Abstract

This study aims to initiate a future Islamic legal methodology through a critical study of the reconstruction of the principles of fiqh. The method used is qualitative with a historical-philosophical approach, through an analysis of the development of classical principles of fiqh and its response to the challenges of modern times. The results of the study show that the traditional framework of usul al-fiqh, which is largely influenced by theological and scholastic mindsets, needs to be reconstructed to be more adaptive to contemporary social, political, and cultural dynamics. This reconstruction includes renewing the ijtihad paradigm, strengthening the maqashid Syariah approach, and integrating it with social sciences. This study emphasizes that the methodological renewal of usul al-fiqh is a strategic step towards making Islamic law more contextual, relevant, and solution-oriented in addressing the problems of the ummah in the future.

Abstract

This study aims to trace the genealogy of Shafi'i fiqh through the tradition of writing matan, sharah, and hasyiah as a form of transmission and development of fiqh knowledge. The method used is qualitative with a historical-hermeneutic approach, through the study of classical literature and philological studies of the main works in the Shafi'i school. The results of the study show that the matan tradition plays a role as the core of the teachings, sharah as a conceptual explanation, and hasyiah as a critical note or commentary on the explanation. These three forms form a complex and dynamic scientific network, reflecting the dialectical process of thought and the continuity of scientific authority in the Shafi'i school. This research emphasizes that the tradition of fiqh literacy is an important methodological legacy in understanding the structure, flexibility, and continuity of the Shafi'i school of thought until the contemporary era.

Abstract

This study aims to examine Islamic fiqh views on abortion and early marriage as issues in women's reproduction. Using a qualitative method with a normative-analytical approach, this study analyzes various opinions in classical and contemporary fiqh on abortion and early marriage. The results showed that in fiqh, abortion is generally considered haram, except in certain conditions that endanger the mother's life, while early marriage is viewed from various perspectives, depending on the social and cultural context. However, there is a consensus among scholars regarding the importance of protecting women's health and rights. This study concluded that women's reproductive fiqh needs to be understood in a modern context, with attention to aspects of health, women's rights, and the principle of justice in Islam.

Abstract

This study aims to examine the treasure trove of fiqh interpretation as an important contribution to the development of Islamic fiqh. Using a qualitative method and a historical-critical approach, this study traces the development of fiqh interpretation through classical to contemporary texts, as well as its role in bridging the understanding of religious texts with the practice of Islamic law. The results of the study show that fiqhi interpretation provides a more contextual framework for the verses relating to fiqh, and enriches the Islamic intellectual tradition in providing legal solutions to contemporary issues. This study emphasizes the importance of fiqhi interpretation in shaping legal foundations that are adaptive and relevant in the midst of changing times.

Abstract

This study aims to analyze the Islamic finance industry from the perspective of human resource management, specifically related to the management of human resources in improving the operational effectiveness and performance of Islamic financial institutions. The method used is qualitative with a case study approach to several Islamic financial institutions in Indonesia. The results show that good human resource management, including recruitment, training, and employee development based on sharia principles, greatly affects service quality and customer satisfaction. In addition, challenges in managing SDI related to a deep understanding of sharia and a lack of competence in the managerial field are major obstacles in the development of this industry. This study recommends the need to increase the capacity of SDI in the sharia finance sector to create synergy between sharia principles and organizational goals.

Abstract

This study aims to analyze the application of arbitration and alternative dispute resolution (ADR) in the economic field as an effective and efficient method of dispute resolution. Using a qualitative method with a case study approach, this study examines the practice of arbitration and ADR in resolving economic disputes, both at the national and international levels. The results show that arbitration and ADR can be a faster and more flexible alternative compared to the formal judicial process, but require clear regulations and transparency in their implementation. Another advantage is its ability to reduce the burden on the courts and maintain good relations between the parties in dispute. This study suggests the need for stronger regulations and a broader understanding of arbitration and ADR among economic actors.

Abstract

This study aims to examine how Omani law protects vulnerable children without family care through foster care arrangements. In addition to assessing the effectiveness of this protection, the study also compares Oman's approach with that of Morocco and the United Arab Emirates, as well as the principles of Islamic Sharia law. Using a descriptive and comparative methodology, this article analyzes the legal conditions for foster care duties and monitoring procedures in Oman. It highlights strengths in the existing legal framework, but also reveals shortcomings in implementation and oversight. Learning from stronger practices in Morocco and the UAE and aligning them more closely with Sharia objectives is one of the recommendations. The research found that while the legal framework in Oman has provided a sufficient basis for the care of vulnerable children without families, there are still significant weaknesses in aspects of implementation and oversight mechanisms. Compared to Morocco and the United Arab Emirates, Oman has not fully adopted best practices in terms of monitoring, ensuring children's rights, and community involvement. The findings also indicate a gap between national legal provisions and the shariah's key objectives in protecting children's rights. By evaluating this dimension of the welfare system through contrasting regional examples and religious principles, this research contributes to the development of a new approach to child welfare.

Abstract

The theological debate in Aceh in the 17th century, particularly the accusations of heresy and infidelity directed by Nūr al-Dīn al-Rānīrī against the Wujudiyah group, reflected the tension between shariah, sufism, and creed. This issue is relevant to revisit because it is not only an essential part of the intellectual history of Islam in the archipelago, but also has strong resonance in contemporary takfīr discourse that impacts the religious practices and socio-legal order of Muslims. This study aims to analyse al-Rānīrī's accusations through the parameters of shariah, particularly in relation to shaṭaḥāt (ecstatic expressions), while also examining its significance in modern debates regarding the limits of faith and the practice of excommunication. Using a literature review method and al-Fatḥ al-Mubīn as the primary source, this study found that al-Rānīrī's verdict was based on the assumption that Wujudiyah rejected the obligations of prayer and fasting. However, a textual analysis of Hamzah Fansuri's thought showed that what is meant was only the condition of Sufis in a state of unconsciousness, which in fiqh is considered a matter of khilafiah (disagreement). Therefore, the accusations of bid'ah and kufr do not have sufficient legal legitimacy. This finding confirms that the discourse of takfīr is not only a historical problem, but also has significant socio-legal implications in contemporary times, both through institutional fatwas and the narratives of transnational groups that have the potential to give rise to stigmatisation and social conflict.

Abstract

This article examines the epistemological and performative construction of Ijtihād irshādi at the Lajnah Bahtsul Masail (LBM) of Pesantren Lirboyo as a paradigm that repositions fatwa not merely as juridical determination, but as ethical discourse shaped through communicative, pedagogical, and socially embedded reasoning. Responding to contemporary socio-religious issues such as domestic violence, interfaith marriage, and digital era household needs, this research argues that Ijtihād irshādi emphasises moral orientation, dialogical clarification, and contextual sensitivity while remaining grounded in maqasid al-shariah and the pesantren tradition. Using a qualitative phenomenological case study combined with Foucauldian archaeological discourse analysis, this study examines LBM documents, in-depth interviews with kiai and senior students, and participant observation in bahtsul masail sessions to map the epistemic formation of irshādi fatwas. The findings demonstrate that Irshadi reasoning works through nonimperative ethical guidance, performative enunciation of authority, and flexible interpretive mechanisms that integrate classical texts with lived realities. The study contributes conceptually by clarifying the epistemic structure of irshādi fatwas, methodologically through the synthesis of phenomenology and archaeological analysis, and practically by showing how pesantren-based jurisprudence can guide Muslims through evolving ethical challenges.

Abstract

Penelitian ini bertujuan untuk menganalisis penerapan prinsip-prinsip kontrak dan manajemen Islam dalam transaksi Letter of Credit (L/C), khususnya dalam konteks perdagangan internasional. Dalam praktiknya, L/C merupakan instrumen perbankan yang krusial untuk menjamin pembayaran antara eksportir dan importir. Namun, dari sudut pandang ekonomi Islam, terdapat sejumlah aspek yang perlu ditinjau ulang agar sesuai dengan prinsip-prinsip syariah seperti keadilan, transparansi, dan larangan terhadap riba serta gharar. Kajian ini menggunakan pendekatan kualitatif deskriptif melalui studi pustaka dan analisis konten terhadap literatur fikih muamalah dan praktik perbankan syariah kontemporer. Hasil penelitian menunjukkan bahwa meskipun L/C konvensional pada dasarnya mengandung unsur jaminan dan kepercayaan, beberapa komponennya—seperti bunga atas keterlambatan pembayaran atau biaya administrasi tidak transparan—dapat bertentangan dengan prinsip syariah. Oleh karena itu, penting untuk merumuskan model L/C syariah yang mengedepankan akad-akad seperti wakalah, murabahah, dan kafalah. Penelitian ini bermanfaat bagi akademisi, praktisi perbankan syariah, dan regulator dalam memahami potensi integrasi nilai-nilai Islam dalam manajemen risiko dan kontrak keuangan internasional, serta memberikan kontribusi terhadap pengembangan produk keuangan syariah yang lebih sesuai dengan prinsip Islam.
