Abstract

Indonesia is a country with diverse religions and beliefs, making it vulnerable to horizontal conflicts. Reports from the Setara Institute indicate that religion-based conflicts continue to recur. One of the root causes lies in the conflation of theological and political domains, particularly in the use of the term kafir. As the majority community, Indonesian Muslims often face difficulties in distinguishing the position of this term in religious contexts from that in citizenship. In 2019, Nahdlatul Ulama (NU), through its National Conference (Munas) in Banjar, issued an important decision by replacing the term kafir with non-Muslim in the context of citizenship. This study analyzes that decision using a qualitative approach, focusing on the official documents of the 2019 NU Munas, and examines the stages of this change through the perspective of Reine Forst’s ethics of tolerance. The study offers two main findings. First, the elimination of the term kafir in the civic domain underscores a paradigm shift: the modern state no longer bases the relations among its citizens on religious classification but rather on the principle of equal rights. Second, the NU decision reflects a model of tolerance grounded in respect for humanity rather than purely theological relations. The novelty of this research lies in its attempt to connect the NU Munas decision with Forst’s theory of tolerance, which has rarely been discussed in studies of tolerance in Indonesia. Thus, this study contributes to broadening the understanding of tolerance, not only as a social practice but also as a normative framework that places humanity at the center of respect.

Abstract

This study aims to explore the contribution of religion through local spirituality in building ecological awareness and responding to the global environmental crisis based on local wisdom values. Using a theoeccological approach, this study reflects religious teachings through the lens of indigenous spirituality as a living and contextual narrative of religious faith. The main focus of the study is on the Sundanese Indigenous community, specifically the practice of integral environmental conservation, including land, forest, water management, and food security and sustainability. The results show that the ecological ethics of the Sundanese Indigenous community are not merely cultural practices, but rather expressions of spirituality carried out collectively. Principles such as ulah ngarusak (do not damage), leuweung kolot (forbidden forest), huma management, and the leuit system (traditional rice barn) reflect the sacred relationship between humans, nature, and the cosmos. The novelty of this study lies in the integration of the theoecological perspective with Sundanese local wisdom, which has previously been studied more in anthropological or ecological dimensions alone. Thus, this study offers an alternative model for how local spirituality can be formulated as a concrete and applicable theoecological narrative. The implication is that the integration of local spirituality-based ecological values into environmental conservation and food security policies is crucial for building a just and sustainable human ecology.

Abstract

This study aims to explain the relationship between religiosity and religious moderation, as well as the dynamics of students’ religious identity at PTKI in Kediri. The research employed a mixed-method approach using a sequential explanatory strategy. The study was conducted at the State Islamic Institute (IAIN) of Kediri, involving seventh-semester students of the Islamic Psychology Department, Faculty of Ushuluddin and Dakwah. The findings reveal that religiosity has a significant influence on religious moderation—students with higher religiosity exhibit stronger moderation. Religious understanding and spiritual experience play a major role in shaping a moderate attitude. The respondents’ religious identities vary: achievement (47.9%), moratorium (16%), foreclosure (10.6%), and diffusion (25.5%). The achievement identity represents the most mature condition, characterized by commitment following a process of exploration, formed through knowledge, parental influence, and peer interactions. These findings emphasize the importance of strengthening moderate religious understanding and fostering supportive social environments to enhance students’ attitudes of religious moderation.

Abstract

This study aims to explore how the concept of religious moderation is implicitly embedded in the kitab kuning, particularly within the fiqh-sufistic thought of Imam al-Ghazali. Unlike conventional fiqh, which focuses primarily on vertical obligations to God, al-Ghazali integrates external legal observance with internal spiritual ethics, establishing a comprehensive framework that connects ritual devotion with social responsibility. Methodologically, this research employs qualitative library research using Bidayat al-Hidayah and Ihya’ ‘Ulum al-Din as primary sources, analyzed through content analysis to identify ethical and social patterns that reflect moderation. The findings reveal twenty-three ethical principles formulated by al-Ghazali, encompassing aspects such as companionship (al-shuhbah), social etiquette, and moral conduct, all of which promote equality, inclusivity, and communal harmony. Theoretically, this study contributes to the discourse on Islamic ethics and moderation by situating al-Ghazali’s fiqh-sufistic synthesis as an epistemological foundation for contextualizing religious behavior in plural societies. The originality of this research lies in its reinterpretation of classical Islamic ethics as practical indicators of religious moderation in the Indonesian context, offering new insights for curriculum development in pesantren, deradicalization programs, and civic education. While limited by its textual scope and lack of empirical validation, this study provides a theoretical basis for future field research examining the application of al-Ghazali’s ethical framework in modern educational and social environments.

Abstract

This study aims to analyze the application of the principle in dubio pro matrimonio and the principle of family protection in the rejection of the annulment of a mixed marriage between an Indonesian citizen and a foreign citizen, as stated in the Religious Court Decision of Panyabungan Number 319/Pdt.G/2024/PA.Pyb. This research employs a normative juridical method with a statutory and case study approach, analyzed through the perspectives of maqasid al-shari‘ah and Indonesian positive law. The results indicate that the judge rejected the annulment request because there were no substantive grounds as stipulated in Law Number 1 of 1974 and the Compilation of Islamic Law, such as coercion, fraud, or the absence of the essential elements and requirements of marriage. Administrative deficiencies, such as the absence of an embassy permit, were deemed merely technical and did not affect the validity of the marriage contract either according to Islamic law or state law. From the maqasid al-shari‘ah perspective, this decision reflects an effort to preserve family welfare (hifz al-nasl) and protect the rights of both husband and wife. Meanwhile, the application of the in dubio pro matrimonio principle underscores the judge’s orientation toward maintaining the continuity of the household as a form of legal protection for the institution of marriage. Thus, this decision demonstrates the harmonization between the principles of substantive justice in Islamic law and the legal certainty of Indonesia’s positive law in the context of mixed marriages.
