Abstract

The ambiguity of the elements “dealer” and “user” in Articles 114, 112, and 127 of Law Number 35 of 2009 on Narcotics creates legal uncertainty in the practice of criminal justice. These three provisions often overlap in law enforcement, particularly when investigators and public prosecutors apply more severe charges without comprehensively examining the legal construction of the defendant’s actions, including the social and situational context behind them. This study is a normative legal research that examines the doctrine of judicial legal discovery, principles of criminal law, and the principle of proportionality in sentencing in a more in-depth and structured manner. The results of the study indicate that judges have the authority to interpret the elements of narcotics criminal acts systematically, grammatically, and teleologically to clearly distinguish between “abusive users” and “dealers with the intent to distribute.” Legal discovery is needed to prevent overcriminalization and to ensure the protection of the rights of suspects and defendants throughout the entire criminal justice process. This study concludes that the appropriate method of interpretation is an integration of systematic interpretation, teleological interpretation, and the ratio legis of the Narcotics Law.

Abstract

This study aims to analyze the financial distress condition of PT Pertamina Patra Niaga during 2019–2023 using the Springate Score (S-Score) model. Financial distress is a critical stage preceding potential bankruptcy, commonly detected through declining liquidity, profitability, and operational capability. This study employed a quantitative descriptive approach using secondary data sourced from audited financial statements. The Springate model, consisting of four key ratios (working capital to total assets, EBIT to total assets, EBT to current liabilities, and sales to total assets), was applied to evaluate the company’s financial stability. The results show fluctuating financial performance. PT Pertamina Patra Niaga was categorized as financially healthy (safe zone) in 2019, 2020, 2021, and 2023, but experienced financial distress in 2022 due to severe liquidity pressure and increased short-term liabilities. The overall average S-Score of 0.9453 places the company in the grey area, indicating potential vulnerability to financial instability. The findings highlight the importance of improving liquidity management, strengthening working capital, and increasing operational efficiency to prevent future distress. Abstract

The principle of legality is a fundamental concept in the Indonesian criminal justice system, ensuring legal certainty and the protection of human rights from arbitrary criminal punishment. However, the rapid development of modern crimes often leads to legal gaps or vague norms that require judges to conduct judicial law-finding (rechtsvinding) when resolving criminal cases. This research aims to analyze the position of the principle of legality as a legal limit to judicial authority and examine how far judicial law-finding can be carried out without violating the essential principles of criminal law. This study employs a normative legal research method with a statute approach, conceptual approach, case approach, and historical approach. The results demonstrate that the principle of legality plays a crucial role in restricting judicial interpretation to prevent the creation of new offenses that may harm defendants and to ensure punishment can only be imposed based on pre-existing laws. Nonetheless, judicial law-finding remains necessary to address contemporary crimes that are not yet regulated under statutory law. Therefore, a proportional balance between legal certainty and substantive justice is required so that the principle of legality and judicial law-finding can work synergistically within Indonesia’s criminal justice system.

Abstract

A graduate is generally expected to possess stronger competencies than a non-graduate, particularly at the undergraduate level, where higher education should foster greater competitiveness and work readiness to meet industry standards. However, many fresh graduates report feeling unprepared to enter the workforce, and employers frequently perceive them as lacking essential readiness for work. This study aims to examine the relationship between self-management and work readiness among fresh graduates of undergraduate programs. The proposed hypothesis states that there is a positive relationship between self-management and work readiness. The study involved 120 fresh graduate participants. Research data were collected using the Work Readiness Scale (reliability coefficient = 0.883) and the Self-Management Scale (reliability coefficient = 0.900). Data analysis was conducted using the Product Moment correlation technique. The results show a correlation coefficient of r = 0.846 with p = 0.000 (p < 0.050), indicating a significant positive relationship between self-management and work readiness among fresh graduate undergraduate students.

Abstract

This study aims to analyze the influence of multi-stakeholder collaboration on the resilience of tourism activities and to examine the mediating role of sustainable tourism management within a community-based tourism village context. A quantitative explanatory research design was employed, using Partial Least Squares Structural Equation Modeling (PLS-SEM). The research was conducted in Nglanggeran Tourism Village, Special Region of Yogyakarta, Indonesia, with data collection carried out in 2025. A total of 90 respondents were selected through purposive sampling based on their active involvement in village tourism activities. The three main constructs, namely multi-stakeholder collaboration, sustainable tourism management, and tourism activity resilience, were measured using a 5-point Likert scale instrument. PLS-SEM analysis was employed to evaluate the measurement and structural models, encompassing assessments of validity, reliability, R², Q², and hypothesis testing via bootstrapping. Findings indicate that multi-stakeholder collaboration has a positive and significant effect on both sustainable tourism management and tourism activity resilience. Sustainable tourism management also shows a positive and considerable influence on tourism activity resilience. Furthermore, a partial mediation effect was identified, wherein sustainable tourism management strengthens the impact of multi-stakeholder collaboration on the strength of tourism activities. Structured and inclusive multi-stakeholder collaboration, when integrated with sustainable tourism management practices, enhances the resilience of tourism activities in community-based destinations. These results underscore the crucial importance of collaborative governance and sustainable management practices in fostering destination sustainability and resilience.

Abstract

This study investigates the forms and functions of illocutionary acts in the film Norah (2023) using a qualitative descriptive approach. The research problem centers on how dialogic interactions and rural Saudi socio-cultural contexts shape the distribution of illocutionary types. Data were collected via observation and note-taking, then classified according to Searle’s five categories (assertive, directive, commissive, expressive, declarative) and analyzed through three stages: data collection, analysis, and presentation. The findings reveal that illocutionary speech acts in the film Norah are dominated by directives in the form of commands, prohibitions, and invitations, which highlight the speaker’s role in controlling actions. In addition, expressive and commissive acts appear in the form of advice, requests, and polite expressions that function to maintain harmony and interpersonal closeness. Overall, the use of illocutionary acts in the film reflects social relations and the dynamics of everyday interaction in rural Arab society.

Abstract

This research aims to develop a Discovery Learning learning model with the Think, Talk, Write (TTW) strategy to improve the application of narrative text writing learning in grade V students at UPT SDN 16 Bangkala, Jeneponto Regency. This research uses a Research and Development (R&D) approach by adapting a 4D development model which includes the define, design, develop, and disseminate stages. The research instruments consisted of expert validation sheets, observations, teacher and student practicality questionnaires, and writing ability tests. The results of expert validation showed that the developed learning model was in the very feasible category, with a feasibility score of 92%. The practicality test also showed high results, namely 91% of teachers and 89% of students, which indicates that this learning model is easy to understand, easy to apply, and encourages active involvement of students in the learning process. Descriptively, the results of the pre-test and post-test illustrate a change in students' ability to write narrative texts, from an initial average score of 62.50 to 82.30 after the application of the developed learning model. Thus, this study concludes that the Discovery Learning learning model with the Think, Talk, Write strategy is feasible, practical, and has the potential to support the improvement of the writing skills of elementary school students. This model is recommended to be implemented more widely in Indonesian language learning, especially in narrative writing skills, and can be used as a reference for the development of literacy learning at the elementary education level.

Abstract

This study investigates how Word of Mouth, service quality, and brand image influence B2B customer loyalty at As-Syifaa Pharmacy in Majalengka, with customer satisfaction acting as a mediating variable. A quantitative approach was applied using the SEM-PLS method, drawing on data from 300 purposively selected customers. The analysis included measurement of validity and reliability, followed by structural model testing to identify both direct and indirect relationships among variables. The findings reveal that Word of Mouth, service quality, and brand image each play a meaningful role in enhancing customer satisfaction, which in turn becomes the strongest predictor of customer loyalty. Satisfaction was also found to mediate the effects of the three antecedent variables, either fully or partially, highlighting its central role in shaping long-term business relationships. These results indicate that building B2B customer loyalty requires more than consistent operational performance; it also depends on maintaining a credible brand reputation and fostering positive relational communication within the business network. Based on these insights, the study recommends strengthening service standards, reinforcing brand consistency, and managing interpersonal communication to support sustainable loyalty among B2B partners.
