Abstract

The general election as a pillar of democracy faces new challenges with the rapid development of information technology, one of which is the practice of doxing—disseminating personal data without consent to harm individuals. In the context of Indonesia’s 2024 General Election, doxing cases have increased, targeting political figures and ordinary citizens, potentially undermining political participation and violating the right to privacy. This study aims to analyze the legal framework governing doxing based on Law Number 1 of 2024 concerning Electronic Information and Transactions (ITE Law) and Law Number 27 of 2022 concerning Personal Data Protection (PDP Law), as well as to examine the form of criminal liability for perpetrators of doxing in the context of the 2024 election. This normative juridical research employs statutory, conceptual, and case approaches. The findings reveal that although not explicitly regulated, doxing can be classified as a legal violation under the two laws. However, law enforcement still faces technical and normative obstacles, such as difficulty in identifying perpetrators and proving intent. Strengthening legal provisions and the capacity of law enforcement officers is essential to ensure accountability without compromising democratic principles.

Abstract

Enforcement of the election organizer's code of ethics is an important aspect of maintaining the democratic process and elections in Indonesia. The integrity of election organizers is a main pillar in realizing democratic and legitimate elections. The Election Organizer Ethics Council (DKPP) has a crucial role in upholding ethical standards among election organizers. This research aims to analyze the legal aspects of the DKPP's decision regarding violations of the election organizer's code of ethics in East Lombok Regency in 2024, focusing on the case study of Case Number 187-PKE-DKPP/VIII/2024. Through a case study approach and normative juridical analysis, this research will examine the legal basis, considerations, and implications of the DKPP's decision on election organizers and the integrity of the election process at the local level, namely East Lombok Regency. The results of this research indicate that the legal analysis of the Election Organizer Ethics Council's Decision in Case Number 187-PKE-DKPP/VIII/2024, which resulted in the permanent dismissal of a member of the East Lombok Regency KPU, is based on the normative aspect and the fundamental essence of ethics and the neutrality of independent and fair election organizers without any affiliation or indication of bias towards any group or faction

Abstract

Economic development in today's world has grown rapidly, leading to numerous changes in human life. By investing in the capital market, it becomes one of the alternatives for financing the community's economy and is easily accessible to the public. One of them is to invest in bond securities in issuer companies. However, by purchasing bonds in the capital market with the issuer company, in addition to providing benefits through interest rates, there are risks, including if the issuer company goes bankrupt. Under these conditions, the holder of the unsecured bond will be positioned as a concurrent creditor, whose repayment is made after the separatist and preferred creditor. Although not guaranteed collateral, bondholders still obtain legal guarantees of their rights through information disclosure, the role of trustees, and arrangements within the applicable legal framework.

Abstract

This study aims to examine the extent to which the identification doctrine is applied in establishing corporate criminal liability for acts of corruption. The increasing number of corruption cases involving corporate entities poses a challenge for the criminal justice system in attributing legal fault to legal persons that lack independent intent or will. The objective of this research is to analyze how the identification doctrine is utilized to bridge this issue and to assess its effectiveness and fairness in judicial practice. This study employs a normative legal approach using qualitative methods through the analysis of statutory regulations, legal doctrines, and court decisions. The findings indicate that although the identification doctrine provides a logical foundation for prosecuting corporations through the actions of their directors or executives, its application still faces challenges in distinguishing between individual actions taken personally and those undertaken on behalf of the corporation. This ambiguity may result in legal uncertainty and injustice in the enforcement of criminal sanctions. Therefore, clear and firm criteria are necessary in determining corporate criminal liability to support a more just and accountable legal system.

Abstract

This study is motivated by the ongoing debate regarding the application of the death penalty to perpetrators of corruption in Indonesia, particularly in relation to the protection of human rights as stipulated in Law Number 39 of 1999. The purpose of this research is to explain the extent to which the death penalty can be appropriately and proportionally applied to corruptors while considering human rights principles. This study employs a normative legal approach focused on the analysis of statutory regulations and relevant legal literature. The data is analyzed using a qualitative juridical method, emphasizing a normative review of applicable positive law. The findings reveal a discrepancy between the imposition of the death penalty for corruption crimes and the right to life guaranteed by Indonesia’s human rights legal instruments. The implication of this research highlights the need to reconsider the policy of capital punishment for corrupt practices to ensure alignment with the principles of justice, humanity, and respect for human rights within the national legal system.

Abstract

This study uses a qualitative method with a normative legal approach that aims to analyze legal protection for victims of Information and Electronic Transactions (ITE) crimes, especially in cases of the distribution of digital pornographic content. The rampant distribution of pornographic content through digital platforms is a serious threat to the privacy rights and dignity of victims, especially women and children. In the context of law in Indonesia, protection for victims has been regulated in several laws and regulations such as Law Number 19 of 2016 concerning Amendments to the ITE Law and the Criminal Code (KUHP). However, the implementation of this protection still faces various obstacles, includeing weak law enforcement, limited understanding of victims’ rights, and the suboptimal role of witness and victim protection institutions. Through literature studies and analysis of court decisions, this study found that legal protection is still reactive and has not been optimal in preventing and restoring victims’ losses as a whole. Therefore, a more responsive policy reformulation and strengthening of digital literacy are needed as strategic preventive measures.

Abstract

The handling of terrorism crimes in Indonesia requires a balance between safeguarding the rights of perpetrators as individuals entitled to human rights and fulfilling the rights of victims affected by such acts of violence. This study aims to evaluate how human rights protections for terrorism suspects are upheld during legal proceedings, as well as how the state strives to protect and rehabilitate victims of terrorism under Law No. 5 of 2018 on the Eradication of Criminal Acts of Terrorism. Using a normative juridical approach, this research analyzes a case study based on the North Jakarta District Court’s Decision No. 1580/Pid.Sus.Terrorism/2020/PN.Jkt.Utr. The findings indicate that terrorism suspects are granted fair legal treatment, including the right to defense, a fair trial, and protection from torture, in accordance with the principle of non-derogable rights under international human rights law. On the other hand, Law No. 5 of 2018 establishes a clearer and more comprehensive legal framework to ensure victims' rights, including rehabilitation, compensation, and restitution. However, the implementation of victim protections still faces various technical and administrative challenges. This study recommends strengthening mechanisms for victim protection and enhancing legal enforcers' awareness of human rights principles in handling terrorism cases.

Abstract

Cyberbullying has become a significant social problem in the digital era, requiring comprehensive legal handling. This research analyzes cyberbullying as a form of digital crime and how Indonesian law regulates, handles, and faces challenges in law enforcement in the digital era. This study uses a normative juridical approach with library research methods. The results show that although Indonesia does not yet have specific laws governing cyberbullying, several provisions in existing laws and regulations can be used to ensnare cyberbullying perpetrators. However, the unique characteristics of cyberbullying and the dynamics of technological development pose challenges in law enforcement that require regulatory updates and increased capacity of law enforcement officers. Prevention and countermeasures require a holistic approach involving legal, technological, educational and social aspects.
