Abstract

Several things that underlie the study of Article 160 of the Criminal Code seen from a human rights perspective include the potential for misuse, tends to be discriminatory, and has the potential to restrict freedom of speech. In fact, the Constitution guarantees the protection of human rights for every citizen. Legally, anyone who violates Article 160 of the Criminal Code must be punished, however, in the public space the use of Article 160 of the Criminal Code opens up a 'noisy' space as well as causing its own controversy and problems as revealed in the first sentence in this section. Therefore, the researcher looks deeper in the form of a question, namely: "Does the norm of Article 160 of the Criminal Code violate human rights?" The goal to be achieved is to find out and provide understanding to all stakeholders so that Article 160 of the Criminal Code is reviewed in the meaning of the formulation of its norms as well as to be careful in its application. This research is a normative-empirical legal research with the Law approach method, conceptual and case approach. The conclusion of this study is: first, the elements of Article 160 of the Criminal Code are contrary to Human Rights and the Principles of a Democratic State as long as they are not interpreted as material crimes or Article 160 of the Criminal Code is conditionally constitutional in the sense that it is constitutional as long as it is interpreted as a material crime. Second, although Article 160 of the Criminal Code has been reconstructed into a material crime as per the Constitutional Court Decision Number 7/PUU-VII/2009, in its application it is vulnerable to being misused by authoritarian rulers by creating field conditions

Abstract

This study aims to determine the influence of economic variables, namely: capital, business duration, and working hours on the income of staple food traders at Mengwi Market, Mengwi District, Badung Regency. The sample in this study was determined using the simple random sampling technique, with a total of 73 respondents. Hypothesis testing was conducted using Multiple Linear Regression Analysis. The results of the study indicate that the economic variables capital, business duration, and working hours-partially have a positive and significant effect on the income of staple food traders at Mengwi Market, Mengwi District, Badung Regency. Capital, business duration, and working hours also have a significant simultaneous effect on the income of these traders. The coefficient of determination shows that 70.9 percent of the variation in income can be explained by the variables of capital, business duration, and working hours. The remaining 29.1 percent is influenced by other factors not included in this study

Abstract

This study aims to analyze the effect of profitability, leverage, and firm size on Earnings Per Share (EPS) in property sector companies listed on the Indonesia Stock Exchange for the 2022–2023 period. EPS is a key indicator of a company’s financial performance and is a primary concern for investors. The research employs a quantitative approach using purposive sampling, involving 40 companies and yielding 80 observations. Data were obtained from annual reports and analyzed using multiple linear regression. The results show that profitability, measured by Return on Equity (ROE), has a positive and significant effect on EPS. In contrast, leverage, measured by the Debt to Assets Ratio (DAR), has a negative and significant effect on EPS. Meanwhile, firm size, proxied by the natural logarithm of total assets, does not have a significant effect on EPS. These findings indicate that efficient profit management and capital structure play a more crucial role in determining EPS than company scale. This research contributes theoretically to corporate finance literature and provides practical implications for company management and investors in making strategic financial decisions

Abstract

The goal of this study is to examine the relationship between salary and employee performance at the Baturiti District Head Office by controlling for human resource quality with an intervening variable.  This study employs a quantitative approach.  Forty individuals from the Baturiti District Office participated in the data collection process, which involved administering a questionnaire with an agree-disagree scale and utilizing a variance-based structural equation model, also called SEM or PLS-SEM.  The study's findings show that pay has an effect on performance, which in turn has an effect on HR quality, and HR quality has an effect on performance.  With that in mind, the Baturiti District Office should prioritize raising salaries and enhancing HR quality in order to boost employee performance as part of its realization.  Future efforts to improve Human Resource Quality and raise salaries at the Baturiti District Office can be better understood with the help of this study

Abstract

Freedom of expression is a universal right that must be enjoyed by everyone, but this freedom of expression is not unlimited or absolute. Therefore, it requires regulation in both international instruments and national human rights instruments. The problem in this study is: "How is the regulation of freedom of expression in international instruments and national human rights instruments"? This research is a normative legal research. The approaches used are the statute approach and the conceptual approach. The legal materials used are primary legal materials, secondary legal materials and tertiary legal materials. The collection of legal materials was carried out by document study, while the analysis of legal materials used qualitative descriptive analysis. The results of the study show that the regulation of freedom of expression is regulated both in international human rights instruments (the Universal Declaration of Human Rights and the Covenant) and in national human rights instruments (the 1945 Constitution of the Republic of Indonesia and other laws and regulations). The regulation of freedom of expression is so important. Freedom of expression is one of the absolute requirements that allows democracy and public participation in decision-making. Freedom of expression is a prerequisite for the realization of the principles of transparency and accountability which are ultimately very important for the advancement and protection of human rights.

Abstract

The purpose of this study is to determine the partial and simultaneous effects of capital, working hours, and education on the income of MSMEs in the trade sector in Tabanan District, Tabanan Regency.The sample size in this study consists of 40 business units. The sampling method used is the census technique. Data collection was carried out through interviews, observation, and documentation. The data analysis technique used in this study is Multiple Linear Regression. The results of partial hypothesis testing indicate that capital, working hours, and education have a positive and significant effect on the income of MSMEs in the trade sector in Tabanan District, Tabanan Regency. Capital, working hours, and education simultaneously have a significant effect on the income of MSMEs in the trade sector in Tabanan District, Tabanan Regency

Abstract

This study aims to determine the effect of Tri Kaya Parisudha (manacika, wacika, and kayika) on the financial performance of LPDs in Badung Regency. The research was conducted on LPDs in Badung Regency. The objects of this study are manacika, wacika, kayika, and the financial performance of LPDs in Badung Regency. The total sample in this study consisted of 55 respondents, selected using proportional random sampling. The data analysis technique used is Multiple Linear Regression Analysis. The results of this study indicate that all independent variables (manacika, wacika, and kayika) have a partial, positive, and significant effect on the financial performance of LPDs in Badung Regency. The simultaneous implementation of Tri Kaya Parisudha (manacika, wacika, and kayika) also has a significant effect on the financial performance of LPDs in Badung Regency

Abstract

Rattan handicrafts have promising prospects in both local and international markets due to the trend of eco-friendly products. Social media plays an important role in promotion, but it is still not fully utilized by many business actors. Indang Apang Galeri, an MSME in Palangka Raya with 18.8 thousand followers on Instagram, experienced a decline in sales due to a lack of promotion on social media. This study aims to measure the influence of social media content on increasing the sales volume of rattan products. The method used was quantitative with respondents who were Instagram followers of Indang Apang Galeri who had bought their products. Data were collected through observation, interviews, questionnaires, and documentation, and analyzed using simple linear regression and T-test with the help of SPSS version 30. The results show that social media content contributes 68.6% to the increase in sales, with the rest being influenced by other factors. The tcal value of 10.960 > ttable 2.004 and the significance of 0.001 < 0.05 indicate a positive and significant relationship between social media content and sales volume

Abstract

Raw materials can increase the nutritional value of product. Raw materials with gluten-free and rich in nutrients are very beneficial for health. Mocaf flour (Modified Cassava Flour) and Moringa flour (Moringa oleifera) are gluten-free and rich in nutritional value. This study aims to find out how the organoleptic test value of steamed sponge cake with the proportion of mocaf flour and moringa flour. This study used a Completely Randomized Design (CRD). The research process began with making sponge cake by varying the amount of mocaf flour and moringa flour composition. Four variations of flour composition were used as treatments, namely: P1 =Moringa Flour 0%: Mocaf 100%, P2 =Moringa Flour 1%: Mocaf 99%, P3 =Moringa Flour 3%: Mocaf 97%, P4 =Moringa Flour 5%: Mocaf 95%. Data were analyzed by ANOVA using Microsoft Excel and IBM SPSS 25. If there is a difference, it is continued with the BNJ test at a significance level of 5%. The results showed that mixing the two types of flour as raw materials had a significant effect on all organoleptic parameters. The results of the hedonic test of Bolu Kukus showed that the highest level of preference was in the P2 treatment for all parameters tested.

Abstract

Following the establishment of the Job Creation Law and the associated regulations found in PP 18 of 2021, there were significant alterations made to the validation of existing rights that had earlier been governed by the rules of PP 24 of 1997. This transformation will undoubtedly affect the legal status of the evidence related to these existing rights. The purpose of this research is to examine the status of evidence for older rights concerning land rights registration within Indonesia, employing a normative research methodology. Additionally, the work utilizes both a statutory approach and a conceptual framework. Notably, there exist discrepancies in how evidence of existing rights is treated between PP 24 of 1997 and PP 18 of 2021. In PP 24 of 1997, evidence of older rights was acceptable for the registration of land rights. In contrast, PP 18 of 2021 mandates that evidence of individual old rights needs to be registered within a maximum timeframe of five years. Should the registration not occur within this designated period, the evidence will no longer serve as valid proof for land rights and will merely act as an indication for the process of land registration.
