Res Publica: Jurnal Hukum Kebijakan Publik is a peer-reviewed journal published by Constitutional Law Department, Faculty of Law, Universitas Sebelas Maret three times a year in April, August, and December. This Journal aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning constitutional law and democracy. It provides immediate open access to its content on the principle that making research freely available to public support a greater global exchange of knowledge. Published exclusively in English and / or Bahasa Indonesia (will be considered), the Review seeks to expand the boundaries of Indonesian legal discourses to access English-speaking contributors and readers all over the world. Novelty and recency of issues, however, is a priority in publishing. The scope of the articles published in this journal deal with a broad range of topics in the fields of constitutional law and democracy. Res Publica is an open access journal which means that all content is freely available without charge to the user or his/her institution (for libraries or individual). Abstract

This study aims to determine the implementation of the public service bureaucracy of the online service administration of the Population and Civil Registration Information and Service Administration System (Sapidukcapil) organized by the Boyolali Regency Government, especially the Population and Civil Registration Service based on the Minister of Home Affairs Regulation Number 7 of 2019 concerning Population Administration Services. Online which is viewed from the principle of Good Service. This research is a non-doctrinal legal research (non-doctrinal research). Types and sources of research data using primary and secondary data. Primary legal materials are in the form of Minister of Home Affairs Regulation Number 7 of 2019 concerning Online Population Administration Services, while secondary legal materials are treaties or doctrines, law reviews, and legal encyclopedias. Deductive qualitative data analysis technique. The results of this study in terms of the principle of Good Service are closer to the community, simplify, speed up, and free of charge, so that it is considered effective and efficient, however, this principle is not fully implemented and there are still discrepancies, namely still using old blanks, there is no data collection feature for adminduk vulnerable residents, and foreign applicants are not served in the Sapidukcapil online service.

Abstract

The presence of law enforcement on university campuses has sparked debates about the extent of government authority, particularly regarding maintaining public safety while protecting students’ freedom of expression. In September 2025, during protests in Bandung, police deployed tear gas and rubber bullets near UNISBA and UNPAS. This incident raised questions about whether such actions represented legitimate law enforcement or an attempt to suppress students’ voices. Students strongly criticized the measures, arguing that they were excessive and undermined both democratic rights and the autonomy of academic spaces. This article explores how students perceive the use of force by security forces on campus. It applies a qualitative approach by reviewing existing sources such as media reports, public commentary, and statements from student organizations. The focus is on how students interpret the incident in relation to broader concerns, including the rule of law, human rights, and freedom of expression within educational institutions. Findings indicate that students view the police response as overly repressive and part of a wider trend of restricting student participation in society. The discussion highlights how efforts to preserve order can sometimes conflict with democratic principles, especially in academic environments that are meant to safeguard free thought and speech. The article concludes that this case reveals deeper structural problems in Indonesian policing and calls for a reconsideration of the balance between state security and the protection of student freedoms.

Abstract

One effort to realize the protection and enforcement of human rights is through the establishment of statutory regulations. These laws and regulations must have objective value, follow all existing formation instruments and not conflict with higher provisions in order to achieve legal ideals and realize the protection of citizens' constitutional rights. However, the current fact is that the formation of laws often results in hyper-regulation, conflict between regulations, overlapping regulations, multiple interpretations, inconsistencies and the formation of regulations at high costs. Apart from that, quite a few laws produced by legislators are often deemed unconstitutional, resulting in judicial review by the Constitutional Court. The formation of regulations that are not in accordance with the constitution will certainly have a negative impact on the existence of the rule of law. Therefore, preventive efforts are needed, namely an ex ante review to test the draft law before it is finally passed and promulgated. The aim of this article is to examine the constitutionality of the draft law through ex ante review as a form of protecting the constitutional rights of citizens by establishing a new, independent institution. The method used in this research is a prescriptive doctrinal method with a statutory approach, comparative approach and conceptual approach. Data was obtained from books, journals, articles and analysis of statutory regulations. The results of this research indicate that ex ante review testing is an alternative to prevent violations of the constitutional rights of citizens because every draft law before it is passed and promulgated must be tested first by synchronizing it with the 1945 Constitution of the Republic of Indonesia and harmonizing it with other related laws so that there is no overlapping of laws and regulations so that the public is not worried about the laws that will be enforced.

Abstract

This study aims to examine the forms and methods of protecting citizens' constitutional rights in the application of law in Indonesia. This study focuses on the extent to which the state guarantees and protects the rights of its citizens as stipulated in the 1945 Constitution of the Republic of Indonesia. The method used in this study is a normative legal method with a statutory regulatory approach and a conceptual approach. The data sources analyzed include primary legal sources, namely the 1945 Constitution and its implementing regulations, and secondary legal sources such as literature and relevant scientific journals. The findings of this study indicate that the protection of citizens' constitutional rights is a reflection of the principle of a democratic state based on the rule of law. Within the framework of Friedman's legal system theory, the implementation of this protection requires good cooperation between the legal structure, legal substance, and legal culture that exist in society. However, in practice, there are still discrepancies between norms and implementation, such as weak law enforcement, low levels of public legal awareness, and inconsistencies in the application of regulations. Therefore, it is crucial to strengthen law enforcement institutions and improve legal education for the public so that the protection of constitutional rights can be realized effectively and fairly.

Abstract

Penelitian ini bertujuan untuk melakukan kajian terkait pola rekrutmen calon legislatif terhadap pemenuhan keterwakilan perempuan pada pemilihan umum tahun 2024 di Kabupaten Rembang. Metode penelitian yang digunakan adalah yuridis empiris yaitu selain ditinjau melalui peraturan perundang-undangan juga dikaji tentang fakta hukum di lapangan. Dalam penelitian ini objek penelitian yang dikaji adalah Partai Demokrat Kabupaten Rembang, Partai Gerakan Indonesia Raya (Gerindra) Kabupaten Rembang dan Partai Keadilan Sejahtera (PKS) Kabupaten Rembang. Partai politik tersebut dipilih dengan kriteria Partai politik yang berhasil meloloskan kadernya di DPRD Kabupaten Rembang tetapi tidak dengan caleg perempuannya. Hasil penelitian menunjukkan bahwa ketiga partai politik telah memenuhi kriteria dalam melakukan rekrutmen calon legislatif terhadap pemenuhan keterwakilan perempuan, akan tetapi pada hasil akhirnya tidak maksimal karena tidak ada perempuan yang mendapatkan kursi dari ketiga partai tersebut. Hal ini disebabkan karena ada hambatan internal dan eksternal. Hambatan Internalnya dalam partai politik adalah mekanisme tentang peningkatan keterwakilan perempuan tidak tertulis dalam AD ART partai politik, dan kurangnya kuantitas kader perempuan yang berpartisipasi dalam pemilihan umum legislatif daerah. Serta penokohan kader perempuan yang sangat minim di dalam diri partai. Sementara anggapan masyarakat bahwa perempuan tidak mempunyai kapabilitas dalam politik menjadi hambatan eksternal yang dihadapi partai politik dan perempuan sendiri

Abstract

The principle of Nemo Judex Idoneus In Propria Causa, which prohibits an individual from acting as a judge in a case involving their own interests, serves as a fundamental foundation for ensuring the independence and impartiality of the Constitutional Court, which stands at the forefront of constitutional oversight in Indonesia. This study aims to critically examine the application of this principle within the institutional practices of the Constitutional Court, adopting a critical approach to normative, structural, and implementational aspects. The analysis begins with a review of relevant legislation, legal doctrines, and case studies that illustrate potential conflicts of interest capable of undermining public trust in the Constitutional Court. The findings indicate a disparity between the normative acknowledgment of the Nemo Judex Idoneus In Propria Causa principle and its practical realities, particularly in the trial and decision-making processes of constitutional judges, which remain vulnerable to external influences. As a strategic measure, this study recommends the establishment of an independent supervisory mechanism and reforms to the oversight system to optimize the implementation of the Nemo Judex Idoneus In Propria Causa principle. By offering a critical perspective, this study aspires to make a significant contribution to strengthening the discourse of constitutional law grounded in the principles of justice and independence.

Abstract

Penulisan hukum ini mendiskripsikan dan mengkaji sistem pemilukhususnya mengenai pendanaan kampanye parpol peserta pemilu yang masihmemiliki banyak kekurangan baik dalam pengaturan maupun pelaksanaannya,serta menawarkan konstruksi hukum melalui rencana pemaksimalan APBNsebagai sumber keuangan utama pendanaan kampanye parpol peserta pemilu diIndonesia. Penelitian ini termasuk ke dalam jenis penelitian hukum normatif.Pendekatan yang digunakan dalam penelitian ini yakni pendekatan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Sumber hukum yangdigunakan terdiri dari bahan hukum primer dan bahan hukum sekunder. Teknikpengumpulan data dilakukan dengan studi dokumen (studi kepustakaan). Teknikanalis baha hukum adalah menganalisis hasil penelitian dan pembahasan dengan menggunakan teori-teori yang terdapat dalam tinjauan pustaka. Hasil penelitian menunjukkan bahwa pengaturan pendanaan kampanye di Indonesia masih jauh dari kata ideal. Yang mana dalam pelaksanannya, beberapa penyimpangan politik seperti praktek korupsi, politik uang, dan ketidakpatuhan terhadap laporan dana kampanye masih terus terjadi pada penyelenggaraan pemilu di Indonesia. Sehingga sudah seharusnya pengaturan pendanaan kampanye tersebut dilakukan perubahan dengan mengakomodir pemaksimalan APBN sebagai sumber keuangan utama pendanaan kampanye parpol peserta pemilu.

Abstract

This study aims to determine the testing of regional regulations by the Supreme Court after the decision of the Constitutional Court Number 137/PUU-XII/2015 for  the  implementation  of  good  governance. This  type  of  research is legal research, prescriptive and applied. Sources of legal materials used are primary and secondary legal materials, collection of legal materials by means of literature study, approach techniques using a case approach and legal material analysis techniques using syllogism and interpretation methods using deductive thinking patterns. Based on the results of research conducted by the author, it is known that after the Constitutional Court Decision Number 137/PUU-XIII/.2015 has returned the cancellation authority to the Supreme Court has a correlation with good governance. The annulment of a regional regulation under the authority of the Supreme Court (judicative) in the author’s view is a fair test tool for the obedience of the Regional Government to the implementation of good governance, specifically related to the formation of Local Government Regulation.

Abstract

This study aims to analyze the implementation of village-owned enterprises based on the Regulation of the Minister of Villages of Disadvantaged Regions and Transmigration Number 4 of 2015 in Kemuning Village along with the obstacles. The research method used is an empirical legal method with a descriptive research nature and a statutory, case, and conceptual research approach. From the results of this study it can be concluded that the implementation of village-owned enterprises is not fully in accordance with the Regulation of the Minister of Villages, Disadvantaged Regions and Transmigration Number 4 of 2015 and there are still obstacles in its implementation. The obstacles faced by Kemuning Village-Owned Enterprises are limited capital participation, lack of facilities and infrastructure, and limited human resources.

Abstract

The digital transformation of the judiciary through the e-Court policy in Indonesia aims to realize the principles of speedy, simple, and low-cost justice as a manifestation of the constitutional right to access to justice. However, its implementation has engendered a fundamental paradox that threatens legal certainty and the principle of equality before the law. This study is premised on the assertion that digitalization must not be reduced to mere bureaucratic automation, but must be directed toward the fulfillment of human rights. This article aims to critically examine the paradox of judicial digitalization and reconstruct the e-Court policy to align with distributive justice in the era of disruption. Employing a normative legal research methodology, this study utilizes statute and conceptual approaches, subjected to systematic analysis. The analytical framework is constructed upon Cappelletti and Garth’s third-wave Access to Justice theory and Jeremy Bentham’s utilitarianism, to evaluate whether technology-driven procedural reforms have dismantled structural barriers and maximized utility. The findings reveal that although the e-Court offers administrative efficiency, it is hindered by a digital infrastructure divide, low digital literacy, the lack of integrated civil registry data, and designs that remain inaccessible to persons with disabilities. Empirical data indicating low e-litigation adoption rates in remote areas corroborates the existence of significant access disparities. Consequently, a reconstruction of the e-Court policy is imperative, necessitating a paradigm shift from mere digital efficiency to constitutional digital justice. This reconstruction demands the strengthening of inclusive infrastructure, the harmonization of procedural laws concerning electronic evidence, the implementation of affirmative policies, and the enhancement of digital legal literacy, thereby transforming the e-Court into a robust instrument for the democratization of justice.
