Abstract

The study "European Union Energy Policy After Russia's Attack on Ukraine in February 2022" analyzes the EU's energy policies in response to the energy crisis caused by the attack, which disrupted the EU's heavily Russian-dependent energy supply. Using a qualitative method with a descriptive analytical approach, the research identifies the EU's strategic steps to reduce energy dependence on Russia and transition to sustainable energy. The findings highlight the REPowerEU policy, under Regulation (EU) 2023/435, as the primary response, focusing on diversifying energy imports, increasing renewable energy production, promoting energy efficiency, and enhancing energy infrastructure. Key initiatives include renewable energy projects like solar power in Spain and Portugal, the North Sea Wind Power Hub, and the Celtic Interconnection project, as well as the Renovation Wave Initiative to improve building energy efficiency. These measures aim to address the immediate energy crisis and build a sustainable, resilient energy future for the EU. The study provides academic insights into EU energy policy and security, serving as a reference for those interested in energy policy and international energy security.

Abstract

The easy generation as the successor to the future generation of the nation has an important and urgent role on its shoulders. One of the roles that must be shared by the nation's generation, especially millennials, is how they are able and have a character that is in accordance with the noble values of Pancasila, especially in law enforcement and anti-corruption behavior. It is important to know that corruption is a problem in Indonesia that has not yet been resolved and there tends to be an increase in cases from the previous year. This indicates that the regeneration of the Indonesian nation is on the verge of failure in forming the character of an anti-corruption generation of the nation. By actively and massively applying and implementing Pancasila values, it is hoped that this anti-corruption attitude will be able to grow. In this article, the normative research type is used to analyze the above issues which are the focus of the research. The results of the research show that the existence of Pancasila as a way of life for the younger generation of the Indonesian nation is not working effectively, so concrete efforts are needed to instill these values, one of which is education and the formation of the Pancasila character, both through formal/educational and non-formal institutions.

Abstract

This article discusses the important question of whether an apology from the perpetrator of a criminal offense can remove or mitigate the criminal sanctions imposed. Through theoretical studies, this article explores the role of apologies in the context of criminal law, both as a sign of regret and as a factor to be considered in the judicial process. In Indonesia, although apologies are often used as a form of admission of guilt, legal regulations that explicitly regulate their impact on punishment are still limited. This article also compares the legal approach in Indonesia with other countries that adopt the concept of restorative justice, where apologies can play an important role in resolving legal conflicts. The results of the analysis show that although an apology can lighten the sentence, especially in the context of implementing restorative justice, in general, an apology cannot erase the prescribed punishment.

Abstract

This research aims to determine the implementation of Minister of Trade Regulation No. 51/m-dag/per/7/2015 concerning the prohibition on imports of used clothing in Indonesia and the legal implications for consumer protection based on legal certainty in Indonesia. This research was conducted using a type of normative legal research with two types of approaches, namely the Statutory Approach and the Conceptual Approach. Based on research results, the implementation of Minister of Trade Regulation Number 51/M-DAG/7/2015 of 2015 concerning the prohibition on the import of used clothing is only limited to providing guidance and supervision and does not make recommendations to stop the business activities of trading imported used clothing to law enforcement authorities. The facts that occur in Indonesia state that there is still a lot of imported used clothing being bought and sold in markets and thrift shops, meaning that the implementation of the trade minister's regulations has not been implemented optimally. Legal Implications of the Implementation of Regulation of the Minister of Trade Number 51/M-DAG/PER/7/2015 concerning the Prohibition of Importing Used Clothes for consumer protection based on legal certainty gives rise to vague norms and conflict of norms which results in the absence of legal certainty. This is because the trade minister's regulations cause multiple interpretations and conflict with the finance minister's regulation number 6/PMK.010/2022, so that the rights and obligations to protect consumers are not guaranteed through these regulations.

Abstract

This research discusses the Problems of the Existence of Swallow's Nests and the procedures and permits for their establishment in Gorontalo Regency. The method used in the research is empirical, with qualitative descriptive data analysis that describes and describes data and field facts. The results of the research show that the problems with the existence of swallow nests in Gorontalo Regency consist of; Neighbors' rights were not fulfilled when the building was erected, because the swallowtail bird's nest building, apart from being erected without the permission of the closest neighbors, was also located right near a residential area. The noise from recorded bird calls can disrupt people's activities, and the presence of bird nests does not rule out the possibility of carrying various types of diseases. The lack of permit processing, where the construction of swallow nests in the Gorontalo Regency area has not yet fully obtained a building permit, because for the construction of swallow nests there were no proposals received by the government. Triggering conflict, where it is feared that building swiftlet nests could develop bird flu, cause odors caused by swiftlet feces, the smell of rubbish used as additional food for swiftlets, disrupt air quality, and pollute residents' reservoir water. Apart from that, this conflict can occur because the owner of the swallow's nest building is not domiciled on the premises, so it becomes a problem in itself. The construction of swallow's nests in Gorontalo Regency does not comply with the procedures and permits for establishment as stated in the Decree of the Minister of Home Affairs Number 71 of 1999 concerning Guidelines for the Management and Business of Swallow's Nests, where Chapter III Article 4 is managed with the permission of the Regional Head. Apart from that, it is not yet based on Law Number 28 of 2009 regarding Regional Taxes and Retributions, as well as Regional Regulation No. 5 of 2020 concerning Swallow's Nest Tax in Gorontalo Regency. This is due to weak awareness of environmental law, the community does not understand the procedures for establishing wallet bird nests and local government outreach has not been optimal.

Abstract

This research discusses the integration of Pancasila values in the Indonesian constitutional legal system and its implications for the protection of customary law. Pancasila as the basis of the state and the source of all sources of law in Indonesia plays an important role in shaping applicable legal norms. In the context of customary law, the values of Pancasila must be reflected in legislation and policies governing indigenous peoples. This article highlights the importance of a comprehensive understanding of Pancasila values to ensure indigenous peoples’ rights are protected in a fair and sustainable manner. This research uses a normative juridical approach by analyzing relevant laws and regulations, literature studies, and legal documents. The results of the study show that although there has been formal recognition of customary law in the constitution and various laws, its implementation still faces challenges, especially related to conflicts of interest between the interests of the state, the market, and indigenous peoples. This article concludes that the integration of Pancasila values in the constitutional legal system should be strengthened through more inclusive and equitable policies, as well as more effective legal protection mechanisms for indigenous peoples.

Abstract

Law enforcement of inter-provincial transportation in Indonesia faces significant challenges and obstacles. This study aims to identify factors that hinder effective law enforcement in the inter-provincial transport sector. The main findings indicate weaknesses in the supervision of transport companies, lack of coordination between relevant agencies, and limited trained human resources. In addition, illegal practices such as unlicensed transportation, the use of non-standard vehicles, and low public awareness of regulations, exacerbate the situation. Therefore, more assertive and consistent law enforcement is needed, as well as increased coordination between relevant parties to create a safer, more efficient inter-provincial transportation system that complies with existing regulations.
