Abstract

Abstract Freedom of religion is one of the fundamental human rights that is internationally recognized and regulated in various national legal instruments. Freedom of religion is an important aspect in the context of Indonesia's social and cultural diversity. This article examines the condition of religious freedom in Indonesia, the challenges faced, as well as the legal and human rights implications that accompany it. The main focus is given to the analysis of legal regulations, incidents of human rights violations in religious freedom, and efforts to protect religious rights. A multidimensional approach is used to analyze various factors that influence religious freedom, including legal, political, social and cultural aspects. challenges such as intolerance, discrimination and interreligious conflict are the main focus in this analysis. Prospects for strengthening religious freedom, including efforts to strengthen legal protection and the promotion of interfaith dialogue, should be well advanced. This research aims to provide an in-depth understanding of the dynamics of religious freedom in Indonesia and offer policy recommendations that can help create an inclusive and just environment for all religious communities. Thus, it is hoped that this research can make a significant contribution in advancing issues of religious freedom and strengthening the foundations of democracy and pluralism in Indonesia.

Abstract

Indonesia is a unitary state that places law as the highest basis that regulates all state life. The consequence of Indonesia as a rule of law state is that all government institutions in the formation and exercise of authority must also be based on applicable legal regulations so that they are not based on mere power. The rule of law also regulates how state institutions carry out their duties as an attribute of state completeness. State institutions domiciled in Indonesia, or in this case the distribution of state power, have a structured hierarchy. To be able to carry out a national life in Indonesia, the constitutional system is regulated by a system of checks and balances between state institutions. Using a normative juridical approach, with analytical descriptions and literature studies, it was discovered how the relationships between state institutions in the Indonesian constitutional system are found. The position of state institutions in this constitutional system is not only divided but also limited by law

Abstract

National implementation must reflect the Constitution's wishes for all citizens. Articles 56 and 57 of Law Number 24 of 2003 concerning the Constitutional Court explained that the Constitutional Court has the authority to review the 1945 NRI Law. The Constitutional Court does not always play a negative role as a legislator in making decisions. In rare cases, developments have led to a transition to the type of Constitutional Court decisions that extend to positive legislation. This research uses a normative legal approach. Research by conducting legal research. The results of this research indicate that the change in Constitutional Court law from negative to positive was based on the need to fill legal gaps and balance legal certainty, justice, and expediency. Constitutional Court Decision 90/PUU-XXI/2023 introduces new regulations that limit the minimum age requirements for presidential/vice presidential candidates, taking into account their experience in office.

Abstract

A person or legal entity that acquires rights to land must register their land ownership. However, land ownership can also lead to disputes, such as the dispute over former eigendom verponding land numbers 3740, 3741, and 3742 in Dago Elos. The Defendants have occupied the land for years without issues, and some have certificates of land ownership or building rights. In the verdict of Judicial Review Case Number 109 PK/Pdt/2022, the Defendants' actions in occupying the disputed land were deemed illegal. Therefore, the author is interested in analyzing whether the Defendants' actions meet the elements of illegal actions according to Article 1365 of the Civil Code and related regulations, and to what extent the Defendants are protected by the verdict. The research was conducted using a normative juridical method, with literature review generating descriptive notes and data, and utilizing a statutory approach. The results show that the Defendants' actions in occupying the disputed land do not constitute illegal actions under Article 1365 of the Civil Code due to the lack of elements. No legal protection can be provided because the verdict is final. The judge did not provide legal reasoning based on the juridical alignment between legal facts, evidence, and the legal basis of statutory regulations.

Abstract

Skills are a product of the fostered child development system for children in conflict with the law (ABH) and are an embodiment of justice with the aim of gaining social personality or restoring unity in the relationship between prisoners and society. Not only as a direction or goal of correctional crime, but also as a treatment of prisoners because educating children who are in conflict with the law (ABH) is not an effort or medium to take revenge or take revenge. Educational dimension development includes an understanding that the imposition of criminal sanctions can empower the social life of children who are in conflict with the law to have a healthy social personality. This research study is to ascertain how the coaching pattern is carried out in order to achieve an increase in the skills of the target children at the Batam Class II Batam Class II Special Development Institute for Children in accordance with Law Number 22 of 2022 concerning Corrections. Empirical legal studies are a type of research that is used by making observations in collecting data as well as using a literature study and documentation approach as support. Books, journal articles and other forms of scientific writing were used. The results of the study show that the implementation of the skills program in optimizing social independence for assisted children at the Batam Class II Special Development Institute for Children has been implemented optimally although it still requires improvement, while Internal and External Factors are obstacles. implementation of skills acceleration in LPKA Class II BATAM.

Abstract

Illegal mining itself is a mining activity or extracting agricultural products carried out by the community or a business entity or we can call it a company where this activity does not have a business permit and also does not use the principles regarding how to mine in accordance with existing regulations or not. use mining methods properly and correctly. The basic mining laws that apply in Indonesia are stated in the Mining UlUl Number 3 of 2020 concerning amendments to UlUl Number 4 of 2009 concerning Mineral and Coal Mining, mining excavation itself consists of several types. Starting from strategic minerals or group a minerals, vital minerals or group c, and finally, group c minerals. In Indonesia itself we can certainly find cases of illegal mining in various regions, that is why enforcement efforts should be carried out as best as possible in order to reduce the growth rate of existing illegal mining which of course is to guarantee or increase state income through existing mining businesses. certainly legal in the eyes of the law.

Abstract

This research aims to understand and find out the factors behind the food crisis experienced by agricultural commodity farmers and the legal protection as well as the efforts made by the government to prevent food crises by strengthening the budget for agricultural commodity farmers. This research uses normative juridical research methods, research by tracing or reviewing and analyzing library materials or ready-to-use document materials. This research uses primary legal materials, namely legal materials originating from statutory regulations, such as Undang-Undang No.18 Tahun 2012 Tentang Ketahanan Pangan, Undang-Undang No. 19 Tahun 2013 Tentang Perlindungan dan Pemberdayaan Petani, Peraturan Pemerintah No. 17 Tahun 2015 Tentang Ketahanan Pangan dan Gizi, but also utilizing secondary legal materials such as relevant journals and books as well as tertiary legal materials in the form of data and facts from the internet. The results of the research show that this food crisis has a broad impact on Indonesian society, Indonesian people will experience soaring prices of basic commodities, hunger, dependence on imports, and affecting agricultural crop production. To overcome the food crisis, farmers must increase crop productivity in a sustainable way, such as using organic fertilizer, balanced fertilization, and using superior seeds. Apart from that, the government's efforts to handle the food crisis for agricultural commodity farmer include setting the basic price of food production and determining the government purchasing price (HPP).

Abstract

This research aims to examine the criminal responsibility of children as perpetrators of murder caused by the influence of alcohol. Criminal cases involving children as perpetrators of murder are increasing in Indonesia, and one factor that is often the cause is the influence of alcohol. In this research, a study was conducted by the Gorontalo Police to identify the factors that make children perpetrators of murder in this jurisdiction. Internal factors to consider include emotional instability and alcohol use. Emotional instability in children, such as problems with poor emotional control and uncontrollable anger, can make them vulnerable to engaging in violent acts, including murder. Alcohol use also has a significant influence, changing children's behavior to be more aggressive, impulsive and less controlled. Apart from internal factors, this research also involves consideration of the juvenile criminal justice system. Applicable laws, such as Law Number 11 of 2012 concerning the Juvenile Criminal Justice System, regulate sanctions imposed on children based on age differences. The judge has the authority to consider the severity of the act, the child's personal circumstances, or the situation at the time the act was committed or afterwards. This is important to ensure appropriate criminal liability according to the child's circumstances.

Abstract

Euthanasia, a topic that sparks debate, is a controversial action from both Islamic and medical perspectives. In Islam, honoring human life is considered a paramount value, as emphasized in the Qur'an. Therefore, the practice of euthanasia is seen as incompatible with religious values. In medical practice, ethical codes provide moral guidance emphasizing the importance of protecting human life, thus making this practice also conflicting with these principles. Although some argue that euthanasia can end unbearable suffering, Islamic views stress the importance of preserving human life without hastening death. Therefore, in Indonesia, with a majority Muslim population, euthanasia practices are prohibited based on religious values and applicable laws.

Abstract

Internet gambling crimes in Indonesia are increasing from year to year. This phenomenon is a bad thing for the Indonesian people. Therefore, the author conducted research which aims to find out how criminal law tackles internet gambling in Indonesia. By using normative research methods. In this legal research, the author uses primary legal materials and secondary legal materials obtained through literature studies that are appropriate to the topic of discussion that the author has taken. Based on the research results, it can be concluded that internet gambling regulations in Indonesia are regulated in Article 27 Paragraph (2) and the threats are regulated in Article 45 Paragraph (3) of the ITE Law. However, the regulations in this article do not clearly regulate witnesses for internet gaming players. This law only contains services used to carry out internet gambling. Law No. 1 of 2023 concerning the Criminal Code can be a solution to overcome the weak response to internet gambling crimes in Indonesia because acts committed digitally have been accommodated in this law.
