Abstract

Constitutional Court Decision No. 23/PUU-XIX/2021 opens cassation appeal against PKPU decisions by the Commercial Court in cases filed by creditors and rejected peace offers from debtors. Whereas the non-opening of legal remedies according to Article 235 paragraph (1) and Article 293 paragraph (1) of the K-PKPU Law aims to ensure legal certainty and fulfill the needs of the business world for fair, fast, open, and effective debt settlement. The purpose of this study is to determine the implications of the opening of cassation legal remedies for PKPU decisions due to the Constitutional Court Decision on the mandate of the K-PKPU Law. The method used is normative juridical and qualitative. The results showed that the opening of cassation legal remedies for PKPU decisions due to Constitutional Court Decision No. 23/PUU-XIX/2021 has violated and hampered the mandate of the K-PKPU Law to create legal certainty and resolve debt problems quickly and effectively. That the Constitutional Court's consideration in making Decision No. 23/PUU-XIX/2021 is based on efforts to maintain the realization of justice, however, it must also be understood that the spirit of resolving bankruptcy cases through PKPU is expediency, namely the continuity of the debtor's business. Therefore, it is recommended to regulate the procedure for filing and handling cassation appeals against PKPU decisions with a fast deadline, within which it is still possible to produce quality cassation decisions, and also implement the insolvency test in bankruptcy regulations in Indonesia.

Abstract

This study explores the interrelations among organizational culture, perceived organizational support, transformational leadership, and work engagement. Using a robust statistical framework, the research examines how these variables interplay and influence one another, thereby affecting employee performance and job satisfaction. Organizational culture was found to have a significant predictive power over perceived organizational support, but its direct influence on work engagement was less pronounced, necessitating a mediator such as perceived support. Perceived organizational support robustly mediated the relationship between organizational culture and work engagement, emphasizing the necessity for employees to feel valued and supported. Transformational leadership had a nuanced impact; it directly influenced work engagement marginally, yet did not significantly affect perceived organizational support nor work engagement indirectly through perceived organizational support. These findings suggest that transformational leadership may require additional mediating factors to effectively promote engagement. The study's indirect pathway analysis highlights that the pathway from organizational culture to work engagement through perceived organizational support is significant, confirming the mediating role of perceived support. Conversely, transformational leadership’s indirect impact on work engagement through perceived support was non-significant, indicating the potential need for other mediating variables. Conclusively, the research provides insights into the complex dynamics of workplace variables, stressing the importance of a holistic organizational approach to enhance employee engagement and performance. It also underscores the critical nature of employees' perceptions of support in translating leadership and cultural values into engagement.

Abstract

The percentage of e-money users in Indonesia is still low, not comparable to several neighboring countries. Even though the Indonesian government has made regulations regarding e-money security, in terms of digital payments it is still low. This research analyzes the determining factors for the use of e-money for millennials. This research was conducted in Batam City, which is considered representative of Indonesia. The sample size was 400 millennial respondents, using SPSS version 29.0, it was concluded that perceived usefulness, performance expectancy, social influence and trust had a significant positive effect on intention to use e-money. Meanwhile, perceived use and effort expectancy do not have a significant effect. This condition actually indicates that the existence of government regulations regarding payment security has the most significant impact in encouraging the use of e-money.

Abstract

In this research, marine and fisheries development in West Kalimantan is directed at optimizing the management and sustainable use of natural resources, increasing fisheries productivity and production, expanding employment opportunities, supporting increased non-oil and gas exports and increasing consumption of fishery products. This data was collected through literature study and complemented by field observations and semi-structured interviews with groups of fishermen in Kampung Nelayan Kakap, Kubu Raya, West Kalimantan and related government agencies in West Kalimantan. By using the snowball sampling technique as an interview sample, the research results show that the majority of people's livelihoods in Fisherman's Village rely on catching fish, shrimp and crabs by fishermen using small traditional boats. The decreasing number of fish catches is also a problem faced by local fishermen, even though selling prices have increased in line with increasing demand for fishery products. The results of the interpretation are an effort to optimize maritime culture in the form of life behavior and human procedures as a nation's community towards the sea and the utilization of all the potential maritime wealth that exists in, on and around the sea to meet the living needs of society and the current economy of a country. present and future by exploring and developing ideas in the form of knowledge, social norm systems and the technology that supports them.

Abstract

This article is a literature review that discusses the articles of financial experts who popularized the method of calculating expected portfolio returns using economic factors that are considered to have an influence on the value of the portfolio greater than or equal to the influence exerted by market indices. The calculation method described in this study is an extension of the CAPM model introduced by Sharpe, Treynor, and Lintner in the 1960s. This article discusses starting from the method of Arbitrage Pricing Theory introduced by Ross in 1976, and the economic factors that become variables in the calculation of Arbitrage Pricing Theory proposed by NF. Chen, Roll, and Ross in 1986. then explained the calculation model Fama and French 3 Factor Model introduced in 1992, then Carhart 4 Factor Model which is an expansion of FF3FM, Pator-Stambaugh Model introduced by Lubos Pastor and Robert F. Stambaugh in 2001, and finally discusses the calculation model Fama and French Five Factor Model introduced in 2014 which is an expansion of FF3FM

Abstract

Work ability, work discipline and communication certainly have an interrelated relationship, by running it according to procedures and directions all work will be easily completed. Therefore, the purpose of this study is to determine the effect of work ability, work discipline, communication, on company performance mediated by resilient leadership. The method uses quantitative analysis with the help of SEM PLS data processing tools. Data collection using questionnaires to a total of 580 ojol drivers in Batam City. The research variables consist of work ability (X1), work discipline (X2), communication (X3), leadership (Y1), and organizational performance (Y2). The results concluded that hypotheses 2, 3, 5, 6, and 7 can be accepted while hypotheses 1 and 4 are not accepted in this study because they have statements that are not strong with the results of the coefficient of determination test for the dependent variable value of 0.750 (75%) and the mediating variable is 0.691 (69.1%) and data quality (Goodness of Fit) of 0.702.

Abstract

Modern life is increasingly developing, causing technology to become more advanced, the use of money is becoming easier and more sophisticated with the existence of e-wallets, meaning people don't need to carry cash for any payment, which is easier by just carrying a digital wallet. The aim of this research is to empirically prove the influence of service features, promotions, convenience and price on usage decisions. This research was conducted on e-wallet users, especially in Madiun City, using a purposive sampling method with certain criteria and obtained 384 respondents. The research was conducted for 5 months. This research method uses a quantitative approach using IBM SPSS Statistics version 26. The results of this research are that the Service Feature variable has a significant influence on usage decisions, promotion has a significant influence on usage decisions, convenience has a significant influence on usage decisions, and it can also be seen that price has an influence significant impact on the decision to use Dana's e-wallet in Madiun City

Abstract

The Advocates' Organization (OA) is a professional forum for advocates which was founded with the aim of improving the quality and becoming a supervisor for its members, namely advocates. The basis for establishing an advocate organization is Law no. 18 of 2003 concerning Advocates (Advocate Law). Perkumpulan Penasehat Hukum Keadilan Rakyat (PPHKR) is one that exists in Indonesia and was founded in 2020 and currently has Regional Leadership Councils (DPD) in 20 Provinces in Indonesia. The main problems in developing OA, which operationally carries out business functions, are: There is no website that can provide information regarding the existence of OA and there is no massive marketing governance system. With this problem, the solution that the Abdimas Team will try to provide is; create an OA Web and organize a massive marketing program. The activity plan consists of 4 stages, first identifying OA's needs, then creating a website according to OA's needs, third preparing a marketing plan and then socializing the marketing plan so that it can be implemented by OA.

Abstract

This study examines the effect of good corporate governance characteristics, namely managerial ownership, institutional ownership, environmental committee, board size, independent commissioners, gender diversity, and CEO duality, on carbon emissions disclosure. This study used a quantitative approach, utilizing secondary data sourced from annual reports and sustainability reports from the energy, industry, materials, and transportation sectors. The sample observation period in this study is from 2018 - 2022. The sampling method uses purposive sampling to obtain a final sample of 26 companies. The selection of analytical technique involves panel data regression analysis utilizing the selected random effect model. The analytical tool used in this purpose is Eviews 12. The findings of this study indicate that variables such as management ownership, institutional ownership, board size, independent commissioners, and gender diversity did not have a significant effect on carbon emissions disclosure. Furthermore, the presence of environmental committees and the practice of CEO duality were found to have a significant positive effect on the disclosure of carbon emissions. Also, the findings of this study indicate that the effect of firm size on the relationship between good corporate governance characteristics and carbon emission disclosure is limited to that of a predictor rather than a mediator.

Abstract

The Gospel first entered the Land of Papua through Ottow and Geissler, on February 5, 1855, at Mansinam Island. The presence of the Gospel has changed the entire life order of Native Papuans from a primitive culture to a civilized and educated society. Religious activities are rousing and implemented throughout the city of Manokwari and even in remote villages. However, on the other hand, crime, juvenile delinquency, and prostitution still characterize Native Papuans' life in Regional Manokwari. This study aims to find the causes of the discrepancy between the faith and actions of indigenous Papuans in the Evangelical Christian Church in Regional Manokwari. In this study, researchers used inductive-descriptive-analytical qualitative methods, with a literacy approach, structured in-depth interviews, observation, and documentation. Researchers used the phenomenological paradigm with purposive sampling and snowball sampling techniques to get sample for interview. From this research, it was found that clarity on calling as a pastor, purification in the pastoral care of the congregation, as well as needs for native Papuans to be recognized, accepted, and appreciated are factors that influence the quality of Christian faith of Native Papuans in Evangelical Christian Church, Regional Manokwari. This research found that born-again is fundamental and very decisive for the transformation of faith, from a legalistic one to a faith that can deny itself and prioritize God's will to live a holy, righteous, just, and loving life.
