Abstract

Hubungan hukum berupa kemitraan antara pengemudi taksi online dan perusahaan aplikasi menyebabkan polemik dalam hal pertanggungjawaban hukum. Tujuan dari penelitian ini, yaitu menganalisis perlindungan konsumen dan mekanisme tanggung jawab hukum atas PMH yang dilakukan oleh pengemudi taksi online terhadap konsumen. Penelitian ini menggunakan metode penelitian hukum normatif dengan pendekatan perundang-undangan dan konseptual. Berdasarkan UU No. 22/2009 dan UU No. 8/1999, perusahaan penyedia aplikasi bertanggung jawab memastikan keamanan layanan melalui identitas pengemudi, kendaraan, layanan pengaduan, dan fitur darurat, sehingga konsumen dapat menempuh dua mekanisme pertanggungjawaban hukum, yaitu terhadap pengemudi taksi online sebagai individu dan terhadap perusahaan penyedia aplikasi sebagai pelaku usaha berdasarkan prinsip vicarious liability. Dimana prinsip ini akan memungkinkan adanya pertanggungjawaban dari perusahaan penyedia aplikasi tanpa menghapuskan tanggung jawab dari pengemudi taksi online. Meskipun demikian, belum adanya regulasi yang memadai terkait pertanggungjawaban hukum dari hubungan kemitraan dalam suatu peraturan perundang-undangan dapat menjadi tantangan dalam penerapan prinsip vicarious liability. Oleh karena itu, penelitian ini merekomendasikan dibentuknya regulasi khusus terkait hubungan kemitraan antara pengemudi taksi online dan perusahaan penyedia aplikasi untuk memperkuat perlindungan hukum bagi konsumen dan meningkatkan pengawasan terhadap pengemudi.

Abstract

The growth of the Indonesian cosmetics industry reached 21.9% with details of 913 companies in 2022 and 1,010 companies in mid-2023. This encourages business actors to compete so that a series of innovations and advertising strategies are carried out in order to attract consumers' attention. However, in the advertising process, business actors sometimes overclaim the contents of their products. On the other hand, the existence of this overclaim is not accompanied by consumer knowledge of the contents of a beauty product. This study examines in more depth the role of law in protecting consumers and the legal responsibility of skincare owners as business actors for overclaiming their beauty products. The research method used is juridical-normative with a statutory regulatory approach and a conceptual approach. The results of this study indicate that the role of law in protecting consumers against overclaims in product marketing has been accommodated in Indonesian national law starting from UUPK to BPOM-level regulations. Regarding legal accountability, it is mandatory for business actors as regulated in the UUPK and BPOM Regulation Number 3 of 2022.

Abstract

This research aims to analyze the supervision of the installation of campaign props (APK) which damage the environmental sustainability of the 2024 election campaign. Case studies in Central Bangka Regency show various violations of the installation of campaign props on trees, parks, electricity poles and bridge fences as well as through comparative studies of several regions. other. By using normative law (legal research) through statutory, case and comparative approaches. The results of the research resulted in a discussion of election regulations regarding the installation of campaign props as an effort to preserve the environment. Law Number 7 of 2017 concerning Elections with a comparative study of Law Number 32 of 2009 concerning Environmental Protection and Management. Through KPU and Bawaslu regulations as well as regional governments, an analysis of environmental sustainability regulations was then carried out to determine the impact of environmental pollution due to violations of APK installation. Violations in installing campaign props damage the environment in a number of areas. Incidents occurred in almost every region, the short campaign time was only 75 days and there were limitations and supervision by Bawaslu in a number of regions in following up on APK installation violations. Inherent and participatory supervision is needed to monitor APK installation violations that damage the environment. The regulatory urgency is for Bawaslu and its staff to be given access by local governments to supervise APK installation. Bawaslu's authority to supervise the installation of APKs needs to be given in the form of action to remove violating APK installations together with civil service police units. The recommendation of this research is that election participants, organizers and local governments create a collaborative script on the commitment to protect the environment in installing APK.

Abstract

The case of persecution of two women in Pasir Putih Kambang, Pesisir Selatan Regency, West Sumatra, reflects a series of incidents that show weaknesses in law enforcement regarding sexual violence and gender discrimination. This incident involved physical and psychological attacks on two cafe patrons by around 300 people for no apparent reason, resulting in trauma and damage to the victims. The authorities' handling of this case highlights the challenges in protecting victims and delivering justice. This research uses a qualitative approach to gain an in-depth understanding of the chronology of the incident, the perception of the relevant community, and the psychological impact of the victims. The case study method was used to analyze this case as a representation of broader problems in the implementation of laws related to sexual violence. The research location in Pasir Putih Kambang was chosen because the incident was interesting for further research, especially related to law enforcement and protection of victims. The research subjects are local communities and related parties who can provide insight into this problem. The aim of this research is to understand the phenomenon of persecution and sexual violence in the context of this case, as well as identifying factors that influence law enforcement and protection of victims. It is hoped that this research can provide more effective policy recommendations in preventing and handling similar cases in the future, in order to create a safer and fairer environment for all individuals.

Abstract

Gamification has become a core strategy in the online taxi industry, implemented to enhance driver performance through incentive systems, point accumulation, and rankings. While it provides flexibility and income opportunities, this system often results in unfair working conditions, including extended working hours, income instability, and inadequate social protection. Utilizing a library research approach and normative juridical analysis, this study assesses the impact of gamification on worker welfare and identifies regulatory loopholes in their legal protection. The findings indicate that the partnership status weakens drivers' bargaining power, while algorithmic systems restrict their control over work. Consequently, more transparent regulations and labor protection policies that are responsive to platform-based work models are necessary.

Abstract

Consumer protection in public services is a crucial element in ensuring justice and legal certainty for the public. This study aims to analyze consumer protection regulations and the implementation of policies supporting the fulfillment of consumer rights in public services. The research problem addressed is the extent to which existing regulations provide effective protection and how policies are implemented in practice. The research method used is normative juridical with a statutory and case study approach. The findings show that although the regulatory framework is available, its implementation faces various challenges, such as weak supervision, lack of public outreach, and suboptimal consumer dispute resolution. This study recommends strengthening regulations, enhancing the capacity of supervisory institutions, and fostering synergy among agencies to achieve effective consumer protection in the public service sector.

Abstract

There are still some tangible maritime security threats in Indonesia national ideals and the President’s vision. the Law No. 32 of 2014 which gives mandate to Bakamla RI to establish security and safety patrol operation in Indonesian territorial and jurisdiction region. This research aims to discuss Bakamla failure to transform into Indonesia Coast Guard and the Indonesian maritime security is re-concepted to establish Indonesian Sea Power. By qualitative method that collect some data and information from latest news then analyzed by national constitution and theories from some experts, this research obtained two statements. Firstly, Bakamla RI has failed to transform into Indonesia Coast Guard and secondly, the Indonesian maritime security system needs to be re-concepted into coordinated multi agencies multi tasks in order to establish Indonesian Sea Power.

Abstract

The rapid pace of technology has brought about significant changes in the economic sector, including the emergence of online lending services that provide easy access to funds. However, behind this convenience, there are serious problems related to discriminatory collection practices by online loan providers, especially those operating illegally. These practices include various forms of violations such as intimidation and threats against borrowers, gender-based harassment, unauthorized dissemination of personal data, and harsh treatment based on social status. The impact of this practice is far-reaching, causing not only financial loss but also severe psychological distress to the borrower, even leading in some cases to extreme measures such as suicide. This research aims to analyze the form of discriminatory billing practices in online lending services in Indonesia and evaluate the implementation of legal protection for consumers who are victims of such practices. Using the normative juridical research method, this research examines various relevant laws and regulations, including Law No. 8/1999 on Consumer protection, Law No. 11/2008 on Electronic Information and Transactions, as well as regulations from the Financial Services Authority (OJK) and the Indonesian Joint Funding Fintech Association (AFPI). The results show that although regulations have been implemented to protect consumers discriminatory billing practices are still rampant due to weak supervision and low public financial literacy regarding the risks of online lending. As a solution, this study recommends strengthening regulations and stricter supervision mechanisms, increasing financial education for the public, and increasing cooperation between the government and related parties in combating illegal online loans. Thus, it is hoped that consumer protection can be optimized and discriminatory billing cases can be minimized in the future.

Abstract

Penerapan konsep ekonomi hijau (green economy) dalam pembangunan perekonomian nasional menjadi titik infleksi bagi negara-negara di seluruh dunia untuk mengakselerasikan demokrasi ekonomi. Demokrasi ekonomi tidak sekadar berbicara ekonomi kerakyatan, namun juga membahas ekonomi berkelanjutan. Ekonomi berkelanjutan berfokus pada skema pembiayaan yang ditujukan untuk proyek-proyek berwawasan lingkungan, yang kemudian disebut sebagai investasi hijau (green investment). Untuk menunjang hal tersebut, OJK melalui Roadmap Keuangan Berlkelanjutan membuka ruang untuk dilakukannya penerbitan obligasi hijau (green bond) yang dilandasi oleh POJK No. 60/POJK.04/2017 yang bertujuan untuk mendanai sebagian atau seluruh proyek berwawasan lingkungan. Permasalahan hukum muncul ketika POJK  a quo tidak mengatur standar kelayakan proyek penerima green bond secara jelas sehingga membuka ruang terjadinya praktik greenwashing. Penelitian ini menggunakan jenis penelitian yuridis-normatif dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Hasil penelitian menunjukkan perlu adanya standar kelayakan proyek penerima green bond sebagai instrumen perlindungan hukum bagi investor, sekaligus untuk menjamin penyaluran dana tepat sasaran serta mendukung terciptanya iklim investasi yang berwawasan lingkungan dan berkelanjutan untuk mencegah terjadinya praktik greenwashing.

Abstract

Fenomena perceraian yang terus meningkat di Indonesia telah berdampak terhadap pemenuhan hak anak terutama dalam hal pemberian nafkah. Meskipun telah ada regulasi yang mengatur hak nafkah anak pasca perceraian, kenyataan banyak putusan pengadilan yang tidak dijalankan secara efektif. Penelitian ini bertujuan untuk mengidentifikasi faktor-faktor yang menyebabkan terabaikannya pemenuhan nafkah anak, menganalisis akibat hukum bagi orang tua yang lalai dan mengeksplorasi model kelembagaan Bahagian Sokongan keluarga (BSK) di Malaysia sebagai alternatif Solusi. Medote penelitian yang digunakan adalah pendekatan deskriptif dengan analisis normative-komparatif. Hasil penelitian menunjukkan bahwa faktor ekonomi, lemahnya sistem eksekusi dan minimnya kesadaran hukum menjadi penyebab utama kegagalan pemenuhan nafkah anak. Selain itu, sanksi huhkum yang bersifat administrative dan perdata belum memberikan efek jera yang kuat. Studi terhadap BSK di Malaysia menunjukkan bahwa keberadaan Lembaga khusus di bawah Mahkamah Syariah mampu menjembatani kendala dalam eksekusi nafkah melalui mekanisme bantuan hukum, mediasi dan pemberian nafkah sementara. Penulis merekomendasikan pembentukan Lembaga serupa di bawah Pengadilan Agama Indonesia guna memperkuat perlindungan hak anak pasca perceraian.
