Abstract

This article examines the concept of fiqh of moderation (wasaṭiyyah) through the framework of inclusive, flexible, and contextual approaches to Islamic jurisprudence. However, the notion of fiqh of moderation is not a new term, and previous studies have yet to elucidate the mechanism through which inclusive, flexible, and contextual approaches can effectively serve as models of religious moderation. This article aims to address this lacuna by exploring their practical application to contemporary challenges in Muslim societies. This article uses a qualitative approach with a literature study type of research (library research). This article concludes that the inclusive approach of fiqh of moderation encompasses the diversity of legal opinions (madhāhib) and fosters interfaith dialogue. The flexible approach employs ijtihād to address emergent issues while upholding shariah principles. The contextual approach takes into account socio-cultural specificities in legal interpretation, guided by maqāṣid al-sharīʻah (the higher objective of Islamic law). These findings indicate that the integration of these approaches within the fiqh of moderation framework results in the creation of a balanced methodology. This methodology preserves the core principles of shariah while enabling adaptability to modern circumstances. This article contributes to the discourse on religious moderation by proposing a theoretical framework that seeks to harmonize Islamic tradition with contemporary social dynamics. The framework functions as a resource for scholars, policymakers, and Muslim communities seeking to implement moderate religious perspectives that promote social harmony while maintaining religious authenticity.

Abstract

The present study demonstrated that the "Contextual Transformative Ethics" model facilitates the integration of Islamic ethical values into contemporary governance practices, thereby enhancing national commitment and tolerance in Papua through the "Rembuk Amanah" mechanism, which respects local traditions. This research paper examined the synergy between Islamic ethics and modern governance in the implementation of a mental revolution in the Papua Religious Affairs Office through an analysis of value-based institutional transformation. This study addresses a significant gap in the extant literature on ethics in bureaucratic practice. While there are numerous studies on the subject, there is a paucity of specific models that integrate Islamic ethical values with modern governance approaches in diverse socio-cultural contexts, such as Papua. The objective of this study is to identify a model of adaptation of Islamic ethical values into modern bureaucratic practices, with a focus on the social and cultural conditions of Papuan society. The data collection process entailed participatory observation in five KUA, in-depth interviews with 24 respondents, including officials, staff, and service users, as well as the analysis of policy documents and operational records of institutions during the period 2020-2024. The analysis employed Tariq Ramadan's contemporary Islamic ethics theoretical framework, Ostrom-Basurto's adaptive governance model, and George-Sim's authentic leadership approach through the stages of reconciliation, presentation, and data construction. The research findings revealed the unique phenomenon of "Rembuk Amanah" as a cultural negotiation mechanism between Islamic values and local wisdom. Furthermore, the identification of the "Agent of Change" group, which has developed a digital-based service system while maintaining a traditional personal touch, was noted. The research yielded a model of "Contextual Transformative Ethics" and the concept of "Responsive-Adaptive Governance," which describes the dynamic interaction between bureaucratic structures, ethical values, and cultural contexts in institutional transformation. The study's limitations stem from its narrow geographical scope and cross-sectional design, which precludes a comprehensive analysis of long-term change.

Abstract

The phenomenon of globalization has had a profound impact on how societies conceptualize and engage with religious practices. In the context of globalization, challenges such as taṭarruf (extremism), takfīr (excommunication), and taʻāṣub (fanaticism) have underscored the imperative for the promotion of religious moderation. The objective of this study is to examine the notion of religious moderation as a potential remedy for extremism, excommunication, and fanaticism. Employing a qualitative research method and a library-based approach, the study reveals that religious moderation is essential for harmonizing religious principles with the challenges posed by global change. It is also positioned as an effective approach to countering religious extremism, reducing excommunication, and mitigating fanaticism that threatens social harmony. However, this study also identifies challenges in implementing religious moderation, particularly in addressing radicalism driven by globalization. This study addresses a significant research gap in the field of religious moderation by underscoring the absence of effective strategies for integrating moderation values into educational and social policies. The practical implications of this research underscore the necessity of fortifying the role of educational institutions, media outlets, and government policies in methodically and sustainably promoting religious moderation.

Abstract

The emergence of radicalism in the context of Indonesia's digital era poses a significant concern for family institutions. Family resilience systems and understanding of religious moderation values are important to build simultaneously. This study examines the integration and internalization of religious moderation values within family institutions, intending to mitigate the propagation of radicalism in Indonesia during its digital era. This study employs a qualitative research method with a conceptual approach. The data utilized in this study are secondary data derived from journal articles, online mass media, books, reports, and documents obtained through literature reviews. Then, the data analysis method uses interactive qualitative based on Froma Walsh's family resilience theory. The findings of this study suggest that the notion of family resilience, grounded in the integration and internalization of religious moderation, can be operationalized through the establishment of a moderate religious system pattern, an intricate nuclear family structure, and transparent interpersonal communication. This study offers a pragmatic reference for families seeking to enhance their resilience against the threat of deviant religious beliefs in Indonesia's digital era. Furthermore, it can serve as a policy consideration regarding the internalization of religious moderation values within the family institution in the Pusaka Sakinah program at the Ministry of Religious Affairs.

Abstract

This study uses a confirmatory factor analysis approach to explore the relationship between understanding fiqh al-muwāzanāt and emotional maturity in religious conflict resolution. Data was collected via an online survey involving 412 respondents (56.3% male; 43.7% female). The model testing results using Structural Equation Modeling (SEM) demonstrated a strong model fit (χ² = 187.24, df = 76, p < 0.001, CFI = 0.942, TLI = 0.927, RMSEA = 0.058, SRMR = 0.043). Furthermore, the findings revealed a significant correlation between the understanding of fiqh al-muwāzanāt and emotional maturity (r = 0.68, p < 0.001), with both variables simultaneously exerting a substantial influence on individuals' ability to resolve religious conflicts (β = 0.42 and β = 0.37, p < 0.001). The mediation analysis results further indicated that emotional maturity mediates the relationship between fiqh al-muwāzanāt understanding and religious conflict resolution (indirect effect = 0.25, 95% CI [0.18, 0.32]). Thus, this study highlights the dynamic interaction between textual religious understanding and individuals' emotional regulation competencies, thereby expanding upon previous studies by Lattu and Schmidt et al., which primarily focused on the cognitive aspects of religious comprehension. Additionally, unlike Najib's study, which relied on a qualitative approach, this research provides empirical evidence through a quantitative-based validation of a more comprehensive theoretical model. Consequently, these findings underscore the urgency of integrating contextual religious understanding and emotional matrity as a strategic intervention approach for resolving religious conflicts in the digital era.

Abstract

This article examines the construction of tolerance fiqh in the 2024 Resolution of the Ijtima' Nasional VIII of the Fatwa Commission of the Indonesian Ulema Council (MUI), which includes perspectives on interreligious relations, greetings across faiths, and tolerance in the context of religious festivities. The issuance of these guidelines is closely tied to Indonesia's religious diversity, requiring clear normative guidance and boundaries rooted in Islamic law to promote harmonious interfaith interaction. Therefore, this article looks at the ideas and boundaries of tolerance found in the guidelines by using the principles of maqāṣid al-sharīʻah (the higher goals of Islamic law) and fiqh al-aqalliyyāt (Islamic laws for minorities). It further explores the legal reasoning, normative structure, and socio-religious implications within Indonesia's pluralistic society. This literature-based study uses the 2024 resolution as the primary source, supported by secondary materials, including journals and classical works in fiqh and uṣūl al-fiqh. This article concludes that the guidelines for tolerance in Islamic law clearly separate beliefs, worship, and social interactions. This distinction allows for mutual respect and interfaith tolerance while upholding boundaries, such as prohibiting interreligious greetings, using religious symbols from other faiths, and participating in non-Muslim religious celebrations. The resolution thus maintains a firm commitment to ḥifẓ al-dīn (protection of religion) while providing measured flexibility in social engagement. This article contributes to developing a contextual and balanced Islamic legal methodology for managing religious diversity in Indonesia.

Abstract

The issues of arrogance, religious extremism, and misunderstanding of Islamic teachings are serious problems that have the potential to disrupt socio-religious stability. This article explicitly explores the recent proliferation of instant preachers (ustadz) who lack a profound comprehension of religion, a moderate sanad, and an intellectualist interpretation of religion. Ultimately, these groups exhibit signs of religious arrogance, encompassing the practice of takfīr, the assertion of supremacy, and a proclivity for advocating discrimination over violence. The writing of this article uses a qualitative method of descriptive critical analysis and literature study. The main data refers to the findings of virtual observations related to the rampant phenomenon of arrogant instant preachers, then data from surveys by specialized institutions that study extreme religious movements on social media, and selected interviews with various parties. The findings of this article indicate that individuals who acquire a comprehensive understanding of religion without the guidance of a qualified and tempered instructor are susceptible to developing an exaggerated sense of self-importance, which can manifest in religious extremism. With its takfirī characteristics and often legalizing violence, this is a serious problem, especially for preachers in Indonesia. This article can be academically useful in the field of religious pattern studies in Indonesia. Practically, it is expected to get a response from the Ministry of Religious Affairs, the National Council for Religious and Cultural Affairs (BPNT), Indonesian Ulema Council's Countering Extremism and Terrorism Agency (BPET-MUI), and moderate religious organizations Nahdlatul Ulama (NU) and Muhammadiyah to pay more attention to the emergence of new preachers who have sprung up on social media with backgrounds and religious understanding that are far from the competency standards of mastery of religious knowledge.
