Abstract

Marriage is a contract that allows men and women to work together in accordance with their natural inclinations and creates a reciprocal relationship between rights and obligations. Based on this background, the criteria for selecting guardians for minors who are not subject to parental authority and the responsibility of guardians for the sale of the inheritance of children under their supervision are articulated as problems. This research uses normative legal research methodology. Normative legal research is the study of secondary sources of information in the field of law. that the state has defended the rights of children, especially with regard to inheritance. If one of the parents of a child dies when the child is still an adult, the child automatically takes on the role of guardian, including the authority to sell movable and immovable property belonging to the child with due regard to the law. Because the child is cared for by his or her own parents, the child's rights are protected and their future is secured because the longest living parent is still present and responsible.

Abstract

Health, as a human right and an essential component of well-being, needs to be realized in accordance with Indonesia's national goals. The evolution of knowledge and technology in the healthcare sector has made tremendous progress, providing the foundation for the emergence of various online health Platforms, also known as Telemedicine. The obstacles that arise along with the growth of online health Platforms in Indonesia are related to the provision of digital health services, which can open up opportunities for errors in the diagnosis process and harm Telemedicine users as patients. The formulation of the problem given is 1). How is the legal regulation of medical practice on Telemedicine Platforms in Indonesia and 2). What are the sanctions for Telemedicine Platforms due to losses suffered by patients?.

Abstract

A will or testament is a document that records a person's wishes regarding what they want to happen after death, and the document can be revoked by the maker in accordance with the provisions of Article 875 of the Civil Code. As a notary, his/her duty is to create an official document that has greater legal force than a document created without the signature of an authorized party. In creating a testament deed, a notary has specific responsibilities related to reporting the will as stipulated in Article 16 paragraph (1) letters i and j of UUJN-P. However, if a notary does not register a deed of testament, the consequence is the downgrading of the document's status to an underhand deed. This could potentially lead to the invalidation or invalidity of the document as evidence made by the notary. This research uses a normative method with a statutory approach and concludes that the non-registration and online reporting of a deed of testament to the Central Register of Testaments by a notary can result in the downgrading of its status to an underhand deed, threatening the validity of the document created by the notary.

Abstract

The advancement of the tourism sector in Bali has caused many foreign tourists to want to visit Bali. The surge in the need for vehicles for traveling has led to motorcycle rentals in the Badung Regency area. This study attempts to find out the responsibility of foreign nationals in the event of damage to motorized vehicles and to find out how efforts are made to deal with damage to motorized vehicles in Badung Regency.  The results of the study prove that the responsibility of the renter in the event of damage to the motor vehicle in a written or oral agreement. In the lease agreement that has been mutually agreed upon if there is damage to the tenant is obliged to compensate for the losses experienced. Both parties must pay more attention to the clauses of the agreement to be agreed upon, especially in the event of damage to the motorized vehicle, so that a written agreement is made and there is no more oral agreement. Not only that, the renter is expected to read and master the contents of the agreement, as a result there is no negligence that can lead to losses for the renting party or motorcycle rental.

Abstract

The rapid advancement of technology has made the task of booking hotel tickets easier for the public. The problem discussed in this research is the case of losses suffered by consumers due to the cancellation of onl reservations made by business actors. This is stated as a problem of default which is a condition of non-fulfillment of achievements or obligations in an agreement. This research is conducted to find out the validity, and the timing of an online hotel booking transaction agreement, especially hotels in Bali. The research method uses normative legal research that examines the problems of legal regulation or legal norm. The result of the research is that consumers have received compensation due to the cancellation of hotel reservations made by business actors. In the Civil Code, it is formulated that negligence in an agreement can be concluded as a default, which is an unlawful act in various forms of default against every obligation imposed in every provision of the applicable law. For the government, the hotel and consumers must have insight into the requirements that apply in the Law regarding default issues in online hotel bookings.

Abstract

Legal protection related to personal data has been legalized but raises norms of vagueness. So the formulation of the problem, 1) How is the security arrangement of population administration data according to law number 27 of 2022 concerning personal data protection? and 2) How is the form of legal protection for the theft of population administration data in Indonesia. Using normative research methods. The results showed that the Personal Data Protection Law is still not maximized in its application, so it is still multi-interpretive in article 67 paragraph (2). The lack of clarity of the phrase "against the law" does not provide definite limits and understanding of each element in detail. The article will have a multi-interpretive impact in its application, which is vulnerable to abuse, for the purpose of criminalizing others. Factors that encourage the occurrence of criminal acts of data theft cases, ranging from factors of law enforcement officials, security, and official laws to the lack of knowledge of the law from the public in Indonesia, which is the strongest cause of criminal acts of personal data theft.

Abstract

The existence of skincare products as a necessity is in great demand by the public, but the existence of this online media problems can arise because they do not care about the ingredients in skincare products such as ingredients exceeding the standard, namely mercury can damage skin cells. The formulation of this problem, 1) How is the legal regulation of business actors who use chemicals exceeding standards in skincare products to avoid harm to consumers in Indonesia? and 2) How is legal responsibility for business actors who use chemicals exceeding standards in skincare products that harm consumers in Indonesia? This research uses normative legal research and doctrinal law as well as statutory and conceptual approaches. The conclusion of this study is that the legal regulation of Article 4 letter c, Article 7 letter a, d, Article 8 paragraph (1) of the GCPL Law, Article 196 of the Health Law and Article 8 of BPOM Regulation No. 17 of 2022. The legal responsibility is based on Article 19 of the GCPL. Suggestions to the government should better supervise the circulation of skincare products that use chemicals that exceed the standard because if more and more circulate, consumers will be harmed.

Abstract

Immoral acts by foreigners in tourist destinations must receive sanctions based on regulations in the Criminal Code and sanctions based on customary law. The problem is, 1) what are the legal regulations for foreigners who commit immoral acts in tourist destinations? and 2) How the judge considered decision Number 66/Pid.B/2021/PN. Sgr about immoral crimes committed by foreigners in tourist destinations? This research describes the legal regulations and considerations of judges in deciding cases of acts of decency by foreign citizens in tourist destinations. This research uses deductive legal logic which is analyzed descriptively through a statute approach, conceptual approach and case approach. This research shows that the legal regulations for foreigners who carry out decency acts in tourist destinations are part of the regulations for decency acts in the Criminal Code and customary law. The judge's decision considerations are based on legal and non-legal factors. The relationship between the two lies in the application of criminal sanctions and the judge's consideration in making a decision.

Abstract

Dwangsom is defined as an additional penalty imposed by the judge on the defendant (convicted) to pay a sum of money to the plaintiff with the aim that the defendant (convicted) is willing to fulfill the main sentence imposed by the judge voluntarily within a predetermined time. The problem formulations raised in this paper are (1) How is the application of dwangsom to the judge's decision at the Denpasar Religious Court, and (2) How are the obstacles to the application of dwangsom to defendants who are unable to carry out the decision (economic incapacity). The research method used is an empirical research method. Forced money is regulated in 606a BRV and 606b BRV, in its application forced money in Indonesia has been applied properly according to the Law on the application of forced money (dwangsom), although forced money has been implemented properly but there are still some technical obstacles, which need to be resolved.

Abstract

Illegal importation of used clothing is a common practice in Indonesia. It is not uncommon for used clothing that has been illegally imported to be traded freely. The problems discussed in this study are 1) the legal regulation of imported used clothing according to Law Number 7 of 2014 and 2) the role of the government in overcoming the phenomenon of illegally imported used clothing that is freely traded in Indonesia?. The research method used is normative juridical research method through literature study. The legal materials used are primary legal materials and secondary legal materials. The results of the study stated. Legal arrangements for imported used clothing have been explicitly explained through Article 47 paragraph 1 of Law Number 7 of 2014 concerning trade. The role of the government in overcoming the phenomenon of illegal imports of used clothing that is freely traded in Indonesia is realized through supervisory efforts with the formation of regulations of Law Number 7 of 2014 and enforcement efforts through sanctions against illegal importers and used clothing business actors in Indonesia.
