Kemajuan media platform Youtube banyak disalahgunakan oleh seseorang sehingga merugikan para seniman Indonesia, hal ini menyebabkan lagu yang diciptakan oleh seniman dibajak atau ditiru oleh orang lain tanpa izin dengan mengcover lagunya dan mengunggahnya di media platform Youtube yang mendapatkan keuntungan yang cukup fantastis. Metode yang digunakan adalah yuridis normatif, dengan menggunakan pendekatan perundang-undangan dan pendekatan konseptual. Teknik pengumpulan dengan menggunakan studi kepustakaan yang bersumber dari bahan primer dan sekunder. Dari hasil penelitian ditemukan bahwa permasalahan dalam hak cipta lagu atau musik di Indonesia adalah Indonesia belum mengatur secara tegas tentang royalti lagu yang dicover oleh seseorang yang diunggah di Youtube dan sanksi tegas terhadap pelanggar hak cipta, dan pola pikir pencipta lagu yang masih enggan mendaftarkan karyanya untuk mendapatkan hak cipta. Karena nilai ekonomis pendaftaran lagu lebih mahal dari nilai jual lagu di pasaran. Selain itu, kelemahan dari penegak hukum dan kesadaran hukum pencipta juga menjadi faktor banyak bermunculan pengcover lagu yang tidak bertanggungjawab. Namun UU Hak Cipta memberikan perlindungan yaitu perlindungan preventif dan represif. Problematika penentuan royalti hasil lagu cover yang diunggah di Youtube belum diatur dengan jelas dalam peraturan per UU-an. Salah satu faktor terjadinya pembajakan lagu adalah karena pencipta lagu enggan mendaptarkan karya, karena biaya dikeluarkan lebih mahal dari royalti lagu. Selain itu, juga masih lemahnya penegakan hukum terhadap pembajak lagu di platform Youtube.

Sebuah peraturan pada prinsipnya harus berhasil guna dan berdaya guna bagi kehidupan masyarakat. Penulisan mengenai efektivitas penerapan Peraturan Walikota Tanjungbalai Nomor 40 Tahun 2020 tentang Peningkatan Disiplin dan Penegakan Hukum rotokol Kesehatan dalam Pencegahan dan Pengendalian Corona Virus Disease 2019 (COVID-19) adalah untuk mengetahui implementasi sebuah peraturan dalam menekan angka penyebaran COVID-19 di Kota Tanjungbalai dan untuk mengetahui dampak penerapan Peraturan Walikota tersebut terhadap masyarakat kota Tanjungbalai dari aspek hukum dan ekonomi. Dalam penulisan ini menggunakan metode penelitian hukum empiris dengan gabungan data primer yaitu dengan melakukan wawancara langsung kepada masyarakat, Kepolisian, dan Pemerintah Kota Tanjungbalai dan juga dengan data sekunder. Perolehan data berasal dari hasil wawancara sehubungan dengan Peraturan Walikota Kota Tanjungbalai dan peraturan lainnya yang relevan dengan topik penulisan ini, juga buku-buku, jurnal ilmiah, dan berita-berita online. Hasil penelitian yang dicapai dalam penulisan ini adalah bahwa salah satu strategi pemerintah Kota Tanjungbalai dalam mengendalikan COVID-19 adalah dengan menerbitkan Peraturan Walikota. Dalam implementasinya Peraturan Walikota tersebut belum sepenuhnya efektif oleh karena kurangnya kesadaran dan kepercayaan masyarakat Kota Tanjungbalai akan COVID-19 beserta adanya rasa pesimis dari masyarakat terhadap pemerintah Kota Tanjungbalai.

Background: Indonesia is one that upholds fair and certain law enforcement. However, sometimes these two things do not materialize properly and optimally because there are still arbitrary law enforcement actions by law enforcement officials, especially police investigators. The actions taken can be referred to as abuse of power. The potential for abuse of power arises when police investigators have other goals to benefit themselves, other people or certain groups through law enforcement. Abuse of power can cause harm to victims, both materially and immaterially. National Police investigators who abuse power can be criminally prosecuted if they commit an act that has elements of a crime. It is mandatory for the National Police investigators to be held criminally liability. In addition, victims of abuse of power also have the right to receive legal protection. Research Method: The research method uses a normative juridical approach Findings: The respect for law enforcement that is fair and definite obliges every police investigator to carry out his duties and authorities in accordance with statutory regulations and if he violates the law by committing an abuse of power, the personnel must be held accountable, including criminal liability. Conclusion: Victims of abuse of power are entitled to legal protection for losses arising from abuse of power

Latar Belakang: Tanah merupakan sebuah aset berharga bagi mereka yang memilikinya. Hak kepemilikan atas tanah ditunjukkan dalam wujud sertifikat tanah. Seiring dengan pembangunan infrastruktur untuk kepentingan umum maupun pembangunan komersial lainnya, muncul praktik mafia tanah yang meresahkan masyarakat. Keterlibatan mafia tanah dalam pembebasan lahan untuk pembangunan menimbulkan berbagai permasalahan baik berupa sengketa tanah maupun konflik masyarakat. Metode Penelitian: Metode yang digunakan dalam penelitian ini adalah analisis deskriptif dengan pendekatan yuridis normatif. Analisis deskriptif bertujuan untuk memberikan gambaran obyek penelitian secara kritis, sedangkan penelitian yuridis normatif menerapkan kajian terhadap perundang-undangan (statute approach). Hasil Penelitian: Hasil analisis mengelompokkan pembahasan terkait praktik mafia tanah di Indonesia menjadi empat bagian yaitu (1) kebijakan pertanahan di Indonesia, (2) berbagai kasus mafia tanah di Indonesia, (3) keterlibatan aparat negara dalam pusaran mafia tanah, dan (4) upaya pemberantasan mafia tanah dan penegakan hukum tindak pidana mafia tanah. Kesimpulan: Penelitian ini menemukan reforma agraria yang telah dilakukan pemerintah sudah memperbaiki berbagai sistem mekanisme penyelenggaraan tanah untuk pembangunan bagi kepentingan umum. Namun pemerintah bersama DPR perlu merumuskan sebuah undang-undang baru terkait Tindak Pidana Mafia Tanah sebagai strategi efektif dalam upaya pemberantasan dan penegakkan hukum tindak pidana mafia tanah.

The advocate's code of ethics is the cornerstone of advocates in carrying out their professional duties in defending the interests of clients inside and outside the courtroom in good faith, because the advocate's code of ethics governs all behavior of advocates in carrying out their professional duties in providing legal assistance and defense by upholding the law and legislation. Invitation in accordance with the oath of office. The author uses the normative legal research method (normative juridical). Advocates are an honorable profession (officium nobile), namely advocates in carrying out and carrying out their professional duties to defend the interests of their clients' legal rights are protected by law and law as well as the Advocate Code of Ethics. In carrying out their professional duties, advocates also have the freedom to adhere to independence, honesty, confidentiality and openness. Where the legal position of the advocate profession is as one of the law enforcers whose position is equal to other law enforcement agencies, so that one another must respect each other between colleagues and other law enforcers. Because Advocates are an honorable profession (officium nobile), Advocates must maintain their honor in front of the public by adhering to the advocate's code of ethics, as a basis of good faith not to be prosecuted civil or criminal.

Abstract Background: Some of the problems in the criminal process in court include the accumulation of settlement of criminal cases and the bureaucracy of a long trial The Plea Bargaining concept that has been implemented in the United States can be adopted in Indonesia while considering the values of Pancasila based on integrative theory (integratif theory) and the theory of dignified justice (keadilan bermartabat theory). Research Metodes: The research method used is normative juridical. This research uses a conceptual approach, a statutory approach, a comparative approach and a historical approach. Findings: The results of this research involve the reformulation and explanation of the ontological, epistemological, and axiological aspects of the concept of plea bargaining. There are provisions in the Draft Criminal Procedure Law that do not yet reflect the concept of plea bargaining. Reformulation of the concept of plea bargaining is based on the theory of dignified justice (keadilan bermartabat theory), so that the creation of the purpose of the law of dignified justice that is rooted in the values and the national spirit or the soul of the nation (volksgeist). Conclusion: By adopting the concept of plea bargaining that has been formulated based on dignified justice, it can solve the problem of stacking criminal case settlement in courts and trial bureaucracy and as a form of Criminal Procedure Law Reform in Indonesia. Abstrak Latar Belakang: Sebagian permasalahan dalam persidangan pidana di pengadilan antara lain penumpukan penyelesaian perkara pidana dan birokrasi persidangan yang cukup lama. Konsep Plea Bargaining yang telah diterapkan di negara Amerika dapat di adopsi di negara Indonesia dengan tetap mempertimbangkan nilai-nilai Pancasila berdasarkan teori integratif dan teori keadilan bermartabat. Metode Penelitian: Metode penelitin yang digunakan adalah yuridis normatif. Penelitian ini menggunakan metode pendekatan konseptual (conceptual approach), pendekatan perundang-undangan (statute approach), pendekatan perbandingan (comparative approach) dan pendekatan historis (historical approach). Hasil Penelitian: Hasil penelitian ini adalah mereformulasi dan menjelaskan aspek ontologi, epistimologi dan aksiologi konsep plea bargaining. terdapat pasal di Rancangan Hukum Acara Pidana yang belum mencerminkan konsep plea bargaining, reformulasi Konsep plea bargaining yang berbasis teori keadilan bermartabat dapat diejawantahkan dalam Rancangan Hukum Acara Pidana. Reformulasi konsep plea bargaining ini berdasarkan teori keadilan bermartabat, sehingga terciptanya tujuan hukum yaitu keadilan bermartabat yang berakar pada nilai-nilai dan semangat nasional atau jiwa bangsa (volksgeist). Kesimpulan: Dengan mengadopsi konsep plea bargaining yang telah direformulasi berbasis keadilan bermartabat dapat menyelesaikan permasalahan penumpukan penyelesaian perkara pidana di Pengadilan dan birokrasi persidangan serta sebagai bentuk pembaruan hukum acara pidana di Indonesia. Kata kunci: Reformulasi; konsep plea bargaining; teori keadilan bermartabat; Pancasila.

The role of the Business Competition Supervisory Commission (KPPU) of Regional Office V Balikpapan is to create a Healthy Business Competition Climate in East Kalimantan.The practice of fraud in the tender process in the implementation of procurement of government goods / services can be in the form of conspiracy. Business Competition Supervisory Commission (KPPU) as supervisor of business competition based on Law Number 5 of 1999 concerning Prohibition of Monopolistic Practices and Unfair Business Competition has the task of supervising the prohibition of conspiracy in tenders as stipulated in article 22 of Law Number 5 of 1999, One of which is to decide breach of tender conspiracy in this case the case that has been handled by the KPPU of the Balikpapan Regional Representative Office namely Case Number 17 / KPPU-L / 2016 concerning Alleged Violations Article 22 of Law Number 5 of 1999 concerning Improvement of the Jongkang Road to Jakarta Samarinda Samarinda Karang Paci Road (Ring Road III) Tenggarong Seberang District. The method used in this study is normative juridical supported by field research, namely the Business Competition Supervisory Commission (KPPU) Regional Office V Balikpapan. The results of the study based on the case verdict showed that the KPPU of the Balikpapan Representative Office had successfully handled this case so that they had sentenced each Reported Party I, and 2 They had sentenced each Reported Party I, and 2 PT Karyatama Nagasari as Reported Party I and PT Jasin Effrin Jaya as Reported Party II, to pay a fine of Rp. 5,021,028,000.00 (Five Billion Twenty One Million Twenty Eight Thousand Rupiah) which must be deposited to the State Treasury, and Prohibit PT Karyatama Nagasari as Reported Party I and PT Jasin EffinJaya as Reported Party II to participate in the tender in the field of road construction services for 2 (two) years in all regions of Indonesia.

This study aims to determine the implementation of Mayor Regulation Number 02 of 2019 concerning the system and procedures for implementing local tax collection related to swallow's nest tax in Samarinda City. This research is an Empirical legal research sourced from primary and secondary data. The results showed that the tax collection carried out by the City Revenue Agency in its implementation and implementation was constrained by several factors. So it is advisable to implement a local government tax collection of bird's nest as well since the issuance of the regulations after the mayor and the local government or the province should consider to help Regional Revenue Agency Samarinda carry out tasks that have been mentioned in the regulations of the mayor.

This study aims to determine the implementation of facility rights and accessibility for people with disabilities at health institutions in Samarinda City (in terms of East Kalimantan Provincial Regulation Number 1 of 2018 concerning the Protection and Fulfillment of the Rights of Persons with Disabilities). This research is an empirical legal research which is sourced from primary data and secondary data. The results showed that the facility rights and accessibility for persons with disabilities at Health Offices in Samarinda City were still not evenly distributed, and facilities that were not friendly to persons with disabilities or were still not easily accessible to persons with disabilities and still did not meet the requirements of the needs of persons with disabilities. So it is suggested that local governments can implement facility rights and accessibility for persons with disabilities since the issuance of this regional regulation and that regional governments should consider helping and being more concerned about the rights of persons with disabilities in Samarinda City.

This study aims to find out the constraints of land acquisition of Maloy Special Economic Zone (KEK) conducted by the East Kutai Regency Government in the review of Law No. 2 of 2012 on Land Procurement for Development for the Public Interest. This research is normative legal research sourced from Secondary legal materials and primary legal materials. The results of this study showed that the constraints of land procurement in the Special Economic Zone (KEK) Maloy in its implementation occurred negligence caused by several factors. So it is recommended that the Government of East Kutai Regency in conducting land procurement activities in the Maloy Special Economic Zone (KEK) should follow the mechanism of land procurement properly so that all the processes are not harmed.
