Abstract

The Latin word "corruption" comes from the words "korruptus" and "corruption", which means "bad, depraved, deviant from morals, insulting words, or slanderous. Corruption, according to the Black Law Dictionary, is defined as an action carried out with the aim of obtaining several benefits which are contrary to duties and other official truths: "an act from an official or trusted person who unlawfully and wrongly uses a number of advantages for himself or another person which is contrary to his duties and other truths". Eradication of Corruption Crimes Number 31 of 1999, which was later changed to Law Number 20 of 2001, shows that the government is committed to eliminating criminal acts of corruption. The author uses standard methods in writing this journal to describe the problems discussed: Law Enforcement in Criminal Cases Corruption of the Natuna Regency NGO Non-Governmental Organization Forkot (Case Study Decision Number 28/Pid.sus-TPK/2023/PN Tpg). Abstract

The presence of a Whistleblower will aid law enforcement and make it simpler to unearth a criminal case of corruption, highlighting the critical role of the reporter in law enforcement. Consequently, whistleblowers should be granted legal protection by the state to ensure that their rights are safeguarded. Additionally, the state should recognize and reward those who blow the whistle on wrongdoing in order to show its gratitude for their assistance to law enforcement and their role in safeguarding the nation. So, a number of issues will be addressed by this study. Whistleblowers in Indonesia are legally protected from criminal prosecution in instances of corruption. (2) Procedures established by legislation within the context of criminal law to protect those who blow the whistle on corrupt officials. Abstract

Indonesia is a constitutional democracy. The authority of the Constitutional Court in examining and deciding cases of disputes over the results of regional head elections has become an old song worked on by the Constitutional Court itself and the Constitutional Court has often withdrawn and canceled its authority in terms of disputes over the results of regional head elections and caused legal uncertainty related to regional head election issues. Then the Constitutional Court ruled that the articles petitioned by the Respondents were contrary to the 1945 Constitution and had no binding legal force. The Constitutional Court is authorized to hear disputes over the results of regional head elections as long as there is no law regulating this matter. Article 1 of Law No. 22/2017 on Regional Head Elections is included in the Election regime, which is carried out directly, publicly, freely, confidentially, honestly and fairly. It is rumored that the 2024 elections will be the cornerstone of the history of simultaneous national elections. This study aims to determine the role of the constitutional court in resolving direct election disputes and to determine the responsibility of special judicial bodies in direct election disputes.

Abstract

Special Economic Zones (SEZs) in Indonesia serve as strategic instruments to attract domestic and foreign investments and accelerate economic growth in specific regions. Legal certainty within SEZs, encompassing regulatory stability, transparent licensing procedures, and effective legal protection, plays a crucial role in shaping investor perceptions and decisions. This research employs a normative juridical research method, focusing on the study of applicable legal norms or rules to analyze, interpret, and examine relevant legal principles. The findings indicate that investor perceptions of legal certainty are significantly influenced by regulatory complexity and consistency, transparent licensing procedures, and adequate legal protections. Investors tend to favor investment environments offering clear regulations, efficient licensing processes, and robust legal protections to mitigate investment risks. Based on these findings, it is recommended to enhance regulatory transparency and consistency, streamline licensing processes, strengthen legal protections, and improve investor education on SEZ regulations and legal protections. These steps are expected to enhance the attractiveness of SEZs as competitive and sustainable investment destinations, contributing significantly to regional economic growth.

Abstract

The increasingly rapid development of the times has opened people's views to be more open to various kinds of world and national problems. Technology, which is one of the tools for thinking, has created innovative patterns of thinking in society that are mature in determining diverse perspectives and actions, as well as every outcome of views and attitudes that is permitted as long as it does not violate the rules and norms that have been regulated in state life. Customary forests are one of the categories of social forestry which are located in the living areas of local indigenous communities and can usually be found in inland areas. Customary forests are also regulated in Law Number 41 of 1999 concerning Forestry as stated in Article 1 number 6 "Customary forests are state forests that are within the territory of customary law communities." Conflicts between company interests and the rights of indigenous communities sometimes arise due to a lack of legal protection and unequal power, this is based on expansion which can be said to be irregular because quite a few mining companies expand mining areas outside the mine itself in order to exploit very natural resources. abundant in it.

Abstract

Marine pollution resulting from ship navigation activities is a primary concern in safeguarding the maritime environment in Indonesian waters. This article examines law enforcement regarding marine pollution from an environmental law perspective, focusing on existing regulations in Indonesia. Through a normative legal approach, the article identifies the legal framework governing the prevention and mitigation of marine pollution and the responsibilities of relevant parties. Additionally, employing a policy analysis approach, this article evaluates the effectiveness of implementing these regulations in addressing cases of marine pollution caused by ship navigation activities. The analysis reveals that while Indonesia possesses a relatively comprehensive legal framework, challenges persist in ensuring effective law enforcement, including inter-agency coordination and limited human resources. The article also offers recommendations for strengthening law enforcement and marine environmental protection in the future.

Abstract

This research discusses the legal and economic aspects related to Sales and Purchase Agreements in the context of debt settlement. The main focus is the legal analysis of Sales and Purchase Agreements which is based on Debt-Receivable or Money Lending and Borrowing Agreements, as well as its impact on legal certainty and protection for the parties involved. This research also investigates the provisions of Articles 1457 and 1458 of the Civil Code regarding the validity of sale and purchase transactions, as well as the process of transferring land rights through a Deed of Sale and Purchase carried out by the Land Deed Official. The study results show that PPJB is often used as debt collateral, although this practice is not legally valid because Sales and Purchase Agreements and Debt-Receivable Agreements have different concepts and principles. The use of Sales and Purchase Agreements as debt collateral is considered problematic because it violates Article 1320 of the Civil Code which regulates the conditions for the validity of an agreement. This research emphasizes the importance of understanding the differences between sales and purchase agreements and accounts payable to ensure legal clarity and adequate protection for all parties involved in the agreement.

Abstract

The global COVID-19 pandemic has disrupted the health sector, forcing countries to transform their health. In Indonesia, the response to this crisis was the issuance of a new health law, namely Law No. 17 of 2023. One of the updates is the provision that provides legal protection for medical personnel, namely in the process of criminal investigations against medical personnel, investigators must first request a recommendation from the authorized panel in disciplinary examinations, in this case, referring to the previous law, the Indonesian Medical Discipline Honorary Council (MKDKI). The recommendation determines whether the investigation can be continued or not based on the implementation of the professional practice of medical personnel, whether or not it is in accordance with professional standards, service standards, and standard operating procedures. The request for a recommendation from the panel must be received by the investigator no later than 14 days, and if it is more than that, the panel is considered to have approved the investigation of medical personnel. This is a polemic because for crucial decisions, namely assessing whether or not there is a violation of standards, only 14 days are given, while in reality the examination takes months. Finally, the research is presented to measure the legal certainty of the complaint examination procedure within the MKDKI, the legal certainty of the panel's recommendations regarding the continuation of the investigation process, and to reformulate provisions that are not yet fair in the process.
