Abstract

Criminal acts arise from various aspects of human activity, including the political, social and economic spheres. The success of law enforcement is traditionally measured by the ability to bring criminals to justice and impose appropriate penalties. However, in certain minor cases, such as theft, embezzlement, and fraud with minimal losses, the public questions the need for prosecution, as they believe that prosecution does not match the seriousness of the offense.  The purpose of this study is to analyze the implications and effectiveness of prosecution discontinuation based on restorative justice in the Indonesian legal framework. Using a qualitative research approach, this study examines the regulatory structure and practical application of restorative justice in Indonesia. Data was collected through document analysis and interviews with legal practitioners to explore alignment of regulations with legal principles and community expectations. The research findings show that, although restorative justice offers a viable avenue to achieve peace between offenders and victims, its implementation in Indonesia is still limited, as it is not yet embedded in the broader criminal law system. Currently, peace agreements between the parties are only considered as a mitigating factor in the sentencing process. This research suggests that stronger legal legitimacy for restorative justice, such as the inclusion of restorative justice into the Draft Criminal Procedure Code is essential to adapt to the evolving legal culture and public expectations. The implications of this research highlight the need for comprehensive criminal law reform to ensure justice that aligns with societal values and contemporary legal standards.

Abstract

Effective governance is essential for ensuring the efficient delivery of public services and fostering community development. In Samarinda City, addressing administrative and developmental challenges requires the implementation of a robust governance framework. This research explores the application of TOGAF (The Open Group Architecture Framework) to improve the efficiency and effectiveness of local governance in Samarinda City. The study aims to analyze how TOGAF can strengthen strategic alignment, decision-making, and operational efficiency within local government frameworks. This research employs a qualitative approach through a literature review of academic articles, case studies, and industry reports on the application of TOGAF in governance contexts. The findings indicate that TOGAF facilitates strategic alignment of IT resources with governance goals, improves decision-making through structured methodologies, enhances operational efficiency through resource optimization, and promotes interoperability between government departments. However, challenges such as the framework's complexity, resource demands, and adaptability to local contexts must be addressed. The results suggest that adopting TOGAF incrementally, investing in capacity building, and ensuring stakeholder engagement are crucial for successful implementation. These findings have important implications for the Samarinda City Government, providing practical recommendations to enhance governance through TOGAF, and contributing to the broader literature on IT frameworks in public sector governance. Further research could explore case studies of TOGAF implementation in other cities with similar challenges to offer additional insights into its practical applications.

Abstract

The quality of education for MSME actors in Indonesia shows significant regional disparities, which impact their ability to compete in the market. This research aims to assess the achievement of quality education for MSME actors in the 34 provinces of Indonesia in 2021, focusing on key indicators such as high school completion rates, literacy rates, ICT skills, high school repetition rates, and higher education enrollment ratios. The research employs the Qualitative Comparative Analysis (QCA) method to analyze the educational conditions across provinces. The findings reveal a considerable gap in educational outcomes, with provinces like DI Yogyakarta and DKI Jakarta showing better educational performance, while Papua faces significant challenges. The research concludes that improving access to quality education for MSMEs is essential for fostering innovation, enhancing business performance, and contributing to national economic growth. This research highlights the need for targeted government interventions to address the educational disparities in Eastern Indonesia and other underperforming regions.

Abstract

The issue of limiting land ownership by private legal entities, particularly limited liability companies (PTs), has become an important concern in agrarian policy in Indonesia, particularly in the plantation sector. Although there are regulations governing the maximum limit of land ownership, their implementation remains unclear, especially regarding Cultivation Rights Title (CRT) and location permits. This ambiguity allows large companies to control vast tracts of land, exacerbating inequality and marginalizing smallholders. This study aims to analyze the normative ambiguities in land tenure restrictions, particularly related to CRT and location permits, and assess their implications for land distribution and smallholder welfare. The research seeks to explore the need for stricter and clearer regulations to promote equitable distribution of land ownership and align agrarian policy with the principles of social justice mandated by the 1945 Constitution. A normative juridical approach was used, focusing on analyzing the legal norms governing restrictions on land ownership by private legal entities in the plantation sector. The study found that ambiguities in the regulations, especially those under the Ministerial Regulation of ATR/BPN, have created legal uncertainty regarding the area of land that can be controlled by private legal entities. Restrictions based solely on business type and commodity allow large companies to monopolize land, disadvantaging smallholders and exacerbating inequality in land distribution. This research has implications highlighting the need for comprehensive policy reforms with clearer and stricter land ownership restrictions to ensure a more equitable distribution of land.

Abstract

This research examines the effect of service quality on employee performance and customer satisfaction at PT PBM Adhiguna Putera. As a maritime transportation and logistics company, PT PBM Adhiguna Putera faces challenges in improving service quality and customer satisfaction in the post-COVID-19 era. This research aims to analyze the relationship between service quality, employee performance, and customer satisfaction, as well as to examine the mediating role of employee performance in this relationship. The research employs a quantitative approach with a descriptive design. Data collection was conducted through a survey of 75 consumers and in-depth interviews with key stakeholders. Data analysis was performed using SPSS and SmartPLS to measure the strength of relationships between variables based on the research's structural model. The findings indicate that service quality has a positive and significant effect on employee performance (coefficient 0.790; p-value 0.000) and customer satisfaction (coefficient 0.903; p-value 0.000). Additionally, employee performance positively influences customer satisfaction (coefficient 0.412; p-value 0.038). The mediation analysis reveals that employee performance mediates the relationship between service quality and customer satisfaction, with a coefficient of 0.326 and a p-value of 0.029. The implications of this research emphasize the importance of improving service quality and human resource management as key strategies for enhancing company performance. The findings can serve as a foundation for PT PBM Adhiguna Putera in designing more effective policies to improve customer satisfaction through the enhancement of employee performance.

Abstract

The rapid advancement of information technology has brought significant changes to the educational landscape, with web-based learning becoming an essential tool in enhancing learning outcomes. This research aims to develop interactive learning media based on the Google Sites application to support the teaching of matrix multiplication operations, a concept that often challenges high school students. The goal is to create a media tool that can improve students’ understanding and facilitate independent learning, particularly in the context of mathematics education. Using the Research and Development (R&D) method, this study follows the ADDIE model, which includes stages of Analysis, Design, Development, Implementation, and Evaluation. The learning media was developed and validated through expert feedback, with the effectiveness assessed via practicality and validation tests. A trial with 11 students from the S-2 Mathematics Education Program at the State University of Malang was conducted to gather feedback on the media’s usability and interactivity. The results showed that the Google Sites-based learning media was both valid and practical, with an average validation score of 3.5 and a practicality score of 3.8. These scores indicate that the media is suitable for educational use, engaging students in the learning process. The interactive features, including simulations and video content, supported students in better understanding matrix multiplication. This research contributes to the development of web-based learning media, offering a viable tool for enhancing mathematics education. Future studies could explore extending this media to other mathematical topics and evaluate its effectiveness across various student competencies.

Abstract

Democracy is a fundamental principle in most modern states, and elections serve as a key expression of people’s sovereignty. However, in Indonesia, political money crimes, such as money politics, threaten the integrity of the democratic process. The aim of the research is to explore the legal challenges and loopholes in the election system that facilitate the rise of such criminal activities. The research employs an empirical and normative-juridical approach, utilizing case data from general elections and various legal analyses. The findings reveal significant weaknesses in the electoral framework, particularly regarding the enforcement of regulations during the campaign and voting periods, leading to widespread vote-buying. Furthermore, the research highlights that the legal provisions governing electoral offenses are insufficient to deter money politics, as they fail to encompass all potential perpetrators, particularly those outside campaign teams. The implications of this research suggest a need for stricter legal measures and improved oversight mechanisms to ensure the legitimacy of elections and uphold democratic principles.

Abstract

The concept of criminal responsibility, involving both mens rea (mental state) and actus reus (physical act), is essential in determining liability for criminal acts in Indonesia. In narcotics trafficking cases, the application of these elements plays a crucial role in establishing accountability, especially when it comes to asset forfeiture. However, there are challenges in effectively applying these principles, particularly the concept of strict liability, which remains unclear in certain legal provisions regarding asset seizure. The research aims to analyze how mens rea and actus reus are applied in narcotics-related crimes in Indonesia and their implications for asset confiscation. Using case studies and legal analysis, the research identifies gaps in the application of strict liability and highlights inconsistencies in the law. The results show that although the principle of strict liability is implicitly applied in the Narcotics Law, there is a lack of clarity in its implementation, which leads to inconsistencies in the legal process. This research highlights the need for clearer legal frameworks and more consistent application of strict liability to enhance the effectiveness of narcotics crime deterrence. The implications of this research suggest that legal reforms are necessary to improve asset seizure processes and overall law enforcement effectiveness in Indonesia, providing a foundation for future research on the integration of criminal and civil aspects in narcotics cases.

Abstract

Competition law is shaped by the ideological tension between etatism, which advocates for state control over private enterprises, and liberalism, which promotes unregulated competition. As the socio-economic landscape continuously evolves, the law must adapt to address these conflicts, particularly in Indonesia's distinct context. This research aims to analyze the effectiveness of Indonesia's Undang-Undang No. 5 Tahun 1999, the law concerning the prohibition of cartel practices, monopolistic behavior, and unfair business competition, in combating cartel practices. Through a normative juridical approach, the study delves into the prospects and challenges associated with tackling cartels under the current competition law framework in Indonesia. The findings of this research indicate that while the existing legal framework is an essential tool, there is a pressing need for additional legislative measures to more effectively address the complexities of cartel behavior. The study’s implications suggest the necessity of expanding the scope of competition laws, enhancing enforcement mechanisms, and adapting the regulatory infrastructure to better confront and prevent cartel practices in today’s dynamic market conditions.

Abstract

Biodiversity decline has significant implications for environmental sustainability, necessitating an integrated approach to environmental planning and management. Environmental degradation is closely linked to socio-economic conditions, particularly poverty and economic growth. In response to this issue, this research aims to analyze the development of coffee-based agroforestry systems in forest areas to optimize land use in Humbang Hasundutan Regency, North Sumatra, Indonesia. The research employs a quantitative approach, with coffee farmers practicing agroforestry in forest areas as the research population and sample. The findings indicate that a more suitable and sustainable agroforestry system for this region is the agrosilvopastoral model, which integrates trees, agricultural crops, and fodder grasses. This system is particularly effective in steep and very steep terrains with shallow and loose soil. Additionally, in basin areas near springs and rivers, agroaquaforestry or agroaquasilvicultural systems are recommended, incorporating agricultural crops, trees, fish ponds, and fodder grass to maintain environmental stability. The implications of this research suggest that implementing these agroforestry models can enhance land productivity, support farmers' economic sustainability, and contribute to environmental conservation in forest areas.
