Al-Ahkam: Jurnal Ilmu Syariah dan Hukum offers open access to its contents in order to make them easily available to the public audience so it may support a wider exchange of knowledge. Al-Ahkam: Jurnal Ilmu Syariah dan Hukum is intended to present research on the discourse about theories of Islamic law, with a particular attention to the discussion on maqasid, as well as contemporary practices of Islamic penal law and Sharia economics in Indonesia and elsewhere in the Muslim world.

Abstract

Discriminatory behavior experienced by persons with disabilities is still often encountered, one of which is access to job opportunities. The cause of the low access to work is due to the low access to education of persons with disabilities. This study aims to describe the role of Islamic Community Organizations in Surakarta City as a strategic entity partnering the government in solving problems experienced by people with disabilities. The theory used refers to the theory of Human Rights in the Islamic concept. In essence, Islam provides equality to all people in obtaining education, employment, and other rights which are summarized in the five basic needs. This research is a non-doctrinal legal research. The data used are the results of interviews conducted with the management of NU and Muhammadiyah in the city of Surakarta. Data analysis was carried out using material logic with an inductive syllogism. The results showed that the role of Islamic organizations NU and Muhammadiyah in Surakarta in the field of education has been realized. The inclusive education program through SMA Muhammadiyah 6 Surakarta and inclusive madrasah which are currently managed by Islamic organizations are trying to improve the quality of life for people with disabilities. Another role that can be carried out is in the field of religion by providing worship facilities and developing fiqh with disabilities. In the field of economic empowerment, Islamic organizations NU and Muhammadiyah have experience in managing social funds sourced from zakat, infaq, and shodaqoh. The management of community social funds can be expanded to provide benefits for persons with disabilities in the form of working capital assistance.

Abstract

Al qur’an mambahas soal pernikahan secara rinci dalam banyak ayat. Kurang lebih terdapat 104 ayat, baik dengan menggunakan kosa kata nikah yang terulang sebanyak 23 kali, maupun kata zauwj yang ditemui berulang sebanyak 80 kali. Kajian mendalam terhadap keseluruhan ayat perkawinan tersebut menyimpulkan pada 5 prinsip perkawinan. Pertama, prinsip mawaddah wa rahmah. Kedua, prinsip monogami. Ketiga, prinsip Mu‘āsyarah bil-Ma‘rūf (pergaulan dengan sopan santun). Keempat, prinsip Saling Melengkapi dan Melindungi, baik dalam relasi seksual maupun relasi kemanusiaan. Kelima, prinsip memilih jodoh, baik bagi laki-laki maupun perempuan. Masyarakat memandang bahwa perempuan tidak mempunyai hak penuh dalam masalah perkawinan sehingga apabila memilih jodoh maka harus dipilihkan orang tua. Memilih jodoh yang merupakan salah satu prinsip perkawinan sering kali berbenturan dengan adanya hak ijbar yang dimiliki oleh walinya. Inilah yang kemudian menjadi sorotan, bahwa dalam Islam hak perempuan dalam menentukan pasangan merupakan hak penuh orang tuanya dan tidak memiliki hak dalam menentukan pilihan jodoh atau pasangan. Wacana yang berkembang sampai saat ini bahwa wali mujbir ialah orang tua yang memaksa anaknya untuk menikah dengan pilihan dari orang tuanya atau lebih dikenal dengan istilah ‘’kawin paksa’’. Tulisan ini merangkum secara tuntas pemikiran KH. Husein Muhammad  tentang hak Ijbar. Pemikiran KH. Husein Muhammad tentang hak Ijbar berusaha mengambil jalan tengah di antara perbedaan pandangan antar madzhab dengan tetap menjadikan pertimbangan sebuah kemaslahatan sebagai titik utama.

Abstract

There are three objectives in this research, namely to find out the concept of sharia economic law in financial institutions in terms of Law Number 21 of 2011 concerning OJK (Financial Services Authority), strengthening sharia economic law within the Financial Services Authority, and handling sharia economic law problems. by the Financial Services Authority. In this study through the stages of problem identification, preparation of activity proposals, and program implementation. By using a normative legal research method (juridical-normative) with a statutory approach and a concept approach. In terms of data collection, library research is the technique used in collecting our research data for content analysis in order to obtain normative data. The concept of sharia economic law at the Financial Services Authority is related to sharia economics, the strengthening of sharia economic law is contained in Law Number 21 of 2011 concerning the Financial Services Authority, if there are sharia banking problems this can be resolved by using a court or through an institution organized by the Authority. Financial Services, namely Alternative Dispute Resolution Institutions.

Abstract

It is widely mentioned that Sharia in Islam, especially the application of law (ḥudūd) is widely seen as treatment that is not in accordance with human rights. The conception of human rights and humanity still has various epistemological and theological problems. Human rights as discussed by the West are loaded with the paradigm of secular humanism which is very contradictory in Islam. This study discusses the suitability of the purpose of implementing maqāṣid al-sharī‘ah with humanity based on Islamic views. The implementation of Sharia has encountered many obstacles in the form of protests or rejections from many parties. In this article we argue that Muslims devise their own conception of human rights that is in accordance with the Islamic worldview. In the end, by the application of maqāṣid al-sharī’ah, Sharia can met ever-changing contemporary discourses.

Abstract

Aceh is the only region in Indonesia granted special rights to implement Islamic law within its territory, as stipulated in Law No. 44 of 1999 regarding the administration of special autonomy in the Aceh Special Region. This uniqueness can be seen as a political solution to the long-standing conflict in Aceh. Several institutions serving as enforcers of Islamic law were established to support the implementation of local regulations on Islamic law, including the Sharia Court, the Sharia Office, and the Wilayatul Hisbah. Additionally, the Aceh regional government collaborates with the police and the prosecutor's office, where they act as investigators, interrogators, and public prosecutors in the implementation of Islamic law. This research examines the implementation of the qānūn of jināyāt in Aceh. The research findings indicate that the implementation of Islamic law in Aceh faces several challenges. Firstly, the Wilayatul Hisbah faces issues related to their authority, as according to Sharia rules, their role is limited to supervision, while investigation falls under the jurisdiction of the police. In practice, the police often disregard Islamic law in Aceh, mainly due to several provisions conflicting with national laws. Consequently, many cases of Sharia violations end with reconciliation processes within the police and do not proceed to court prosecutions. Secondly, the execution process is often lengthy, and in many cases, execution is neglected. The principles of equality before the law and legal certainty have not yet become primary principles in the application of Islamic law in Aceh.

Abstract

This research is based on the issue of ineffective zakat management. In response to this situation, a study was conducted on the concept of zakat management according to Umar bin Abdul Aziz. The purpose of this research is to provide alternative solutions to the current problems in zakat management. The research adopts a library research or literature-based method with a descriptive-analytical approach, drawing from books, journals, and other scholarly works that serve as the object of study. The primary source used in this research is the book "al-Khalifah al-Rasyid wa al-Muslih al-Kabir ‘Umar ibn ‘Abdul ‘Aziz" by Prof. Dr. ‘Ali Muhammad al-Shalabi, which contains the biography of Umar bin Abdul Aziz and his zakat management policies. The research concludes that there are five strategies in Umar bin Abdul Aziz's concept of zakat management and distribution, including: 1) being based on the Qur'an and the Sunnah of the Prophet, 2) accelerating the distribution of zakat to the rightful recipients (ashnaf), 3) reforming the quality of human resources for zakat officials, 4) distributing zakat based on regional zakat income, and 5) Umar bin Abdul Aziz's ijtihad (independent reasoning) in some objects subject to mandatory zakat. The impacts of this concept include: 1) surplus zakat income, 2) recipients of zakat becoming contributors (muzaki), and 3) achieving economic stability and community welfare.

Abstract

Political dynasties can be interpreted as the distribution of power based on familisme. The phenomenon of this political dynasty was often found in the era of regional autonomy. The enactment of regional autonomy is utilized by political elites to strengthen their power in the region. The phenomenon of this political dynasty certainly has a negative impact on the sustainability of democracy in Indonesia. To conduct this research, the authors used a qualitative literary research method by reviewing literature related to regional autonomy, democracy and political dynasties. Data collection techniques using documentation techniques. Then the data is analyzed through three stages, namely data condensation, data display and conclusion. Based on the research conducted, it was found that the number of political dynasties that occurred in the era of regional autonomy was increasing. What's more, the practice of political dynasties also has a negative impact on the sustainability of democracy. Because political dynasties lead to stagnation of leadership in just one group. In addition, political dynasties also tend to lead to the emergence of corruption dynasties.

Abstract

President  Essebsi  (2017) approved  the  law of gender  equality  in  inheritance  in Tunisia. Instead of gaining public appreciation of Islam, this achievement was seen as contrary to sharia. This research seeks to address whether or not there could be a common ground between  applying  sharia and gender equality through an examination of sharia regarding  inheritance, and, finally, an attempt to show the relationship between sharia and the  Tunisia’s constitution of 2014 in responding to social change. The paper argues that in spite of the constitution’s progressive language, women still face legal discrimination in  their ability  to inherit because of sharia.

Abstract

This article aims to explain the law of sexual consent or sexual consent according to maqasid sharia. Lots of approval and attraction to women, molestation, persecution that causes feelings of oppression and speech. Even in the West there is violence, so that Western women demand the freedom of their body rights. From this sexual agreement, feminism aims to seek justice or benefit for them. In compiling this article, the author uses critical analysis methods to explain the concept of feminism and sexual consent. The results of this study conclude that sexual consent according to Westerners is a solution so that no more treatment is recommended. In fact, Muslims also participate and agree to the concept. This is, which is contrary to maqashid shari'ah or the existence of shari'ah. So that consent and acceptance will only cause harm.

Abstract

This study aims to analyze sharia principles in the practice of loans and debts to minimize bankruptcy cases among the public. Some elements in sharia may have an impact on changing the behavior and attitude of debtors. First, sharia prohibits individuals from taking loans for luxury goods although this is permissible in sharia. Second, people are urged to be careful in spending their money and be careful not to give in to lust. Lastly, there is genuine concern within sharia for the repayment of loans and debts. In addition, sharia also advises creditors to extend the repayment period without charging interest if the debtor is in trouble. For Islamic financial institutions, Sharia regulates profit and loss sharing contracts. Furthermore, various types of charity, for example zakat, alms, and waqf, can be used in Muslim societies to protect debtors from bankruptcy. This study adds new knowledge in Islamic financial literacy, which will contribute to improving people's financial well-being.
