Abstract

HIV/AIDS control policies in Indonesia have shifted from a purely medical response to a multidimensional approach that encompasses legal, ethical, and social justice aspects. Minister of Health Regulation (Permenkes) No. 23 of 2022 is the latest regulation that reaffirms the state's commitment to comprehensive HIV/AIDS control. This article aims to analyze the Permenkes from an ethical-regulatory perspective, focusing on how legal norms and ethical values are constructed within public health policy. The study employs a qualitative approach using document analysis and normative-philosophical analysis of the regulation's content, in relation to principles of health ethics such as non-maleficence, justice, autonomy, and beneficence.  The analysis shows that Permenkes No. 23/2022 has normatively accommodated public ethical principles, such as confidentiality protection, the right to treatment, and the prevention of stigma and discrimination. However, implementation in the field still faces structural challenges, including service limitations, regional disparities, and social resistance. This article recommends the need for stronger integration between legal and ethical-participatory approaches in policy implementation, so that HIV/AIDS prevention is not only effective in regulatory terms but also morally just.

Abstract

The issue of gender justice in Islamic inheritance law is often debated, especially regarding the difference in inheritance shares between sons and daughters. This study aims to analyze how the principle of gender justice is applied in the practice of inheritance distribution based on the Compilation of Islamic Law (KHI), particularly with regard to daughters, as well as how the community perceives these provisions. This study uses a qualitative approach with field research in a village that actively applies Islamic inheritance law. Data was collected through in-depth interviews with heirs, religious leaders, and village officials, as well as analysis of inheritance distribution documentation. The results of the study show that although the KHI normatively stipulates that female children receive half the share of male children, its application in society is often distorted due to the influence of patriarchal culture, social pressure, and ignorance of women's rights. In some cases, female children even receive a much larger share based on “voluntariness” or “respect.” This study recommends strengthening gender-based legal awareness and the need to reactualize the values of maqāṣid al-syarī‘ah in the implementation of Islamic inheritance law to make it more fair and contextual.

Abstract

The delay in the distribution of inheritance is a common social phenomenon in society and often leads to tension, injustice, and conflicts among heirs. This study aims to analyze the factors causing the delay in inheritance distribution and its socio-legal impacts using a sociological approach to law. The method used is descriptive qualitative with data collection techniques through observation, in-depth interviews, and documentation in one village in North Sumatra. The results of the study indicate that the delay in the distribution of inheritance is influenced by cultural factors, the dominance of certain parties within the family, a lack of understanding of inheritance law, and concerns about the breakdown of kinship relationships. The resulting impacts include inequality in access to rights, weakened social cohesion, and the absence of legal certainty regarding property ownership.

Abstract

The phenomenon of sound horeg, which is the use of high-powered audio equipment in various community activities, has sparked debate between entertainment values, public order, and religious norms. This study aims to analyze sound horeg from an Islamic legal perspective using a philosophical-critical approach, while also considering the role of local wisdom as an instrument of social regulation. The research method used is field research with in-depth interviews, participatory observation, and documentary studies of entertainment practitioners, religious leaders, village officials, and affected residents. Data analysis is conducted qualitatively using a hermeneutic-philosophical approach to interpret the relationship between the principles of maqashid syariah, customary norms, and contemporary cultural practices. The results of the study indicate that sound horeg is acceptable under Islamic law as long as it fulfills the principle of maslahah (public interest), does not cause harm, and respects the public's right to peace and quiet. Local wisdom functions as a mechanism for adapting values, but its effectiveness depends on social consensus and the moral commitment of the community. This study recommends a community-based regulatory model that is in line with Sharia and cultural values, in order to create a balance between freedom of expression in entertainment and public order.

Abstract

The phenomenon of dropshipping as an online business model is becoming increasingly popular in the digital economy era due to its ease for sellers to market products without the need to keep stock. However, this system raises legal questions, particularly regarding its validity under Islamic law. This study aims to examine dropshipping practices through an Islamic legal approach, conducting a critical analysis of the contract, ownership of goods, and fulfillment of the conditions and requirements of a sale. The research method used is qualitative with a normative approach, referencing primary sources of Islamic law such as the Quran, Hadith, and fiqh muamalah literature, as well as secondary sources in the form of electronic commerce regulations in Indonesia. The findings indicate that dropshipping can be justified under Sharia law if it meets certain conditions, such as clarity of the transaction object (ma’qud ‘alaih), transparency of information, and the absence of elements of gharar or fraud. The contract used must be adapted, for example, through a wakalah or salam contract, to ensure compliance with Sharia principles. This study recommends the need for contemporary fiqh guidelines regulating dropshipping practices so that businesses can operate in accordance with positive law and in harmony with Islamic values.

Abstract

This study explores the philosophical foundations of Islamic law to address contemporary epistemic crises caused by secularization and legal positivism, particularly in Indonesia’s pluralistic context. Through a qualitative-philosophical design, it analyzes six integrated epistemological pillars Al-Ghazali’s synthesis of revelation-reason-morality, al-Shāṭibī’s maqāṣid al-sharīʿah, Harun Nasution’s transcendent-empirical bridge, Juhaya S. Praja’s contextual dialectics, critique of Kelsen’s legal positivism, and multidisciplinary integration to reconstruct a holistic Islamic legal philosophy that unites kauliyah (scriptural values) and kauniyah (empirical sciences). Findings reveal that reducing Islamic law to formalistic rules ignores its transformative, ethical, and contextual essence. The proposed framework not only counters Western positivist limitations but also provides an epistemological basis for expanding Islamic law beyond marriage and banking into socio-environmental-economic domains such as climate justice, inclusive economics, and minority rights. While normative and non-empirical, this model offers a robust foundation for future participatory policy development among ulama, scholars, and state actors.

Abstract

Adoption or also commonly called adoption is a form of legal actions that have important implications for some of the legal status of the parties involved in it. Assessment of the removal of the child is not found in some classical fiqh literature as a separate discussion, so as if the assessment on this matter is not so important-at least not in the classical fiqh codification. Referring to the actual conditions at this time, the institution of adoption is one of the institutions that need to be considered and given more attention, given the significant number of implications that can be caused. This study is a normative study of the laws and regulations of some countries is related with adoption. For the purpose of analysis is, the authors use the approach of socio-juridical and historical so hopefully will be able to describe the direction of the development of legal systems of some countries.

Abstract

This research aims to comprehensively examine the relationship between da’wah and fardhu kifayah in Islam, as well as to identify the central role of da’wah in revitalizing the values of these collective obligations in the lives of individuals and society. The study uses a qualitative method with a library research approach, which involves in-depth analysis of authoritative sources such as the Qur’an, Hadith, fiqh books, and writings of classical and modern scholars .The results of the discussion show that da’wah is a broad concept that not only functions as a means of spreading Islamic teachings but also as a spiritual guide, character builder, driver of social change, balancer of injustice, unifier of community solidarity, and promoter of civilization. Meanwhile, fardhu kifayah is a collective obligation based on the principles of mutual cooperation and public interest (maslahah), which includes not only religious worship but also social, economic, and cultural issues. The role of da’wah in revitalizing the values of fardhu kifayah is realized through the dissemination of knowledge, the development of social awareness, the formation of an active attitude, the organization of networks and institutions, monitoring and evaluation, and the use of modern technology. Without da’wah, the values of fardhu kifayah tend to remain merely theoretical, while with effective da’wah, these values can come alive as culture and behavior, enabling the Muslim community to fulfill its role as a middle community (ummatan wasatan) that brings truth and goodness.

Abstract

Divorce constitutes a legal event that carries significant juridical and social implications for family life. In Indonesia, the practice of divorce conducted outside the Religious Court is still found within society, particularly among Muslim communities, despite the normative provisions stipulated in Law Number 1 of 1974 on Marriage, which explicitly mandate that divorce may only be effected before a court of law. This study aims to analyze the legal and social consequences of divorces carried out outside the Religious Court within the framework of the national legal system. Employing a normative legal research method with statutory and conceptual approaches, this study is supported by an extensive review of legislation, court decisions, and doctrines of Islamic family law. The findings indicate that divorce for Muslim couples is legally valid only when it is pronounced through a decision of the Religious Court. Nevertheless, in social practice, divorces conducted outside the Religious Court—either unilaterally or through oral agreements between the parties—remain prevalent. Such practices generate complex implications. From a juridical perspective, divorces conducted outside the court lack legal force, resulting in the marriage status remaining administratively valid, which in turn complicates the fulfillment of civil rights, including the division of marital property, inheritance rights, and the issuance of divorce certificates. From a social perspective, this condition has the potential to give rise to stigma, discrimination, and socio-economic vulnerability, particularly for women and children. Furthermore, from the standpoint of state administration, out-of-court divorces create obstacles in civil registration processes and weaken legal protection mechanisms for children. This article underscores the urgency of law enforcement and the enhancement of public awareness regarding legally valid divorce procedures in accordance with Indonesian law in order to ensure legal certainty, the protection of women’s and children’s rights, and orderly state administration.

Abstract

The rapid development of artificial intelligence (AI) has increasingly influenced various aspects of social life, including religious practices among Muslim communities in Indonesia. The use of AI in religious contexts—such as Islamic question-and-answer applications, automated sermon and khutbah generation, religious text translation, and digital worship assistants—has raised normative and ethical debates regarding its legitimacy and legal boundaries within Islamic law. This article aims to examine the response of Islamic law to the use of artificial intelligence in religious practices in Indonesia by focusing on normative and ethical considerations. The study employs a qualitative normative–critical approach through document analysis of fatwas, contemporary scholarly opinions, relevant digital technology regulations, and previous research findings on AI and religion. The analysis is conducted using the frameworks of uṣūl al-fiqh and maqāṣid al-sharīʿah to assess the compatibility of AI applications with the fundamental principles of Islamic law. The findings indicate that Islamic law is generally receptive to the utilization of AI as a supportive tool in religious practices, provided that it does not replace scholarly authority, undermine core theological principles, or generate social and religious harm. Nevertheless, the use of AI in religious contexts requires clear normative boundaries and ethical oversight to prevent the erosion of religious meaning and scholarly legitimacy. This study underscores the need for an adaptive and critical Islamic legal framework to address the challenges posed by artificial intelligence in contemporary Indonesian religious life.
