Res Publica: Jurnal Hukum Kebijakan Publik is a peer-reviewed journal published by Constitutional Law Department, Faculty of Law, Universitas Sebelas Maret three times a year in April, August, and December. This Journal aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning constitutional law and democracy. It provides immediate open access to its content on the principle that making research freely available to public support a greater global exchange of knowledge. Published exclusively in English and / or Bahasa Indonesia (will be considered), the Review seeks to expand the boundaries of Indonesian legal discourses to access English-speaking contributors and readers all over the world. Novelty and recency of issues, however, is a priority in publishing. The scope of the articles published in this journal deal with a broad range of topics in the fields of constitutional law and democracy. Res Publica is an open access journal which means that all content is freely available without charge to the user or his/her institution (for libraries or individual). Penelitian ini bertujuan untuk mengidentifikasi dan menganilis implementasi dari Peraturan Walikota Semarang Nomor 8 Tahun 2022 terhadap peningkatan sistem pelayanan publik di Kota Semarang dalam reformasi birokrasi pelayanan publik. Metode penelitian yang digunakan adalah penelitian yang bersifat deskriptif dengan pendekatan perundang-undangan, konseptual. Jenis dan sumber hukum pada penelitian ini menggunakan bahan hukum primer berupa wawancara dan sekunder dengan teknik pengumpulan studi dokumen dan studi Pustaka. Teknik analisnya menggunakan teknik analisis bahan hukum dengan metode analisis kualitatif. Data dan informasi yang diperoleh dihimpun, kemudian dianalisis secara kualitatif dan hasilnya dipaparkan secara deskripsi sehingga diperoleh gambaran menyeluruh tentang permasalahan yang diteliti.Hasil penelitian ini menemukan bahwa ada peningkatan sistem pelayanan publik di Kota Semarang pasca di sahkannya Peraturan Walikota Semarang Nomor 8 Tahun 2022. Rencana Pembangunan Jangka Menengah Nasional 5 tahunan Kota Semarang ikut di perbaharui dalam Perwali Nomor 8 Tahun 2022 ini dengan tujuan memberikan pelayanan kepada masyarakat dengan maksimal. Terobosan yang menjadi sorotan utama saat ini adalah Pelayanan Akhir Pekan dan Malam hari di setiap kecamatan pada dengan durasi sebulan sekali, Program tersebut memiliki landasan hukum yang kuat serta respon publik yang sangat bagus dikarenakan masyarakat Kota Semarang dalam hal ini Kecamatan Mijen mampu mengurus administrasi dengan lebih dekat dan lebih cepat. Bagi Pemerintah Kota Semarang pemasukan daerah turut meningkat dan integrasi pelayanan publik meningkat dengan progresif.

ABSTRACTThis research describes and examines the problem, first about how to recognize local religion in post-Constitutional Court verdict No.97/PUUXIV/2016. Second, analysis of verdict of the Constitutional Court No.97/PUU - XIV/2016 on the fulfillment of human rights of followers of local religion. This research is a normative analytic and descriptive-analytical normative legal research. Secondary data types contain primary, secondary and tertiary legalmaterials. The data collection technique used is the study of literature, then the technical analysis used is the deductive method. The results of the research obtained by the author, the first verdict of the Constitutional Court No.97/PUU-XIV/2016 has been approved to significantly recognize the local religion in the legislation. Secondly, the implications of the Constitutional Court’s verdict No.97/PUU-XIV/2016 effect on the fulfillment of the rights of believers (ancestral local religion) throughout Indonesia.Keywords : MK verdict No. 97/PUU-XIV/2016; local religion; human rights.

This study analyzes and examines the mplications of canceling the authority of the judicial commission under the supervision of constitutional judges on the practice of judicial corruption in Indonesia. This research is a legal research that is of a descriptive analythical, with a legal approach and a conceptual approach. The type of data collected consists of primary legal material and secondary legal material. The data collection technique used is library research. The technical analysis used is a syllogism method that uses a deductive syllogism. The results of the study shows that the cancelling the authority of the judicial commission under the supervision of constitutional judges which is caused by Putusan MK No 005/PUU-IV/2006 and Putusan MK No 1-2/PUU-XII/2014 has caused judicial corruption in the Constitutional Court of republic Indonesia because there is no independent external organ that that can supervise the Constitutional Court Judges.

Kedudukan Presiden sebagai lembaga eksekutif dalam sistem pemerintahan presidensial memiliki tanggung jawab penuh sebagai kepala negara serta sebagai kepala pemerintahan. Hal ini tidak menutup kemungkinan bahwa Presiden maupun Wakil Presiden dapat melakukan pelanggaran hukum sehingga bisa diberhentikan pada masa jabatannya. Indonesia merupakan negara hukum. Konsekuensi sebagai negara hukum ialah harus ditegakkannya mekanisme checks and balances. Hal tersebut dapat ditunjukkan dengan adanya Mahkamah Konstitusi dalam proses pemakzulan (impeachment). Penelitian ini bertujuan untuk mengkaji eksistensi kedudukan serta peran Mahkamah Konstitusi dalam konteks pemakzulan (impeachment) Presiden dan/atau Wakil Presiden pasca amandemen UUD NRI 1945 baik secara filosofis, sosiologis, maupun yuridis. Penelitian ini merupakan penelitian hukum normative yang bersifat preskriptif dengan pendekatan konseptual. Kesimpulan dari penelitian ini menunjukkan bahwa eksistensi Mahkamah Konstitusi dalam proses pemakzulan (impeachment) di dalam UUD NRI 1945 pasca amandemen terdapat pada Pasal 7B ayat (4) dan Pasal 24C ayat (2).

ABSTRACTThis legal writing analyzes and examines the problem about the functionalization of Komisi Perlindungan Anak Indonesia (KPAI) in the protection of children’s constitutional rights. This legal writing belongs to the type of normative legal research with legislative approach, historical approach, and case approach. The legal source consist of primary legal material and secondary legal material. The technique of data collection is done by study of literature and the technical analysis is done by the syllogistic deduction method. The results showed that the KPAI in the state institutional structure acts as a supervisory institution whose purpose was not to overlap with existing state institutions. The supervisory role held by KPAI has become important because existing institutions are not able to carry out their duties properly. The implications of KPAI’s functionalization in protecting the constitutional rights of children can be seen through KPAI’s work achievements for the last 2 (two) years, namely in 2018 until 2019. Judging for these 2 (two) years, KPAI has carried out its duties well as an independent human rights enforcement supervisory institution especially children in Indonesia.Keywords : KPAI’s Position, KPAI’s Functionalization, Children’s Constitutional RightsABSTRAKPenelitian ini menganalisis dan mengkaji permasalahan mengenai fungsionalisasi Komisi Perllindungan Anak Indonesia (KPAI) dalam perlindungan hak konstitusionalanak. Penelitian ini adalah penelitian hukum normatif dengan pendekatan perundang-undangan,pendekatan sejarah, dan pendekatan kasus. Sumber hukum yang digunakan adalah bahan hukum primer dan bahan hukum sekunder. Teknik pengumpulan data yang digunakan adalah studi kepustakaan, serta dengan teknis analisis yaitu metode deduksi silogisme. Hasil dari penelitian ini menunjukan bahwa, KPAI dalam struktur kelembagaan negara berperan sebagai lembaga pengawas agar kewenangannya tidak tumpang tindih dengan lembaga negara yang telah ada sebelumnya. Peran pengawasan yang dipegang KPAI pun menjadi penting dikarenakan lembaga negara yang sudah ada tidak mampu menjalankan tugasnya dengan baik. Kinerja KPAI dalam perlindungan hak konstitusional anak kemudian dapat diukur melalui capain kerja KPAI selama 2 (dua) tahun terakhir yaitu pada tahun 2018 sampai tahun 2019. Menilik selama 2 (dua) tahun tersebut, KPAI telah melaksanakan tugasnya dengan baik sebagai lembaga independen pengawas penegakan perlindungan hak anak. This writing aims to analyze the regulation of internal supervisory functions of Constitutional Justices as an effort to realize independent judicial power and to analyze the implications of Constitutional Court Decision Number 1-2 / PUU-XII / 2014 on the implementation of supervision of Constitutional Justices.This type of research is normative legal research that is prescriptive which is using a statutory approach, case approach, historical approach and conceptual approach. Sourceof legal materials of this research were obtained from primary legal materials and secondary legal materials that relating to legal issues reviewed. Primary legal materials used in the form of legislation and judgment decisions, while the secondary legal materials used in the form of publications about the law that is not an official document. Techniques of collecting legal materials used are document studies or literature studies which are then analyzed using the deduction method.Based on the result of the research, it is concluded that the supervision of Constitutional Justice is initially in the form of internal and external supervision which arrangement based on Law Number 24 Year 2003 and Article 24B of the 1945 Constitution of the Republic of Indonesia Year 1945 which is further regulated in Law Number 22 Year 2004. The arrangement is changed due to the Decision The Constitutional Court Number 005/PUU-IV/2006 which makes internal controls the only supervisory system of Constitutional Justices, thereafter the supervision of the Constitutional Justices underwent several dynamics of change in order to establish effective oversight. In 2013 the Court experienced a tremendous crisis that resulted in the loss of public confidence. In response to that the government enacted Perpu No. 1 of 2013 which was then ratified into Law No. 4 of 2014. However, the law was revoked by the Constitutional based on the Constitutional Court’s Decision Number 1-2/PUU-XII/2014. The implication of the decision is the re-enactment of Law Number 8 Year 2011 and the supervision of Constitutional Court Justice is further stipulated in PMK Number Year 2014.

This research aims to find out a clear picture of the systematic implementation of the procurement of TKPK services, obstacles and strategies to overcome obstacles regarding the procurement of labor services with employment agreements in Surakarta City. This type of research includes descriptive research. The research approaches taken are: statute approach, case approach, historical approach, and conceptual approach. The main data collection techniques were conducted through interviews and library data collection. The results of the research include: 1) The rationale for the issuance of Surakarta Mayor Regulation number 37 of 2021 concerning Guidelines for Procurement of Labor Services with Employment Agreements is in accordance with the needs of services to the community. The implementation of Labor Procurement with Employment Agreements in Surakarta City has been carried out in accordance with the support of the PDIP faction of the Surakarta City DPRD and the Personnel and Human Resources Development Agency carries out tasks related to planning, implementation and evaluation of TKPK in Surakarta City. 2). There are several obstacles that arise in the implementation of TKPK in Surakarta City. These are found in: Regulations and Policies are considered less consistent. Local Labor Empowerment is considered less appropriate. Evaluation and continuous improvement are not implemented. Budget Management and Performance Management System. 3) The strategy implemented to overcome the obstacles in the implementation of TKPK procurement in Surakarta City is that the strategy of Clarifying Regulations and Policies consistently, managing the Budget well and collaborating with other parties as a source of TKPK budget. Hukum Tata Negara Darurat mengatur bagaimana hukum memberikan ruang bagi negara dalam menentukan kebijakan melalui instrumen hukum dalam kondisi yang mendesak, memaksa, dan telah mengganggu stabilitas negara maupun ketertiban umum. Kondisi darurat negara pada masa pandemi Covid-19, pemerintah Indonesia menggunakan instrumen Peraturan Pemerintah Pengganti Undang-Undang (Perppu). Tindakan pemerintah tersebut apakah telah berdasar pada konstitusi dan memenuhi indikator kondisi darurat akan dianalisis dalam penelitian ini. Jenis penelitian ini adalah penelitian hukum yuridis normatif. Pendekatan yang digunakan dalam penelitian ini adalah pendekatan yuridis, yakni menganalisis hakikat keadaan darurat negara (state of emergency) sebagai dasar pembentukan perppu. Bahwa ketentuan hukum yang berlaku dan mengatur mengenai keadaan bahaya atau keadaan darurat ini adalah ketentuan pasal 12 dan pasal 22 Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Pemerintah Indonesia memilih tiga pendekatan utama pemberlakuan tindakan darurat dalam penanganan Covid-19, yaitu: 1) mengandalkan ketentuan dalam konstitusi yang mengatur mengenai keadaan darurat; 2) menggunakan undang-undang yang ada untuk memberikan dasar bagi tindakan darurat atau membentuk undang-undang baru; dan 3) pendekatan yang ambigu yang tidak memiliki dasar hukum yang eksplisit, seperti tindakan eksekutif yang tidak memiliki (atau tampaknya tidak memiliki) landasan hukum yang spesifik. Penetapan status darurat bencana nasional dan status kedaruratan kesehatan masyarakat merupakan opsi yang diambil pemerintah dalam menghadapai situasi darurat pandemi Covid-19. Pemerintah cenderung melihat bencana sebagai bagian yang terpisah keadaan bahaya berdasarkan Pasal 12 UUN NRI Tahun 1945.

AbstractThis article aimed to explain and review about the legal protection of non-marital children after the Constitutional Court Decision Number 46/PUU-VIII/2010 against the Court Decision Number 109/PDT/2022/PT BTN. This article is a normative legal research. Sources of data are primary and secondary legal materials. The technique for collecting legal material is a library research. The approaches are statutory approach and conceptual approach. The legal material analysis technique uses qualitative analysis and syllogisms methodes using a deductive mindset. The result is that the legal protection of non-marital children before the Constitutional Court Decision 46/PUU-VIII/2010 was through the ratification and registration of the marital status of the child’s parents and child's birth, while after the Constitutional Court Decision Number was not based on the recording and ratification, but it has provided certainty and legal protection for non-marital children even though the validity of the marriage of the parents is still uncertain. In Court Decision Number 109/PDT/2022/PT BTN the Judge has violated and did not apply the Constitutional Court Decision according to the substance, so there is no legal certainty regarding the protection of non-marital children.AbstrakArtikel ini bertujuan untuk menjelaskan dan mengkaji terkait perlindungan hukum anak luar perkawinan pasca Putusan Mahkamah Konstitusi Nomor 46/PUU-VIII/2010 terhadap Putusan Nomor 109/PDT/2022/PT BTN. Artikel ini merupakan penelitian hukum normatif. Sumber data berupa bahan hukum primer dan sekunder. Teknik pengumpulan bahan hukum berupa teknik studi kepustakaan. Pendekatan dalam artikel ini adalah pendekatan perundang-undangan dan konseptual. Metode berpikir menggunakan analisis metode kualitatif dan penalaran (silogisme) dengan menggunakan pola pikir deduktif. Hasil dari artikel ini ialah bahwa perlindungan hukum anak luar perkawinan sebelum adanya Putusan Mahkamah Konstitusi 46/PUU-VIII/2010 ialah melalui pengesahan dan pencatatan status perkawinan orang tua dan kelahiran anak, lalu pasca Putusan Mahkamah Konstitusi Nomor bukan didasarkan pada pencatatan dan pengesahan tersebut melainkan memberikan kepastian dan perlindungan hukum bagi anak luar perkawinan walaupun keabsahan dari perkawinan orang tuanya masih belum pasti. Pada Putusan Nomor 109/PDT/2022/PT BTN hakim melanggar dan tidak menerapkan Putusan Mahkamah Konstitusi sesuai substansinya, sehingga tidak ada kepastian hukum pada perlindungan anak luar perkawinan.
