TAFAQQUH: Jurnal Hukum Ekonomi Syariah dan Ahwal Syahsiah is published by the Center for Research, and Community Service (P3M) of Sekolah Tinggi Ilmu Syariah Darul Falah Pagutan Mataram NTB (STIS DAFA). This journal features studies on Sharia economic law and Islamic family law. It is published biannually, in June and December. The editorial board invites academics, lecturers, and researchers to contribute their original scholarly articles that have not been previously published in other journals. Manuscripts should be typed with 1.5 cm spacing on A4 paper, 10-15 pages, or 3500-5500 words, using Mendeley or Zotero reference management. This e-journal is the online version of the printed edition of TAFAQQUH, published by P3M of Sekolah Tinggi Ilmu Syariah Darul Falah Pagutan Mataram NTB (STIS DAFA).

Abstract

This study aims to understand the resolution of Islamic economic disputes through litigation in Religious Courts and analyze the position of DSN-MUI Fatwas in court proceedings. The focus is on a case between KJKS BMT Berkah Al-Fath Mulia and Fahmi Akbar Idries Bin Ahmad Mudjib regarding breach of contract (wanprestasi) and surety liability (Borgtocht), adjudicated by the Yogyakarta Religious Court under case number 386/Pdt.G/2021/PA.YK. The research employs a normative method with a library research approach. The collected data is analyzed descriptively to explain the role of DSN-MUI Fatwas in legal considerations for resolving Islamic economic disputes. The findings reveal that the judge utilized DSN-MUI Fatwas in legal considerations as written doctrines reflecting Islamic principles and societal values. In this case, DSN-MUI Fatwa Number 07/DSN/MUI/IV/2000 on mudharabah financing was used to strengthen other legal considerations permissible under legal provisions. This research contributes to clarifying the role of DSN-MUI Fatwas as legal guidelines in resolving Islamic economic disputes in Religious Courts. It enhances understanding of the integration of Islamic law into Indonesia's judicial system.

Abstract

This study aims to analyze the Islamic Legal Review of the wage system for traditional sand miners in Dusun Ketapang, Desa Gegerung, Kecamatan Lingsar, Kabupaten Lombok Barat, as implemented by the mine owners for both permanent and casual workers. This qualitative research produces descriptive data in the form of written or spoken words from interviews and observations, using a normative sociological approach that connects the norms of wage practices with the ijarah concept in theory and practice. The analysis uses the theory of ijarah and principles of Islamic contracts. The findings show that the wage system in this area does not align with Islamic law, as there is no prior agreement or understanding between the mine owner and the miners regarding the wage rate, leading to uncertainty and a disparity between the two parties. In an Islamic wage system, it is crucial that neither party feels disadvantaged.

Abstract

This study aims to (1) examine the perspectives of the Hanafi and Syafi’i schools of thought (mazhab) regarding the concept of wali adhol in marriage contracts, and (2) evaluate the relevance of these perspectives in the context of marriage in Indonesia. The research employs a qualitative approach with library research as its primary method. Data analysis is conducted using a comparative method, which juxtaposes the two mazhab's views to draw conclusions. The findings reveal that the Hanafi school does not require the presence of a guardian (wali) for a legally competent and mature woman in a marriage contract, except for minors and individuals with mental incapacities. If a guardian refuses a competent woman’s request to marry a suitable partner, the guardian is deemed ineligible to refuse (adhol). Conversely, the Syafi’i school mandates the presence of a guardian for all marriage contracts, whether for a mature woman or a widow. In the Indonesian context, the Hanafi school’s perspective is considered more relevant due to its flexible approach, which takes local customs into account and grants greater autonomy to brides in deciding their marriage arrangements. This study contributes by providing a comparative perspective on the role of guardians in Islamic marriage law, serving as a reference for the development of family law in Indonesia, particularly in addressing cases involving wali adhol.

Abstract

This research aims to examine the Effectiveness of the Sharia Arbitration Board in Consumer Disputes based on the DSN-MUI Fatwa regarding Online Shops. Considering the tendency of consumers to resolve consumer disputes through out-of-court channels (Non Litigasi). Using a qualitative descriptive method, this research examines related journals, compares research findings, and analyzes relevant regulations and fatwas. The research results indicate that there are still weaknesses in the Sharia Arbitration Board in resolving consumer disputes, including: the dispute resolution process requiring the agreement of both parties, the weak legal force of the decisions, limited legality, limited infrastructure that does not reach all of Indonesia, the need for reliable human resources for Sharia arbiters who understand online business issues, and the acceptance and legitimacy from the wider community

Abstract

This study aims to examine the concept of property ownership rights in the Qur'an, emphasizing the balance in life through the management of wealth for collective well-being. Islam acknowledges the natural human inclination toward owning wealth but establishes regulations to ensure that ownership benefits not only individuals but also the broader community. This research employs a descriptive-analytical method with a library research approach. Primary sources include the Qur'an, Hadith, and tafsir texts, supplemented by relevant supporting literature. The findings reveal that Allah SWT is the ultimate owner of all that exists in the heavens and the earth (QS. Al-Maidah: 120), while humans are entrusted with temporary ownership to sustain their livelihoods (QS. Al-Hadid [57]: 7). This ownership is categorized into three types: individual ownership, acquired through work (QS. Al-Jumu'ah [62]: 10) or inheritance (QS. Al-Baqarah [2]: 180; QS. An-Nisa’ [4]: 11-12); state ownership, which includes zakat, ghanimah, and fa'i (QS. Al-Anfaal [8]: 41; QS. Al-Hasyr [59]: 7); and public ownership, encompassing resources managed for communal benefit (QS. Ar-Rahmaan [55]: 10). This study contributes to the development of Islamic economic theory by emphasizing the importance of equitable wealth distribution and providing practical foundations for economic policies grounded in Qur'anic values to achieve collective prosperity.

Abstract

The purpose of this study is to determine what obstacles arise in the implementation of the sharia economic system in Indonesia, how problems arise and how to overcome them so that they can be resolved periodically. The research method used is descriptive research. The results of this study indicate that the solutions to overcome the problems of sharia economics in Indonesia include the correlation of educational institutions in the development of sharia-based concepts, government attention to the real role of sharia economics in the economy of the Indonesian people who are predominantly Muslim, the introduction of dinar and dirham currencies to enrich the nawacita and sharia economic transactions in society and expanding the network of sharia economics in Indonesia by adding competent human resources in each region with the aim of being able to provide understanding to the community who want to know the concept of sharia economics in Indonesia. The contributions to be achieved in this study include providing solutions to relevant stakeholders to implement solid and systematic regulations and not overlapping with other regulations between institutions, improving the quality of competent and professional human resources, training/education/socialization of employees and the community, innovative marketing, product innovation, adjustments to the actual sector, improving services and professionalism are needed in answering solutions to the sharia economy in Indonesia.

Abstract

Studi ini bertujuan untuk menggali pemhaman mendalam terkait ilmu qiraat al-quran.Ilmu Qira'at Al-Qur'an adalah ilmu yang mempelajari cara pengucapan Al-Qur'anyang berbeda-beda antara satu imam dengan imam qira'at lainnya. Ilmu ini jugamempelajari cara penyampaian kata-kata Al-Qur'an. Qira'at merupakan cabang ilmuUlum Al-Qur'an yang memiliki peran penting dalam kajian ilmu keislaman. Ilmu inimeneliti keabsahan nas Al-Qur'an dari segi pengucapan dan tulisan. Metode yangdigunakan adalah analisis teks-teks serta literatur terkait yang membahas konsep –konsep terkait ilmu qiraat al-quran. Abstract

This research examines the marriage system in Indonesia through the perspective of Maqasyid Syariah developed by Imam As-Syatibi. The main focus of the study is to analyze the extent to which the marriage system in Indonesia reflects and fulfills the five main objectives of Sharia (al-kulliyyat al-khams) according to As-Syatibi, namely the protection of religion (hifz ad-din), life (hifz an-nafs), intellect (hifz al-'aql), lineage (hifz an-nasl), and wealth (hifz al-mal). Using a qualitative approach with document analysis and literature study methods, this research reveals that the marriage system in Indonesia generally aligns with the principles of Maqasyid Syariah; however, several aspects need improvement to achieve a more optimal alignment. The research findings highlight the need to strengthen the protection of women and children, enhance pre-marital education, and refine the marriage dispute resolution mechanisms to better align with the principles of Maqasyid Syariah.

Abstract

The development of accounting science has triggered the development of more complex accounting standards. The development of accounting standards has led to differences in accounting practices between countries, including European countries. The application of accounting standards in Europe cannot be separated from the influence of the development of American and British accounting systems in European countries. This research aims to see the influence of America and England on the development of accounting in European countries and to compare European countries' accounting practices and systems. The method used in this research is library research, by collecting data from relevant books and journals. This library data is then arranged in a structured manner to obtain research results. The research results show that the European accounting system has been largely influenced by America and England. European countries have absorbed accounting standards in the form of IFRS in their accounting practices. Several European countries have created their own country's accounting standards, but their practices are still adapted to international accounting and IFRS so that there is still harmonization of accounting standards in each European country.

Abstract

This study aims to explore the implementation of Sharia principles in cooperatives as an alternative for communities transitioning to Sharia cooperatives in Mataram City, using a qualitative phenomenological approach. Through a descriptive-analytical method, this research focuses on collecting data from cooperative administrators, managers, and members selected through purposive sampling. Data were gathered through in-depth interviews, observation, and documentation, and then analyzed using data reduction, presentation, and conclusion techniques with credibility validation through triangulation. The results indicate that Sharia cooperatives operate based on principles of justice, transparency, prohibition of interest, and social responsibility, forming a profit-sharing business model oriented toward collective welfare. Additionally, the growth of Sharia cooperatives in Mataram is supported by government regulations and increasing market demand for Sharia-based financial services, prompting many conventional cooperatives to adopt the Sharia system. This research contributes to the development of Sharia economic policies and practices as an inclusive, sustainable business model that can enhance financial inclusion in society.
