Res Publica: Jurnal Hukum Kebijakan Publik is a peer-reviewed journal published by Constitutional Law Department, Faculty of Law, Universitas Sebelas Maret three times a year in April, August, and December. This Journal aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning constitutional law and democracy. It provides immediate open access to its content on the principle that making research freely available to public support a greater global exchange of knowledge. Published exclusively in English and / or Bahasa Indonesia (will be considered), the Review seeks to expand the boundaries of Indonesian legal discourses to access English-speaking contributors and readers all over the world. Novelty and recency of issues, however, is a priority in publishing. The scope of the articles published in this journal deal with a broad range of topics in the fields of constitutional law and democracy. Abstract

This article aims to determine the tax opsen arrangement in Sukoharjo Regency. In addition, it is also to determine the impact of the tax opsen arrangement. This research uses a descriptive normative type, using secondary legal sources and primary, secondary, and tertiary legal materials. The article conducted in this writing is research on the regulation of the law by examining the laws and regulations on Tax Opsen. Tax Opsen arrangement has various impacts, including accelerating the receipt of Regional Original Revenue (PAD) in the Regency / City, Increasing Regional Independence, Increasing Revenue in the Regency / City, Increasing the Taxpayer's Burden, and Decreasing Revenue in the Province. The regulation of tax opsen in Sukoharjo Regency is contained in Sukoharjo Regency Regional Regulation Number 10 of 2023 concerning Regional Taxes and Levies, especially in Article 1, Article 2, Article 3, Article 49 to Article 53, Article 54 to Article 58, and Article 136. The Tax Opsen arrangement is actually a transfer of provincial tax revenue sharing that can increase regional independence without increasing the burden on taxpayers because it is directly recorded as Regional Original Revenue (PAD) and also supports better planning, budgeting, and realization of the APBD.

Abstract

ABSTRACTThis study aims to examine the application of affirmative action by political parties in an effort to increase women’s representation in the legislative body. The research method used is empirical juridical that is in addition to being reviewed through legislation, it is also examined about the legal facts in the field. The type of data collected includes primary and secondary legal materials. Data collection techniques are by library research, interviews, and observations. Meanwhile the data analysis technique used is the deduction method. The objects of this study were Surakarta City PDIP, Surakarta City Golkar Party, and Surakarta City PSI. From this study, it was produced that (1) Surakarta City PDIP, Surakarta City Golkar Party, and Surakarta City PSI were still less than optimal in implementing Affirmative Action to increase women’s participation in legislative institutions because of the AD ART Political Parties, work programs, political culture, and the participation of women in regional elections is still lacking. (2) the lack of political parties in implementing Affirmative Action to increase women’s participation cannot be separated from gender injustice, namely subordination, which considers male gender more capacity to be involved in politics than female gender, causing male superiority and female cadre’s lack of confidence, a double burden namely the view of the community that if women want to do politics then all forms of household affairs must continue to be carried out like being a housewife, and marginalization of women who politicize both in the internal domain of political parties and in the external domain that places women at the periphery in the sense of prioritizing all the interests of female cadres.Keywords: affirmative action; political parties; women in the legislature.

Abstract

This study describes and examines the problem regarding the customary forest was released from its status as a national forest ; as well as how is the analysis and impact after the Constitutional Court decision number 35/PUU-X/2012 in giving position and protection of customary forests. This research uses a type of doctrinal (normative) research that is prescriptive. Types and sources of legal materials include primary and secondary legal materials. The legal material collection technique used is library research. Furthermore, the legal material analysis technique used with the syllogism method uses a deductive mindset. The results of the study show that the Constitutional Court Decision Number 35/PUU-X/2012 has changed the status of customary forest from state forest to private forest to provide legal certainty and justice for customary law communities as subjects who inhabit customary forest areas. Furthermore, after the decision was made, it had an impact on the central government to implement it through the Minister of Environment and Forestry Regulation No. 32 of 2015 concerning Private Forests, and the Regional Government implements it through the preparation of Regional Regulations related to the recognition of the existence of Customary Forests and Customary Law Communities. However, the implementation has not run optimally, as evidenced by the existence of several cases of disputes over customary forests in Indonesia. Penelitian ini mendiskripsikan dan mengkaji permasalahan, pertama mengapa hutan adat dilepaskan statusnya sebagai hutan negara oleh Kedua, bagaimana analisis serta dampak pasca adanya putusan Mahkamah Konstitusi nomor 35/PUU-X/2012 dalam memberikan kedudukan dan perlindungan terhadap hutan adat. Penelitian ini menggunakan jenis penelitian doktrinal (normatif) bersifat preskriptif. Jenis dan bahan sumber bahan hukum meliputi bahan hukum primer dan sekunder. Teknik pengumpulan bahan hukum yang digunakan adalah studi kepustakaan. Selanjutnya Teknik analisis bahan hukum yang digunakan dengan metode silogisme menggunakan pola pikir deduktif. Hasil penelitian menunjukkan bahwa Putusan Mahkamah Konstitusi Nomor 35/PUU-X/2012 telah merubah status hutan adat dari hutan negara menjadi hutan hak untuk memberikan kepastian dan keadilan hukum bagi masyarakat hukum adat sebagai subjek yang mendiami kawasan hutan adat. Selanjutnya pasca ada putusan tersebut membawa dampak bagi pemerintah pusat untuk mengimplementasikannya melalui Peraturan Menteri Lingkungan Hidup dan Kehutanan No. 32 tahun 2015 tentang Hutan Hak, dan Pemerintah Daerah mengimplementasikan melalui penyusunan Peraturan Daerah terkait dengan pengakuan keberadaan Hutan Adat dan Masyarakat Hukum Adat. Namun dalam implementasinya belum berjalan dengan maksimal, dibuktikan dengan masih adanya beberapa kasus sengketan hutan adat di Indonesia.

Abstract

ABSTRACTThis study aims to determine whether the Constitutional Court Decision Number 39 / PUU-XVII / 2019 can be used as a legal basis for determining and assigning the winner of a presidential election. This research is a prescriptive normative legal research. The research approach that I use is a statutory approach with data sources obtained through primary and secondary data. Primary data were obtained from laws and rulings, while secondary data were obtained through literature studies, namely books, journals and scientific articles, legal dictionaries and materials from internet media. The data collection technique used is literature study, so that the writing of this law is then understood as writing literature, namely research on secondary data. Based on the results of this study, the authors conclude that theConstitutional Court’s decision does not yet have strong force to become the legal basis for determining the winners of the presidential and vice presidential electionsand even though the principles of justice and truth have been reached, there is no guarantee that the decision will be obeyed.Keywords: legal basis; judicial judgment; general election.

Abstract

The regional autonomy, giving authority to each region to set and managing availablity of natural resources.Through cooperation between the regions optimization the utilization of natural resources especially water to the welfare of all indonesians can be achieved .But in the fact, conflict / dispute often occur between regions caused by differences in perception/ philosophy to the utilization of natural resources itself and carefulness of local government in assessing cooperation made to rules regulations that constantly changing dynamically. Like dispute authority that occur between the Klaten district government with Surakarta government city in water resources Cokro utilization in Klaten district.

Abstract

Strengthening the role of local government in the dimension of cooperation requires the support of external parties to support the implementation of its duties and functions. This research uses a sociolegal type with a qualitative nature and approach. The types of data and data sources used are divided into primary and secondary. The results showed that the obstacles felt by the region consisted of two, first the limited budget and its absorption that had not been earmarked for pre-disaster. In addition, public awareness to love and preserve the environment also affects the formation of preparedness. Cooperation with external parties to strengthen the role of local governments can be done to overcome these obstacles, both through non-governmental organizations and between other local governments in pre-disaster activities.

Abstract

ABSTRAKPenelitian ini bertujuan untuk membahas tentang pengaturan Gerakan 2019 Ganti Presiden yang berkaitan dengan agenda Pemilihan Umum Presiden yang berlangsung setiap 5 tahun sekali di Indonesia, Untuk mengetahui apakah gerakan tersebut melanggar aturan perundang-undangan di Indonesia atau tidak. Penelitian ini merupakan penelitian hukum (yuridis) normatif, yaitu dengan mengkaji bahan-bahan pustaka (studi kepustakaan), sifat penelitian yang normatif, praktis dan preskriptif. Karena itu, data yang digunakan dalam penelitian ini adalah data sekunder, yang mencakup bahan hukum primer, sekunder, dan tersier, sumber data penelitian berasal dari beberapa bahan hukum yang relevan dengan Pemilu Presiden di Indonesia seperti Undang-Undang Nomor 42 Tahun 2008 Tentang Pemilihan Umum Presiden dan Wakil Presiden, Kitab Undang-Undang Hukum Pidana, Undang-undang Nomor 7 Tahun 2017 yang berhubungan dengan Pemilu. Dokumen tersebut akan dianalisis dan kemudian disusun secara sistematis yang pada akhirnya digunakan sebagai bahan penarikan kesimpulan, sehingga dapat menjawab permasalahan. Pendekatan penelitian menggunakan pendekatan undangundang dan pendekatan kasus. Dalam teknik pengumpulan data menggunakan teknik analisis data dengan logika deduktif, logika deduktif atau pengolahan bahan hukum dengan cara deduktif yaitu menjelaskan suatu hal yang bersifat umum kemudian menariknya menjadi kesimpulan yang lebih khusus.Kata Kunci : Gerakan 2019 Ganti Presiden, Undang-Undang Nomor 7 Tahun 2017, Pemilihan Umum, Kampanye Media Sosial.ABSTRACTThis research discusses about regulating the 2019 Movement to Change the President which discusses for the agenda of the Presidential Election which is held every 5 years in Indonesia, To study whether the movement break the regulations  in Indonesia or not. This research is a normative (juridical) legal research, namely  by examining library materials (literature studies), the normative, practical and prescriptive nature of the research. Therefore, the data used in this study are secondary data, which includes primary, secondary and tertiary legal materials, research data sources related to several legal materials that are relevant to the Presidential Election in Indonesia such as Law Number 42 Year 2008 Regarding Presidential Elections and Vice President, Criminal Law Act, Law Number 7 Year 2017 related to Elections. This document will be analyzed and finalized compiled finally used as conclusions, so as to answer questions. About research using laws and regulations. In data collection techniques using data analysis techniques with deductive logic, deductive logic or the processing of legal materials in a deductive way that is to explain a general thing and then draw more specific conclusions.

Abstract

This research examines the criteria for Law-Aware Villages/Kelurahan Sadar Hukum which are implemented based on Circular Letter of the Head of the National Law Development Agency (BPHN) Number PHN-05.HN.04.04 of 2017 concerning Changes in Criteria for Assessment of Law-Aware Villages/Kelurahan Sadar Hukum. The embryo of legal awareness comes from the community and the closest point to the community are those in villages and sub-districts. Law Conscious Villages are a manifestation of legal development directed towards a national legal system based on Pancasila and the 1945 Constitution of the Republic of Indonesia, in accordance with the ideals and objectives of the enactment of Law Number 17 of 2007 concerning the National Long-Term Development Plan 2005-2025, which is explained in the appendix at the point of realizing a democratic Indonesia based on law. Law-Aware Villages are a facilitation of the implementation of the constitutional mandate of Article 1 paragraph (3) and Article 27 paragraph (1) of the 1945 Constitution of the Republic of Indonesia. The criteria for Law Aware Villages based on the Circular Letter of the Head of the National Law Development Agency (BPHN) Number PHN-05.HN.04.04/2017 consists of the dimensions of access to legal information, legal implementation, access to justice, access to democracy and regulation. This program aims to build a culture of legal awareness in the community. The implementation of the Legal Aware Village/Kelurahan is expected to provide a realization in the national legal system in accordance with Pancasila and the 1945 Constitution of the Republic of Indonesia.

Abstract

ABSTRACTIndonesia is one of the countries that often experience child sexual abuse. The cases number significantly increase. The regulations in law Number 35 of 2014 concerning Child Protection are unable to provide a deterrent effect on perpetrators of child sexual abuse. That’s why chemical castration punishment was born. The application of this punishment becomes controversial, some people thought it was appropriate to have a deterrent effect. But on the other hand, this punishment is  considered to violate human rights. The problem in this research is: Does chemical  castration punishment for pedophiles violate human rights?  and what’s the ideal castration punishment to not to violate human rights? the research method used is normative legal research. The purpose of this study is to find out whether castration punishment violates human rights and to find out the ideal way of chemical castration punishment. The theoretical benefit of this research is to develop science, especially in human rights. while the practical benefits of this research are the consideration of the stakeholders in making government regulations related to the method of implementing castration punishment in Indonesia.Keywords  : human rights; chemical castration; sexual abuse.

Abstract

The study examines how the implementation of Law number 6 of 2014 related to the function of the Tegaltirto Village Consultative Body in forming participatory village law products in the Tegaltirto Village, as well as knowing the obstacles faced by the Tegaltirto Village Consultative Body in carrying out its function in forming participatory village law products in the Tegaltirto Village. . This legal research is in the form of a descriptive empirical legal research with a qualitative approach. Types and sources of research data used by the author are primary data and secondary data with data collection techniques through interviews, and retrieval of textual study information to assess secondary data. Then analyzed using data analysis techniques with a qualitative analysis model. The research was conducted at Tegaltirto Village, Kepanewon Berbah, Sleman Regency. The results show that in the process of forming the Kalurahan law product. The Tegaltirto Village Consultative Body is involved in the product of this Kalurahan Regulation in accordance with the statutory regulations. In carrying out its function, discuss and agree on the Draft Perkal. However, the Tegaltirto Village Consultative Body was not active in initiating the Village Head Regulation Draft. In accommodating and channeling the aspirations of the community, the Tegaltirto Urban Village Consultative Body is active in capturing aspirations and disseminating it to the community. So that the stipulated legal product has involved community participation. In carrying out its functions the Tegaltirto Village Consultative Body has experienced obstacles that they are aware of or not, namely: 1) The position of the Head of Tegaltirto Urban Village, which was vacant for one year; 2) Human resources of the Village Head Consultative Body; 3) The fee earned is too small; 4) No budget plots for absorption of community aspirations; 5) External factors lack of public knowledge about the existence of the Tegaltirto Village Consultative Body which is due to a lack of socialization regarding this matter.
