This article aims to explain the status of ships under Pelindo's property rights, and what legal remedies Pelindo can take after the merger. This research is an empirical juridical legal research (non-doctrinal). The type of data used in this research is secondary data. This research uses three approaches, namely statute approach, case approach, and conceptual approach. Furthermore, related to data analysis, the data collected from the research results were then analyzed by the author in a descriptive-qualitative manner. The result of this study is that the merger carried out by PT Pelindo against PT Pelindo I, III, and IV has implications for the value of the company's assets that increase, this condition causes the inclusion of the company's authorized capital. The special thing that must be considered in this merger is about ship assets. Ship assets that have not been renamed, cannot be used in operational activities and the ship is not loaded with property rights and is suitable for operation. Therefore, the ship must be renamed in accordance with the Regulation of the Minister of Transportation of the Republic of Indonesia Number PM 39 of 2017 concerning Ship Registration and Nationality.

Abstract

Emergency services are intangible, making it challenging for public agencies like the City of Tshwane Emergency Services Department (CoT's ESD) to analyse customers perceptions and assess the desired results of their service quality. The review of literature indicates limited academic attempts to evaluate expectations from customers and their perceptions in relation to customer satisfaction in the Municipal Government Emergency Services Department (CoT ESD) context, especially in South Africa. It is in this regard that the study evaluated the customer perceptions and expectations of residents regarding service quality delivery of CoT ESD. The study adopted the quantitative method with the use of self-administered questionnaire to a randomly selected sample of 274 respondents within the seven regions of the City of Tshwane. Data was analysed using the SPSS version 27. The study concludes that there is a positive relationship between customer expectations and the satisfaction; there is a positive relationship between customer perception of services delivered on services delivered by the Emergency Services Department of the City of Tshwane. The study recommends that the Emergency Services Department must remain committed to ensuring client satisfaction, which can be a part of its overall business plan

Abstract

This paper examines the importance of entrepreneurship education in South Africa's primary education sector. The paper argues that the consolidation of entrepreneurship education at primary and high school levels in South Africa can contribute to socio-economic development but also help address issues such as poverty inequality and youth unemployment. This paper employed Schumpeter's Theory of Innovation and the Need for Achievement Theory as a theoretical lens. A systematic literature review was employed as a research approach in this paper. Five databases were used to search for data. The paper revealed that entrepreneurship education had not been fully consolidated in South Africa's primary education sector, significantly depriving learners of innovative skills and competencies to help them become entrepreneurs tomorrow. The paper recommends that the government accelerate the inclusion of entrepreneurship as a standalone subject in the primary education sector so that by the time learners graduate from high school and enter university, they have a deep understanding of entrepreneurship, which increases their chances of becoming entrepreneurs, thus contributing to the country's socio-economic development.

Abstract

This research aims to focus on analysing how website-based SKP in Medan City to form Smart ASN is carried out. The method used is a qualitative method with a case study approach. The data collection techniques include in-depth interviews, direct observation or observation, and documentation. Researchers used interactive model analysis as an analysis technique in this study. Data analysis begins with reviewing all available data from various sources. After reviewing, the next step is data reduction, unit arrangement, categorisation, and data interpretation. Data presentation was done with narrative text and pictures. The last stage is conclusion drawing or verification, where researchers express conclusions from the data obtained during the data collection. The results showed that the Medan City Government had encouraged organisational success through professional ASN HR performance management. One method is a measurable employee performance appraisal system using a website-based online SKP management system. The Medan City Government's working mechanism follows the Agile work scale concept. ASN core values become a strong foundation for strengthening work culture and become a guide in implementing ASN performance management to support the implementation of e-government towards Smart ASN. Smart ASN is a digital talent and leader supporting bureaucratic transformation in Indonesia. On the other hand, there are weaknesses when giving assessments to ASN by other ASN colleagues that are often not realised, namely the existence of a culture of reluctance in giving assessments. As a recommendation, coordination with the central government can overcome the overlapping management systems implemented to make it easier for ASNs to achieve their performance targets

Abstract

This study examines the issue of the term of dismissal of pretrial applications after the Constitutional Court decision Number: 102 / PUU / -XII / 2015 and Supreme Court Circular Number: 5 of 2021 concerning the Implementation of the Formulation of the Results of the Supreme Court Chamber Meeting in terms of validity and enforceability. This research was motivated by the blurring of norms governing the termination of pretrial applications as in Article 82 paragraph (1) letter d of the Code of Criminal Procedure which states that pretrial deaths are when the main case has begun to be examined by the district court. This research uses normative juridical research methods and uses the Statute Approach, Conceptual Approach, and Historical Approach. The results of this study found that the Constitutional Court has validity in deciding cases as case Number: 102 / PUU / -XII / 2015 and the appeal is valid to be issued by the Constitutional Court. The Supreme Court also has validity in issuing Supreme Court Circular Number: 5 of 2021 concerning the Implementation of the Formulation of the Results of the Meeting of the Supreme Court Chamber related to the regulation of the term for the termination of pretrial applications. After the decision of the Constitutional Court and the Supreme Court Circular, based on the decision of the court handling pretrial application cases, it is the Supreme Court Circular that is currently in force or guided by the examining judge of pretrial cases on the basis that the Supreme Court Circular has legal certainty compared to the Constitutional Court Decision regarding the term for the termination of pretrial applications.

Abstract

One of the most important factors that determine the success of business endeavors is the organizational leadership that is both focused and effective. For the purpose of inspiring teams and directing efforts toward the accomplishment of organizational objectives, this leadership is absolutely necessary. The study purpose was to analyze organization leadership as an implementation strategy of performance of National Social Security Fund, Kenya. The researcher identified three theories for the study; Economic Theory of wealth creation, Social cognitive Theory and Systems Theory. The study philosophy was interpretivism with explanatory and descriptive research design espoused. The target population of the study was 365 employees of the National Social Security Fund at the head quarters. The population was stratified or categorized according to their cadres, then purposive sampling was used on the predetermined senior management cadre while simple random sampling techniques was used on the middle management and non-management staff who had equal chances of being selected for analysis. Questionnaires were administered to be completed by respondents for primary data while document analysis helped the researcher to secure secondary data. The sample size was 186 and this was determined using Krejcie and Morgan table. Data was analyzed using inferential and descriptive statistics. Under inferential statistics the researcher used regression while under descriptive statistics; the mean and the standard deviation were used for measures of central tendency and measures of dispersion respectively. The outcome was presented by the use of frequency tables. The study demonstrated a strong positive correlation (R = 0.793) between leadership and performance, with approximately 62.9% of the variability in performance explained by the model (R Square = 0.629). ANOVA results indicated that the regression model is statistically significant (F = 9.168, p < .001), suggesting that leadership contributed to explaining the variability in performance. The coefficient revealed significant influences of leadership on performance (p < .05). Specifically, a one-unit change in each of these factors led to significant percentage changes in NSSF's performance; leadership scoring 0.192 or (19.2%). Based on these results, recommendations were made to enhance organizational effectiveness, leadership programs should be implemented to empower managers and executives, fostering a culture of strong leadership within NSSF. Further studies should explore the mediating role of technology on the influence of strategy implementation processes.
