Abstract

The Constitutional Court has agreed to annul the explanation of Article 55 (2) of the Law No 21 of 2008 on Islamic Banking. This explanation has caused conflict of dualism in the litigation process of default ad fraud cases of Islamic Banking. Previously, both Religious Court and Civil Court claim to have the competency to settle cases of Islamic Banking although according to Article 49 of the Law no 3 of 2006 on Religious Court the right has be granted to Religious Court. After the Counstitutional Court‟s decision, there should be no choice of forum in settling the cace of Islamic Banking. Thus, judges of Religious Court need to prepare for this.

Abstract

Misogini in the Qur’an is an understanding of the verses of the Qur'an in Surah An-Nisa which contain various problems related to the relationship between men and women both as humans and as husband and wife in a household life or in social, cultural, and political life. Among the many issues concerning women, the inferiority (women as subordinates, inferior and not good), while men are superioritas (human superior, leader). The purpose of this study is to describe the views on household leadership, beatings of women, women's testimony and inheritance, by scholars and in particular by Al-Sya'rawi. The research method used is library research (library research) by examining the views or thoughts of Al-Sya'rawi on the misogyny verse in the Qur'an. The results in the study show that Al-Sya'rawi sees, understands the verses of the Qur'an that seem to be detrimental to women, actually not harming women, but as justice of Allah SWT. and for the benefit of the woman herself.Misogini dalam Al-Qur’an adalah pemahaman terhadap ayat Al-Qur’an dalam Surat An-Nisa yang memuat berbagai persoalan yang berkaitan dengan relasi antara laki-laki dan perempuan baik sebagai manusia maupun sebagai suami-istri dalam suatu kehidupan rumah tangga atau dalam kehidupan sosial, budaya, dan politik. Di antara sekian banyak isu tentang wanita adalah inferioritas (wanita sebagai manusia bawahan, rendah dan kurang baik), sedangkan pria merupakan superioritas (manusia atasan, pemimpin). Tujuan dari penelitian ini adalah mendeskripsikan pandangan tentang kepemimpinan rumah tangga, pemukulan terhadap wanita, kesaksian wanita dan warisan, oleh para ulama dan khususnya oleh Al-sya’rawi. Metode penelitian yang digunakan studi kepustakaan (library research) dengan menelaah pandangan atau pemikiran Al-Sya’rawi terhadap ayat misogini dalam Al-Qur’an. Hasil penelitian ini menunjukkan bahwa al-Sya’rawi melihat, memahami ayat-ayat Al-Qur’an yang kelihatannya merugikan wanita, sebenarnya bukan merugikan wanita, tapi sebagai keadilan Allah SWT dan untuk kemaslahatan wanita itu sendiri.

Abstract

Tulisan ini hendak mendeskripsikan (1) bagaimana Ulama Muhammadiyah melalui institusi Majlis Tarjih memproduksi produk-produk hukum Islam yang dibutuhkan oleh kalangan masyarakat, terutama warga Muhammadiyah dengan bersandar pada al-Quran dan hadits, dan (2) produk hukum Islam apa saja yang dihasilkan oleh Majlis Tarjih Muhammadiyah sebagaimana yang dirilis melalui website resmi organisasi keagamaan ini. Poin pertama, akan dijawab melalui bagaimana manhaj (bangunan metodologi) penentuan hukum Islam yang dilakukan oleh Muham­madiyah melalui majlis Tarjih. Sedangkan poin kedua akan dijawab melalui pengungkapan fakta yang ada dalam rilis Himpunan Tarjih Muhammadiyah dan kumpulan fatwa Majlis Tarjih Muhammadiyah yang dirilis melalui website resminya.

Abstract

Tax law in Indonesia has a clear hierarchy in order: the 1945 Constitution, the Bill, Government Regulation, Decree of the President and so on. This hierarchy is executed strictly. Lower level regulations must not conflict with higher-level rules. Taxes are one of the country's financial problems. Regulation used by government to regulate the country's financial problems, is Article 23A of the 1945 Constitution (taxes and other fees for the purposes of coercive state governed by law). Contrary to the efforts and hard work of director general of taxes, and of course the taxpayer compliance in meeting their tax obligations, was the careless use of the tax revenue as they should. Money that has been collected with great difficulty, is not used wisely, especially taking into account the priorities and multiplier effects. It seemed the money is used for business-related allowances for state officials. In this regard, Islam as ad-din (religion) has set rules governing the procedures of the relationship between man and al-Khaliq (God) and relations among humans (mu'amalah) in all aspects. These aspects are economic, political, social, cultural, state defense and security, technology and others. In the economic field (majal iqtishadi), Al-Quran and Hadith regulate how individual and state gather income (mawarid). This is also to fulfill the various needs of all human (collective). These include both personal needs and the needs of the country. Fulfillment of various requirements is necessary to devoted completely to God.Tax (dharibah) is one form mu'amalah in economics, as a means of fulfilling the needs of the state and society to finance public needs such as safety, health, and education. Even though the tax is allowed by ulama, the implementation should be in accordance with Shariah guidelines. Otherwise, the tax would come out of the track as a means of meeting the needs of the state and society rather become oppressive tool of the ruler to the people. Keywords: Tax Law, Tax, Islamic Law.

Abstract

The history of the Arabs of the past has followed the teachings of Ismail As and Ibrahim As. The doctrine that contains worship, crowding only to Allah SWT. But it has been marred by his followers named 'Amr bin Luhay a leader of Banu Khuza'ah by adding to the teachings of Abraham. Along the course of history, there was an Islamic civilization, but many historians wrote when the historic event took place. Many kinds of opinions in determining the month of the fall of revelation is the month of early Rabiul. There is also a set month of Ramadan. Another class sets the first revelation in Rajab by conveying all sorts of arguments. There is an opinion about the date at which the revelation was revealed to the Prophet (s). Some opinions specify the seventh date, there are also on the seventeenth, there are opinions on the eighteenth, other opinions of the nineteenth and there are also opinions that set the date of twenty-one. But historians agreed on Monday when revelation was revealed to Prophet Muhammad SAW. The question is when will the first revelation be revealed and how is the method used to extract the truth? The basic approach used is with the approach bayani and burhani. Ie used historical data or history (verse, hadith and tarikh) which is data serve and astronomical data which is data burhani. The analysis is done by cross-confirmation between data bayani and burhani data. Having processed these data then found conclusion that data burhani (astronomy) in accordance with the data bayani (history or history) stating that Badr War happened on 19th of Ramadan and thus al-Quran revealed the first time that marked the birth of Islamic civilization is on the day Monday 19th Ramadan year 14 SH coincides with August 25, 609 M. So the age of Islamic civilization on Tuesday, 18th Ramadan 1438 H just last, even reached the age of 1451 years kamariah and Wednesday, 19th Ramadan 1438 H is his birthday- 1451.

Abstract

Usually,  in  determining  the  beginning  of  the  Ramadan  and  Shawwal in every year in Indonesia there are always differences that arise due to differences in understanding the fundamental principles that cause by differences understanding of dzahir nash, there is a reference to the opinion on the basis of estimating wujudul Hilal (the moon is exactly on ufuq) and there is also a reference to the opinion of rukyatul hilal (moon is above ufuq with the provisions of Imkanu ar-rukyah), both of the methods in determining the beginning of Ramadan and Shawwal are applied every year in Indonesia. When the results of ijtihad fall on the same day, it does not cause problems in the community, but when the results fall on different days, recognized or not, it certainly can cause problems among the people, especially the ordinary people, at least a little bit of confusion, so they have to wait for government’s decision, in this case the Ministry of Religious Affairs.Keywords: Wujudul Hilal, Ru’yatul Hilal and determination of the beginning of Qamariyah month

Abstract

Financial technology is an activity that focuses on providingfinancial services ideas using software. Which is fintech, it expectedthat various facilities can be obtained later. The development of fintechbegan since the discovery of blockhain and cryptocurrency. In addition,this development is also one of the developments in digital-basedtechnology and is a new innovation and his impact on all economicactivities, especially in the Islamic economy. As for Fintech Syariah, of course it must be based on an Islamicperspective and refer to Maqashid Syari'ah al-Khams and containbenefits for every transaction carried out by the contractor.  All formsof economy and business transactions originating from the Qur'an andthe Sunnah are clear,  paying attention to and protecting the rights ofeach individual in order to uphold justice and eliminate injustice intransacting through the shariah fintech.

Abstract

This paper discusses  qiyas and maslahah mursalah. The goal is to make it easier for us to establish a law. The data collection method that the writer uses is a literature study in the form of searching for books related to qiyas and  maslahah  mursalah. Qiyas In language (Arabic) means measuring, knowing the size of something,  comparing, or equating something with another. For example  قمت اللوب بالنراع which means "I  measure  clothes  in cubits." According to Ushul Fiqh terminology, as stated by  Wahbah al-Zuhaili, qiyas is connecting or equating the Law of something with no legal provisions with legal provisions there is  Illat similarity between the two. The meaning of  Maslahah in  Arabic means "actions that encourage human goodness." This article uses the induction and deduction methods and the descriptive analysis approach by conducting a literature study. The result shows that Allah decreed all the laws to his servants in orders/prohibitions containing Maslahah and benefits. The specialty of this paper is that it is written in detail based on arguments so that it is easy to understand. Qiyas and maslahah mursalah are very important for us to understand more deeply to determine an appropriate law. Maslahan Mursalah is an extension of qiyas if there are no more arguments that can support  qiyas.Artikel ini membahas tentang qiyas dan maslahah mursalah. Tujuannya untuk memudahkan dalam membuat undang-undang. Metode pengumpulan data yang digunakan adalah studi kepustakaan berupa pencarian kitab-kitab yang berhubungan dengan qiyas dan maslahah mursalah. Qiyas dalam bahasa (Arab) berarti mengukur, mengetahui ukuran sesuatu, membandingkan, atau menyamakan sesuatu dengan yang lain. Misalnya اللوب بالنراع yang artinya "Aku mengukur pakaian dalam hasta". Menurut istilah Ushulfiqh, sebagaimana dikemukakan oleh Wahbah al-Zuhaili, qiyas adalah menghubungkan atau menyamakan hukum sesuatu yang tidak ada ketentuan hukumnya dengan ketentuan hukumnya terdapat kesamaan illat antara keduanya. Arti Maslahah dalam bahasa Arab berarti “perbuatan -perbuatan yang mendorong kebaikan manusia”. Artikel ini menggunakan metode induksi dan deduksi serta pendekatan analisis deskriptif dengan melakukan studi kepustakaan. Hasil penelitian ini menunjukkan bahwa Allah menetapkan segala hukum kepada hamba-hamba-Nya dalam perintah/larangan yang mengandung maslahah dan kemaslahatan. Keistimewaan makalah ini adalah penulisannya secara detail berdasarkan argumentasi sehingga mudah dipahami. Qiyas dan Maslahah Mursalah sangat penting untuk dipahami lebih dalam untuk menentukan hukum yang tepat. Maslahan Mursalah merupakan perpanjangan dari qiyas jika tidak ada lagi dalil yang dapat mendukung qiyas.

Abstract

The family is built from the ties between two different beings and then be allied in a marriage. Marriage oriented to form a sakinah family, which is based on love and affection. Marriage is a strong commitment between fellow brides. The family is in human experience.In relation with Islamic law, the family has a strategic position. Legal arrangements for individuals and families are closely linked to the awareness and religious adherence of each Moslem. With the formation of a family, it will automatically rise a law in it. Where this law contains a rule that is charged to all family members.There are several inherent goals in each marriage those are (1) justifying the sexual relationship to satisfy the intent of human character, (2) realizing a family with the basis of love, love and (3) obtaining a legitimate generation.Family has a very important function in individuals forming. Therefore, the whole function must be kept in mind. If one of these functions does not perform, so there will be disharmony in the system of rule in the family.
