Abstract

This study aims to analyze the legal implications arising from default in the implementation of a cooperation agreement, with a case study of the dispute between Jefri Nichol and Falcon Pictures. This case attracted public attention because it involved a famous actor and a well-known production house in Indonesia, and contained various aspects of civil law that are relevant to the protection of the rights and obligations of the parties in the cooperation agreement. The approach used in this study is normative juridical supported by case studies. Data were collected through analysis of legal texts, regulations, contracts, and court decisions relevant to disputes over default in employment contracts. This study found that default in a cooperation agreement can trigger legal consequences, including compensation, cancellation of the agreement, or termination of the cooperation relationship. In the case of Jefri Nichol vs. Falcon Pictures, the main factor causing the dispute was a violation of the contract clause governing the exclusivity of the cooperation, which led to a lawsuit by Falcon Pictures against Jefri Nichol. The results of the study indicate that clear, detailed, and fair contract clause arrangements are very important to avoid legal disputes. In addition, settlement through mediation can be a more efficient alternative compared to litigation. This study provides recommendations to the parties involved in the cooperation agreement to improve their understanding of contract law and draft the agreement carefully by considering potential legal risks.

Abstract

Law Number 11 of 2020 concerning Job Creation which uses the omnibus law method has sparked widespread controversy, especially in the employment aspect. Significant changes to several previous legal provisions are considered to weaken the protection of workers' rights. The research method used is normative juridical with a statutory approach which refers to Law Number 11 of 2020 concerning Job Creation. This research analyzes this issue from a Critical Legal Studies perspective, which highlights law as a social construction influenced by the interests of economic and political elites. The research results show that the Job Creation Law is not completely neutral and objective. On the contrary, this law strengthens the dominance of employers' interests at the expense of workers' basic rights. This article emphasizes the need for revision of the Job Creation Law to create a balance between investment interests and protecting workers' rights. By involving the active participation of all stakeholders, more inclusive and socially just regulations can be realized.

Abstract

In the context of strengthening competitiveness in the national and international areas, the government is holding and seeking to improve licensing. One of them is in terms of business licensing. Where in terms of licensing improvements, the government makes permits on an electronic basis. The research method used in writing this article is to use normative juridical methods. This research is based on laws and regulations, journals, and other documents that are related to the issues discussed. Online Single Submission or OSS can be interpreted as the realization of Law Number 11 of 2020 or the Job Creation Law. In this permit registration stage, we only need to fill in the data and requirements through the OSS system. In this risk-based OSS, the division of business level scale is also seen based on how big the risk level of the business activity is for the environment and society. The distribution of this risk is divided into 4 levels of business risk, namely low, medium low, medium high and high. If seen based on the implementation of the OSS system so far there have been many advances and improvements in the OSS Version of this Risk Based Approach. Progress that can be seen is regarding filling in detailed data in the Risk Based Approach Version of the OSS system so that business actors only really need to register for business licenses through the OSS system. However, the drawback of this risk-based OSS system is regarding guarantees for the protection of personal data that have not been written specifically. Even though there are regulations regarding supervision in this OSS system.

Abstract

The control of land by large corporations in Indonesia, such as PT Semen Indonesia in Rembang, PT Silva Inhutani Lampung in Mesuji, and PT Perkebunan Nusantara in North Sumatra, reflects a phenomenon of "modern feudalism". These corporations obtain government permits without adequate consultation with local communities, resulting in economic, social, and environmental injustices for indigenous peoples and small farmers. Conflicts often arise with intimidation and forced evictions. Economically, corporations transform traditional livelihoods into low-wage labor, restricting access to agricultural land and forests. The impacts include social isolation, community conflicts, and environmental damage like deforestation and water pollution. The government needs to tightly regulate corporate land control, ensure community participation, and enforce environmental laws for sustainability and protection of indigenous rights and natural resources.

Abstract

This journal discusses the legal responsibilities of commercial banks in protecting customers through the Deposit Insurance Corporation (LPS) in accordance with Law no. 24 of 2004. This research aims to analyze the role of LPS as an institution that guarantees customer deposits, as well as the bank's obligations in maintaining the security of customer funds. The method used is a normative approach with analysis of relevant legislation. The research results show that commercial banks have a significant legal responsibility in protecting customer funds from the risk of loss, both due to internal and external negligence. In addition, LPS regulations provide guarantees for customers, thereby increasing public trust in the banking system. This research recommends the need to strengthen regulations and supervision to ensure banks fulfill their customer protection obligations optimally.

Abstract

Hukuman Mati Atas Delik Pembunuhan dalam Hukum Pidana Positif merupakan hukuman yang selalu menjadi masalah yang diperdebatkan oleh ahli hukum, khususnya di Indonesia. Hukuman mati merupakan salah satu jenis hukuman yang sudah diberlakukan sejak  lama dan pertama kali diatur dalam undang-undang raja Hamurabi di Babilonia pada  abad k e-19 AD.  Indonesia hingga saat ini merupakan salah satu negara yang masih memberlakukan hukuman mati bagi para pelaku kejahatan tertentu yang termasuk  dalam kategori kejahatan luar biasa (extra  ordinary  crimes).  Upaya banding hukum merupakan hak dari pihak yang dikalahkan untuk tidak menerima putusan pengadilan yang berupa perlawanan atau banding dalam hal menuntut cara yang diatur dalam Undang-Undang. Upaya hukum terhadap putusan pengadilan ialah usaha untuk mencari keadilan pada tingkat pengadilan yang lebih tinggi dari pengadilan yang menjatukan putusan tersebut. Artikel ini mencoba untuk menganalisis bagaimana penerapan hukuman mati dalam sistem Hukum Pidana Indonesia, Studi ini menggunakan penelitian hukum normatif dengan pendekatan kasus, kesimpulan artikel ini menunjukkan bahwa penerapan hukuman mati yang ada dalam Hukum Pidana Indonesia justru memperkuat nilai moral, keadilan dan nilai-nilai kemanusiaan, yang sangat dibutuhkan untuk menciptakan ketertiban dan ketenteraman umat manusia itu sendiri.

Abstract

Human Rights (HAM) are rights that are inherent from the time humans are born and cannot be separated from humans at all, as well as a legal concept as well as a characteristic of a legal state which aspires and states that humans have rights related to themselves as individuals, and also is a deep and complex issue. So that the state is fully obliged to respect the citizenship status of its citizens, and prevent violations of human rights. The research method applied in this paper is the normative juridical method, namely legal research carried out by studying library materials or secondary data as a basis for analysis. This research was carried out by exploring the laws and regulations in force in Indonesia and literature related to the problems discussed in this paper. In a democratic society, human rights are considered a fundamental principle, which must be safeguarded and protected by the government. Meanwhile, state administration is a system of state regulation and administration based on law. The two are certainly interconnected and bound. Human Rights (HAM) in Indonesia are a very complex issue where every human being is attached to basic rights that have been destined since birth. This right must be respected, respected and protected by the state. Of all the challenges and hopes mentioned, human rights protection in the context of state administration in Indonesia has a fundamental role.

Abstract

This study aims to analyze the phenomenon of intimate clothing with tight designs among UINSU female students, as well as the factors that influence their understanding of Islamic clothing. Using a qualitative approach with observation, interview, and documentation techniques, this study revealed that many female students understand Islamic clothing as an obligation to cover their intimate parts without considering aspects of modesty. The influence of social media and modern fashion trends also play a major role in shaping their clothing style. This study concludes that a deeper understanding of the values of Islamic dress is needed to maintain a balance between religiosity and modernity.

Abstract

Legal politics is a strategic instrument in the formulation and enforcement of laws that reflects the vision, mission, and goals of a state. This article examines how legal politics influences the drafting of legislation and its implementation in law enforcement in Indonesia. Using a descriptive qualitative approach, this study reveals that legal politics in Indonesia is shaped by various political, economic, social, and cultural dynamics. The findings highlight challenges in maintaining the integrity and independence of the legislative process and law enforcement due to political interference. This article recommends strengthening oversight mechanisms and increasing public participation in legal politics to establish a more just and accountable legal system.

Abstract

Price rounding is the practice of adjusting the price of goods by rounding it either up or down. In fuel purchase transactions, this often occurs when consumers fill their tanks (full-tank purchases), and the price charged by gas station attendants does not match the amount displayed on the fuel dispenser screen. If such practices continue unchecked, they could become a habit that disadvantages consumers.This study aims to analyze the phenomenon of price rounding in fuel purchases at gas stations from the perspective of consumer protection laws. This article employs a juridical-empirical research method, using a statute approach grounded in legal provisions and regulations, alongside a conceptual approach. The research includes a detailed review of existing laws, interviews with consumers, and library research. Data analysis is carried out using descriptive-analytical techniques.According to Law No. 8 of 1999 on Consumer Protection, the practice of price rounding in fuel transactions at gas stations constitutes a violation of consumer rights, particularly the right to receive accurate and reliable information. Furthermore, it infringes on the consumer's right to obtain goods that correspond to the payment made. If left unaddressed, such practices could harm consumers by failing to uphold their rights.
