Abstract

This study is motivated by the facts on the field that there are many cases of family on the practice of the grants from parents to daughters. From the study on six cases on the practice of parents’ grants to their children, it is concluded that all of the grants given to the children can be categorized as grants in the general terms since they are in the forms of pure grants or will. From the perspective of Islamic law, this practice still can be justified since it is in accordance with faraidh and grants concept in Islam.

Abstract

The politics can be referred to as the relations of power. If so, then the gender relation is a relation of power, between the parties that dominate and are subordinated, that is the gender power relations in the struggle for access and control between women and men in the management of resources in the household. So it is important to know how the access and control of women and men who works as rubber tappers farmers is in the public and domestic domain in the Hanua village. This study of the socio-political conditions of rural women is in qualitative-descriptive perspective, and the data is collected with the sharing of life techniques in which 20 men and women used as informants and is analyzed using the gender framework analysis (GFA) or the Harvard analysis techniques. Hanua is the village in Kahayan watershed, where the main livelihood of the population is rubber tapper farmers. Actually, the Dayaks do not distinguish the status of men and women in the public sphere, but there is a distinction in the exercise of power in domestic and public environments, which the men power is higher than women. This is reflected from unequal women’s access and control, both in the management of family income and investment.

Abstract

The legal principles of women position in the Banjar community customary law are reflected from the legal norms used in the division of inheritance in lembaga damai  (peace institute) by means of peaceful settlement (islah /faraid islah). The process in the so called lembaga damai shows how women position is recognized as heir. This study is conducted to identify the legal norms of inheritance and the legal norms of women position in the Banjar community customary law.This study employs normative methods which data is drawn from primary, secondary and tertiary legal materials and from in depth interviews with the key informant. The result of the study shows that the Banjar legal norms on inheritance which is implemented in the lembaga damai is executed with peace settlement (islah/faraidh islah). Women are recognized as heir and their part of inheritance is relative—can be larger than men, can be equal to men, or can be less than men. This relative magnitude of inheritance indicates that the principle of divine, the principal of benefit and balance which it all rest on “maslahah mursalah” proposition are well applied.

Abstract

This article analyzes the response of M. Quraish Shihab interpretation on the controversy of sensitive issue in feminism discourse that arises among classical and contemporary Moslem scholars, that is the process of women creation. An interpretation mainstream has been grew among the classical Moslem scholars that women were created from the ribs—a literal interpretation and emphasizes the process of physical events which then has implications for their subordinate position compared to men. Whereas, a metaphor interpretation which emphasizes on the women psychology rather than the actual physical events grows among the contemporary scholars. This study tries to elaborate the interpretation argumentations and to locate the interpretation in the debate arises among classical and contemporary interpretation.

Abstract

This study aims at assessing the implementation of the empowerment program of commercial sex workers through community development at the Pebatuan localization complex in Banjarbaru which has been undertaken by PusatPengabdianMasyarakat (PPM) IAIN Antasari Banjarmasin. It is identified from the result of the study that the empowerment program is considered effective. The empowerment program effectiveness is indicates from: the benefits of religious sermon, the suitability of the sermon material, the sermon attraction, the ability of the preacher, the sermon duration, the trainings benefits, the trainings suitability, the ability of the trainer, the trainings duration, the trainings skills, the awareness to participate in the trainings, the trainings facilities, the suitability of the trainings equipment, the program sustainability, the need to continue the programs, the programs committee services, the committee clarity, the employers’ support to participate in the sermon, the employers’ support to participate in the trainings, the will to change the way of life, the belief of changing fate, and the will to develop the trainings. Moreover, there is a significant correlation between the related variables which includes the religious sermon activities, the trainings activities, the facilities, the awareness to participate in the trainings, the employers’ supports, and the belief and will of the participants and the committee services. However, some weaknesses of the variables are also found, namely: the lack of facilities provided, the lack of ability of the trainers, the lack of skills given in the trainings, the lack of duration of the sermon and trainings.

Abstract

The affirmative action policy through the provision of a 30 % quota of parliamentary seats has been passed three times in legislative elections—2004, 2009, and 2014. Yet, the desired representation still cannot be achieved and even the figure of 20% has not been able to accomplish. Whereas, women representation in the parliamentary is something that very basic in order to meet women’s political rights in the state. Men and women should have the equal opportunity to participate and to have control in running the government. However, there are still few women who plunge into politics. In addition to the dominant role of the party elite and inadequate recruitment system of the legislative candidates, political education is also still very minimal and a strong kinship system have made politics to be the last choice for women. Thus, women’s lack of interest and desire to get involved in politics results in lack of women’s representation quota in parliament.

Abstract

This study tries to picture the shift in gender relations discourses in the interpretation paradigm in Indonesia by comparing the interpretation (tafsir) of ‘Abd al Rauf Singkel and M. Quraish Shihab. The result of study shows that there are some similarities and differentiations in the pattern of the compared interpretation of the two Indonesian Malay scholars on gender versus. ‘Abd al Rauf Singkel’s interpretation generally follows the traditional interpretation paradigm, yet the creativity elements still can be found. As the main source, The interpretation of Al-Mustafid which refers to al-Jalalain interpretation may describe the mindset of ‘Abd al Rauf Singkel whose his is in the traditional interpretation mainstream and which is gender bias. It is reflected in some of his interpretations. However, His views are more moderate and tolerant as shown in his interpretation on the issues of women creation and leadership. The shift of gender relation discourse is more visible in the interpretation of Quraish Shihab. He seems to have his own interpretation which does not fully follow the view of both traditional and contemporary interpretation. He, for example, interprets ‘nafswahidah’ as ‘Adam’ whose couple is Eve. However, he does not agree that Eve was created from Adam himself, but from Adam’s type. Thus, he is in a position between the traditional and the contemporary. A similar tendency can also be seen from other themes. These interpretations are a step further than the previous Indonesian commentators (mufasir), not least ‘Abd al Rauf Singkel.

Abstract

The presence of homeless children has been commonly visible in big cities in Indonesia. Children are a gift and trust of God that in them inherent dignity as human must be respected. Children’s rights are part of human rights as contained in the 1945 Constitution, Law No. 39, 1999 on Human Rights, The President Decree of The Republic of Indonesia No. 36, 1990 on the ratification of Convention on the Rights of the Child. The phenomenon of homeless children in Indonesia, especially in big cities such as Banjarmasin, is increasingly complex. This writing is to find out how the religious education takes part in the homeless children’s everyday life in Banjarmasin.

Abstract

Women’s right in politics has been regulated by law. Specifically, Law No. 12 of 2003, article 65, paragraph 1, has specified the quota of women in the general election by 30 percent. Nevertheless, the women’s representation in the legislative has not met expectations. The data from the Ministry of Women Empowerment and Child Protection has shown that the number of women who sit in the House of Representatives (DPR) is only 18 percent, while in the People’s Consultative Assembly (MPR) and the Regional Representative Council(DPD) are respectively 20 and 27 percent,. The data also shows that the women who sit in the Province Legislative Council (DPRD Provinsi) is only 16 percent, and 12 percent in the City Council (DPRD Kota) dan the Regency (DPRD Kabupaten). The success of the women candidates to become the members of legislature can not be separated from their sincerity and persistence efforts to apply the right strategy. Strategies determine the success of the candidates. Referring to the importance of strategy, thus, it becomes significant tospecifically examine the candidates’ strategies in a study entitled: “Strategi Caleg Perempuan Terpilih sebagai Anggota DPRD Kabupaten/Kota di Kalimantan Selatan Pemilu 2014” The problem formulated in this study is how the strategies implemented by the elected women candidates as the members of the City Council and the Regency in South Kalimantan in the 2014 Election. The study employs qualitative method through descriptive study. The study takes place in South Kalimantan where the  samples are taken from seven locations with a diverse number of votes. There are three findings from the study. First, in general, the elected women candidates have employed the strategy of political marketing and the strategy of social capital. The strategy of political marketing employed by the elected candidates include: segmentation and mapping, campaign and positioning, and evaluation and monitoring. Second, thesocialization is held privately by door-to-door visiting the people. The candidates carry out periodic evaluation and monitoring with involving their successful team. Third, the entire candidate has a good social capital, i.e. the ability to relate and cooperate with others. The social capital includes: the ability to build network and to gain thrust, and to bind themselves to the religious beliefs of the candidates and the public in their electoral district

Abstract

Based on the family culture in South Kalimantan which is patriarchy. men have the privilege more than that of women. South Kalimantan is an area predominantly occupied by Muslim. Since the arrival of Islam in South Kalimantan around the 16th century brought about by the Sultanate of Demak via trade, Banjarmasin kingdom turned into a patterned Islamists led by Sultan Suriansyah with governance structures that are influenced by Javanese culture. Java whose sensible patriarchal culture considered the women at that time onlyas a supplement and concubines to men. In addition, gender inequality and patriarchal culture are deeply rooted in the cultural traditions of Banjar. Growing view in society about women makes them do not take part freely in the public domain. Public already believes that women can take part only in the privacy of the home environment. Few female characters are written in this study with the aim to open up the idea that Banjarese women are intelligent, able to provide imaging of the women, who have equivalent education to men, and are capable of acting to contribute energy and thoughts on public space in the field of education.
