Abstract

The purpose of this study is to analyze the philosophical basis of the reverse proof system for future Gratification corruption crimes and the formulation of norms for the reverse proof system for future Gratification corruption crimes. The research method used in this study is normative juridical with qualitative descriptive data analysis techniques. The results of the study are the philosophical basis of the reverse proof system for the crime of graft corruption related to bribery Article 12 B, namely that both the public prosecutor and the defendant are obliged to prove but the public prosecutor alone proves the gift received by the recipient of the gratuity while the defendant proves that the gratuity is not a bribe, has nothing to do with position and does not conflict with their duties or obligations. The construction of legal substance, which directs the formulation of reverse evidentiary norms with an emphasis on legislative policies according to the 2003 CAC as a characteristic of the combination of the hukum umum and hukum sipil legal systems as a legal system.

Abstract

The settlement of South China Sea disputes by the International Arbitration Board is a complex challenge. The South China Sea is a strategic area disputed by several countries in Southeast Asia. International Arbitration Bodies play an important role in handling these disputes. Arbitration proceedings began in 2013 and a decision was announced in 2016. Although the decree is legally binding, its implementation still faces political and diplomatic challenges. Cooperation between the countries involved is necessary to achieve an effective solution.

Abstract

This journal discusses how the legal protection review relates to losing goods or money in online transactions. In this digital era, online transactions that are increasingly popular have become part of people's daily lives, so strong legal regulations are needed to avoid scamming and other losses. This research aims to increase public awareness of conducting online transactions because we know that in online transactions, we cannot know whether the goods sold by the seller are true or not. The research method of this journal uses the Library Method by using primary and secondary study materials, such as articles, journals, and others, and a Normative Juridical approach. The conclusion of the research states that online fraud in the form of defects in ordered goods is very common, and the majority of people affected by scamming do not know what actions to take to get their rights in the transaction other than contacting the admin of the online shop or customer service from an e-commerce company

Abstract

The rise of Boat People arriving in Australia made the Australian government issue a policy called a policy Operation Sovereign Border, the policy is a policy used to deal with asylum seekers by preventing and expelling asylum seekers. This policy reaped controversy because it violated the provisions of international law. This legal writing analyzes how efforts to deal with boat people and their rights and obligations according to international law as well as the influence of Australian policies in dealing with boat people and the impact of Australian policies on Indonesia. This research uses a normative juridical method which is carried out through a literature study with a statutory, historical approach, and conceptual. Australia has also ratified the 1951 Convention which has become the basis of international law for refugees, and has also regulated the protection of refugees and has become a reference for many countries in developing their refugee laws and policies. Australia's policy on preventing migration by boat has several significant effects, such as: (1) Reducing the number of migrants via; (2) Impact on the people smuggling business; (3) controversies and issues of human rights; and (4) Regional effects.

Abstract

The research problem of this study is the reform of criminal justice from the due process model to the reintegrative model as a consequence of the development of criminal law, including in the resolution of criminal cases. The reintegrative model is a process of establishing new norms or values, as a form of adaptation in the enforcement of criminal law with the approaches of restorative justice, penal mediation, and discretion. The research method used is normative legal research, with statutory, historical, comparative, and conceptual approaches. The results of this study indicate that, firstly, the reform of criminal justice from the due process model to the reintegrative model is an effort to integrate several approaches such as restorative justice, penal mediation, and discretion. This approach is introduced as an effort to minimize the dominance of the due process model. Resolving criminal cases using the due process model is not the only model for resolving criminal cases, but there are many alternatives available. The concept of the reintegrative model emerged due to the numerous issues in law enforcement with the current dominance of the due process model in criminal justice, which focuses on imprisonment as punishment. Secondly, the reintegrative model of criminal justice provides an alternative for resolving criminal cases, with several approaches that can be used and maximized, including restorative justice, penal mediation, and discretion. Restorative justice can be applied in resolving various criminal offenses, penal mediation involves resolving criminal cases outside the court through deliberation and consensus, and police discretion is a justified police action in the interest of the public. However, these approaches are not well-implemented because some still perceive that resolving criminal cases using these approaches is not part of the criminal law enforcement process

Abstract

Pain usualy experienced by patients on ventilator in the ICU. Efforts to reduce pain with foot massage done independently on the patient. Foot massage safe complementary therapy, providing relaxing effect, feeling comfortable and reducing pain. This study used quasi experiment research design with pre and post test control group design. The total sample of 40 respondents was divided into an intervention group 30 respondents were given foot massage once a day for 2 consecutive days, the control group was 10 respondents given analgesic therapy for 2 consecutive days. Post test pain scores 30 minutes after getting treatment on first and second days. Results showed that majority of the age group 46-55 years 30%, majority male 57%, 65% were suctioned, and body position changes 82%, there was difference in pre-test (p = 0.001) and post-test (p=0.007) the intervention group, there was difference in the level of pain after foot massage in the intervention group and the administration of analgesics the control group (p=0.000), there was effect of suctioning mucus (p=0.003), there was effect of changes in body position (p=0.008). This means that foot massage has effect reducing pain levels in patients. This study recommends the need for further research and foot massage one of independent nurse interventions in nursing care for patients with ventilatory pain.

Abstract

The current technological development is progressing rapidly. However, the implementation of this technological advancement is still not optimally applied in all areas, especially in rural areas. Therefore, the application of Knowledge Management System (KMS) is necessary. According to Law Number 6 of 2014 concerning villages, in section 3 of the Village Law, Article 86 on the village information system and rural area development, it is stated in the first point that villages have the right to access information through the village information system developed by the local government of the district/city. Currently, the problems that occur in villages are the lack of maximum service and information, the scarcity of village officials in managing computerized data, and the lack of systematic archiving. By implementing KMS, it can be a solution for public services and information, as well as data processing and correspondence in the village, so that the community will receive excellent services from the village government.

Abstract

This study aims to determine and analyze the influence of social media marketing on impulsive purchases and hedonic shopping values and to analyze the role of impulsive purchase reactions that mediate hedonic shopping values. The target of this research is all online consumers in Bandung City aged between 18-25 years as many as 150 respondents. Samples were taken using non-probability techniques, with purposive sample techniques and then the data obtained from the samples were analyzed using Partial Least Square (PLS) with path analysis. The results of the study show that there is a significant influence between social media marketing on hedonic shopping value and there is a significant effect between social media marketing on impulsive purchases and a significant effect between social media marketing on hedonic shopping value through impulsive purchases, and this indicates that social media marketing affects hedonic shopping value both directly and through impulsive purchases.

Abstract

The outpatient unit is a part of the hospital. The outpatient unit has an important role because it is the first door or medium for contact and interaction with service users or patients. Outpatient care is also an entry point for other inpatient services. Seribu Islands Regional General Hospital as the only hospital in the Thousand Islands region has not yet reached the required minimum outpatient service standard. This study aims to analyze the quality of outpatient care at Seribu Islands Hospital with the criteria of Malcolm Baldrige. The criteria for evaluating organizations are based on seven criteria, namely leadership, strategic planning, customer focus, measurement, analysis, and knowledge management, staff focus, process management, and performance results. This study uses a descriptive analytic research design with quantitative and qualitative approaches. The data collected was obtained through questionnaires, in-depth interviews, and document review. The results of the study using the Malcolm Baldrige Criteria showed that Seribu Islands Hospital won a score of 379.83 out of a maximum of 1000. This means that for hospital performance assessment based on MBNQA, Kepulauan Seribu Hospital won the average title and was included in the Early Improvement category (point scale 376-475 ). Early improvement means that Seribu Islands Hospital is in a position of early stage improvement in the health service sector. For this reason, it is recommended that Thousand Islands Hospital develop strong leadership and good teamwork in order to determine the right strategic plan.

Abstract

The study aims to describe a case of precocious puberty caused by classic simple virilizing congenital adrenal hyperplasia. This is a case of 4 years-old boy who developed premature pubarche 5 month before consultation. Patient also has penis enlargement with prepubertal testes and facial acne since age of three. His voice also changed to be more like an adult male voice. Physical examination revealed an alert boy, with normal vital sign, body weight of 27 kilograms (>P95, CDC Growth Chart 2000) and height of 126 centimeter (>P95, CDC Growth Chart 2000), with advanced bone age of 14-years-old child. The Sexual Maturity Rating score was G1P3( tanner stage 3), and his height was more than his mid-parenteral height. Laboratory test  was done revealed 17-OHP of 196.03 ng/ml (n: <= 0.90ng/ml), high level of testosterone at 270.1 ng/ml (n: <= 0.19ng/ml), level of B-HCG : <2.3mIU/ml, low level of LH : 0.1 mIU/ml (n: >0.6 mIU/ml), and low level of  FSH: 0.1 mIU/ml (n: 0-5.0mIU/ml). Ultrasound of Kidney shows a picture of hyperplasia of left adrenal gland. All of these findings allowed diagnosing him with classic simple virilizing congenital adrenal hyperplasia. Based on this diagnosis, he was then started on hydrocortisone, and after 6 months of starting the treatment, he has a favourable clinical outcome, without any secondary sex characteristics or bone age progression. Peripheral precocious puberty due to classic simple virilizing congenital adrenal hyperplasia may be asymptomatic from birth to the preschool age, therefore early  detection, immediate and appropriate managements are crucial and important to prevent late outcomes.
