Abstract

Humanitarian intervention is an attempt to prevent or stop the gross human rights violations with particular strengths (diplomatic and military) in a State, either with or without the consent of the State (countries with internal conflict). The problems in this journal are: first, how the arrangement of international law on humanitarian intervention. Secondly, the role of the UN in humanitarian intervention in armed conflicts. The method used is a normative legal research methods with the main source of data collection procedures is a legal substance that contains of normative law. The results showed that the rules of international law on humanitarian intervention by the United Nations stipulated in the UN Charter and general principles of international law. Humanitarian intervention legally justified by following provisions in applicable international law, namely Articles 39-51 of UN Charter. While the role of the UN in humanitarian intervention in armed conflicts carried out by the Security Council as the organ of the United Nations in maintaining peace with the decision issued in the form of a resolution for areas experiencing conflict. Therefore, it takes an international treaty that regulates clearly about humanitarian intervention, so that in practice, remain consistent with the objectives and executive organs of humanitarian intervention. Keywords: Humanitarian Intervention, Security Council of UN, Armed Conflict.

Abstract

Hak masyarakat adat telah diatur dalam beberapa perjanjian internasional. Masyarakat adat dalam hukum internasional merupakan bagian dari hak asasi manusia baik itu secara individu maupun kelompok (kolektif). Prinsip dasar hukum internasional dan hukum hak asasi manusia telah diterima masuk kedalam hukum nasional dan pada tataran implementatif peraturan hukum nasional untuk memperhatikan perlindungan hak-hak masyarakat adat dapat terjamin sesuai dengan semangat konstitusi dan hak asasi manusia di Indonesia. Metode penelitian yang digunakan dalam penelitian ini adalah pendekatan yuridis normatif dengan spesifikasi penelitian deskriptif analitis. Pencarian data berupa bahan hukum primer dan sekunder serta tersier, data-data yang dikumpulkan bersumberkan pada bahan pustaka, kemudian dianalisis dengan menggunakan metode yuridis kualitatif. Penelitian ini menitik beratkan pada kajian teori hak asasi manusia baik secara individu maupun kolektif sebagai bentuk perlindungan hak asasi manusia sesuai dengan kaidah hukum internasional dan hukum nasional. Dalam pengaturan hukum internasional dan nasional, khususnya hukum nasional yang berhubungan dengan perlindungan hak-hak masyarakat adat. Dalam hal penelitian ini juga membahas bentuk-bentuk perlindungan terhadap hak-hak masyarakat adat baik menurut ketentuan-ketentuan hukum internasional dan peraturan perundang-undangan di Indonesia.

Abstract

Constitutional Court is established as an effort to uphold the rule of law and provide maximum protection for democracy as well as human rights, particularly civil rights. The main purpose of the rule of law is to protect citizens' freedom from state power. Therefore, this study aims to examine the implementation of civil rights against vulnerable groups in the Indonesian legal and constitutional system. Data were analyzed using a normative juridical approach by examining theories, concepts, legal principles, and statutory regulations obtained from legal sources such as books, articles/writings, and other documents. The government issued various laws and regulations with multiple conventions such as the rights of the child and the elimination of all forms of discrimination but this effort has not been supported by a strong shared commitment. Based on these circumstances, it is necessary to develop an effective law enforcement mechanism to protect citizens' rights, particularly vulnerable groups.

Abstract

Internet merupakan salah satu media perwujudan hak asasi manusia untuk berkomunikasi dan memperoleh informasi yang dilaksanakan secara tertib dan bertanggung jawab berdasarkan moral, nilai-nilai agama, keamanan, dan ketertiban umum berdasarkan Pancasila dan Undang-Undang Dasar Negara Republik Indonesia Tahun 1945. Pemerintah memfasilitasi pemanfaatan teknologi informasi dan transaksi elektronik serta melindungi kepentingan umum dari segala jenis gangguan sebagai akibat penyalahgunaan informasi elektronik yang mengganggu ketertiban umum sesuai dengan ketentuan peraturan perundang-undangan. Banyak masyarakat Indonesia, terutama di pedesaan di wilayah Lampung, masih belum memiliki pemahaman utuh tentang cara penggunaan internet yang positif dan sehat. Salah satu desa yang secara pemahaman masih kurang akan hal itu ialah Desa Margodadi, Kecamatan Padang Cermin, Kabupaten Pesawaran, Provinsi Lampung. Fakta tersebut membuat desa ini sebagai salah satu desa yang secara informasi teknologi masih merlukan sosialisasi & pendidikan terkait penggunaan dan tantangan teknologi ke depannya. Fakta tersebut membuat tim dari Fakultas Hukum Univeritas Lampung, Jurusan Hukum Internasional untuk melakukan pendampingan dan edukasi agar masyarakat desa dalam penggunaan internet paham akibat hukum yang timbul dari kegiatan di dunia virtual. Sehingga masyarakat dapat secara maksimal menikmati manfaat internet demi peningkatan potensi ekonomi daerah dengan tetap meminimalisir dampak negatif penggunaan internet. Masyarakat yang paham hak dan kewajibannya tidak akan mudah terjerumus ke dalam kejahatan di dunia virtual. Metode yang digunakan ialah pendekatan gabungan normative dan sosiologis secara kualitatif. Hasil dari yang didapat setelah dilakukan penyuluhan di Desa Margodadi ialah terdapat peningkatan pemahaman yang cukup signifikan dari warga setempat akan tata cara penggunaan internet yang sehat dan aman.

Abstract

Space technology has rapidly evolved due to technological advancements, emphasizing the need for regulatory attention. This paper examines the regulation of sensitive space technology across ASEAN countries through a comparative analysis. Sensitive space technology, a high-stakes field crucial for conducting space activities, requires regulation due to the boundless nature of space. Typically, the regulation of space activities is established within international law, while specific national laws govern these activities in countries actively engaged in the space sector. The research adopts a descriptive qualitative methodology, utilizing literature reviews as the primary data source. This research aims to explore and compare the regulatory frameworks for sensitive space technology in ASEAN countries. This analysis could serve as a guide or benchmark for Indonesia as it develops national regulations on sensitive space technology. The findings reveal that Indonesia has enacted a Space Act dedicated to the space sector. Malaysia similarly regulates its space activities through a Space Act and accompanying Space Regulations. While lacking a specific law for sensitive space technology, Singapore manages these activities under existing legislative frameworks.

Abstract

ASEAN is a regional organization for Southeast Asia that was established on 8 August 1967 by five ASEAN countries at the time, namely Indonesia, Singapore, Malaysia, Thailand and the Philippines. Today, ASEAN has eleven members with Timor Leste as the youngest member. Like any other international organization, ASEAN has its own decision-making system. The decision-making system in ASEAN before the Charter was only consultation and consensus. That is, decision making based on the agreement of all members and can only be decided if no one refuses, this refers to the Bangkok Declaration. Meanwhile, after the establishment of the 2007 ASEAN Charter, there is a new decision-making system, namely ASEAN Minus-X. A decision-making system that does not rely on the approval of all its members, so that a policy can be decided even if only approved by a few members. This decision-making system can only be done in the economic field. From these two decision-making systems, there are several challenges that exist so that new ideas emerge to reformulate the decision-making system in ASEAN, which is considered relevant to the times and can accommodate all the interests of ASEAN members.
