Abstract

The implementation of ḥawālah (transfer of debt liability) and kafālah (guarantee) in Indonesia’s Islamic banking reveals an increasing tension between formal Shariah compliance and institutional risk management imperatives. Although classically categorised as tabarruʿ-based and non-profit contracts, contemporary practices reposition them as fee-generating instruments and risk transfer mechanisms, raising concerns about substantive alignment with Islamic legal and ethical principles. This study critically examines the extent to which modern applications of ḥawālah and kafālah reflect their classical fiqh foundations and maqāṣid al-sharīʿah objectives, and analyses how regulatory frameworks and institutional risk management influence their reinterpretation. Using a normative, legal and comparative approach, the research analyses classical fiqh al-muʿāmalāt doctrines, AAOIFI Shariah standards, DSN–MUI fatwas, and Indonesia’s positive law governing Islamic banking, supplemented by semi-structured expert interviews. This analysis is based on two expert interviews with members of Shariah Supervisory Boards and DSN–MUI-affiliated practitioners involved in Islamic banking governance.The results reveal a significant conceptual and functional shift, where formal Shariah compliance often masks substantive transformation into institutional risk management tools, evidenced by fee-based structures, hybrid contractual arrangements, and standardised product designs that prioritise institutional risk governance over the original altruistic rationale of tabarruʿ. Empirical signals from the interviews indicate recurring fee structures exceeding administrative cost recovery thresholds, implicit use of ḥawālah in transfer products without explicit contractual labelling, and kafālah arrangements structured similarly to risk-priced service contracts. The study highlights the need for clearer governance standards and substantive regulatory guidance to mitigate Shariah dilution while accommodating legitimate risk management needs. From a policy perspective, regulators should establish clearer criteria for permissible fee structures and hybridisation boundaries to ensure alignment with maqāṣid al-sharīʿah while maintaining financial stability. By reconceptualising ḥawālah and kafālah as hybrid institutional contracts, this research advances a maqāṣid al-sharīʿah–oriented evaluative framework that transcends procedural conformity toward ethical and institutional coherence.

Abstract

This study aimed to determine and analyze the distribution of Angkola customary inheritance to daughters. The type of research was field research, with a qualitative descriptive method, and the approach used legal sociology and a state approach. In contrast, the data types used consisted of primary and secondary data. The findings were that the kinship system used by the Angkola tribe in the distribution of inheritance adheres to a patrilineal kinship system, so with this patrilineal system, the position and inheritance rights of daughters are not recognized by Angkola custom. Even though they are not classified as heirs, daughters can still get a share of their parent's inheritance utilizing Olong Ate, namely giving love from a brother to his sister without a nominal amount. With the concept of Olong Ate, the share received by Daughter cannot be determined; the share for Daughter may be less, more, or equal to the share for boys. If Daughter's share is equal to or bigger than the boys, then there is a clash between Angkola customary and Islamic inheritance laws

Abstract

Pernikahan adalah salah satu ibadah yang tentunya akan dilalui oleh setiap muslim, dan tujuan utama dalam pernikahan sebagai pelengkap seseorang Islam dalam ibadah juga untuk membangun keluarga dan menyebabkan mawadah wa Rahmah pada keindahan Islam kepada keturunannya. selain itu sudah akrab bagi kita, terutama umat Islam yang sering dalam membangun negeri yang dicita-citakan oleh Nabi Muhammad untuk menghadapi masalah-masalah kehidupan, baik dari segi bathiniyah an Zhohiriyahnya. Seiring waktu dalam kehidupan rumah tangga terkadang dibumbui dengan masalah dan sengketa di mana jika kehidupan rumah tangga tidak dapat hidup dengan rasa kasih sayang akan menghasilkan kejenuhan keluarga dan masalah berakhir dengan perceraian di era kebodohan, jika suami tidak senang istrinya dan berniat untuk bercerai, suami melakukan zhihar. Zhihar ekspresi yang menyakitkan seorang wanita, karena kata-kata seperti itu jelas menunjukkan sikap suami mengabaikan atau cenderung tidak menghargai pengorbanan dan pelayanan istri. Bahkan ia tega Megeluarkan kata-kata yang menyinggung seolah-olah ia tidak pernah merasakan manisnya kehidupan suami-istri selama ini. Kata Kunci : Zihar, Kaffarat, Implikasi dan Hukum Islam

Abstract

The lease finance contract plays a significant role in contemporary financial operations in Indonesia. However, the lease contract must adhere to Islamic law and government regulations in order to promote the reliability of leasing within society and among business participants. The purpose of this study was to analyze the compliance of leasing practices in Indonesia to Islamic law and regulatory standards, as well as to evaluate the level of compliance and protection provided by legal provisions in leasing contracts for small and medium-sized businesses operating in the home industry sector in Indonesia. This study employs a qualitative analytical method based on the application of a statutory and conceptual approach to data description and analysis. The results show that the leasing activities carried out by business entities in Indonesia are conducted in compliance with the principles of Islamic law and the regulations set by the government. Leasing has demonstrated its significant role in fostering economic expansion and augmenting state revenue. Nevertheless, it is anticipated that the government will assume a more proactive role in enhancing consumer protection and ensuring efficient oversight, so ensuring that leasing practices adhere to current legal regulations

Abstract

Juvenile cases in conflict with the law are ideally resolved through diversion, a restorative mechanism that prioritizes recovery, avoids stigmatization, and encourages participatory dialogue among stakeholders. However, in practice, diversion implementation in Indonesia often encounters systemic and cultural barriers, especially when relying solely on formal legal institutions. This study explores the role of Reconciliatory Customary Judges (RCJs) in Tana Toraja as culturally embedded mediators and reconstructs their potential function within the national diversion framework. Using a mixed-methods approach, the research combined qualitative interviews with customary leaders (to parenge), religious figures, and law enforcement actors, alongside quantitative surveys conducted among community members. The empirical findings reveal that RCJs hold significant social legitimacy, drawn from their alignment with tongkonan kinship systems and aluk todolo norms of deliberation (musyawarah). Their mediation practices reflect Islamic principles of reconciliation (sulh) and complement the restorative justice goals of the Juvenile Criminal Justice System (UU-SPPA). The study identifies a legal pluralism in practice, wherein Islamic, customary, and national legal traditions converge. RCJs have proven effective in resolving community conflicts and are trusted across generational lines, making them ideal mediators in diversion cases. The results call for the institutionalization of RCJ roles across diversion stages, including police, prosecution, and judiciary levels, to enhance cultural responsiveness, legal legitimacy, and social restoration. This research offers a transformative framework for integrating localized wisdom into national legal reform. By recognizing RCJs as formal diversion mediators, Indonesia can bridge gaps between normative aspirations and socio-cultural realities, promoting a restorative justice system that is legally sound, culturally resonant, and constitutionally grounded

Abstract

The coronavirus has had a tremendous impact on the world economy, many people's businesses have experienced a decline in revenue during covid-19. Hotel and restaurant tax revenues during the covid19 period have also been paralyzed. So that tax deposits become the heaviest burden for business actors. In this case, how does the concept of 'Usyur see the problems that plague this world so that tax revenues during the Covid-19 pandemic. This research uses qualitative research methods with descriptive analysis. A qualitative approach is an approach that seeks to interpret the meaning of an event as an interaction of human behavior in a particular situation. The results found are that 'Usyur provides relief to business actors when an outbreak hits the world, but in its implementation it often experiences obstacles and obstacles and its application has not been implemented in Indonesia. 'usyur has not been fully implemented even though there are sharia hotels and restaurants, 'usyur has not been as busy as it is going well, although the concept will lead to the concept of sharia tax revenue. This is an input for future business actors in realizing sharia tourism and hotels

Abstract

Abstract

There are several facets to the complicated problem of polygamy in Indonesia, including positive law, Islamic law, and societal factors. While Islam does provide a legal framework for polygamy and Law Number 1 of 1974 concerning Marriage does regulate it thoroughly, it might be challenging to put the idea of fairness as the primary criterion into practice. The issue that affects the legal protection of women and children stems from polygamy's injustice, which includes both material and non-material components, and from the lack of strong oversight of unregistered marriage practices. In order to better safeguard women and children involved in polygamy, this research will examine the degree to which legal standards are followed and how these standards are put into effect. Combining a socio-legal framework to comprehend its social application with a legal examination of Islamic and national legal norms, this research employs a normative descriptive technique with a qualitative approach. Findings reveal that unregistered weddings and other legal loopholes continue to be a big problem, even though laws have been enacted to restrict careless polygamy. Legal change, including the digitization of marriage registration, stricter polygamy permission processes, and the empowerment of women, are proposed remedies in this research. Another tactic for creating a flexible and responsive legal system is to combine local values with international norms like CEDAW. This study's findings will help shape Indonesia's marriage law policy in a more equitable and welcoming direction.

Abstract

The source of Islamic law is the main foundation a mujtahid for exploring Islamic law for existing arguments, both agreed ptopositions or disputed. Qaul Shahabi is one of the syar’i arguments wich became a discussion of scholars about the success in the determination of the law. Study of Qaul Shahabi become one of the interesting themes among experts ushul fiqh, even though they put it in the position of the disputed argument. However, the majority of scholars use Qaul Shahabi as a backrest in deciding the case of islamic law, especially events that are not partially explained in the Alquran and Hadis. Debate among these scholars only limited to which friends can be used as a basis and reference, but that does not prevent them from making Qaul Shahabiy a shar'i proposition

Abstract

This research aims to determine the strategy for increasing inclusive finance through Shariah fintech at Bank Syariah Indonesia KCP Gunung Tua using SWOT analysis. A qualitative research approach was utilized. The results of the SWOT analysis revealed that the IFAS matrix scored 0.6 and the EFAS matrix scored 0.54, indicating Quadrant I and suggesting an aggressive strategy that supports growth policies by leveraging all strengths to maximize opportunities. Based on these results, the improvement strategy for BSI KCP Gunung Tua includes: first, utilizing transaction services available anytime and anywhere to attract individuals who prefer mobile banking (BSI Mobile) (S3, O3); second, capitalizing on the predominantly Muslim community in Gunung Tua, which has great potential, by offering low operational cost services from the Indonesian Shariah bank (S1, O1); third, leveraging the preference for mobile banking transactions with an easy process at BSI (S2, O3)
