Abstract

This article discusses the cancellation of grants from the perspective of Islamic law and Indonesian civil law with an engagement theory approach. A grant is a legal transaction that involves a voluntary transfer of ownership, but there are situations where the grantor or grantee can cancel a grant. The purpose of this study is to analyze the views of Islamic law and Indonesian civil law regarding the cancellation of grants and explore the similarities and differences between the two legal systems in this context. Through an engagement theory approach, this article analyses the legal basis and requirements for grant cancellation in both legal systems. In Islamic law, grant annulment can be carried out based on Sharia principles that regulate the concept of hijab and qabul and the legal requirements of grants. On the other hand, Indonesian civil law regulates grant cancellation through the norms contained in the Civil Code and related laws and regulations. A comparative analysis is also conducted to identify similarities and differences in the views of the two legal systems regarding the reasons, procedures, and consequences of grant cancellation. In this context, this research provides an in-depth insight into the convergence or divergence between Islamic law and Indonesian civil law in addressing the issue of grant cancellation. The results of this research provide a deeper understanding of the relevant legal aspects in the context of grant cancellation in Islamic law and Indonesian civil law. By understanding their perspectives, parties involved in grant transactions can make more informed decisions and minimize the risk of future disputes. In addition, this article also contributes to the legal literature by exploring a comprehensive comparison between the two legal systems in this specific aspect.

Abstract

This article discusses the development of human resources (HR) of educators at Madrasah Aliyah Nurul Islam Ngemplak Boyolali in facing the challenges of the 21st century. This research was conducted with the aim of analyzing the strategies and approaches applied in developing the human resources of teaching staff and their impact on the implementation of education in the madrasah. The research method used was a qualitative case study, involving data collection through interviews, observation, and document analysis. The results showed that Madrasah Aliyah Nurul Islam Ngemplak Boyolali implemented various efforts to develop educators' human resources, including continuous training, developing pedagogical competence, and utilizing educational technology. The development of educators' human resources has had a positive impact on the quality of the learning process and student achievement. However, challenges such as curriculum changes, technological developments, and increasingly complex demands of society are also faced. In the 21st century, this article recommends the need for increased cooperation among madrasahs, the government, and various related parties to support the development of educators' human resources. In addition, the implementation of sustainable strategies in developing pedagogical competencies and adapting to the development of educational technology is key to changing times. Thus, Madrasah Aliyah Nurul Islam Ngemplak Boyolali can continue to grow and make a significant contribution to preparing a generation that is ready to face future challenges.

Abstract

The following article intends to analyze and present the face of bureaucracy in a developing country like Indonesia in its contact with the culture that lives in society. Bureaucracy as a form as well as an efficient way of working as desired by a number of standard principles, of course for a country with cultural wealth or diversity like Indonesia will reap problems if the bureaucracy is required to operate according to its principles. All ideal bureaucratic principles almost all forbid action based on values that live in a culture. The impersonality of the bureaucracy requires its apparatus to carry out all the rules to be enforced regardless of personal or political relations, especially relations of 'sometimes' relatives. Meanwhile, most of the values that live in society operate in the 'territory' of the extended family, where the most pressing demand is the inclusion of considerations of fairness, decency, goodness and others, all of which are evaluated based on a number of ethical principles. It is this ethical evaluation that makes our bureaucracy often inefficient, tends to be convoluted and wasteful. The end of this paper is a recommendation related to public service ethics.

Abstract

Freedom to learn is a flagship program of the Ministry of Education and Culture of the Republic of Indonesia. Students are taught to have more value than their potential and creativity. This is in line with the current educational needs to produce generations of skilled and critical thinking to solve problems and have moral nobility as self-adornment. Islamic boarding schools as educational institutions have contributed greatly to the country through the quality of skilled and virtuous human resources. The purpose of this study is to reveal the relationship between Islamic boarding schools and the concept of independent learning from a historical and philosophical point of view. The research methodology is a literature study with hermeneutic analysis of referential writing. The result of the research is that the aim of Islamic boarding school education is essentially to develop Muslims so that they deepen religious understanding and gain the pleasure of Allah. Furthermore, the pesantren curriculum consists of monotheism, fiqh, and tasawuf. Meanwhile, the relationship between pesantren and independent learning is based on integrative principles, character, tasawuf, and independence.

Abstract

Sawur Tradition in the Funeral Process of Islamic Society in the Perspective of Emile Durkheim's Sacred and Profane Theory. The sawur tradition, an essential practice in the funeral process of the Islamic community, has become the center of attention to understanding the complexity of the relationship between local culture and religion. This article analyzes the sawur tradition in the context of Islamic funerals using Emile Durkheim's sacred and profane theory approach. The research method used in this study is field research involving participatory observation and interviews with community members involved in implementing the sawur tradition. This qualitative data was then analyzed through a hermeneutic approach to identify the meaning and significance of the sawur tradition. The sawur tradition involves several symbolic elements, including yellow rice, flowers, and small change, all intended as a form of alms to Allah Swt. The practice also involves various rituals and prayers recited by the bereaved family. Through an analysis based on sacred and profane theories, this article discusses how the sawur tradition reflects the sacred aspects considered sacred in the culture of Islamic societies while still maintaining a balance with the profane aspects of everyday life. The results of this study provide a deep insight into the role of the sawur tradition in maintaining cultural identity and religious values in Islamic societies. Using the analytical method of Emile Durkheim's sacred and profane theory, this article explains the meaning, function, and relevance of this tradition in the context of funerals, as well as illustrating the complex interaction between religion and culture in the daily life of Islamic societies.

Abstract

This study considers ex-HTI women who play a role in spreading the ideology of their organization. At the same time, women openly state that Pancasila and democracy are products of Western thought. So, it is very important to implement khilafah in the nation and state kaffah. This understanding has its own problems after the issuance of PERPU No. 2 of 2017 concerning Community Organizations which is the basis for the dissolution of HTI. In this context, with a qualitative research method from the perspective of the women's movement, it is intended to find out about the basic understanding of former HTI women in Kediri City towards their ideology and Pancasila after the issuance of PERPU No. 2 of 2017 concerning Community Organizations. In addition, this study seeks answers to the riseliency pattern of ex-HTI women in Kediri City after PERPU No. 2 of 2017 concerning Community Organizations. By using the method of interviews, documentation and observation, the results of the study found that the foundation of the basic understanding of the former HTI women of Kediri City follows the ideological doctrine of the organization. In its existence, it does not have a big impact after the issuance of PERPU No. 2 of 2017 concerning Community Organizations. They strengthen and spread ideology through recitations in the community and outside the community. the strategies used, do not use jargon that shows HTI. The enactment of PERPU No. 2 of 2017 concerning Community Organizations has no significant effect on the killing of HTI ideology in Kediri City.

Abstract

The Kupatan tradition is one of the cultural heritages that has become an integral part of the life of the Islamic community in the coastal village of Sedayulawas Lamongan. This article aims to explore and analyze the values of harmony embedded in the Kupatan tradition and its impact on social unity and local community cohesion. The research method used is qualitative research with an ethnographic approach. Data were collected through participatory observation, in-depth interviews, and documentation studies. Data analysis was conducted using an inductive approach to identify the values of harmony that emerged in organizing Kupatan. The results show that the Kupatan tradition in Sedayulawas Village is a ritual event and an expression of the profound importance of unity in the local Islamic community. Values such as helping, respecting each other, solidarity, and brotherhood are evident in implementing Kupatan. This article has significant implications for cultural preservation and community development in the coastal areas of Sedayulawas Village and its surroundings. By understanding and appreciating the values of harmony in the Kupatan tradition, communities can strengthen their social relationships and promote peace and stability in their neighborhoods. In addition, this article also provides valuable insights into how local cultural values can be integrated into sustainable development at the local and national levels.

Abstract

The development of Islam is currently experiencing relatively rapid development, mainly supported by technological developments. Islam views technological developments as opportunities for effective da'wah. In addition to facilitating the da'wah process, the existence of technology makes preachers more able to reach Mad'u from all walks of life. Da'i preaches with da'wah material that is readily accepted by the community by adjusting the geographic location, psychology, and intellectual capacity of Mad'u. The research method used in this article was a qualitative method using a literature approach. The result of this article is the da'wah process of contemporary preachers who carry out cosmopolitan Islamic da'wah by upholding the value of tolerance so that all levels of society can accept it. Such da'wah will provide a complex understanding for Mad'u to accept each other's differences within the framework of the Indonesian state.

Abstract

This article investigates reader responses to the classic literary work "Sons and Lovers" by D.H. Lawrence using a feminist perspective. Through a literary analysis approach, this research explores how readers respond to feminist aspects in the novel, particularly in the context of resisting patriarchal views. The article provides background information on D.H. Lawrence's life and how his personal experiences are reflected in this work, with an emphasis on feminist elements within the narrative. The research methodology involves in-depth textual analysis and a survey of reader responses to understand how women in the story challenge patriarchal norms and how readers, especially from a feminist perspective, perceive and interpret the involvement of female characters. In the context of feminist theory, this research discusses how "Sons and Lovers" presents a portrayal of power dynamics and gender inequality, as well as how female characters in the novel attempt to resist or adapt to existing social norms. The research findings are expected to provide insights into the impact of feminist theory on readers' understanding and responses to literary works, particularly in the context of "Sons and Lovers. In conclusion, this research delved into the exploration of D.H. Lawrence's "Sons and Lovers" through the lens of reader-response theory, revealing the pivotal role of the reader's experience, knowledge, and cultural background in shaping their perception of the literary work. The initial section provided a contextual backdrop by elucidating Lawrence's personal and societal milieu, emphasizing the autobiographical aspects intertwined with the broader human experience.

Abstract

The study aimed to learn the impact of teaching with differentiated education strategy in physics acquisition and meditative thinking development among third- grade middle students. The researcher selected the Mediocre Boys in Baghdad as an intentional sample of the experiment, and the research sample reached (58) Students in the third grade average (29) students for each of the two research groups rewarded the researcher between the two research groups in time-age variables with months, intelligence, previous information and a measure of contemplative thinking, The researcher prepared a multi-choice collection test and applied it to the two research groups and adopted a special measure of meditative thinking, after ascertaining its sincerity and consistency, the researcher used the T- test (T-test) to learn the results, and found that the differentiated education strategy had an effective impact on physics attainment and meditative thinking development for the experimental group compared with the control group. The researcher suggested a number of recommendations and proposals.
