasional, hukum acara dan hukum adat, politik dan ilmu sosial. <![CDATA[Abstract. Muhammadiyah's rational approach in establishing just law shows the integration of Islamic values with the modern context. This study aims to explore Muhammadiyah's contribution in the formation of maqashid sharia-based law, emphasizing social justice and the relevance of Islamic law in the era of globalization. The research methods used include literature review and document analysis to identify Muhammadiyah's approach to ijtihad and maqashid sharia. The results of the study show that Muhammadiyah's progressive approach has a significant impact in overcoming contemporary legal challenges, such as gender equality and economic justice. This approach also strengthens the global discourse on just Islamic law, by promoting universal principles derived from Islamic values.]]>

<![CDATA[Sharia financial institutions continue to develop along with increasing public demand for services that comply with sharia principles. Among the various products offered, the Wakalah and Rahn contracts are two important instruments in providing diverse and flexible services. The Wakalah contract, which is a form of representation in transactions, allows customers to appoint a financial institution as a representative in managing their financial affairs. Meanwhile, the Rahn contract, or sharia pawn, allows customers to obtain financing by handing over goods as collateral. This research aims to explore the implementation and benefits of service products in sharia financial institutions that use Wakalah and Rahn contracts. The method used is literature study and case analysis of several sharia financial institutions in Indonesia. The research results show that the use of Wakalah and Rahn contracts not only increases flexibility and security for customers, but also supports the growth and stability of Islamic financial institutions. In addition, products based on these two contracts have been proven to be able to meet the diverse financial needs of society, while maintaining compliance with sharia principles. Thus, the integration of Wakalah and Rahn contracts in service products at sharia financial institutions is an effective strategy in supporting financial inclusion and sustainable economic development.]]>

<![CDATA[Communication ethics is a set of principles that regulate how to communicate politely, courteously, and effectively, which is very important in everyday life, especially in the educational environment. However, communication ethics skills are often not optimally mastered by students due to the lack of interactive and relevant learning media. This research aims to develop innovative role-playing-based learning media designed to improve the communication ethics skills of grade 8 students at MTs Al Azhaar Ummu Suwanah. This research is motivated by the importance of communication ethics skills as one of the basic competencies in learning, which is often poorly facilitated through conventional learning methods. This role-playing media is designed to provide an interactive learning experience through simulating everyday communication situations that are relevant to students' lives. Effectiveness testing was carried out through limited trials and field trials involving 8th grade students as research subjects. Data were collected through observation, and expert validation. The results showed that this role-playing learning media was effective in improving students' communication ethics skills. In addition, this media is also considered attractive, easy to use, and able to create a fun learning atmosphere. Thus, the role-playing board can be an innovative alternative to support the interaction-based learning process and direct practice in the classroom.]]>

<![CDATA[The development of technology and the internet has changed the way humans communicate. One form of this development is the presence of social media. Social media has now facilitated fast and easy interaction. The increasing number of users also increases the potential for criminal acts of misuse of personal data. Misuse of personal data, especially on social media, requires comprehensive mitigation. This study aims to analyze efforts to overcome victims of criminal acts of misuse of personal data on social media, both through penal and non-penal channels. With a normative legal and empirical legal research approach through a study of laws and regulations and legal literature as well as interviews. This study uses a qualitative method. The results of the study show that penal efforts include collecting evidence, identifying perpetrators, and imposing sanctions in accordance with the Personal Data Protection Law. Meanwhile, non-penal efforts are carried out through public education, the establishment of personal data protection institutions, and monitoring social media activities. The main inhibiting factors in this mitigation are the lack of implementing regulations, limited technical capabilities of law enforcement officers, and minimal public awareness of the importance of personal data. This study concludes that synergy between penal and non-penal efforts is needed to protect individual privacy rights in the digital era]]>

<![CDATA[Cross-border digital trade is increasingly happening and is in demand by Indonesian people. The implementation of the memotarium as a form of suspension of import duties on digital goods has had a significant impact on the implementation of international digital trade. The policy of extending the memotarium by the World Trade Organization (WTO) will certainly greatly influence the implementation of digital transactions in Indonesia and the legal policies that regulate this matter. This writing provides an understanding of the impact of the extension of the memotarium by the WTO on the implementation of digital transactions in Indonesia and Indonesia's regulatory arrangements in implementing the extension of the memotarium by the WTO. This problem will be studied through normative methods of literature study with an international trade law perspective through the study of legal regulations, journals, books and previous research. This writing will discuss Indonesian legal regulations as a form of implementation of the extension of the memotarium by the WTO as well as the impact felt by Indonesian digital transactions due to the extension of the memotarium by the WTO. The originality of the research explains the Indonesian regulations governing this matter and the influence of the memotarium extension on Indonesian digital transactions.]]>

<![CDATA[Cybercrime is increasing along with technological developments. The more people are connected to the internet, the more potential they have to experience crime in cyberspace. One of the cybercrimes is the crime of romance scam which is classified as an online fraud crime. The purpose of this study is to analyze the role of Sub-Directorate V Cyber Crime Directorate of Criminal Investigation in tackling romance scam crimes and their inhibiting factors. Using normative juridical and empirical juridical research methods, data were obtained through literature studies and field studies and analyzed by qualitative descriptive methods. Based on the results of the study, the Sub-Directorate V Cyber Crime Directorate of Criminal Investigation has never handled romance scam cases until the investigation due to a lack of evidence and other factors. Sub-Directorate V Cyber Crime Directorate of the Lampung Police has been active in various countermeasures with non-penal means such as conducting socialization and education to the public, cyber patrols, and digital forensic analysis. It is hoped that the public will be more careful in using social media, a healthy internet culture is needed and digital literacy is needed, and the government needs to revise laws and regulations regarding cybercrime.]]>

<![CDATA[So that in the future the two candidates can live peacefully, eternally, shoulder to shoulder and help each other, living in harmony. One of the considerations recommended by Islam when concluding a marriage is kafa'ah. Ulama have different opinions on this issue and we will discuss it in order to find out the opinions of the ulama and their arguments regarding this issue. This writing uses literature research or library study methods, with the process of collecting, analyzing, interpreting data and conclusions from various books related to the problem discussed. Although there are differences of opinion, the majority of scholars agree that religion should be the main consideration in the Kafa`ah of marriage. Even though Muhammad bin Hasan had a different opinion, he still considered religion in cases of wicked behavior.]]>

<![CDATA[Hygiene and health education has an important role in supporting quality services in the tourism sector. With increasing awareness of the importance of sanitation and health, tourists are now more likely to choose destinations that prioritize cleanliness as part of their experience. This research aims to analyze the influence of hygiene and health education on service quality in the tourism sector, both from the perspective of industry players and tourists. The method used is literature study and interviews with tourism business actors in various regions. The research results show that consistent implementation of hygiene education can increase tourist confidence, create a safe and comfortable experience, and increase the competitiveness of tourist destinations. Therefore, integrating hygiene and health education programs into tourism management is a strategic step to support the sustainability of this industry.]]>

<![CDATA[Muhammadiyah movement, which is one of the largest Islamic organisations besides Nahdlatul Ulama' in Indonesia, is known for its contribution in modernising the education system. The discussion in this article highlights the role of Muhammadiyah in developing education based on values derived from Islam from primary to tertiary levels. The modernisation includes curriculum, teaching methods, and management of educational institutions that are relevant to the demands of the times. The integration of Islamic values into the education system aims not only to improve academic knowledge but also to build students' character according to Islamic teachings and values. Through the concept of holistic education that includes intellectual, moral, and spiritual aspects, Muhammadiyah seeks to create a generation that is intelligent and has integrity. The article also highlights Haedar Nashir's thoughts on progressive Islamic education, which emphasises the importance of innovation and human resource development as well as technological development for the nation's progress.]]>
