Abstract

This study  discusses  the  implementation of the  determination of Integrated  Marriage  of The  formulation of this research  are:  Firstly, how  is the society’s response to the enactment of Government Regulation  No. 19 of 2015  on Non-Tax State  Revenue in the  Ministry of Religious Affairs? Second, what  factors cause  the  community to carry out  marriage  in the Central  Marriage on KUA Kecamatan Ratu Agung?The  type of this research  is descriptive  research  with sociological juridical approach. Data collection using interview technique, observation, documentation. This study concludes  that: Firstly, the public welcomes  a positive response to the enactment of Government Regulation  No. 19 of 2015.  The regulation  is considered as the government’s new breakthrough to discipline the marriage  cost so as to minimize illegal levies. In addition, people  with limited economic ability who want to get married  is greatly helped  by the existence  of this provision.  If previously the cost of marriage is felt by them is quite high, with this provision they can perform the marriage  for free with the condition must be implemented in the Office of Religious Affairs and  at work hours.  Of course  this gets a positive response from the community, because it is very helpful especially for the middle to lower society. Secondly,  the factors that cause  the community to carry out marriage  in the marriage  hall at the Office of Religious Affairs of Ratu Agung District are economic factors and  work permits.  In general, informants  stated  that getting married  in the Office of Religious Affairs without  cost so as to ease  the financial burden. Abstract

Abstract: The research method used in this study is qualitative (field research). The data collection instruments employed include observation, interviews, and documentation. The types and sources of data used are primary and secondary data. The data analysis techniques applied consist of data collection, data reduction, data display, conclusion drawing, and data verification. The results of the study indicate that the implementation of the Mayah Nagehi customary sanction for individuals who become pregnant outside of marriage is a form of punishment for those who violate religious norms and customary laws in Sibak Village, Ipuh District, Mukomuko Regency. The imposed sanction includes one goat that meets specific requirements, an adequate amount of rice for the traditional prayer ceremony, and all other necessities for the implementation of the customary sanction, such as cooking spices, cooking utensils, and other food ingredients. All of these are arranged by the head cook according to the required quantity and needs. Once the food is prepared, the traditional leaders, village head and officials, imam, head of the Village Consultative Body (BPD), and other customary invitees will partake in the communal meal. From the perspective of ‘urf, this sanction can be classified as al-‘adah al-shahihah (a valid, proper, and good custom), as it aims to deter the offender and preserve communal welfare.Keywords: Tradition, Sanction, Premarital Pregnancy, ‘Urf. Abstrak: Metode penelitian yang digunakan dalam penelitian ini adalah metode kualitatif (field research). Instrumen pengumpulan data yang digunakan meliputi observasi, wawancara, dan dokumentasi. Jenis dan sumber data yang digunakan adalah data primer dan sekunder. Teknik analisis data yang digunakan meliputi pengumpulan data, reduksi data, display (penyajian data), penarikan kesimpulan, dan verifikasi data. Hasil penelitian menunjukkan bahwa pelaksanaan sanksi adat Mayah Nagehi terhadap pelaku hamil di luar pernikahan merupakan bentuk hukuman bagi masyarakat yang telah melanggar norma agama dan hukum adat di Desa Sibak, Kecamatan Ipuh, Kabupaten Mukomuko. Sanksi yang dibebankan berupa satu ekor kambing dengan syarat tertentu, beras secukupnya untuk keperluan acara doa adat, serta seluruh perlengkapan pelaksanaan sanksi adat lainnya seperti bumbu masak, peralatan masak, dan bahan makanan lainnya. Semua kebutuhan tersebut diatur oleh ketua juru masak sesuai dengan jumlah dan keperluan yang diperlukan. Setelah hidangan tersebut siap, para pemangku adat, kepala desa beserta perangkatnya, imam, ketua BPD, dan undangan adat lainnya akan menyantap hidangan tersebut bersama-sama. Dalam perspektif ‘urf, sanksi ini dapat dikategorikan sebagai al-‘adah al-shahihah (adat yang sahih, benar, dan baik), karena bertujuan memberikan efek jera kepada pelaku serta menjaga kemaslahatan umat.Kata Kunci: Tradisi, Sanksi, Nikah Hamil, ‘Urf.

Abstract

Abstract: The formulations of the research problems are: (1) How is the strategy of the lecturers of Islamic counseling study program in Bengkulu in forming a Sakinah family? (2) How is the understanding of the lecturer in Islamic counseling study program in forming a Sakinah family? (3) What are the tricks of the Islamic counseling guidance study program lecturers in Bengkulu?. This study uses a type of field research with a qualitative descriptive approach. Research data were collected using observation, interview and documentation methods. The data collected from these techniques were analyzed using data reduction, data presentation and data verification. The validity of the data was obtained by using data truangulasi. The results of this study indicate that: 1) the strategy of the lecturer in Islamic counseling study program in Iain Bengkulu is by husband and wife to understand each other, to understand each other’s rights and obligations of husband and wife, by knowing things starting from educating children, financial management and most importantly communication.2) The understanding according to some lecturers about the sakinah family is that it can provide psychological calm where both husband and wife both have roles to complement each other where if there is a problem in the family one of them relents, and if one is angry one forgives, because the house a harmonious ladder in which there is comfort, tranquility, serenity and even the main communication. 3) The tricks of the BKI Study Program lecturers in forming a sakinah family, namely: The first is to maintain communication because communication is one way of making a sakinah family by when there is a problem, solve it immediately, do not drag on, pray for the family (husband and children), understand each other and fulfills 3 things, namely the eyes, stomach, under the stomach. Abstrak: Rumusan masalah penelitian ini ada adalah : (1) Bagaimana strategi dosen prodi bimbingan konseling Islam di IAIN Bengkulu dalam membentuk keluarga sakinah ? (2) Bagaimana pemahaman dosen prodi bimbingan konseling Islam dalam membentuk keluarga sakinah ? (3) Bagaimana Trik-Trik dosen prodi bimbingan konseling Islam di IAIN Bengkulu ?. Penelitian ini menggunakan jenis penelitian lapangan dengan pendekatan deskriptif kualitatif. Data-data penelitian dikumpulkan dengan menggunakan metode observasi, wawancara dan dokumentasi. Data yang terkumpul dari teknik tersebut dianalisis dengan menggunakan reduksi data, penyajian data dan verivikasi data. Keabsahan data diperoleh dengan menggunakan truangulasi data. Hasil penelitian ini menunjukkan bahwa : 1) Strategi dosen prodi bimbingan konseling Islam di IAIN Bengkulu ialah dengan suami istri saling memahami, mengerti satu sama lain hak dan kewajiban suami istri, dengan mengetahui hal dimulai mendidik anak, manajamen keuangan dan paling penting komunikasi. 2) Pemahaman menurut beberapa dosen tentang keluarga sakinah ialah bisa memberikan ketenangan secara psikologis yang mana baik suami dan istri keduanya memiliki peran saling melengkapi satu sama lain dimana jika ada masalah dalam keluarga maka salah satu mengalah, dan jika salah satu marah satu memaafkan, karena rumah tangga harmonis yang mana didalamnya terdapat kenyamanan, ketentraman, ketenangan bahkan komunikasi yang utama. 3) Trik-trik dosen prodi bimbingan konseling Islam dalam membentuk keluarga sakinah, yaitu : Yang pertama menjaga komunikasi karena komunikasi merupakan salah satu cara menjadikan keluarga sakinah dengan ketika ada masalah selesaikan segera jangan berlarut, mendoakan keluarga (suami dan anak), saling memahami satu sama lain dan memenuhi 3 hal yaitu mata, perut, dibawah perut. Abstract

The custom is the code  of conduct in life that includes real aspect that has  been set as custom wedding, this research is the  study  of shapes of marriage beleket (mating  honest) Rejang  Rejang  Lebong  in customs. In this study researchers using this type of research libraries  (Library Research). I.e. using techniques of data  collection undertaken by way of reading  and  reviewing  some literature  or books  as well as legislation  relating to problems in thorough, as for activities conducted in the analysis  of the data,  namely:  1. Looking for books  to find understanding and  laws regulating marriage beleket (mating  honest) custom Rejang. 2. Choose  the verses  of Qur’an and  Hadith about  marriage as well as books  of Fiqh related. 3. create a systematic verses  of Qur’an and  Hadith  and  Fiqh books.  4. The Data obtained in the analysis  of inductive  qualitative  basis.The results  of this research indicate that: 1. marriage beleket/honest is a form of marriage in the family requires the Rejang, bid pay money  to be honest or to the girl leket and in mating beleket/jujurnya big money  this honest and  much more  cakkercik (besides money). honest marriage is a form  of marriage eksogami, children  then  enter  klen or bloodlines father, because marriage is a marriage that ensured beleket bloodlines patrlineal.2. in the the purpose of Marriage beleket is equal  to marriage in accordance with the concept of marriage in Islam i.e. marriage must be Sekufu described in the Qur’an in Sura An Nur, verse 26 An Nur, verse 3 and Al Hujurat verse 13. In the procession of honest marriage/marriage beleket Rejang Rejang Lebong in customs were in accordance with the marriage in Islam and  not against  syari ‘, but with a result of beleket in the form of marriage gitie tikea (replace the mat)  should be abandoned because it is in the form of the larger tikea gitie mafsadahnya from on maslahah obtained, according to the word of God Saw in Qur’an Sura Al-Baqarah verse and Hadith the Messenger of Almighty, 234. In fostering  domestic life forms indigenous beleket Rejang marriage greater  mafsadahnya of maslahah in accordance with the Quran,  Hadith, Fiqh rules, so that the form of the marriage custom of the Rejang beleket called ‘urf fasid is incompatible with the Islamic Sharia’. Abstract

Abstracts: The marriage age stipulated in Law No. 16 of 2019 as an amendment to Law No. 1 of 1974 concerning Marriage has provided significant benefits, where previously it was set at 16 years for women and 19 years for men, now it has changed to 19 years for men and 16 years for women. This change deserves recognition because the results of the struggle to revise Law No. 1 of 1974 have been approved by the Constitutional Court. The age provisions stipulated by the Constitutional Court, namely 19 years for men, are considered to reflect maturity in attitude, ability to act, and responsibility for the actions taken. Meanwhile, women who are 19 years old are considered adults and able to live a household life. When viewed from the perspective of the maslahah mursalah theory, this is related to the four main elements protected by religion, which are the initial objectives of legal syari'at. The four elements are the maintenance of offspring, soul, mind, and property in the context of the family. The issue regarding the minimum age limit for marriage is an area of ijtihadiyah which is always open to change in line with developments in conditions, society, time and place which require adjustment.Keywords: Transformation, Age of Marriage, Maslahah Mursalah Abstrak : Usia pernikahan yang diatur dalam Undang-Undang No 16 Tahun 2019 sebagai amandemen dari Undang-Undang No 1 Tahun 1974 tentang Perkawinan telah memberikan manfaat yang signifikan, di mana sebelumnya ditetapkan 16 tahun untuk perempuan dan 19 tahun untuk laki-laki, kini berubah menjadi 19 tahun untuk laki-laki dan 16 tahun untuk perempuan. Perubahan ini patut mendapat pengakuan karena hasil perjuangan untuk merevisi Undang-Undang No 1 Tahun 1974 telah disetujui oleh Mahkamah Konstitusi. Ketentuan usia yang ditetapkan oleh Mahkamah Konstitusi, yaitu 19 tahun untuk laki-laki, dianggap mencerminkan kematangan dalam sikap, kemampuan bertindak, serta tanggung jawab atas tindakan yang diambil. Sementara itu, perempuan yang berusia 19 tahun dianggap sudah dewasa dan mampu menjalani kehidupan rumah tangga. Jika dilihat dari perspektif teori maslahah mursalah, hal ini berkaitan dengan empat unsur utama yang dilindungi oleh agama, yang menjadi tujuan awal pensyari’atan hukum. Keempat unsur tersebut adalah pemeliharaan keturunan, jiwa, akal, dan harta dalam konteks keluarga. Isu mengenai batas minimal usia untuk menikah ini merupakan ranah ijtihadiyah yang selalu terbuka untuk perubahan seiring dengan perkembangan kondisi, masyarakat, waktu, dan tempat yang memerlukan penyesuaian..Kata Kunci: Transformasi, Usia Perkawinan, Maslahah Mursalah.

Abstract

Abstract: In an effort to optimize mediation as a means of resolving civil disputes, especially divorce cases and disputes resulting from divorce, mediators at the Lebong Religious Court should always strive for two disputing parties to take a peaceful route, because a peaceful route will speed up dispute resolution. The implementation of mediation also needs to be maximized because if the parties do not reach an agreement to live in harmony again, mediation can continue with disputes resulting from divorce. This research aims to determine the implications of implementing dispute mediation resulting from divorce on the rights of ex-wives and children at the Lebong Religious Court. The research method used is descriptive qualitative by collecting information from primary data sources and secondary data sources, reviewing and analyzing according to the topic discussed in this research. The results of this research show that there are implications for implementing dispute mediation resulting from divorce on the rights of ex-wives and children at the Lebong Religious Court, one of which is fulfilling the rights of ex-wives and children after divorce.Key words: mediation, dispute, consequences of divorce. Abstrak : Dalam upaya mengoptimalkan mediasi sebagai sarana penyelesaian sengketa perdata khususnya perkara perceraian dan sengketa akibat perceraian para mediator di Pengadilan Agama Lebong sudah seharusnya selalu mengupayakan dua pihak yang bersengketa untuk menempuh jalur damai, karena jalur damai akan mempercepat penyelesaian sengketa. Mediasi juga perlu dimaksimalkan penerapannya karena apabila para pihak tidak mencapai kesepakatan untuk hidup rukun kembali, mediasi dapat dilanjutkan dengan sengketa akibat perceraian. Penelitian ini bertujuan untuk mengetahui implikasi pelaksanaan mediasi sengketa akibat perceraian terhadap hak mantan istri dan anak di Pengadilan Agama Lebong. Metode penelitian yang digunakan adalah deskriptif kualitatif dengan mengumpulkan informasi dari sumber data primer dan sumber data sekunder, mengkaji, dan menganalisa sesuai dengan topik pembahasan dalam penelitian ini. Hasil dari penelitian ini, terdapat implikasi pelaksanaan mediasi sengketa akibat perceraian terhadap hak mantan istri dan anak di Pengadilan Agama Lebong, salah satunya terpenuhinya hak mantan istri dan anak pasca perceraian.Kata kunci: mediasi, sengketa, akibat perceraian.

Abstract

Researcher discusses the problems effectiveness of mediation in Class 1A Religious Court of Bengkulu.  In the first study that has  been conducted by researchers at the  Class 1A Religious Court of Bengkulu  City found  information about  the low success of the mediation conducted by a judge mediator and the sheer  number divorce  cases in Class 1A Religious Court of Bengkulu.  Based on the description above,  the formulation of the problem: How is the effectiveness of mediation in preventing divorce conducted by the Religious Court of Bengkulu City Class 1A. And the factors that become supporting and inhibiting the success of mediation in Class 1A Religious Court of Bengkulu  City . In this thesis  the author uses  the method used  in the study of this law is the juridical sociological. Results from this study is the author  concluded that the mediation is conducted in the Religious Court of Bengkulu City Class 1A by following the reference of PERMA No.01 of 2008 has not been effective although there are successful but still very low, many factors are the cause of which is the level of compliance in the community through  the process of mediation is still very low, culture  of people who argue that divorce  is not a disgrace to individuals  and families and the quality of the judges  appointed as a mediator is still uneven and  there  are  only four (6) judges  who  have  attended mediation training organized by the  Supreme Court Republic  of Indonesia.

Abstract

Abstract: Hadith is something that was narrated from the Prophet sallallaahu'alaihi wasallam after his prophethood. Meanwhile, the meaning of sunnah is more comprehensive and more general. Because the sunnah also includes the life journey of the Prophet sallallaahu 'alaihi wasallam before his prophethood and after his prophethood. After explaining the meaning of hadith, we can see that in general there are hadith in the form of actions, words, or agreements or determinations. The hadith structure includes sanad and matan.  Sanad is a chain of speakers/narrators (transmitters) of hadith.   Matan is the editor of the hadith.   The position and function of Hadith is as the second source of Islamic law, as a reinforcement and confirmation of the law, as an explanation or detail of verses of the Al-Qur'an which are still general in nature, establishing laws not contained in the Al-Qur'an. Relationship between the Qur'an and Sunnah. Judging from the existing law, the relationship between As-Sunnah and the Al-Qur-an, as a reinforcement of the laws that already exist in the Al-Qur-an, interpreters or details of things that are mentioned in mujmal in the Al-Qur-an, is a part of mujmal Al-Qur-an, Bayan Tafsiri, Bayan Taqriri, Bayan Taudhihi.Keywords: As-Sunnah, Sources of Islamic Law, Life, Contemporary Abstrak: Hadits adalah sesuatu yang diriwayatkan dari Nabi  shallallaahu‘alaihi wasallam  setelah kenabiannya. Sedangkan sunnah pengertiannya lebih menyeluruh dan lebih umum. Karena sunnah juga mencakup perjalanan hidup Nabi shallallaahu ‘alaihi wasallam sebelum kenabiannya dan setelah kenabiannya. Setelah diuraikannya pengertian hadits, maka kita dapat mengetahui bahwa secara umum hadits itu ada yang berupa perbuatan, perkataan, maupun persetujuan atau penetapan. Struktur   hadis   yang   meliputi   sanad   dan   matan.  Sanad   ialah   rantai   penutur/rawi (periwayat)   hadits.   Matan   ialah   redaksi   dari   hadits.   Kedudukan   dan  fungsi   Hadis   yaitu sebagai sumber hukum Islam yang kedua,  sebagai penguat dan pengukuh hukum,  sebagai penjelas atau perincian terhadap ayat-ayat Al-Qur’an yang masih bersifat umum, menetapkan hukum-hukum tidak terdapat dalam Al-Qur’an. Hubungan Al-Qur’an dan Sunnah. Ditinjau dari hukum yang ada maka hubungan As-Sunnah   dengan   Al-Qur-an,   sebagai   penguat   hukum   yang   sudah   ada   di   dalam  Al-Qur-an, penafsir atau pemerinci hal-hal yang disebut secara mujmal dalam Al-Qur-an, bayan dari mujmal Al-Qur-an, Bayan Tafsiri, Bayan Taqriri, Bayan Taudhihi.Kata kunci :  As-Sunnah, Sumber Hukum Islam, Kehidupan, Kontemporer

Abstract: The Rejection of Itsbat Marriage in the Decision of the Tais Religious Court Number: 13/Pdt.P/2021/PA.Tas is an interesting phenomenon in Islamic law to study because it involves the recognition of the validity of a marriage in Muslim society, so it is necessary to study the basis of the Judge's considerations so that case Number: 13/Pdt.P/2021/PA.Tas regarding itsbat nikah is unacceptable and the impact on justice seekers of the decision on itsbat nikah is unacceptable from the perspective of Islamic legal thought. To answer these problems, the legal research method used is normative juridical with the statute approach, case approach and conceptual approach. The results of the study showed that in legal considerations in determining case Number: 13/Pdt.P/2021/PA.Tas the Judge of the Tais Religious Court rejected the petition of the Petitioners because Petitioner II at the time of his marriage to Petitioner I was still someone else's wife. In this case, Petitioner II committed polyandry where he is still married to his old partner and has not been officially divorced in court so that it can be said that Petitioner II violated Article 9 of Law Number 1 of 1974 in conjunction with Article 40 letter a of Presidential Regulation of the Republic of Indonesia No. 1 of 1991 concerning Compilation of Islamic Law and if the application for itsbat marriage is rejected by the judge for marriages that are not registered, then the marriage loses legal force. As a result, in the event of future problems, the husband and wife are unable to take legal action. The parties who suffer the most in this situation are the wife and children, because the wife will find it difficult to obtain rights such as maintenance and property in the event of a divorce.Keywords: Marriage Itsbat and Judge's Decision Abstrak: Penolakan Itsbat Nikah pada Penetapan Pengadilan Agama Tais Nomor: 13/Pdt.P/2021/PA.Tas merupakan fenomena hukum Islam yang menarik untuk diteliti karena menyangkut pengakuan atas sahnya sebuah pernikahan dalam masyarakat Muslim sehingga perlu dikaji dasar pertimbangan Hakim sehingga perkara Nomor: 13/Pdt.P/2021/PA.Tas tentang itsbat nikah tidak dapat diterima dan dampak kepada para pencari keadilan terhadap putusan itsbat nikah tidak dapat diterima dalam perspektif pemikiran hukum Islam. Untuk menjawab permasalahan tersebut, metode penelitian hukum yang digunakan adalah yuridis normatif dengan pendekatan Undang-Undang, pendekatan kasus dan pendekatan konseptual. Hasil penelitian menunjukkan bahwa dalam pertimbangan hukum pada penetapan perkara Nomor: 13/Pdt.P/2021/PA.Tas Hakim Pengadilan Agama Tais menolak permohonan para Pemohon dikarena Pemohon II pada saat menikah dengan Pemohon I masih berstatus isteri orang lain. Dalam hal ini Pemohon II melakukan poliandri di mana masih terikat dalam pernikahan dengan pasangan yang lama dan belum bercerai secara resmi di Pengadilan sehingga dapat dikatakan Pemohon II melanggar Pasal 9 Undang-Undang Nomor 1 tahun 1974 jo Pasal 40 huruf a Peraturan Presiden Republik Indonesia No 1 tahun 1991 tentang Kompilasi Hukum Islam dan bila permohonan itsbat nikah ditolak oleh hakim untuk perkawinan yang tidak dicatatkan, maka perkawinan tersebut kehilangan kekuatan hukum. Akibatnya, jika terjadi masalah di masa depan, pasangan suami istri tidak dapat mengambil langkah hukum. Pihak yang paling menderita dalam situasi ini adalah istri dan anak-anak, karena istri akan kesulitan mendapatkan hak-hak seperti nafkah dan harta gono-gini saat terjadi perceraian.Kata Kunci: Itsbat Nikah dan Putusan Hakim

Abstract

Abstract: There is an obligation to involve the community in drafting village regulations. Therefore, this conceptual article is intended to find out how the process of community formation and participation in the preparation of village regulations is carried out. The approach used is the statute approach by collecting primary and secondary legal materials which are then analyzed descriptively. The results, first, are the stages of forming village regulations starting from planning, drafting, discussing, stipulating, promulgating, to dissemination. Second, community participation in the preparation of village regulations is a form of democratic political relations in village governance. In addition, the intended participation can be used as a means to discuss and agree on strategic matters. Keywords:Society Participation; Village Regulation. Abstrak: Ada kewajiban untuk melibatkan masyarakat dalam penyusunan peraturan desa. Oleh karena itu, artikel konseptual ini dimaksudkan untuk mengetahui bagaimana proses pembentukan dan partisipasi masyarakat dalam penyusunan peraturan desa. Pendekatan yang digunakan adalah perundang-undangan (statute approach) dengan mengumpulkan bahan hukum primer dan sekunder yang kemudian dianalisis secara deskriptif.Hasilnya, pertama, tahapan pembentukan peraturan desa dimulai dari perencanaan, penyusunan, pembahasan, penetapan, pengundangan, hingga penyebarluasan.Kedua, partisipasi masyarakat dalam penyusunan peraturan desa merupakan wujud adanya hubungan politik yang demokratis dalam tata kelola desa.Selain itu, partisipasi yang dimaksud dapat dijadikan sebagai sarana untuk berdiskusi dan menyepakati hal-hal yang bersifat strategis.
