Abstract

AbstractLegal Culture as collective respons to the Mariage Law (the Act No. 1 Year 1974), are different in every Adat Communities in Indonesia, especially in the Age Limit for man (19 years old) and woman (16 years old)  who are going to marry. So, this Act could be said as living law, if the value system of Adat Law Communities are relevant to the Age Limit to marry which are stated by the Act No.1 Year of 1974. In a few cases in the Batak Toba Society, the average of age limit to get merry are 27 years old for man and 23 years old for woman. Therefore, the legal culture of Batak Toba Society have been supported the Act No.1 Year 1974. It is also could get less deal number of mother who give birth to, if that it’s number has been grown up in Indonesia recently.Keywords : Anthropology of Law, the legal culture of Batak Toba Society, Act No.1 Year of 1974, the average of age limit to get merryAbstrakBudaya hukum sebagai respon kolektif masing-masing masyarakat Adat, terkait dengan batas usia kawin dalam Undang-Undang Nomor 1 Tahun 1974 disikapi berbeda berdasarkan nilai-nilai yang hidup di masing-masing masyarakat. Aturan tersebut menjadi hukum yang hidup (living law) bila nilai-nilai masyarakat adat tersebut mendukungnya, demikian pula sebaliknya. Abstract

AbstractThe certificate issued for the beneficiary, intended it can be easily proved the land tenure, the ongoing disputes of land tenure even thought land registration has been done.  Many people's with good faith in the practice of  land transaction in Indonesia were deceived because the land have two or more certificates. Double certificates can be caused due of intent, not accidental and wrong administrative, both internal or external. A dispute settlement of land tenure (double certificates)  trought by National Land Agency (BPN ) and litigation (court). AbstrakPenerbitan sertifikat  diberikan kepada yang berhak, bertujuan agar pemegang hak dapat dengan mudah membuktikan kepemilikan tanahnya, dalam pelaksanaannya walaupun pendaftaran tanah sudah dilakukan, namun masih sering terjadi sengketa-sengketa hak-hak atas tanah. Banyak orang dengan itikad baik dalam praktek  jual beli tanah di Indonesia yang tertipu karena tanah yang dibelinya mempunyai dua atau lebih sertifikat. Penyebab terjadinya sertifikat  ganda bisa dikarenakan adanya unsur kesengajaan, ketidaksengajaan dan dikarenakan kesalahan administrasi baik secara internal maupun eksternal. Mekanisme penanganan sengketa hak atas tanah (sertifikat ganda) penyelesaiannya dapat melalui Instansi Badan Pertanahan Nasioanl (BPN) dan melalui pengadilan.

Abstract

Thus far, equality before the law is understood as an ideality without limitation and exception. Its enforceability is considered to apply indiscriminately for every law breaker. However, reality of law enforcement says differently when a perpetrator of the crime is called an early age child. Special regulations exist injustice system, law governing it as well as provisions derived from the children rights, although the child is positioned as dealing with the law. In such context of an establishment of law regarding children in conflict with the law, it is interesting to find philosophical roots of distinctive treatment negating equality before the law. The explorative step is more attractive, especially when many mosaics of conception has been discovered about what are the truths whena child is in conflict with the law: 1) violations committed by children are not purely mistakes of the children, 2) children are, nevertheless, having rights that must be fulfilled including when dealing with the law, 3) children has privileges with broad distribution of regulations in various sectors and according to the view based on Pancasila, they are keten (a link) of a nation. Such varied conceptions elicit necessity of unearthing philosophical roots, truths and realitiesthat are always plural. So that, the law established is not only be legal because it is formed in legitimate manner and by legitimate power (pedigree thesis), also incorporating theexisting basic values or moral principles, though not absolute, depending on condition of society (the moral thesis) (Twining, 2009). Thus, study of such legal products is not only be seen as the work of professional, but as Satjipto Rahardjo viewed, it is placed as an scientific object to explain that a law codified in legislation, though, is not something sacred to examine for its philosophical content.

Abstract

AbstractPurpose of this study is to find out the independence of the judiciary of corruption in the state system in Indonesia. The method used is a normative legal research methods (legal research), with the approach of the statute .Data sourced from legislation, library materials, and interviews. Qualitative data was analyzed in such a way and set out in writing a descriptive analysis. The results of this study illustrate that the independence of the corruption judiciary is determined from the independence of its institutions, the courts, and the judges. The intervention against corruption court decision is not aimed at her agency or the judicial process, but addressed to the judge overseeing the corruption case, in the form of feedback, criticism and even censure which was published in a newspaper that has led to contempt of court. AbstrakTujuan Penelitian ini ialah untuk mengetahui kemandirian pengadilan tindak pidana korupsi dalam sistem ketatanegaraan di  Indonesia.  Metode yang digunakan ialah metode penelitian hukum normatif (legal research), dengan pendekatan perundang-undangan (Statute approach) .. Data yang  bersumber dari perundang-undangan, bahan pustaka, dan hasil wawancara. Data kualitatif kemudian dianalisis sedemikian rupa dan dituangkan dalam bentuk tulisan secara diskriptif analisis. Hasil penelitian ini memberi gambaran bahwa bentuk kemandirian pengadilan tindak pidana korupsi ditentukan dari kemandirian lembaganya, proses peradilannya, dan hakimnya. Adanya intervensi terhadap putusan pengadilan tindak pidana korupsi bukan ditujukan terhadap lembaganya atau proses peradilannya, tetapi ditujukan kepada hakim yang menangani perkara korupsi, berupa tanggapan, kritik dan bahkan celaan yang dimuat dalam berita surat kabar yang sudah mengarah pada contempt of court.

Abstract

Article 66 paragraph (1) Act Number 2 of 2014 essentially regulates the consent of the Notary Honorary Council in the criminal justice process. The provisions in the a quo article have been still being applied and become a positive law in Indonesia. One of the criminal justice process in the notarial field relates to the criminal act of revelation of secrets as regulated in Article number 322 paragraph (1) of the Criminal Code. The consent given by the Notary Honorary Council as outlined above can certainly be viewed in the context of criminal law.The research is a normative legal research using secondary data of both primary legal materials and secondary legal materials. The data collecting technique used is documentary study with written materials as the data collection tool to be analyzed qualitatively using content analysis.The research result showed that in the context of criminal law, basically a notary who provides a copy of the deed and/or documents attached to the minuta deed or notarial protocol in the notarial archives for the purpose of the investigator, the public prosecutor or the judge has committed a criminal act of revelation of secrets as stipulated in Article number 322 paragraph (1) of the Criminal Code. However, the notary is not necessarily criminally liable considering the consent of the Notary Honorary Council as the grounds of impunity.Keywords: Notary Honorary Council consent, grounds of impunity, criminal act of revelation of secrets.

Abstract

Developments in information and communications technology have significantly influenced and changed lives of peoples by  providing  new opportunities for consumers and businesses.  In digital economic era, an increasing number of consumers engage in e-commerce, which provides easier and faster access to products and services However it also presents some challenges for consumers that differ from offline commercial transactions. The impersonality of e-commerce weakens the relationship between businesses and consumers, thereby increasing consumer vulnerability that could lead to  to unfair commercial practices and causing uncertainty and lack of trust by consumers. Therefore,  there is a need by the government and busineese to promte and protect consumer trust in digital markets so it will not hamper development digital economy

Abstract

AbstractThis paper is partly the result of prime research of Higher Education discusses the contribution of legislation in the field of food PVP and protect the economic rights of breeders of plant varieties that produce seeds crops. research conducted an empirical legal research. Data obtained from informants and analyzed using interactive models of analysis. The results showed that Indonesia as one of the country have little megabiodiversity germplasm that can be developed into high-yielding varieties. Although there is little genetic but basically each region has the potential to develop high yielding varieties through plant breeding and protected by pvp. pvp is a form of protection of the economic rights of plant breeders. Although each region has the potential for yielding varieties that can be requested, but the PVP application of knowledge communities and relevant agencies on the protection of plant varieties is still lacking. Legislation in the field of food has not been able to PVP and encourage breeders of plant varieties produce seed crops because they can not protect their economic rights. Draft a list of six National Legislation Program 2010-2014, only two bill that has been passed into law, the Act Number 13 of 2010 concerning Horticulture was passed in 2010 and the Act Number 18 of 2012 concerning Food was passed in 2012.Keywords : protection of plant variety, protection of economic rights, food securityAbstrakTulisan ini merupakan sebagian hasil Penelitian Unggulan Perguruan Tinggi yang membahas kontribusi perundang-undangan bidang PVT dan pangan dalam melindungi hak ekonomi pemulia varietas tanaman yang  menghasilkan bibit unggul tanaman pangan.  Penelitian yang dilakukan merupakan penelitian hukum empiris. Data diperoleh dari informan dan dianalisis dengan menggunakan interactive models of analysis.   Hasil penelitian menunjukkan bahwa Indonesia sebagai salah satu negara megabiodiversity hanya mempunyai sedikit plasma nutfah yang dapat dikembangkan menjadi varietas unggul.. Meskipun hanya terdapat sedikit plasma nutfah tetapi pada dasarnya tiap daerah memiliki potensi varietas unggul yang dapat dikembangkan melalui kegiatan pemuliaan tanaman dan dilindungi melalui PVT. PVT merupakan salah satu bentuk perlindungan hak ekonomi para pemulia tanaman. Meskipun tiap-tiap daerah mempunyai potensi atas varietas unggul yang dapat dimintakan permohonan PVT tetapi pengetahuan masyarakat dan instansi terkait tentang perlindungan varietas tanaman masih kurang.   Perundang- undangan di bidang PVT dan pangan belum mampu mendorong pemulia varietas tanaman menghasilkan bibit unggul tanaman pangan   karena belum dapat melindungi hak ekonomi mereka. Dari enam daftar RUU  Program Legislasi Nasional tahun 2010-2014, baru  dua  RUU yang telah disahkan menjadi UU, yaitu Undang Undang Nomor 13 tahun 2010 tentang Hortikultura yang telah disahkan pada tahun 2010 dan Undang-Undang No 18 tahun 2012 tentang Pangan yang disahkan tahun 2012.Kata kunsi : Perlindungan varietas tanaman, perlindungan hak ekonomi, ketahanan pangan

Abstract

AbstractState of Indonesia is in the form of the republic, which consists of several islands. So called archipelago that has outstanding cultural richness and are not owned by another country, one of the Indonesian national pride by having a diversity of ethnic, tribal customs that have high values inherited by our ancestors to be conserved and have value quite high as a tool to build character as a nation and is the capital of local wisdom very proud of each region through provincial and district/city in the archipelago along still recognized and not contrary to the values of national wisdom that the values of pancasila . Indigenous people ( MAHUdAT ) and customs / traditional culture is still recognized its existence ( living law) as mandated by Article 18 B in conjunction with Article 32The  1945  constitution jo permendagri No. 39 of 2007 , for it needs to be implemented and used as the basic capital development in all fields in order of regional autonomy . Empowering Indigenous leader and kinship to participate in governance , which made the subsequent government policy areas outlined in the regulations . Sehingga disebut dengan Nusantara yang memiliki kekayaan budaya yang luar biasa dan tidak dimiliki oleh negara lain, salah satu kebanggaan bangsa Indonesia dengan memiliki keanekaragaman etnis, suku budaya/ adat istiadat yang mempunyai nilai-nilai luhur yang diwariskan oleh nenek moyang untuk dilestarikan dan mempunyai nilai yang cukup tinggi  sebagai alat untuk membangun karakter bangsa dan merupakan modal sebagai Kearifan lokal yang sangat dibanggakan oleh masing-masing daerah melalui Provinsi dan kabupaten/kota di seluruh Nusantara sepanjang masih diakui dan tidak bertentangan dengan nilai-nilai Kearifan nasional yaitu nilai-nilai Pancasila. Masyarakat Hukum Adat ( MAHUDAT) beserta adat istiadat/budaya tradisionalnya hingga saat ini masih diakui keberadaannya (living law) sebagaimana yang diamanatkan oleh Pasal 18 B jo Pasal 32 UUD Negara Republik Indonesia Tahun 1945 jo Permendagri No 39 Tahun 2007, untuk itu perlu diimplementasikan dan digunakan sebagai modal dasar pembangunan di segala bidang dalam rangka penyelenggaraan otonomi daerah. Pemberdayaan Tokoh Adat dan Kekerabatannya untuk dapat berpartisipasi dalam penyelenggaraan pemerintahan, yang dibuat sebagai kebijakan Pemerintah Daerah selanjutnya dituangkan dalam Peraturan daerah. AbstractThe politic party is a democration tool at any country which function for to channel populace aspiration to government, to give politic education, and another. In other to function get materialized, so country was giving help finance for to help the politic party in the it operation activity. Politic party in to manage help finance from country must justify to the country building on law, so the law must made by country pass legal policy. Legal policy responsibility politic party in management help country finance is a formal policy of country for attain national destination by law. For attain national destination mentioned, so to do law making as legislation and technical regulation which arrange responsibility mentioned. The development perceivable direct general election implementation period on the Indonesian Republic that is general election 2004 years, 2009 years, and 2014 years. Agar fungsi itu dapat terwujud, maka negara memberikan bantuan keuangan untuk membantu partai politik di dalam menjalankan kegiatannya. Partai politik dalam mengelola bantuan keuangan dari negara wajib mempertanggungjawabkan kepada negara berdasarkan hukum, maka hukum harus dibuat oleh negara melalui politik hukum. Politik hukum pertanggungjawaban partai politik dalam pengelolaan bantuan keuangan negara adalah suatu kebijakan resmi negara untuk mencapai tujuan nasionalnya melalui hukum. Untuk mencapai tujuan nasional tersebut, maka dilakukan pembuatan hukum berupa peraturan perundang-undangan dan peraturan teknis yang mengatur pertanggungjawaban tersebut. Pasca reformasi politik hukumnya mengalami perkembangan dari aspek pengaturan. Perkembangan itu dapat dipahami menurut periodisasi penyelenggaraan pemilu secara langsung di Negara Republik Indonesia, yaitu: Pemilu 2004, 2009, dan 2014. Dalam ketiga penyelenggaraan pemilu tersebut terbentuk produk-produk hukum untuk mengatur pertanggungjawaban partai politik dalam pengelolaan bantuan keuangan.Kata kunci: Politik Hukum, Partai Politik, Pertanggungjawaban Bantuan Keuangan Negara

Abstract

AbstractLeasing agreement is extremely useful for society, but there are many deviations from the principles of contract law and the principles of leasing in actual practices, so that is needed to make the breeding of the principles contract law. In the leasing agreement practice, there are some deviations from the principles of contract law and the leasing principles, so that they create inbalancing in the legal  relations;  the breeding of contract law principles becomes an important  thing which must be done immediatly in order to have a fair and balancing legal relations; the principle of contract law as the result of breeding is the harmony principle as prismatic principles of contract. The harmony principles  that integrated of the principle of  the reasonableness/equity, laras, rukun, the balancing and the proportionality.Key Word: breeding, the principle of contract law, financial, leasing
