Abstract

AbstractThis research is aimed at studying and exploring about the relationship between the arrangement of election system adopted in Act No 8 Year 2012 on the election for the members of DPR, DPD and DPRD in 2014 general election and  the practice of political corruption. The research is socio-legal research which integrates law norm with sociological aspect, applying approach method which put law principles and policial attitude. The result of the research shows that there is a positive correlation between the arrangement of open list proportional election with most number base and political corruption. As this system is highly cost, the candidates of legislative member happen to conduct deceitfulness in the election or what is classified as money politic to get support of the voters. The motive of political corruption conducted by the member of DPR and DPRD is to get back the high cost during the election. The renewal model of the election arrangement to creating political anti-corruption is through purifying proportional election system by applying close list proportional system with serial number base. AbstrakPenelitian ini bertujuan untuk mengkaji dan mendalami tentang hubungan pengaturan sistem pemilu yang diadopsi dalam UU No. 8 Tahun 2012 Tentang Pemilu Anggota DPR, DPD dan DPRD pada pemilu tahun 2014 dengan praktek korupsi politik. Penelitian ini merupakan jenis penelitian sosio-legal yang menggabungkan norma hukum dengan aspek sosiologis dengan menggunakan metode pendekatan asas-asas hukum dan perilaku politik. Hasil penelitian memperlihatkan, bahwa pengaturan sistem pemilu proporsional terbuka (open list) berbasis suara terbanyak berkorelasi positif terhadap pratek korupsi politik. Karena sistem pemilu ini berbiaya mahal, akibatnya calon anggota legislatif melakukan aneka model kecurangan dalam pemilu yang dikualifikasikan sebagai praktek politik uang untuk mendapat dukungan pemilih. Motif korupsi politik yang dilakukan oleh anggota DPR dan DPRD adalah mengembalikan biaya mahal yang dikeluarkan saat pemilu. Model pembaruan pengaturan sistem pemilu untuk menciptakan pemilu antikorupsi politik adalah memurnikan sistem pemilu proporsional dengan merubah model pengaturan sistem proporsional terbuka terbatas (close list) dengan berbasis nomor urut.

Abstract

AbstractProtection of folklore is very important. Indonesia set folklore in the Copyright Act of 2002. In the Copyright Act of 2002 provisions on folklore contained in Article 10, but the settings of folklore in the Copyright Act of 2002 was inadequate, so it is still happening some of Indonesian folklore claimed by foreign countries. Internationally, as yet there is uniformity in the protection of folklore. Regulations in the protection of folklore in every country there has been no uniformity as well. There is a set folklore widely in intellectual property law, but some are set specifically in the Copyright Act.

Abstract

AbstractBackground of this research is the rapid growth Bangkalan of the post-operational Suramadu bridge which have significant impact on increasing local income. Increased of local revenues must be increase the welfare of society, therefore development  sourced from the budget should be oriented in various aspects leading to the nation's independence. Unfortunately, society is still not maximal to use of channels of participation in budgeting. This study uses legal research empirical or socio-legal research, interview and observation is used to obtain primary data in the form of public participation in the budgeting process in Bangkalan.  The result of this research is interpretation about Bangkalan development is only on physical form, the Bangkalan society is not maximized in using the existing channels as participation in the preparation and budget planning. AbstrakPenelitian ini dilatar belakangi berkembang pesatnya Bangkalan pasca operasionalisasi Jembatan Suramadu yang tentunya juga membawa dampak signifikan terhadap meningkatnya pendapatan daerahnya. Meningkatnya pendapatan daerah sudah seharusnya meningkatkan pula kesejahteraan masyarakatnya, oleh karena itu pembangunan yang bersumber dari APBD harus berorientasi dalam berbagai aspek menuju pada kemandirian bangsa. Sayangnya masyarakat masih belum maksimal menggunakan saluran partisipasi penganggaran. Penelitian ini menggunakan metode penelitian hukum empiris atau yang biasa di sebut sebagai sosio legal research, wawancara mendalam serta observasi digunakan untuk mendapatkan data primer berupa partisipasi masyarakat terhadap proses penganggaran di Kabupaten Bangkalan. Penelitian ini mendapatkan hasil bahwasanya masyarakat di Bangkalan masih memaknai pembangunan hanya dalam bentuk fisik, masyarakat belum maksimal dalam menggunakan saluran yang ada sebagai bentuk partisipasi dalam penyusunan dan perencanaan APBD.

Abstract

ABSTRACTThe basis of legitimacy authentication on state administrative decision (berschikking) is that the state administrative decision is charged as in contradictory with the legislation prevailing and the general principles of good governance. Such the provision is governed in Article 53 clause (2) a,b, Act Number 9 of 2004 about PTUN, as the first amendment to the Act Number 5 of 1986 about PTUN. The existence of good governance general principles in the Act Number 5 of 1986 has not been confirmed as legal norm, but in the Act Number 9 of 2004, the general principles of good governance (AAUPB) have been confirmed in formal juridical way as the legal norm. In the presence of such the confirmation, various opinions raise, on the one hand, the presence of AAUPB confirmation restricts the judge’s movement, so that the existence of AAUPB remains to be ethics and is not necessary to be included into the Act. AAUPB is better growing and developing in non-written legal norm as code of ethics (Muchsan, in W. Riawan Tjandra, 2009:140). On the other hand, some people argues that AAUPB confirmed in formal juridical way as a legal norm is not a problem, because the judge in the society change and development is required to be more active, creative, future oriented and not handcuffed by normative rules as the legal positivism tenet prioritizing more the procedural justice. The judge may not be bound by the written convention only but should also explore the legal values and sense of justice living within the society as mandated by the jurisdictional law. The Judge interprets and constructs law to produces a verdict emphasizing on the justice the society expects.Abstrak                Dasar pengujian terhadap keabsahan keputusan tata usaha negara (beschikking) adalah bahwa keputusan tata usaha negara yang digugat bertentangan dengan peraturan perundang-undangan yang berlaku dan asas-asas umum pemerintahan yang baik. Ketentuan tersebut diatur dalam Pasal 53 ayat (2) a,b, Undang-undang Nomor 9 Tahun 2004 tentang PTUN, sebagai perubahan pertama atas Undang-undang Nomot 5 Tahun 1986 tentang PTUN. Eksistensi asas-asas umum pemerintahan yang baik dalam Undang-undang Nomor 5 Tahun 1986, belum ditegaskan sebagai norma hukum, namun dalam Undang-undang Nomor 9 Tahun 2004, asas-asas umum pemerintahan yang baik (AAUPB) tersebut ditegaskan secara yuridis formal sebagai norma hukum. Dengan penegasan tersebut, timbul berbagai pendapat, di satu pihak dengan adanya penegasan AAUPB akan membatasi ruang gerak hakim, sehingga eksistensi AAUPB tetap sebagai etika dan tidak perlu dimasukan dalam undang-undang. AAUPB lebih baik tetap tumbuh dan berkembang dalam bentuk norma hukum tak tertulis sebagai code of ethics (Muchsan, dalam W. Riawan Tjandra, 2009 : 140). Di pihak lain berpendapat bahwa AAUPB yang secara yuridis formal ditegaskan sebagai norma hukum, bukan merupakan suatu permasalahan, karena hakim dalam perubahan dan perkembangan masyarakat dituntut untuk lebih aktif, kreatif, berpandangan ke depan dan tidak terbelenggu oleh aturan-aturan normatif sebagai ajaran positivisme hukum yang lebih mengedepankan keadilan prosedural. Hakim tak boleh terikat oleh undang-undang yang bersifat tertulis saja, tetapi harus menggali nilai-nilai hukum dan rasa keadilan yang hidup dalam masyarakat sebagaimana diamanatkan undang-undang kekuasaan kehakiman. Hakim dapat melakukan penafsiran dan konstruksi hukum untuk menghasilkan putusan yang mengedepankan keadilan yang diharapkan masyarakat.

Abstract

AbstractThis paper aims to examine how the legal ability of the legal system of Commercial Paper in achieving the objectives of the law. The study needs to be undertaken, given the legal system should ideally have the ability to achieve the objectives of the law in support of law enforcement. The conclusion summarizes that overall existing legal system in Commercial Paper trading activities has limited law capability, because it only resolves legal certainty, while other objectives such as justice and expediency has not achieved by all elements of the existing legal system. Abstrak                     Tujuan penulisan makalah ini adalah untuk mengkaji bagaimana kemampuan hukum dari sistem hukum Commersial Paper dalam mencapai tujuan hukum. Hal ini perlu untuk dilakukan, mengingat sistem hukum idealnya memiliki kemampuan dalam mencapai tujuan hukum guna mendukung penegakan hukum. Kesimpulan hasil pembahasan terhadap permasalahan yang diajukan tersebut adalah bahwa secara keseluruhan sistem hukum yang ada dalam kegiatan perdagangan CP memiliki keterbatasan kemampuan hukum karena baru dapat mencapai tujuan kepastian hukum saja, sedangkan tujuan hukum lainnya, yakni keadilan dan kemanfaatan  belum dapat dicapai oleh seluruh unsur sistem hukum yang ada.

Abstract

AbstractImprisonment as the main criminal is the most threatened against offenders. Imprisonment in Indonesia criminal law as a legacy of colonial law enforcement. With the development of the concept of criminal theory form retributive to restorative sentencing, imprisonment and the implementation should be reviewed so that can be in accordance with human rights principles. This research examined the imprisonment in the Indonesian criminal law, customary criminal law, and Islamic Penal law, and also the concept of imprisonment renewal in the concept of Criminal Law Code of Indonesia, and then what is the punishment that is accordance with restorative justice theory that can protect the human rights of the convicted person, victims, and society.Key Word: Imprisonment, human rights, restorative justice.AbstrakPidana penjara sebagai pidana pokok merupakan pidana yang paling banyak diancamkan terhadap pelaku kejahatan. Pemberlakuannya merupakan peninggalan hukum kolonial. Dengan perkembangan pemikiran mengenai konsep pemidanaan dari retributif ke restoratif, pelaksanaan pidana penjara pun harus dikaji ulang sehingga dalam penjatuhan maupun pelaksanaannya dapat sesuai dengan prinsip hak asasi manusia. Penelitian ini mengkaji penerapan pidana penjara dalam hukum pidana Indonesia, hukum pidana adat, dan hukum pidana Islam, serta konsep pembaharuan pidana penjara dalam RKUHP, kemudian bentuk pembaharuan pemidanaan apakah yang sesuai dengan teori restorative justice yang dapat melindungi hak asasi terpidana, korban, dan masyarakat.Kata Kunci: Pidana penjara, hak asasi manusia, keadilan restoratif

AbstractThis research is a legal empirical research by using the statute approach. The study is a descriptive analysis. Primary and secondary data used in this study analyzed qualitatively. The results of this research shows that, in order to carry out the affairs of other mandatory related special authority as mandated by Act Number 11 of 2006 regarding the Governing of Aceh, The Government of West Aceh district has implemented the four distinctive areas of Aceh. However, in its implementation faced many obstacles. and support local elites. AbstrakPenelitian ini merupakan penelitian hukum empiris ( empirical research) dengan menggunakan pendekatan perundang-undangan (statute approach). Penelitian bersifat deskriptif analitis. Data primer dan data sekunder yang digunakan dalam penelitian ini dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwadalam rangka melaksanakan urusan wajib lainnya yang menjadi kewenangan khusus sebagaimana diamanatkan dalam Undang-Undang Nomor 11 Tahun 2006 tentang Pemerintahan Aceh, Pemerintah Kabupaten Aceh Barat telah melaksanakan keempat bidang yang menjadi keistimewaan Aceh. Namun dalam pelaksanaannya menghadapi berbagai hambatan. Adapun hambatan-hambatan dan dukungan elit daerah.

Abstract

This research aimed to identify and analyze legal protection for new creditors in the takeover of credit with mortgage guarantee. Type of Research is a normative legal research or an equation with doctrinal research. The results of this research shows that the implementation of the credit take over with collateral mortgage starting from the loan application by the debtor and all the completeness of the terms of credit application, to do a survey to customers. If it is eligible, then continuing to make a credit proposal in which will be submitted to a credit comitee. If it is approved then continued with the credit agreement and collateral agreement that are required to bring the debtor. Then the bank employees accompany the debt to the former creditor, to make payment with funds obtained from third party to make payment with funds obtained from third party. If the repayment has been done, required to request full payment slip and genuine proof of guarantee ownership, then they can be burden by mortgage, roya has to be done first. The transfer mechanism of mortgage in credit takeover is too risky for a new creditor if the Roya’s mail can not be published on the same day. So that way is provide less certainty and legal protection for the new creditors.

Abstract

AbstractThe Al-Munawaroh Muslim is an Islamic communitygrowing in Gilingan urban area of Surakarta City. Most members of this association and many people living around the area were living in poverty. This situation was perceived as a common problem and challenge for the community to resolve it. The aim of this study is to discuss critically the contemporary evident on community governance in Surakarta in line with the Indonesian Constitution of 1945, the Law 13/2011, and the Presidential Decree 166/2014 and that of 96/2015. One case study of the religion-based association namely the Al Munawaroh Muslim of Surakarta has been examined with regard to the networks created by the community in delivering community governance. By using ethnographic method, this research showed that the community had capacity to govern common problem despite its limited capacity; it has capacity to provide sustainable public service for the poor because its leaders, advisers and experienced members were together able to create social capital including internal networks among its members and external networks with other institutions horizontally and vertically. Conflict of some officials of the community was unavoidable because of different interests and preferences among them in managing the resource they belong, and some membersof the communitywere to be self-interest resulting in distrust among the majority of the members to them. Although the community had a capacity of governance by providing public service for the poor with food material and financial assistances, it was not a substitution but a complement for the state role in alleviating poverty.

Abstract

The aims of this research is to explain the batik wood artists level of understanding of Copyright as part of Intellectual Property as stipulated in Act Number 19 Year 2002. The research was conducted with descriptive qualitative approach and the data were collected using questionnaires from 65 batik wood artists that were selected randomly from 673 artists in Gunung Kidul. The data is also completed with interviews from main informants, and observation results and content analysis results. The data validation was done use source triangulation techniques to obtain data that reflecting facts. Data analyzed with interactive model in cycle with stages data collection, data reduction, data presentation and data verification. The results show that the low implementation of copyright registration is not only due to the lack of artists in understanding the Copyright, but rather from the influence of socio – cultural aspects of society that are collective. Thus, emphasizing the moral aspect of the formal aspects such as Copyright that are part of the western culture. The Copyright Act No. 19 Number 2002 is the revision of previously Copyright Act which has not provided a proportional space for Moral Rights compared to Copyright which tends to the economic aspects.
