Abstract

The digital revolution has transformed Village-Owned Enterprises (BUMDes) marketing and management operations, with this study combining Integrated Marketing Communication Theory and Marketing Mix frameworks to examine digital transformation by developing an integrated model connecting marketing communication strategies, management information systems, digital competencies, and resource management. Employing a cross-sectional quantitative design with 174 participants selected through the Slovin formula and utilizing structured questionnaires analyzed via PLS-SEM methodology, the research reveals significant impacts of marketing communication strategies (β=0.689), management information systems (β=0.667), digital competencies (β=0.614), and resource management (β=0.638) on BUMDes performance. The investigation, conducted in the Bangka Belitung Islands Province, aims to evaluate digital transformation's influence on BUMDes performance and rural economic development, with the research model accounting for 72.7% of BUMDes performance variance and 70.8% of rural economic impact variance, thus establishing a comprehensive framework for BUMDes digital transformation.

Abstract

This study discusses the implementation of integrated Governance, Risk, and Compliance (GRC) as a legal protection mechanism for BUMN Directors in dealing with problems and losses that occur. GRC combines three main elements corporate governance, risk management, and legal compliance that work synergistically to increase transparency, and accountability, and reduce uncertainty in decision making. Effective GRC implementation provides legal certainty for Directors, by proving that they have acted in good faith and accordance with applicable regulations. This study also identifies challenges in implementing GRC in BUMN, as well as the importance of the role of technology and changes in organizational culture in supporting the implementation of an effective GRC system.

Abstract

This study aims to analyze the factors influencing gold purchasing and investment in Indonesia based on existing literature. Using the VOSviewer application, the study maps the relationships between keywords frequently appearing in studies related to gold purchasing, which are divided into two main clusters: global external factors and local Indonesian factors. The analyzed studies indicate that factors such as gold prices, promotions, investment literacy, and the socio-economic impact post-COVID-19 pandemic play a significant role in influencing consumer decisions to invest in gold. Additionally, gender factors in small-scale gold trade were also found to affect the dynamics of the gold market in Indonesia. This study provides insights into the complexity of factors influencing the gold market and offers recommendations for stakeholders to formulate policies and strategies that are more responsive to social and economic changes.

Abstract

The development of a sustainable creative economy in Bangka Belitung represents a complex exploration of economic transformation, investigating the critical interplay between green capabilities, digital readiness, external support, and sustainability awareness through an innovative quantitative research approach using Partial Least Squares Structural Equation Modeling (PLS-SEM). By analyzing data from 357 creative entrepreneurs through an online survey conducted in November-December 2023, the study employs a 5-point Likert scale to examine environmentally friendly production practices, digital platform benefits, training access, and environmental understanding, revealing that external support and sustainability awareness have the most significant influence on green business performance with path coefficients of 0.751 and 0.761, respectively. The research addresses significant gaps in previous literature by developing a unique theoretical framework that connects green capabilities with digital readiness in the local creative economy context, ultimately explaining 78.4% of variation in green business performance and 78.6% in business sustainability. The findings confirm the critical importance of integrating organizational resources and unique capabilities to achieve sustainable competitive advantage, providing substantial theoretical contributions to the creative and green economy while offering practical recommendations for local governments, educational institutions, and business actors to develop targeted training programs, curricula, and strategies that support green economic transformation.

Abstract

The growth of Balinese tourism has produced important notes on the impact of increasingly uncontrolled regional exploitation. Land conversion and exploitation of natural resources are of particular concern to the government. In response to this condition, the Coordinating Minister for Maritime Affairs and Investment, Luhut Binsar Panjaitan, issued a moratorium policy on hotel and villa development in Bali. The moratorium policy aims to overcome the negative impacts of over-tourism followed by the conversion of agricultural land, congestion, and environmental degradation. The problem that arises is that the moratorium policy will have an impact on uncertainty and even hinder investment plans in the tourism sector in Bali. However, this moratorium policy also encourages a shift in tourism development in the outskirts of Bali that has not been touched by tourism investment progress. The development moratorium policy is planned to be implemented in Denpasar, Badung, Gianyar, and Tabanan areas. To answer this problem, a normative legal research method is used, where the results of the research conducted are that the hotel and villa development moratorium policy in several areas of Bali will have an impact on decreasing the value of tourism investment and a negative value on local economic growth in Bali.

Abstract

The Palembang songket woven fabric is one of Indonesia’s traditional crafts that holds high historical, cultural, and economic value. It is a cultural heritage with deep historical roots dating back to the era of the Palembang Darussalam Sultanate. Songket fabric is not only a symbol of textile aesthetics but also represents spiritual values and the social structure of the traditional Palembang community. With its distinctive weaving techniques and rich motifs, the philosophical meaning of songket has become an intangible cultural expression passed down through generations. However, in the era of globalization and the expansion of the modern textile industry, songket faces various challenges, including unauthorized commercial exploitation, design counterfeiting, and the degradation of cultural values. This study aims to analyze the legal protection mechanisms through Intellectual Property Rights (IPR) for Palembang songket as traditional cultural heritage. The method used is normative-juridical research, with analysis of national regulations such as Law Number 28 of 2014 on Copyright, Law Number 20 of 2016 on Trademarks and Geographical Indications, and international conventions such as the 2008 UNESCO Convention for the Safeguarding of Intangible Cultural Heritage. This study applies an IPR framework with a collective rights and cultural approach, alongside regional regulations like the South Sumatra Provincial Regulation Number 5 of 2015 on the Preservation and Development of Regional Culture. This regulation emphasizes the importance of developing a commodity-based protection system and incorporating customary law to preserve and economically empower local artisan communities. Adequate legal protection will strengthen songket's position as both a cultural identity and a sustainable economic asset. The results of this research recommend an integrative approach between positive law and culturally-based commodity empowerment to establish fair, sustainable, and contextual protection for Palembang songket woven fabric as an inseparable part of Indonesia’s cultural identity.

Abstract

This study examines the problem of disharmony in the regulation and implementation of professional certification in the financial services sector after the issuance of Law Number 4 of 2023 concerning the Development and Strengthening of the Financial Sector (PPSK Law). The main focus of the study is the analysis of the overlapping authority between the Financial Services Authority (OJK) and Bank Indonesia (BI) and the impact of granting certification authority to professional associations as stated in Article 261 of the PPSK Law. The provision is considered to create dualism in the certification system that weakens the integrity and accountability of the competence of professional personnel in the financial industry. This study reviews the differences in approach between the Professional Certification Institution (LSP) based on the Indonesian National Work Competency Standards (SKKNI) and certification organized by professional associations and evaluates its implementation by OJK and BI. Through a juridical-normative approach and supported by empirical data from strategic institutions, this study finds that the lack of system integration and lack of institutional coordination have an impact on the non-uniformity of competency standards and the potential for systemic risk in the financial services sector. Therefore, a policy harmonization model is needed that emphasizes the importance of integrating the SKKNI-based certification system, with LSP as the main implementer and professional associations as supporting partners, to ensure equal and credible HR quality across all financial services subsectors.

Abstract

Indonesian Migrant Workers (PMI) are a vulnerable group who face various risks in destination countries, including the potential for misuse of their personal data. As the migration process becomes digital, the volume and sensitivity of PMI data managed by various parties increases, creating a strong urgency for data protection. This study aims to analyze the relationship between personal data protection and the certainty of legal protection and overall security of PMI in destination countries. Using a qualitative research method based on secondary data analysis covering Law Number 27 of 2022 concerning Protection of Personal Data (UU PDP), Law Number 18 of 2017 concerning Protection of Indonesian Migrant Workers (UU PPMI), reports from related institutions, and case studies, this study examines the legal framework, international dimensions, risks, and implementation challenges. The findings show that the PDP Law is an important legal foundation, complementing the PPMI Law, but its implementation faces significant challenges related to institutional capacity, coordination, private sector compliance, system security, PMI literacy, and cross-border law enforcement. Strengthening comprehensive and integrated PMI data governance is urgently needed to ensure the security and certainty of protection of PMI rights abroad.
