Abstract

The proof of motive in the crime of premeditated murder plays a crucial role but faces significant challenges due to the absence of a clearly defined motive within Article 340 of the Indonesian Criminal Code, leading to varying interpretations and inconsistent applications of the law. Some judges consider motive as a basis for sentencing, while others do not, resulting in legal uncertainty and concerns over fairness and uniformity in judicial decisions. This research aims to analyze the position of motive proof within the crime of premeditated murder and propose an ideal concept for its future application. Using a normative legal research method with statutory, conceptual, and case study approaches, the findings reveal that the absence of a clear directive regarding motive causes inconsistent judicial practices and undermines legal certainty. The study highlights the need to explicitly incorporate motive as an essential element of proof in Article 340 to enhance fairness and consistency in judicial decisions. It concludes that integrating motive into the legal framework of premeditated murder is critical to ensuring clarity for judicial interpretation, upholding justice, and strengthening the reliability of the legal system.

Abstract

The advancement of industrial activities requires high-performance management to achieve desired outcomes, particularly in complex projects such as construction. This study aims to analyze the application of the Statistical Process Control (SPC) method to improve product quality in the construction project of the Java Residence Cluster in Sidoarjo. Managing cost, time, and quality remains a significant challenge in construction projects. This research focuses on identifying and addressing complaints or defects in housing units that affect the quality of the project, using SPC as a quality control method. Data were collected from primary sources, specifically from the staff of PT. Mitra Usaha Konstruksi, as well as secondary data from relevant literature. The analysis shows that the application of SPC successfully reduced the number of complaints or defects from 5.95 complaints per unit in Cluster 1 Phase 3 to 3.12 complaints per unit in Cluster 2 Phase 1, with an effectiveness rate of 52.47%. Pareto analysis identified that the majority of complaints were related to doors, windows, and wall paint, suggesting that these areas should be prioritized for improvement in future construction projects. The study recommends the continued use of SPC to improve product quality and identify the root causes of defects to ensure compliance with the developer's quality targets.

Abstract

The installation of the Baggage Handling System (BHS) at Sultan Hasanuddin International Airport, Makassar, faces challenges related to cost and time inefficiencies, particularly delays in project completion. This study aims to evaluate these inefficiencies by applying the Earned Value Method (EVM) to assess project performance and identify areas for improvement. Utilizing EVM metrics, the research identifies that the Schedule Performance Index (SPI) is below 1, indicating a delay in the project timeline, with the actual duration extending to 556 calendar days compared to the planned 546 days. This delay underscores the need for a more robust project management approach. The study employs the Critical Path Method (CPM) in conjunction with Microsoft Project to improve scheduling accuracy, alongside recommendations for project acceleration using the Crashing Program method. The findings highlight that early implementation of EVM can help mitigate discrepancies in cost and time, enabling better control and monitoring throughout the project lifecycle. The study concludes that integrating advanced scheduling techniques and real-time performance metrics is essential to achieving efficiency and minimizing delays in similar infrastructure projects.

Abstract

The importance of research on educational films is based on the reality of educational issues in Indonesia. However, previous research on educational films only examined the meaning of films based on text. While the whole context through critical semiotic and ideological study is still minimal. As a result, studies on films with educational themes only produce research that prioritizes textual analysis. Di Timur Matahari is a film set in the lives of children in Papua who are waiting for a teacher to get an education. Although themed education, East of the Sun also highlights political, economic, social and cultural issues. Through John Fiske's semiotic analysis with a qualitative approach, data has been collected and analyzed based on the level of reality, level of representation and level of ideology. The results of the study show that there is inequality in education experienced by children in the Papua region. Inequality and inequality in education due to the unavailability of teachers to teach as well as very limited infrastructure and accessibility. Despite their limitations, Papuan children have a high fighting spirit, are resilient, always happy and have a high of tolerance. Another finding is that the educational gap in Papua will encourage the creation of marginalization that strengthens the cultural system, thus forming a diverse and deep-rooted ideological pattern in Papua society Meanwhile, this research is also expected to increase insight into semiotic research and encourage government policies to pay attention to education on an ongoing basis.
