Tanah merupakan elemen penting bagi kelangsungan hidup manusia. Oleh karena itu keterbatasan atas ketersediaan tanah menjadikan tanah memiliki nilai ekonomis yang cukup tinggi. Semakin berkembangnya peradaban, kebutuhan masyarakat akan tanah semakin meningkat pesat, hal tersebut dapat memicu banyak sekali fenomena sengketa terkait penguasaan atas sebidang tanah tanpa hak kepemilikan. Pada putusan Pengadilan Tinggi Kupang No. 48/PDT/2020/PT KTG Majelis Hakim Pengadilan Tinggi menguatkan putusan pengadilan negeri sebelumnya terkait dengan sengketa pengusaan atas sebidang tanah yang mulanya milik Pamannya bernama Raden Saleh yang merupakan bidang tanah Mage Muok dan tanaman-tanaman asam dan jambu mete, dikuasai dan dimiliki oleh Penggugat (Agustinus Silvester) berdasarkan surat keterangan hibah. Penelitian ini dianalisis penulis untuk mengetahui ratio decidendi yang digunakan para Majelis Hakim dalam menentukan fakta-fakta materiil dan memutus perkara ini. Metode penelitian ini menggunakan jenis penelitian hukum normatif dengan pendekatan peraturan perundang-undangan, pendekatan kasus, dan pendekatan konseptual. Hasil penelitian menunjukkan Majelis Hakim Pengadilan Tinggi Kupang dalam pertimbangannya untuk memutus perkara Nomor 48/PDT/2020/PT.KPG dengan memperkuat putusan pengadilan negeri sebelumnya dirasa penulis sudah tepat. Maka Tanah Mage Muok yang terletak di Dusun Liantahon, Desa Kokowahor, Kecamatan Kangae, Kabupaten Sikka adalah sah milik penggugat berdasarkan Surat Keterangan Hibah Tanah, Nomor: Pem. 470 /249/SK-H/KWR/2011 tanggal 11 Agustus 2011 serta menghukum Tergugat untuk tidak menghalangi proses pengukuran oleh kantor Pertanahan Kabupaten Sikka, atas bidang tanah Mage Muok untuk memperoleh Sertifikat dan tidak menghalangi proses pembayaran uang ganti kerugian oleh PT. PLN (Persero) kepada Penggugat.

The development of information technology is experiencing rapid development and has penetrated into all sectors both in terms of economy, business, industry, even in the entertainment world it also has its own technology. One technology that has penetrated the world of entertainment is consoles and video games. Someone plays games with the aim of just entertainment, notinfrequently they play games with the aim of achieving popularity in the game and to achieve the highest score. Seeing the number of enthusiasts in a game, there are time when gamers appear who want an instant achievement, by making system changes or entering fake commands called cheats. The addition of this cheat system in a game makes it easier for players to achieve their goals, but making other players cheat by playing fair causes the game to be unfair. The purpose of this study is to find out the legal regulations for using cheats in the games against the laws in force in the Republic id Indonesia, including the Criminal Code and the ITE Law. The legal sources in this research are literature, legislation, journals, and relates articles, the data collection method in this study used literature study and literature study.

Pelaku usaha juga banyak yang merasa dirugikan karena dengan berkembangnya kemajuan teknologi saat ini banyak sekali modus yang dilakukan para oknum tidak bertanggung jawab yang menyebabkan pelaku usaha merasa dirugikan, modus-modus tersebut contohnya seperti ada konsumen yang order barang secara online dengan metode pembayaran COD (cash on delivery) atau bisa disebut bayar di tempat, namun pada saat barangnya datang konsumen tersebut tidak mau membayar dengan berbagai alasan atau bahkan ada yang tidak menemui kurir paketnya yang mengakibatkan paket yang sudah dikirim ke alamat penerima harus mengembalikan lagi pada pelaku usaha. Ada juga konsumen yang memesan barang namun tidak memberikan alamat yang sesuai atau hanya diberikan alamat fiktif. Dengan demikian, ketentuan yang terdapat pada Undang-Undang Nomor 11 Tahun 2008 tentang Informasi dan Transaksi Elektronik tidak dapat menjerat konsumen yang tidak bertanggung jawab. Penelitian ini adalah penelitian hukum normative dengan menggunakan pendekatan penelitian undang-undang dan pendekatan koseptual. Pengumpulan bahan hukum dilakukan dengan metode studi literatur.

The core issue in this research is the emergence of a new method of drug distribution through social media platforms such as Facebook and Instagram. This study focuses on the distribution of narcotics through social media within the jurisdiction of the Sidoarjo City Police Resort and examines it using the rational choice theory. This gives rise to the following problems: 1. What motives do drug dealers have for distributing drugs through social media, as viewed from the perspective of rational choice theory? 2. What actions do the police take against the criminal act of drug distribution through social media? The purpose of this research is to identify and analyze the motives of drug dealers in distributing through social media, as well as the actions taken by the police against the criminal act of drug distribution through social media. The research methodology used is qualitative empirical legal research. The study was conducted at the Sidoarjo Class IIA Penitentiary and the Sidoarjo City Police Resort. The research method involves interviews as primary legal data and legislation as secondary legal data. The results of this research are as follows: 1. The distribution of narcotics through social media has benefits and costs. In this study, the benefits outweigh the constraints or losses incurred. 2. The actions taken by the police against the distribution of narcotics through social media. Individual may consciously commit a criminal act due to the presence of rational choice theory, whereby a person considers the benefits and losses they may incur.

Corruption is an act that can directly or indirectly cause state losses. Current developments, both the quality level of crime and the quantity level of cases are increasing continuously every year. In order to reduce the swelling in the cost of resolving criminal acts in Indonesia, the Indonesian Attorney General's Office issued SE Jampidsus Number B-1113/F/FD.1/05/2010 which discusses Restorative Justice in resolving corruption crimes with relatively small losses prioritized not to be followed up when the perpetrator has returned state financial losses. However, this is contrary to Article 4 of Law No. 31 of 2019 concerning the Eradication of Corruption, which states that the return of state financial losses made by the perpetrator still does not climinate the criminalization of the perpetrator of the crime of corruption. The objective to be achieved is whether the settlement using restorative justice is contrary to Article 4 of the Anti-Corruption Law. This type of research uses normative research using a statutory approach and a conceptual approach. The results of this study use the concept of restorative justice in Resolving corruption using restorative justice is contrary to Article 4 of the PTPK Law because restorative justice only fulfills the element of benefit and does not fulfill the elements of justice and legal certainty.

Modification of motorized vehicles today is done by many people in Indonesia. One of them is modifying the exhaust by replacing it with a racing exhaust. Vehicle modifications are still allowed but must be in accordance with the corridors of the provisions of Law Number 22 of 2009 concerning Road Traffic and Transportation, namely meeting technical standards and roadworthiness. The use of racing exhausts that do not meet the rules can be subject to action by the police, especially in the Ponorogo Resort Police area. On this basis, this study reviews how law enforcement against racing exhaust users in the Ponorogo Resort Police Region and looks for obstacles to law enforcement against racing exhaust. This research is a Juridical-Empirical research by looking at legal phenomena obtained by field interviews combined with legal documents. The results obtained show that Law Enforcement in the Ponorogo Resort Police Area uses Law number 22 of 2009 concerning Road Traffic and Transportation with the main provisions using the sound level as stipulated in the National Police Telegram Letter ST/1045/V/HUK.6.2/2021 and noise level rules in accordance with the Minister of Forestry and Environment Regulation Number 7 of 2009 concerning the noise threshold of new type vehicles. Then for obstacle factors influenced by Law Enforcement Factors, Community Factors and Facilities and Infrastructure Factors.

The implementation of specialized medical education involves two main aspects: academic training and healthcare services at Teaching Hospitals. While Postgraduate Medical Students (PPDS) fall under the authority of educational institutions, they also serve roles in hospitals, creating the need for clearer legal regulation. Unlike the well-defined relationship between educational institutions and teaching hospitals—governed by a Cooperation Agreement under the Medical Education Act—the legal status of PPDS within hospitals remains unregulated. This study aims to identify the legal basis for PPDS involvement in healthcare services and assess whether such involvement constitutes an employment relationship under labor law. Using a juridical-normative approach, the research finds that, due to the lack of specific legislation, each Teaching Hospital independently regulates the PPDS relationship through internal policies. Labor law defines employment relationships cumulatively, requiring elements such as work, orders, and remuneration. The study concludes that PPDS service in hospitals does not fulfill all these elements—particularly remuneration—since the incentives PPDS receive differ from the legal concept of wages. As a result, the relationship between PPDS and Teaching Hospitals cannot be categorized as an employment relationship under labor law.

Waqf has significant potential to improve public welfare in Indonesia and continues to evolve in line with societal changes. As an ijtihadi concept, waqf is open to contemporary interpretations, one of which is profession waqf—introduced by the Indonesian Waqf Board (BWI). Profession waqf refers to the endowment of one’s physical or non-physical expertise for the benefit of the public, in accordance with Islamic law. This study aims to explore the concept and subject of profession waqf in Indonesia using normative legal research with statutory and conceptual approaches. Legal materials are analyzed prescriptively to address the core issues. The research concludes that profession waqf involves dedicating an individual’s skills or professional services for public good and must be carried out in line with sharia principles. The actors involved include: (1) the profession wakif, who endows their expertise; (2) the nazhir, who manages and develops the waqf; and (3) the mauquf alaih, the beneficiaries who may be specifically named or generally intended in the waqf pledge. This form of waqf allows professionals to contribute meaningfully to society, not just through material wealth, but through their knowledge and skills.

Part-time workers are workers who work only part of the time from the normal working hours.Provisions for working time are contained in Article 77 of the Labor Law jo. UU no. 6 of 2023, namely 7 hours/day for 6 days or 8 hours/day for 5 days. Part-time workers are not mentioned in any law.The purpose of this research is to analyze the proper arrangements for Part-Time Workers to obtain annual leave rights and legal protection measures that can be given to Part-Time Workers. The research method uses normative juridical research. The writing approach uses a statutory approach by dissecting legal materials collected by means of literature studies which are analyzed prescriptively,as well as a conceptual approach that refers to legal doctrines as well as the views of experts. Based on the results of the study,the criteria for the type of work of Part-Time Workers have similarities so that the rights and obligations for Part-Time Workers can use the provisions in accordance with the Specific Time Work Agreement (PKWT). Regarding the protection of workers' basic rights, in this case the right to annual leave can be given to Part-Time Workers in proportion to the length of service. As for the legal protection that can be given to part-time workers,it is necessary to realize it in the form of a clear legal basis by ratifying the Geneva Convention and implementing it in Indonesia in the form of adding substance to PP 35 of 2021 as a type of work derived from PKWT.

Consumer protection in Indonesia is governed by Law No. 8 of 1999 (UUPK), which aims to ensure legal certainty and safeguard consumer rights. The law provides for criminal sanctions in Articles 61 to 63; however, these are often viewed as inadequate, as they emphasize punitive measures against business actors rather than restitution for consumers. A more effective approach would prioritize recovery and reparation of consumer losses, aligning better with the goals of criminal law reform. This research seeks to evaluate the accuracy and effectiveness of criminal law provisions within the UUPK in achieving justice and legal order. Employing normative juridical methods with statutory and conceptual approaches, the study analyzes both primary and secondary legal materials using prescriptive analysis. The findings reveal several shortcomings in the current formulation and implementation of criminal provisions in consumer protection. These include the lack of fulfillment of key criminal law principles: (1) the principle of reasonable loss, as not all violations result in criminal-worthy harm; (2) the principle of subsidiarity, since criminal law should be a last resort (ultimum remidium); (3) proportionality, where punishment should reflect the gravity of consumer loss; and (4) the principle of legality, particularly lex certa and lex stricta. On the other hand, the principle of tolerance in defining criminal acts is found to be fulfilled. Overall, a shift toward restorative justice and proportional sanctions is needed for more effective consumer protection.
