Abstract

This study aims to formulate a model of contemporary Islamic law approach based on sad dzariah and fath dzariah towards the millennial generation's phenomenon and culture of pranking. There are various new phenomena and cultures in the current millennial era which are identical with moral damage and socio-cultural harm to Indonesian society, as is the culture of pranking by the millennial generation. This is because the current millennial generation's pranking phenomenon has various impacts on people's lives. This condition then raises several questions: First, how is the impact of the phenomenon and culture of pranking by the millennial generation on the socio-cultural formation of Indonesian society? Second, how are the sad dzariah and fath dzariah approach model responding to the impact of the millennial generation's phenomenon and culture of pranking on the socio-cultural formation of Indonesian society? The research method used to answer these questions is to use the library method with databases on books, articles, and various data from the media and research related to the cultural impact of pranking in Indonesia. The data that has been collected is then compiled descriptively and analyzed using the content analysis method to conclude. This study found that: First, although it has a positive impact, it turns out that the negative impact is more dominant in the phenomenon and culture of pranking in Indonesia. Second, sad dzariah and fath dzariah have the urgency to avoid pranks and the culture of pranking as a means to avoid crime.

Abstract

Ashabiyah is the most crucial thing in building integrity in the community's social life, especially in religious life. In Indonesia, various kinds of religions have developed, and differences in ethnicity, race, and language are unique features and challenges for the people of Indonesia. What's more, when talking about religion which is very risky in the history of the world and even in Indonesia, discrimination, violence, intolerance, and violence in the name of religion often become prolonged conflicts. Therefore, this research is presented as a sample form of the polarization of ashabiah from the Tanon community, which has differences in one social unit, even at a more micro level, that's the family. This research is qualitative research with a phenomenological approach as the chosen approach. The design strategy that the researcher uses is to identify the nature of a community phenomenon based on the experiences of individuals who are members of the Tanon Village community, Papar District, Kediri Regency. The theory used is Talcott parson's theory of structural functionalism. The results of this study indicate that the function of the religious elite, abangan, and the Tanon community in the salvation system is one of the forums for building religious harmonization. In addition, the religious elite, in conveying their spiritual teachings from each religion, recognizes religion as a universal truth in Tanon society. The last is a customary ritual, and cultural traditions are a means of latency for the people of Tanon Village in forming a harmonious social life.

Abstract

This study aims to determine the effectiveness of applying the Islamic Law Compilation (KHI) to minimize divorce cases at the Sigli Sharia Court. In addition, this study is to find out the obstacles to applying the Islamic Law Compilation in the Sharia Court and the efforts made by the Sigli Syari'ah Court to minimize disputes/divorce cases based on the Islamic Law Compilation. The research method used is empirical legal research using a case study approach, a statute approach. This study uses 2 (two) theories, namely the theory of legal effectiveness and the theory of the legal system.

Abstract

This study wants to reveal in detail the teacher's ethics according to two different points of view. First, the point of view of the leader of Islamic education reformer Syed Naquib Al-Attas Malaysia. Second, is the figure of Indonesian Islamic education, KH. M. Hasyim Asy'ari Indonesia. The research method used is a literature study combined with content analysis. So the answer is that the teacher ethics perspective of Syed Naquib Al-Attas and KH. M. Hasyim Asy'ari has differences in the details. However, it has a similar goal, namely to strengthen the transfer of knowledge that is strongly connected with the transfer of attitude (Adab/Akhlak).

Abstract

Ulama have a role as cultural and moral figures to protect and foster people in social life. Umara is a political elite tasked with carrying out state political policies and maintaining state ideology. In the socio-political context, the ulama and umara synergize with each other to realize the unity and harmony of the people in religion and the state. In reality, some Islamic organizations led by ulamas create a commotion in the country and are very opposed to the umara policy, causing divisions among community groups. Based on the problems above, the study's results show that (1) the involvement of ulama and umara in the political stage is not new. That strong support from the Shari'a is exemplified by the Prophet Muhammad and Khulafa Ar-Rashidin. (2) Ulama and umara should create an ideal society, namely a society that is independent and runs on the correct principles. (3) Social Sufism offers a solution to overcome conflicts between ulama and umara amid society.

Abstract

The existence of rural Sufism strengthens the dimensions of spirituality and the values ​​of Pancasila. This paper analyzes the contribution of the Qadiriyah-Naqsabandiyah congregation in Kebonagung Village, Babat, Lamongan, for strengthening Pancasila values. From field observations, interviews, and activity analysis, this research found that the strengthening of Pancasila values ​​in Kebonagung village resulted from the moral awareness of the Qadiriyah-Naqsabandiyah congregation. The values of Pancasila are the value of divinity with the spirit of religiosity in worship and religious activities, human values ​​by maintaining Islamic brotherhood, the value of unity by creating strong social cohesion in society, populist values ​​with deliberation in solving problems, the value of justice with the spirit of sharing with others or alms. Strengthening the values ​​of Pancasila makes rural Sufism fulfill the requirements of being a good citizen. This study suggests that the rural Sufism movement is an essential part of supporting the existence of Pancasila from below.

Abstract

The purpose of this study was to describe the vital elan of nationalism in students' souls, explain students' understanding of the dangers of radicalism, analyze the model of strengthening nationalism in Islamic boarding schools, and analyze the mapping model of radicalism in Islamic boarding schools. This research method is a grounded research model with a naturalistic paradigm. Data were collected using in-depth interviews and documentation. Meanwhile, the data analysis used inductive-naturalistic-interpretive techniques. The results of this research found that the expression of the elan vital of nationalism in the soul of the santri is shown through obedience, respect for state symbols, obedience to government rules, and living the substantive meaning of symbols and state philosophy. The form of thought is in the form of the belief that the concept of the Four Pillars of Nationality is final, while the action is in the form of implementing the values of the Four Pillars of Nationality through learning and daily activities.

Abstract

This study is intended to describe the government's propaganda strategy in reconciling followers of the Shi'a and Sunni sects in Sampang Regency. This research was conducted to find out how the government resolves the conflict between the two sects of Islam in Sampang Regency and the government's role in finding common ground between the two. This study uses a field research method that describes and presents the data descriptively. The results of this study indicate that the reconciliation propaganda strategy chosen by the government is a cultural strategy with cultural approaches. The strategy starts from affective aspects, cognitive aspects, and aspects. In addition, the government as a mediator absorbs and collects aspirations from below, both from ulema/kyai and Sunni community leaders and Shiite leaders.

Abstract

This research investigates the judges’ perception and tendency to refer to the Books of Fiqh (Kitab Kuning). This research focuses on sharia economic dispute settlement in Indonesian religious courts. The research method used combines normative legal and empirical socio-legal research. The results found that the perception and tendency of judges towards several sources of legal rules in assessing, weighing, and deciding a sharia economic case in the Indonesian Religious Courts, did not always rely on one KHES as a material source. In Indonesian law, judges cannot use only one source in resolving sharia economic disputes, such as the Book of Fiqh (Kitab Kuning) only. However, it is an equally important combination, and it can be seen from several decisions of the Religious Courts in Indonesia.

Abstract

Religious harmony is a coveted hope in building a nation and state community in an effort to achieve a safe, peaceful, and prosperous life. The interaction of people who have different beliefs is not a trivial matter to be addressed. However, collective awareness is needed to understand the importance of harmony in building community life with various religions. This study takes the theme of the role of local culture in preserving harmony, as well as the impact of globalization on inter-religious relations in Pelang Lamongan Village. The purpose of this research is to understand the role of local culture in preserving religious harmony, and to know the impact of globalization on inter-religious relations in the Pelang Lamongan village community. As for the analysis knife, this research uses the Trilogy theory of religious harmony, Mukti Ali, with the model of internal harmony between religious communities, inter-religious communities, and religious communities with the government. Research using a qualitative approach seeks to examine more deeply the pattern of inter-religious harmony in the village of Pelang Lamongan. With the findings, that culture is one of the efforts to build religious harmony such as local traditions, namely earth alms and life cycle rites, they become routines that they do continuously and continuously. This directly or indirectly has the consequence that it can foster and strengthen inter-religious harmony. An inclusive religious attitude also underlies the tolerant attitude of the Pelang village community, this attitude is manifested in the practice of gotong royong in carrying out socio-religious activities involving Muslims (NU, Muhammadiyah) and Christians. In addition, globalization can be used as capital in strengthening the intensity of social interaction among the people of Pelang Lamongan village.
