Abstract

This study examines musyawarah (deliberation) as a fundamental value deeply embedded in the social, political, and cultural life of Indonesian society, and analyzes its relevance from both Islamic perspectives and Dayak customary traditions. The objectives of this research are to explore the concept of musyawarah based on key Qur’anic verses Ali Imran 159, Ash-Shura 38, and Al-Baqarah 233 and to investigate musdat, the Dayak traditional deliberation system. This research employs a qualitative descriptive approach using content analysis of classical and contemporary Qur’anic exegesis, supported by anthropological literature on Dayak customary law. The findings demonstrate that the Islamic principle of syûrâ emphasizes compassion, dialogue, and collective wisdom in decision-making, while musdat reflects a restorative, consensus-based conflict resolution model centered on communal harmony. The study reveals strong normative and cultural coherence between syûrâ and musdat, showing that deliberation is not only a theological principle but also a deeply rooted local practice within Indonesian indigenous communities. These findings imply that integrating religious and local wisdom can contribute to the development of culturally grounded and socially responsive conflict resolution frameworks in multicultural societies such as Indonesia.

Abstract

: This article discusses the theory of i‘jāz al-Qur’an (the inimitability of the Qur’an) and the critiques offered by Muslim scholars toward various interpretations of it. The Qur’an, as the eternal miracle of the Prophet Muhammad (peace be upon him), possesses an unmatched uniqueness in terms of language, structure, and meaning. Throughout Islamic intellectual history, scholars have provided diverse explanations regarding the essence of this miraculous nature. Some emphasized the rhetorical beauty and linguistic structure of the Qur’an, while others focused on its profound meanings and universal truths. This study also examines criticisms of specific theories such as al-sarfah, proposed by certain Mu‘tazilite scholars, which are considered to diminish the true miraculous quality of the Qur’an. Using a qualitative, library-based analytical approach, this article concludes that the inimitability of the Qur’an lies in the perfect harmony of its eloquence, depth of meaning, and timeless truth.

Abstract

Practical examinations are essential components of the Islamic boarding school system as they assess students cognitive, psychomotor, and affective competencies in an integrated manner. This study aims to describe the implementation of practical exams at Pusat Pendidikan Islam Muharrikunajah (PPIMN) and identify the supporting and inhibiting factors. A descriptive qualitative method was used involving four examiners responsible for tahfidz, Arabic, fiqh, and English subjects. Data were collected through semi-structured interviews and documentation of assessment rubrics, then analyzed using the Miles and Huberman interactive model consisting of data reduction, data display, and conclusion drawing. The findings indicate that the practical exams were generally conducted effectively, yet several obstacles occurred such as insufficient early socialization, sudden policy changes, low motivation among final-year students, and the absence of standardized assessment rubrics across subjects. These findings highlight the need for strengthened planning, standardized instruments, and improved coordination among stakeholders. The study recommends developing an official guideline for practical examinations and providing examiner training to enhance objectivity and consistency of assessment.

Abstract

This study examines the interpretation of purification (taharah) verses in the Qur’an, specifically Surah an-Nisa’ verse 43 and Surah al-Ma’idah verse 6, which constitute the fundamental textual basis for Islamic jurisprudence on ritual purity. The scope of this research focuses on the interpretation of these verses by classical and contemporary mufassirs and their implications for Islamic legal rulings related to wudu’, ghusl, and tayammum. The objective of this study is to analyze the similarities and differences in the exegetical approaches to both verses and to identify their contributions to the formulation of fiqh al-taharah. This research employs a qualitative library research method using a descriptive-analytical approach, drawing on primary sources of Qur’anic exegesis and fiqh literature. The findings indicate that QS. al-Ma’idah:6 provides a more systematic and detailed legal formulation of purification rules, while QS. an-Nisa’:43 emphasizes contextual conditions and concessions in worship. The study concludes that both verses are complementary and together form a comprehensive framework for understanding purification in Islam, both normatively and practically.

Abstract

: In Islamic law, polygamy is not an absolute obligation or recommendation, but rather a dispensation (rukhsah) that is strictly regulated, with the primary condition being the ability to act justly. This article discusses polygamy from the perspective of Islamic legal philosophy by examining its normative basis in the Qur'an, specifically QS. An-Nisa: 3, which permits polygamy with up to four wives, emphasizing justice. The context of the revelation of this verse relates to the protection of the rights of orphans and widows after war. Analysis shows that although permitted, polygamy in practice often struggles to fulfill the essential condition of true justice, as affirmed in QS. An-Nisa: 129. The ruling on polygamy is conditional and must align with Maqāṣid al-Sharī'ah, which are to preserve the interests of religion, life, intellect, lineage, and property. In a contemporary context, polygamy tends to produce negative effects such as family conflict and injustice if not practiced with full responsibility. Therefore, polygamy should be understood as a limited option that may only be implemented when it truly fulfills the principles of justice and benefit.

Abstract

This study aims to comprehensively analyze the challenges, opportunities, and adaptation strategies of Shariah entrepreneurship in responding to global market dynamics and the development of the Industrial Revolution 4.0. The increasing global awareness of the halal lifestyle has positioned Shariah entrepreneurship as a sector with significant growth potential. However, Shariah-based business actors continue to face fundamental challenges, including the complexity of cross-border halal certification processes, low levels of Islamic financial literacy, limited access to capital, and the suboptimal utilization of digital technology. On the other hand, technological advancements such as blockchain, big data, and Islamic fintech present substantial opportunities to create a more transparent, efficient, inclusive, and accountable business ecosystem. This study concludes that the key to the future success of Shariah entrepreneurship lies in the synergy between the implementation of Islamic ethical values grounded in Maqasid Shariah and digital technological innovation. Adaptation strategies through the digitalization of the halal supply chain, enhancement of digital literacy, and the strengthening of ethics-based universal branding are crucial steps to enable Shariah entrepreneurs to compete in international markets while contributing meaningfully to economic development and societal well-being.

Abstract

The tradition of tahlilan, particularly the practice of commemorating the 100th day after death, is a living phenomenon in Indonesian Muslim communities. This ritual is seen as a form of respect for the deceased as well as a means of strengthening social solidarity, but it has been criticized by some Islamic legal scholars because there is no direct recommendation for it in the texts of the Qur'an and Hadith. This study attempts to reinterpret the 100-day tahlilan practice from the perspective of contemporary Islamic legal thought, by examining the position of this tradition in classical Islamic law, contemporary responses to it, and the important role of the concepts of 'urf, bid'ah, and maqāṣid al-sharī'ah in determining the legitimacy of this practice. Using a normative-empirical qualitative approach, the study finds that tahlilan is strongly rooted as 'urf shahih in society as long as it does not conflict with sharia, and can be reviewed through the maqāṣid approach to develop accommodative contemporary ijtihad. These findings highlight the urgency of contemporary Islamic legal thought that is contextual and inclusive of local traditions within the framework of sharia.

Abstract

Evaluation of cognitive learning outcomes in hadith instruction at madrasahs often fails to reflect students’ deep understanding, even when high scores are obtained through objective tests. This study aims to compare the effectiveness of essay tests and objective tests in measuring the cognitive abilities of Grade X students at Madrasah Aliyah Muharrikunnajaah. The research subjects consisted of 55 students (24 students from class X-A and 31 students from class X-B), selected through saturated sampling from the entire Grade X population, with characteristics of ages 15–17 years, male, and coming from a single Islamic boarding school–based institution. The study employed a quantitative comparative approach, with data collected through observation, interviews, and analysis of test documents, and data analysis conducted using descriptive statistics to compare mean scores, variability, and score distributions. The results show that essay tests are more effective in measuring deep understanding (mean scores of 86.21 in class X-A and 85.63 in class X-B), while objective tests are more efficient for uniform measurement (mean scores of 84.04 in class X-A and 82.22 in class X-B), with significant variation among students. The study concludes that a combination of both instruments is necessary for comprehensive evaluation, with practical implications for madrasah teachers in improving the quality of hadith instruction in accordance with 21st-century curriculum demands.

Abstract

This study explores the intersection between Islamic law and human rights in the context of national law in Indonesia. The main focus of this study is to analyze how the concept of Maqashid al-Syari'ah functions as a theological basis for protecting basic human rights. Using normative legal research methods with a conceptual and philosophical approach, this study examines classical Islamic literature and Indonesian positive legal instruments. The results show significant harmony between the five universal principles of Islam (al-kulliyāt al-khams) and Articles 28A-J of the 1945 Constitution, covering the protection of life, religion, reason, lineage, and property. The practical implementation can be seen in the role of zakat in economic justice and the contribution of the Religious Courts in protecting the rights of women and children. However, challenges in the form of interpretative tensions regarding minority rights are still found in the field. This paper concludes that wise harmonization between Islamic law and national law is crucial to strengthening pluralism and inclusive human rights protection in Indonesia.
