Jurnal Ilmu Pendidikan Pancasila, Kewarganegaraan, dan Hukum (PAKEHUM) adalah publikasi akademik yang berfokus pada kajian di bidang pendidikan Pancasila, kewarganegaraan, dan hukum. Abstract

The downfall of Soekarno’s regime and the G30S PKI tragedy in 1965 led to the citizenship cancellation of Indonesian students and delegates who were previously studied abroad. Those accused of having affiliations with communism or loyalty to Soekarno had no chance to return to Indonesia and legal rights as Indonesians. This study aims to examine the political impact on the citizenship status of 1965 exiles and the challenges they faced in gaining recognition of their citizenship rights in the countries where they sought refuge. The methodology used is qualitative analysis, focusing on three countries with the highest number of exiles. Our paper indicates that most of Indonesian exiles have been revoked unilaterally by the Indonesian government, forcing them to seek alternative citizenship in the host countries. In the Netherlands, most exiles were induced to adopt Dutch citizenship due to the country’s single citizenship law, while in Russia and Czechoslovakia, where dual citizenship policies were more flexible, they found it easier to retain their Indonesian citizenship, although sometimes they faced legal limitations. In conclusion, despite experiencing injustice regarding their citizenship, these exiles continued to maintain their nationalism and hoped for recognition of their citizenship status. After the 1998 reform, the Indonesian government began to pay attention to the exiles by offering visa facilitation and reopening opportunities from them to regain their Indonesian citizenship.

Abstract

The 1945 Constitution of the Republic of Indonesia (UUD 1945) is the highest legal foundation that regulates the structure of government, the rights and obligations of citizens, and the direction of the implementation of national and state life. The body of the 1945 Constitution contains basic principles that reflect the values of Pancasila and the spirit of independence, democracy, and social justice. This article examines in depth the principles contained in the body of the 1945 Constitution, including equality before the law, freedom of religion, human rights, the national cultural system, and national defense. This study uses a literature study method with a normative approach. The results of the study show that the body of the 1945 Constitution is flexible and able to adapt to developments in the era, and is a foundation for realizing a democratic system of government, guaranteeing the constitutional rights of citizens, and strengthening national unity within the framework of the Unitary State of the Republic of Indonesia.

Abstract

This research examines the implementation of Archipelago Insight education in shaping student character at SMP Negeri 2 Hilimegai. Through a descriptive qualitative approach with observation and interviews, it was found that teachers play an active role in instilling national values through contextual learning and class discussions. Students showed tolerance and respect for differences. Challenges such as students' lack of interest were overcome with creative teaching methods. Parental support and activities such as singing national anthems and cultural discussions also strengthen the value of nationalism. As a result, character education based on Archipelago Insight has proven effective in forming students with integrity and love for the country.

Abstract

Law enforcement against corruption in Indonesia is a crucial issue in the effort to establish a clean and accountable government. This study aims to analyze the effectiveness of law enforcement in combating corruption using a qualitative approach through literature review and legal document analysis. The findings indicate that although there has been significant progress in handling major corruption cases by institutions such as the Corruption Eradication Commission (KPK), the overall effectiveness remains limited. The revision of the KPK Law, weak inter-agency coordination, lenient sentencing for corrupt officials, and unequal legal treatment are major hindering factors. In addition, public participation in oversight and preventive efforts through bureaucratic reform and digitalization of public services remain suboptimal. Therefore, effective law enforcement requires a holistic approach that includes institutional strengthening, protection for whistleblowers, judicial reform, and the development of a sustainable anti-corruption culture.

Abstract

This article examines legal protection for victims of sexual violence in Indonesia from a human rights perspective. The main focus of the study is to analyze the effectiveness of Law Number 12 of 2022 concerning the Crime of Sexual Violence (UU TPKS) in providing justice, recovery, and victim-centered protection. Using a normative juridical approach and literature study, this research finds that although the UU TPKS represents significant legal progress, its implementation still faces numerous challenges, such as limited understanding among law enforcement officers, weak recovery services, and a lack of inter-agency coordination. Moreover, patriarchal culture and social stigma remain major barriers to victims' access to justice. Therefore, integrating a human rights-based approach into legal policy, public education, and service systems is crucial to ensure that victim protection becomes more comprehensive, just, and humane.

Abstract

In the era of globalization and rapid development of information technology, challenges to national values and national identity are increasingly complex. The younger generation is faced with various foreign cultural influences that can affect their understanding and appreciation of the noble values of the nation. Therefore, Civic Education plays a role as a fortress in maintaining and instilling these values from an early age. As stated by Parawangsa, Dewi, and Furnamasari (2021), Civics Education in Primary Schools focuses on the formation of smart, skilled, and characterized citizens in accordance with Pancasila and the 1945 Constitution. In addition, civic education not only functions as a transfer of knowledge about the political and legal system, but also as a means of shaping the character and morals of students. This is in line with the view that Civics Education aims to foster and increase citizen participation in political and community life, both at the local and national levels.

Abstract

Abstract Civic Education (PKn) plays a crucial role in shaping the nation's character, especially in facing the challenges and opportunities presented by the digital era. PKn aims to equip students with an understanding of their rights and duties as citizens, as well as instill national values based on Pancasila and the 1945 Constitution. In the digital era, technological advancements provide easier access to information but also pose a challenge in preserving national values often eroded by the global information flow. Therefore, civic education must be adjusted to technological developments, accompanied by the enhancement of critical thinking and empathy skills. Technology-based learning strategies, such as the use of digital media and social platforms, can make the learning process more engaging and relevant to the younger generation. This study aims to examine the role of PKn in building the nation's character in the digital age and strategies that can be implemented to optimize PKn learning.

Abstract

This study aims to analyze the role of Citizenship Education (PKn) in supporting the implementation of the Independent Curriculum at SMA Negeri 1 Hiliduho. The Independent Curriculum emphasizes student-centered learning, character building, and the formation of Pancasila student profiles. PKn, as a subject that functions to form intelligent, active, and responsible citizens, is an important component in achieving these goals. Through a descriptive qualitative approach, data were collected through in-depth interviews, learning observations, and documentation studies. The results of the study indicate that PKn has a significant contribution to the formation of student character, increasing democratic literacy, and strengthening attitudes of tolerance and social responsibility. However, its implementation still faces challenges such as limited contextual teaching materials, lack of teacher training, and low student involvement in the participatory learning process.

Abstract

Cultural values, state symbols, and the nation's long history shape Indonesia's national identity, which fosters unity amidst cultural, linguistic, and ethnic diversity. However, globalization and technological advances endanger national identity, especially for the younger generation. The literature analysis process is used in this study to evaluate the dynamics, challenges, and efforts to strengthen national identity. The results of the study indicate that elements such as cultural diversity, Indonesian language, and Pancasila are the main pillars of national identity. The influence of foreign cultures and political decentralization are major problems. The active role of society, multicultural education, and the use of digital technology for cultural preservation are strengthening strategies. These methods are very important to maintain the integrity and nature of the Indonesian nation in the contemporary era.
