Abstract

. Complete Systematic Land Registration, known as Pendaftaran Tanah Sistematis Lengkap (PTSL), constitutes a strategic government policy intended to accelerate the registration of all land parcels and provide legal certainty and protection for land right holders. Nevertheless, its implementation may still give rise to overlapping-certificate disputes when the collection, examination, mapping, and integration of physical and juridical data are not conducted accurately. This study aims to identify the factors causing overlapping certificates in the implementation of PTSL, analyse their juridical implications for the evidentiary strength of land certificates, and formulate a dispute-resolution mechanism capable of achieving substantive legal certainty in land administration. This study employs normative legal research using statutory, conceptual, and case approaches and adopts a descriptive-analytical design. Secondary data consisting of primary, secondary, and tertiary legal materials were collected through library research. Limited observations and interviews conducted at the Bandung Land Office were used as supporting data to contextualise the implementation of legal norms in practice. The data were analysed through qualitative juridical analysis using grammatical, systematic, and teleological interpretation. The findings demonstrate that overlapping certificates in PTSL are caused by inaccurate physical data, inadequate examination of the history of rights acquisition, incomplete integration of older certificates into the cadastral mapping system, ineffective application of the contradictio delimitatio principle, limited effectiveness of public data announcements, and weak administrative coordination and quality control. A land certificate constitutes strong but not absolute evidence and may be annulled when its issuance is proven to contain an administrative or juridical defect. In principle, the certificate issued earlier has a stronger evidentiary position, provided that it was lawfully issued, remains valid, refers to the same physical object, and was acquired in good faith. Overlapping-certificate disputes should be resolved progressively through verification of physical and juridical data, field re-surveying, cadastral overlay mapping, mediation, administrative correction or annulment, and proceedings before the District Court or State Administrative Court according to the legal character of the dispute. Strengthening data validation, integrating historical land records, and implementing quality control at every stage of PTSL are essential prerequisites for achieving substantive legal certainty in land administration.

Abstract

The transformation of public sector human resource management requires the implementation of an objective and professional merit-based system; however, its implementation in Indonesia—particularly regarding the use of Assessment Centers—still faces various challenges. This study aims to analyze the implementation of a merit-based Assessment Center in the selection process for the position of Head of Community Relations (Kasat Binmas) at the Central Java Regional Police Headquarters and to identify the factors influencing it. The study employs a descriptive qualitative approach through a literature review of relevant scientific sources and policy documents. The results indicate that, normatively, the Assessment Center has been conducted in accordance with meritocratic principles using comprehensive instruments; however, empirically, its effectiveness remains suboptimal, marked by a predominance of candidates in the intermediate competency category and a scarcity of candidates with outstanding qualifications. Major obstacles include low applicant interest, budget constraints, low assessor capacity, limited digital literacy among candidates, as well as potential bias and interference in the selection process. The implications of this study underscore the need for institutional capacity building, enhanced human resource competencies, and the optimization of transparent and accountable governance to realize an effective and sustainable merit-based system in the management of the Indonesian National Police’s human resources.

Abstract

In the practice of limited liability companies, situations often arise where the Board of Directors no longer performs its management functions, causing the company’s decision-making mechanisms to reach an impasse. This situation places minority shareholders in a vulnerable position, even though Law No. 40 of 2007 on Limited Liability Companies (UUPT) has, in principle, provided them with protections and scope of authority. This study aims to analyze the legal authority of minority shareholders in filing a request to convene an Extraordinary General Meeting of Shareholders (EGMS) with the agenda of dissolving the company, as well as to examine the mechanisms for the dissolution and liquidation of the company when the Board of Directors no longer fulfills its obligations. The method used is a normative legal approach through an examination of legislation, legal doctrine, and court decisions, specifically the Mataram District Court Decision No. 21/Pdt.P/2022/PN Mtr as a case study. The research findings indicate that minority shareholders possess legal authority—both substitutive and procedural—to initiate the convening of an Extraordinary General Meeting of Shareholders (EGMS) through a court order as a means of restoring decision-making mechanisms that have stalled due to the Board of Directors’ negligence. The subsequent liquidation mechanism further confirms that executive authority is fully transferred to the liquidator upon appointment, so that the role of minority shareholders is limited to a supervisory function to ensure the accountability of the liquidation process without taking over management functions.

Abstract

The purpose of this study is to clearly understand the profile of Micro, Small, and Medium Enterprises (MSMEs) classified as herbal products in Banyuwangi. Furthermore, the purpose of this study is to identify the problems faced by these entrepreneurs and the efforts made to overcome these problems. The approach used in this study is descriptive qualitative. The population in this study is micro, small, and medium-scale entrepreneurs classified as herbal products in Banyuwangi. The sample in this study is producers of herbal products in Banyuwangi who are still actively running their businesses. The data analysis method used is to process data in depth with data from observations, interviews, and literature. Data analysis techniques are carried out by summarizing, categorizing, and interpreting. The results of the study show that the profile of small, micro, and medium enterprises in Banyuwangi Regency shows that MSMEs in the classification of herbal products in Banyuwangi Regency on average start their businesses with their own capital. The number of employees involved in their activities ranges from 2-5, with a monthly turnover of between Rp 8,000,000 and Rp 80,000,000. The products produced by this herbal business in Banyuwangi include beverages, food, and medicines or herbal medicine. Information obtained from informants indicates that sales have increased by 30%-75% during the COVID-19 pandemic. The current challenge is the high cost of production. Financial support is also essential for expanding production scale. Difficulties in obtaining permits are considered very burdensome for business owners, hindering the expansion of marketing activities.

Abstract

The digital age has brought significant transformation to education, requiring learning in Islamic Religious Education to move beyond rote memorization toward deeper understanding and active participation. This study analyzes the implementation of a deep learning approach in Islamic Religious Education among 10th-grade students at Jumapolo State High School in the digital age. A qualitative descriptive method was employed, involving Islamic Religious Education teachers as interview informants and 10th-grade students as questionnaire respondents. Data were collected through in-depth interviews and Google Forms-based questionnaires. The data analysis process included data reduction, data presentation, and conclusion drawing. The findings revealed that Problem-Based Learning (PBL) and Project-Based Learning (PjBL) models were applied to facilitate deep learning in Islamic Religious Education. These models encourage students to engage with learning materials and connect them to real-life situations, resulting in positive learning experiences characterized by interest and self-directed learning. The learning process contributes to students’ cognitive, affective, and psychomotor development. While the use of digital technology, including artificial intelligence (AI), helps students access various information sources, it also presents challenges, as students tend to rely on AI without always verifying the accuracy of the information. Therefore, teacher guidance and strengthened digital literacy are essential. Overall, the implementation of deep learning in the digital era offers opportunities to improve the quality of Islamic religious education.

Abstract

This study aims to analyze the influence of the Technology Acceptance Model on the adoption of digital marketing among MSMEs, with digital marketing training as a moderating variable. The focus of this study is on MSME participants who attended a digital marketing training program organized by the Medan City Department of Cooperatives, MSMEs, Industry, and Trade in collaboration with Lazada Indonesia. This study employs a quantitative approach, using a questionnaire distributed to 100 SME participants who attended the digital marketing training as the data collection method. The data were analyzed using Structural Equation Modeling (SEM) based on Partial Least Squares (SmartPLS). The results show that the Technology Acceptance Model (TAM), with its two main components—Perceived Usefulness (PU) and Perceived Ease of Use (PEOU)—has a positive and significant influence on the adoption of digital marketing. Furthermore, the digital marketing training was also found to have a positive and significant influence on the adoption of digital marketing. Furthermore, digital marketing training was found to moderate the effects of Perceived Usefulness (PU) and Perceived Ease of Use (PEOU) on digital marketing adoption. These findings suggest that SME operators who participate in digital marketing training will enhance their understanding of digital marketing, thereby encouraging them to utilize digital marketing optimally. Furthermore, understanding digital marketing concepts will certainly make it easier for SME owners to adopt digital marketing, as digital skills can expand their market reach—especially given that consumer behavior is increasingly reliant on digital platforms.

Abstract

This study aims to analyze the influence of the Unified Theory of Acceptance and Use of Technology (UTAUT) model on the use of the GoFood online food ordering platform and its impact on the performance of culinary Micro, Small, and Medium Enterprises (MSMEs) in Medan City. This study employs a quantitative approach using the Partial Least Squares Structural Equation Modeling (PLS-SEM) method. The study sample consisted of 210 culinary MSME operators in Medan City, selected using probability sampling. Primary data were collected through the distribution of structured questionnaires and analyzed using SmartPLS 3 software. The results indicate that Performance Expectancy, Effort Expectancy, Social Influence, and Facilitating Conditions have a positive and significant effect on Behavioral Intention. Furthermore, Behavioral Intention and Facilitating Conditions have a positive and significant effect on Use Behavior, while Use Behavior has a positive and significant effect on SME performance. In addition, Facilitating Conditions also have a direct positive effect on SME performance. These findings indicate that the successful adoption of the GoFood platform by culinary MSMEs is influenced not only by perceived benefits, ease of use, and social influence but also by the availability of technological infrastructure and adequate facility support, which can enhance business performance. This study provides empirical evidence regarding the relevance of the UTAUT model in explaining the adoption of digital technology among culinary MSMEs amid the digital transformation.

Abstract

Forced marriage is a marriage that is performed due to pressure or coercion from other parties, such as parents, family, or the social environment. This study aims to analyze the cultural phenomenon of forced marriage in the film Hati Suhita based on the perspective of Islamic Family Law. This research focuses on the practice of forced marriage represented in the film Hati Suhita through dialogue, scenes, and storylines. The method used in this study is qualitative-descriptive with a literature study approach and semi-netnography analysis to understand the phenomenon of forced marriage practices. The results of the study show that the marriage between Gus Birru and Alina Suhita is a form of forced arranged marriage due to family pressure and the authority of his father as a kiai. This condition leads to emotional conflict, rejection, and lack of communication, as well as disharmony in their household. From the perspective of Islamic Family Law, the practice of forced marriage in the film Hati-Suhita occurs because of ijbar rights, which are the reason for coercion in marriage, the legitimacy of the family, and the cultural authority of the Islamic boarding school. The preventive solution is to provide premarital guidance to both parties to minimize conflicts in the household. Although the concept of arranged marriage in Islam is allowed, its implementation must be based on the agreement and willingness of both parties so that the goals of marriage such as the creation of a harmonious, just, and peaceful family, can be realized.

Abstract

Divorce by wife has emerged as a dominant structural phenomenon in Indonesia’s religious courts, reflecting shifting power dynamics and increasing legal awareness among women. This research examines the escalation of cerai gugat at the Class 1A Religious Court of Palu, focusing on its causal factors and socio-legal implications through the lens of feminist legal theory. Using a qualitative case study approach, data were gathered from semi-structured interviews with judges, court officials, and litigants, alongside a thematic analysis of court decisions. Findings indicate that cerai gugat accounts for approximately 70% of divorce cases in Palu, driven primarily by chronic gender imbalances, economic instability, and domestic violence. Despite the high volume of cases filed by women, the transition from legal object to active subject has not fully translated into substantive justice. Post-divorce, women remain trapped in cycles of social stigma and economic vulnerability due to inconsistent ex officio maintenance orders and weak execution mechanisms. The study concludes that the religious judicial system remains largely formalistic, necessitating a shift toward gender-responsive practices and the integration of Islamic feminist principles to ensure the effective protection of women’s rights.

Abstract

The reform of criminal law through Law Number 1 of 2023 concerning the Criminal Code is an important step in the decolonization of law in Indonesia while also providing recognition of the laws that exist within society. This recognition is reinforced through Government Regulation Number 55 of 2025 concerning Procedures and Criteria for Determining Laws that Exist within Society. This study aims to analyze and critically examine the normativization of customary law in national criminal law and assess its implications for the values underlying the handling of criminal acts in indigenous communities. This study is a normative legal study using secondary data consisting of primary and secondary legal materials and employing a regulatory and sociological approach to law. The results of the study show that the recognition of living law or customary law in the National Criminal Code reflects efforts to harmonize national law and customary law. However, through Government Regulation No. 55 of 2025, living law or customary law must go through a formalization process, starting from the administrative recognition of customary law communities, the formation of regional regulations, to verification by the central government. This mechanism places the state as the party that determines the validity of customary norms as customary criminal acts. As a result, customary law, which was previously based on material legality, has shifted towards formal legality that depends on state legitimacy. In addition, restrictions on customary criminal acts so as not to conflict with the Criminal Code and the standardization of fines have the potential to reduce the flexibility and character of customary law and open up the possibility of overlapping authority between customary institutions and state law enforcement agencies.
