Res Publica: Jurnal Hukum Kebijakan Publik is a peer-reviewed journal published by Constitutional Law Department, Faculty of Law, Universitas Sebelas Maret three times a year in April, August, and December. This Journal aims primarily to facilitate scholarly and professional discussions over current developments on legal issues in Indonesia as well as to publish innovative legal researches concerning constitutional law and democracy. It provides immediate open access to its content on the principle that making research freely available to public support a greater global exchange of knowledge. Published exclusively in English and / or Bahasa Indonesia (will be considered), the Review seeks to expand the boundaries of Indonesian legal discourses to access English-speaking contributors and readers all over the world. Novelty and recency of issues, however, is a priority in publishing. The scope of the articles published in this journal deal with a broad range of topics in the fields of constitutional law and democracy. Abstract

This research aims to determine the implementation of protection of traditional cultural expressions by the Surakarta City Regional Government based on Law Number 28 Year of 2014 concerning on Copyright, as well as to determine the factors that can support and hinder the successful implementation of protection of traditional cultural expressions by the Surakarta City regional government. This research is empirical juridical legal research with a qualitative approach. The types and sources of legal research data used in this research are primary legal materials and secondary legal materials. Data collection carried out was interviews and literature study. The data analysis technique used is qualitative, comprehensive and complete.The result obtained from this study are that the implementation of protection by the Surakarta City regional government is not in accordance with Law Number 28 of 2014 concerning Copyright as evidenced as the implementation of Surakarta City Regional Regulation Number 4 of 2018 concerning the Promotion of Intangible Cultural Heritage by the regional government is not optimal. It was also found that the process of implementing the protection of traditional cultural expressions in the city of Surakarta was influenced by several important factors, including supporting factors and inhibiting factors for this implementation.

Abstract

This thesis  examines and describes effect of The Constitutional Court Decision Verdict No. 33/PUU-XIII/2015 concerning the restiction of political dynasty on regional chief election and whether the verdict has been appreciate with Constitution of Indonesia, UUD NRI 1945.This research is normative legal research which is descriptive. The result of this research shows that 1) the effect after constitonal court verdict No. 33/PUU-XIII/2015 resulted in article 7 letter r of Law Number 8 of 2015 having no binding legal force and having an impact of implementing regulating under it, as well as creating a conflict of interest. The implemention of regional chief election if there is a conflict of interest resulting in unequal competition, affect the accountability of local elections, political dynasty, and political corruption. However, if there are no conflict of interest, the implementation of local election run smoothly with a strict supervison of all instrumen. 2) the constitutional court verdict No. 33/PUU-XIII/2015  is not according with mandate of Constitution of Indonesia, UUD NRI 1945 Article 28J paragraph (2) and Article 18 paragraph (4) are related to improving the quality of democracy in regional elections.

Abstract

The writing of this law aims to examine the regulation of political education based on Law Number 2 of 2011 concerning Amendments to Law Number 2 of 2008 concerning Political Parties and to know the ideal and efficient arrangements of political education to prevent corrupt practices. Because one of the functions of political parties is a functions of political education so as to create popular sovereignty political parties need to carry out their functions, namely political educations. This legal research uses descriptive normative research. The approach taken is through the statutory approach and conceptual approach. Sources of legal materials consist of primary legal materials and secondary legal materials. While the legal material collection techniques used are library studies and Cyber Media and analysis of legal materials in legal research is carried out using the deduction method.

Abstract

This study aims to determine the method of constitutional interpretation used by judges in formulating the decision of the Constitutional Court Number 97 / PUU-XIV / 2016. Interpretation of the constitution means to give the meaning or meaning of a term or collection of terms, in an article or paragraph contained in the Act.This research is prescriptive, when viewed from the objectives of this study it includes normative or doctrinal legal research. Sources of legal materials used in this study are primary legal materials, secondary legal materials and non-legal materials. Data collection techniques used are the study of documents or library materials. The data analysis technique used is deductive.The results showed that the type of constitutional interpretation used by the judge in interpreting the decision of the Constitutional Court Number 97 / PUU-XIV / 2016 related to the inclusion of a flow of trust in the Identity Card and Family Card, namely using the interpretation of originalism, namely textual interpretation.

Abstract

This research focuses on the executive preview authority carried out by the Regional Office of the Ministry of Law and Human Rights (Kanwil Kemenkumham) in the process of forming Regional Regulations (Perda/Perkada). The objectives of this study are, firstly, to understand the implementation of the executive preview authority in Perda/Perkada. Secondly, to identify the obstacles encountered in its implementation process. The research method employed is empirical legal research, using the Sociology of Law approach and qualitative in nature. Legal materials were collected by conducting field research at the Kanwil Kemenkumham Central Java and studying literature analyzed qualitatively. The results of this study indicate that: Firstly, the implementation of the executive preview authority conducted at the Kanwil Kemenkumham Central Java goes through these stages: submission of harmonization requests, administrative examination, conceptual analysis, harmonization meeting, preparation of harmonization minutes, approval endorsement, submission of harmonization completion letters. However, this process has not been ideally executed as not all regions conduct executive previews despite the Legal Regulations stating it is mandatory, yet there are no sanctions when regions fail to follow the process. Secondly, obstacles found in the implementation of the executive preview include the lack of Human Resources in Regulation Drafting, the weakness of executive preview authority in legal regulations, and the lack of regional understanding of the administrative document requirements that should be fulfilled before submitting harmonization requests.

Abstract

Democracy guarantees basic human rights, such as the right to life, the right to form political parties, and the right to be elected and to vote in general elections, because with democracy, the basic rights of every human being are guaranteed, creating equality for all citizens without any differences, especially people with disabilities. The purpose of this paper is to analyze the fulfillment of representation of persons with disabilities in the House of Representatives and to find out the ideal construction in building political representation for persons with disabilities. This type of legal research is normative legal research or doctrinal research, which is research based on reading legal materials and primary and secondary legal studies. This research reveals that there are obstacles and constraints for persons with disabilities to be able to have representation in the DPR, these obstacles are in the form of obstacles to the electoral system, parties, campaign systems, and election financing for persons with disabilities. Accessibility of political rights for persons with disabilities still cannot be fulfilled properly. As well as revealing that there is a need for ideal legal construction in building representation of persons with disabilities. Legal construction can be in the form of an affirmation policy for persons with disabilities. Because the state provides equal opportunities in government. With this legal construction, it is hoped that the political representation of persons with disabilities in the DPR will be achieved.

Abstract

This article examines how the implementation of the functions of the Village Consultative Body (BPD) of Tanjungsari Village in the formation of village regulations in Tanjungsari Village, Gunungtanjung District, Tasikmalaya Regency. This article is compiled based on descriptive empirical legal research with a qualitative approach, the types and sources of research data used are primary data and secondary data, with data collection techniques through interviews, questionnaires and textual study information retrieval to assess secondary data, then further analyzed. using data analysis techniques with a qualitative analysis model. The results show that the BPD of Tanjungsari Village when carrying out its function in the formation of village regulations has not played its role optimally in one of the stages of forming village regulations, where the role of the Tanjungsari Village BPD is at the discussion stage of the village regulation draft which should discuss and agree on the village regulation draft, BPD Desa Tanjungsari only agreed on the final result and did not participate in discussing it, then the BPD of Tanjungsari Village also did not do much in terms of channeling the aspirations of the community towards the Tanjungsari Village Government which led to a mutual agreement between the Tanjungsari Village Government and the BPD of Tanjungsari Village in forming village regulations to be inconsistent with aspirations the people. This happens because there are still several factors that hinder the implementation of the functions of the BPD of Tanjungsari Village in the formation of village regulations including, first communication, second inadequate resources, the third disposition, in this case the attitude or character of the Tanjungsari Village BPD leadership and the four bureaucratic structures that have not yet been implemented well.

Abstract

Penelitian ini bertujuan untuk menganalisis mengenai perbandingan didalam pengoptimalan fungsi Badan Permusyawaratan Desa dan faktor yang menghambat terlaksananya fungsi secara optimal di Desa Rejosari dengan Desa Kemasan, Kecamatan Polokarto, Kabupaten Sukoharjo. Penelitian ini merupakan penelitian hukum empiris dengan pendekatan kualitatif. Bahan hukum yang digunakan berupa Bahan hukum primer terdiri dari perUndang-Undangan, catatan-catatan resmi atau risalah dalam pembuatan perUndang-Undangan. Bahan hukum sekunder yang digunakan dalam penulisan hukum ini antara lain meliputi buku- buku teks, internet, artikel ilmiah, jurnal hukum, yang berkaitan dengan permasalahan yang diteliti. Teknik pengumpulan data dengan melakukan wawancara dan studi kepustakaan. Teknik analisis data dalam penelitian ini menggunakan analisis data kualitatif dimana menggunakan tiga teknik yaitu reduksi data, penyajian, dan kesimpulan. Hasil daripada penelitian ini menunjukan analisis bahwa pelaksanaan fungsi legislasi, fungsi menampung aspirasi, dan fungsi pengawasan di kedua desa sudah berjalan cukup optimal dengan proses yang hampir sama. Faktor yang menghambat pengoptimalan fungsi Badan Permusyawaratan Desa di Desa Rejosari dan Desa Kemasan terdapat perbedaan.

Abstract

The Yogyakarta Local Regulation No. 1 Of 2014 is about the handling of homeless and beggars by Social Service Department, Manpower, and Transmigration Department and Public Order Department. The aim of this research is to discover the implementation of Yogyakarta Local Regulation about the handling of homeless and beggars. This journal employs qualitative descriptive approach. The data were collected by field study and case study methods to gain primary and secondary data. The result of the research shows that the implementation of homeless and beggars is done by two steps, controling step and handling step. The controling step is handled by Public Order Department of Yogyakarta. The handling step is handled by Social Service Department, Manpower, and Transmigration Department that consist of represive, coercive, rehabilitation, and social reintegration eforts.

Abstract

ABSTRACTThe President has stated his intention to move the nation’s capital city (capital city or state capital) from Jakarta to Kalimantan. The idea arises because the president wants to implement the equitable distribution of national development. Jakarta is, by law, the legal capital city of Indonesia in accordance with Law No. 29 of 2007. However, regulations regarding the relocation of state capital have not been clearly regulated in Indonesian law. In connection with the plan, problems arose regarding the presidential authority to relocate the state capital. The problem in this study emphasizes on: how is the presidential authority in moving the state capital? Why should the capital move? The research method used is normative legal research that is qualitative in nature. The purpose of this research is to find out whether the relocation of the state capital by the president is in accordance with the applicable legal rules and to know the relocation factors of the state capital. The theoretical benefit of this research is for the development of science, especially in respect of the presidential authority. While the practical benefits of this research are to serve as the consideration of the stakeholders in the lawmaking process related to the relocation of the state capital in Indonesia.
