Abstract

Introduction: Climate change is a global challenge that requires a comprehensive policy response, including environmental economic instruments such as carbon taxes and carbon trading. As a developing country, Indonesia plays an important role in reducing greenhouse gas emissions through its Nationally Determined Contribution (NDC) commitment. However, the implementation of carbon trading still faces various legal challenges, particularly regarding legal certainty, climate justice, and environmental protection. Research Method: This study uses normative legal research methods with conceptual approaches, laws and regulations, and policy approaches. Legal materials are obtained through literature studies that include laws and regulations, journal articles, and scientific proceedings related to environmental law and carbon regulation. Data analysis was carried out qualitatively using a descriptive-analytical method. Results: The results of the study show that carbon trading regulations in Indonesia still face challenges in the form of policy disharmonization, supervision gaps, and suboptimal legal protection for investors and business actors. The principle of climate justice demonstrates the importance of proportionate distribution of responsibilities for reducing emissions as well as protecting vulnerable groups. Environmental protection is the main goal in ensuring the sustainability of ecosystems and preventing environmental damage due to carbon-based economic activities. Conclusion:  The integration of legal certainty, climate justice, and environmental protection is an important factor in strengthening carbon trading regulations in Indonesia. Cross-sectoral policy harmonization is needed to create a transparent, fair, and sustainable carbon trading system.

Abstract

Introduction: Violence against women and children in Indonesia is still at a significant rate, but the legal protections available are not fully effective in ensuring justice for victims. The main problem lies in the gap between the legal norms that have regulated victim protection and the implementation that still tends to be formalistic and not yet victim-oriented. This study aims to analyze the form of legal protection from a positive legal perspective and identify regulatory disharmony and weaknesses in the implementation of legal protection for victims of violence, including women and children. Research Method: This research is normative legal research with a statutory approach and a conceptual approach, through the study of relevant laws and regulations, legal doctrines, and the results of previous research. Results: The results show that legal protection has been regulated in various regulations, but its implementation still faces structural constraints. The main findings show that there are inconsistencies between legal norms and law enforcement practices that are still oriented towards formal evidence, as well as the application of a victim-centered approach in the legal protection process. Conclusion: This study confirms that the effectiveness of legal protection for women and children’s victims of violence is still hampered by regulatory disharmony and weak implementation. The contribution of this research lies in strengthening the integrative analysis between criminal law, victimology, and human rights in a single victim protection framework. Therefore, it is necessary to reformulate protection mechanisms that are more victim-oriented and strengthen coordination between institutions to increase the effectiveness of legal protection.

Abstract

Domestic violence cases have shown a significant prevalence over the last three years, and although most are settled amicably, there is occasionally an urgency that leads investigators to consider continuing the case for the sake of the victim's safety. This situation sparks debate regarding the limits of police authority in overriding peace agreements in domestic violence crimes, along with the potential for more serious criminal acts that may result from them. This Utilizing a doctrinal legal framework, this research explores the normative compatibility between the discretionary powers of law enforcement and the restorative mechanisms codified in modern regulations. The study draws upon secondary legal materials to provide a qualitative critique of how effectively Police directives harmonize with the protective mandates of the Anti-Domestic Violence Law findings indicate that police authority to continue domestic violence cases, despite an existing peace agreement, is based on the investigator's discretionary authority through the Restorative Justice mechanism. The withdrawal of a report by the victim does not automatically terminate the case if indications of violence with fatal impacts are found, where fatality criteria extend beyond physical injury to include significant disruption to daily activities resulting from psychological, sexual, or economic violence. Under such conditions, the safety of the victim and the prevention of recidivism become primary priorities that override the peace agreement.

Abstract

This study aims to analyze the form of legal protection for child victims of sexual violence and its implementation in East Kolaka Regency. This study uses normative legal methods with a legislative approach and a case approach, supported by primary and secondary legal materials through literature studies. The results of the study show that legal protection of children normatively has been expressly regulated in various laws and regulations, especially Law Number 35 of 2014 concerning Child Protection which contains prohibitions and sanctions against perpetrators of sexual violence. However, in its implementation in East Kolaka Regency, there are still various obstacles, including low public awareness, lack of environmental supervision, and lack of optimal prevention efforts. Therefore, it can be concluded that legal protection for children’s victims of sexual violence has not been running optimally and still tends to be reactive, so it is necessary to strengthen the prevention system through the active role of the government, community, and family to create a safe environment for children.

Abstract

This study aims to synthesize carbon dots from melon peel (Cucumis melo L.) and melinjo peel (Gnetum gnemon) waste and evaluate their potential as plant growth-enhancing agents for spinach (Amaranthus tricolor L.). The experiment was conducted using a completely randomized design with several treatment concentrations and a control treatment. C-dots were synthesized through a carbonization process using an oven at 250°C for 45 minutes. The resulting C-dots solutions were applied to spinach plants at concentrations of 0.5 g/L and 1 g/L, while distilled water was used as the control. Plant height was observed for 7 days. The results demonstrated that C-dots application positively affected spinach growth compared to the control treatment. The highest plant height was obtained from melon peel-derived C-dots at a concentration of 1 g/L, reaching 3.7 cm, while melinjo peel-derived C-dots reached 3.0 cm on the seventh day. In general, higher C-dots concentrations were associated with increased plant growth. This study is the first to explore the utilization of melon and melinjo peel waste-derived C-dots as nanomaterials for spinach growth enhancement. These findings indicate that organic waste from melon and melinjo peels has strong potential as an environmentally friendly precursor for C-dots synthesis and sustainable agricultural applications.

Abstract

Critical thinking ability is an essential competence in 21st-century learning that needs to be developed through innovative learning models. This study is a Systematic Literature Review (SLR) aimed at comprehensively analyzing the effectiveness of the SAVI (Somatic, Auditory, Visual, and Intellectual) learning model in improving students' critical thinking skills across various educational levels. The SLR method was conducted following the PRISMA 2020 protocol (Preferred Reporting Items for Systematic Reviews and Meta-Analyses) with literature searches on four main databases: Google Scholar, DOAJ, Garuda (SINTA), and Semantic Scholar. From 520 identified articles, 30 articles met the inclusion criteria and were thoroughly analyzed. The synthesis results show that the SAVI model consistently and significantly improves students' critical thinking skills with an average effect size of 0.78 (high category) based on meta-analysis. The most influential SAVI component is the Intellectual (I) dimension that encourages reflection and problem-solving, followed by the Visual (V) dimension that strengthens conceptual representation. The novelty of this research lies in mapping the moderator variables of SAVI effectiveness, namely: educational level, subject matter, and technology integration mode, which has never been done systematically before in the Indonesian literature context. The SAVI model is recommended as a core learning strategy in the Merdeka Belajar curriculum for developing the Pancasila student profile, particularly the critical reasoning dimension.

Abstract

Background: This study aims to analyze the resolution of land disputes between landowners and companies holding Mining Business Permits (IUP) and to examine appropriate compensation mechanisms. The research method used is normative juridical with a literature study approach in the Pomala area of Kolaka Regency, Southeast Sulawesi, Indonesia. However, in some cases, if mediation fails, the settlement continues to the realm of litigation. This study concludes that the active role of the Regional Government and company transparency are key to resolving mining disputes. Methods: This research is a legal research using normative juridical methods. The approaches used are the statutory approach and the case approach. The data used are sourced from secondary data, including primary legal materials in the form of laws and regulations (the Mining Law and the Basic Agrarian Law) and secondary legal materials in the form of scientific journal articles, official news reports, and previous research results relevant to land disputes in the Pomalaa mining area. The data collection technique was carried out through documentary studies by reviewing literature related to the dynamics of agrarian conflicts between local communities and nickel mining companies in Kolaka. The collected data were analyzed descriptively and analytically to map the root of the problem and available legal resolution efforts. Results: The research results indicate that the dispute arose from differences of opinion regarding the price of land acquisition and the unclear status of compensation for crops on the land. Dispute resolution was prioritized through a consensus approach (mediation) facilitated by the local government to reach an agreement on compensation. However, if mediation failed, the settlement proceeded to litigation. Conclusions: This study concludes that the active role of local governments and company transparency are key to resolving mining disputes. Therefore, collaboration between governments, companies, and communities is necessary to create fair resolutions and provide legal certainty for all parties involved.
