Abstract

Decentralization has opened the space for the establishment of local regulation that triggered public debate whether the localregulations can be justified within the framework of the Unitary State of Republic Indonesia or not. Among the local regulations, there is a phenomenon of 'Sharia Politics' especially in Nanggroe Aceh that its socio-history and socio-cultural of Aceh has a distinctive Islamic tradition. This research is based library research and relies on libraryresearch.The data taken is the literature data by content analysis method. It discusses: first, how should we observe the autonomy and the implementation of Islamic justice in Aceh? Second, why does the issue of Sharia Islam play an important role in the political struggles in Aceh? Third, howgood is the practice of Islam Sharia there? The result of this research can be concluded; first, to determine theautonomy and the implementation of Islamic justice in Aceh, it should beexamined the roots of history since the pre-colonial era to the independence and socio-cultural era. Second, the process of transitionfrom the Religious Court to the ShariaCourt establish some regulation or Qanun related to institutions and procedures and categories of Sharia law that within the framework of the Indonesian legal system. Third, during the problematic era of Islam Sharia’s practice, if it did not take seriously and critically thinking, the prospect of Islamic law practice in Aceh would be bad. Because not all Islamic Law can be copied and translated into legislation and article as those applicable in the system of modern governance.

Abstract

The Regional Supervisory Council has a strategic role in maintaining the Notary profession in carrying out its position. This article aims to examine to what extent the role of the regional notary supervisory council in preventing violations of Notary law in Padang City. This study uses a juridical-empirical approach with data in the form of secondary data and primary data. This study focuses on several things about what factors cause legal violations by Notaries in Padang City, what is the role of the Regional Supervisory Council in preventing legal violations by Notaries in Padang City, and what actions are taken by the Regional Supervisory Council against Notaries who commit violation of the law by a Notary in Padang City. The results of the research study show that the factors that cause legal violations committed by notaries in the city of Padang are notaries who like to accept jobs that are not in accordance with the date the deed was made and the notaries often do not come face to face with clients, in preventing legal violations by notaries in the city. Padang, namely with the socialization and going directly to the field. Actions taken if there is a violation of the law by a Notary, namely carrying out an examination process in order to prove whether the Notary has committed a violation or not.  AbstrakMejelis Pengawas Daerah memiliki peran strategis dalam menjaga profesi Notaris dalam menjalankan jabatannya. Artikle ini bertujuan untuk mengkaji sejauhmana peran majelis pengawas daerah notaris dalam mencegah terjadinya pelanggaran hukum Notaris di Kota Padang. Kajian ini menggunakan pendekatan yuridis-empiris dengan jenis data berupa data sekunder dan data primer. Kajian ini menfokuskan pada beberapa hal tentang faktor apa saja yang menyebabkan terjadinya pelanggaran hukum oleh Notaris di Kota Padang, bagaimana peran Majelis Pengawas Daerah dalam mencegah terjadinya pelanggaran hukum oleh Notaris di Kota Padang, dan tindakan apa yang dilakukan oleh Majelis Pengawas Daerah terhadap Notaris yang melakukan pelanggaran hukum oleh Notaris di Kota Padang. Hasil kajian penelitian menunjukkan bahwa faktor penyebab terjadinya pelanggaran hukum yang dilakukan oleh Notaris di Kota Padang adalah Notaris suka menerima pekerjaan yang tidak sesuai dengan tanggal yang dibuatnya akta tersebut dan Notaris sering tidak bertatap muka langsung dengan klien, dalam mencegah terjadinya pelanggaran hukum oleh Notaris di Kota Padang yaitu dengan adanya sosialisasi dan langsung turun ke lapangan. Tindakan yang dilakukan jika adanya pelanggaran hukum oleh Notaris yaitu menjalankan proses pemeriksaan agar dapat membuktikan apakah Notaris tersebut melakukan pelanggaran atau tidak.

Abstract

The rapid and siqnificant growth of Islamic banking must supported by qualified human resources. People need legal certainty to maintain social order. Sometimes, people make rules to legitimize their acts or to create a new interpretation of the law. Therefore, a strict law is required to control people from jumping to an apologetic conclusion. Islam provides human beings with God’s law as guidance in the world and the life here after. Islamic banking is a national banking system based on Islamic law. Islamic banking is founded based on Islamic economic system. It aims not only for profit but for people welfare.

Abstract

This article explores a mechanism of private dispute resolution by small claim court. The Supreme Court of the Republic of Indonesia issued a policy of the Supreme Court Number 2 Year 2005 on mechanism of small claim court. This article is based on normative research which examine implementation of law especially in the case of small claim court. By using theory and principle of civil code procedures; fast, simple and inexpensive, the finding of this article indicates that small claim court becomes a mechanism of dispute resolution quickly, effectively and efficiently through litigation process. The results of this article confirm that the mechanism for the dispute resolution stage with small claim court is resolved with a simple procedure. Small claim court is filed against a case of breach of contract or default and acts against the law with a period of settlement of a small claim resolution no later than 25 (twenty-five) days from the day of the first session court.AbstrakArtikel ini mengkaji tentang mekanisme penyelesaian sengketa perdata dengan pola gugatan sederhana (small claim court) di pengadilan. Mahkamah Agung Republik Indonesia mengeluarkan Peraturan Mahkamah Agung Nomor 2 Tahun 2015 tentang Tata Cara Penyelesaian Gugatan Sederhana. Artikel ini memggunakan tipe penelitian yuridis normatif, mengenai implementasi ketentuan hukum normatif sebagai norma yang hidup dalam masyarakat. Dengan menggunakan teori dalam hukum dan prinsip hukum acara perdata yaitu asas cepat, sederhana dan biaya ringan, artikel ini menemukan bahwa penyelesaian gugatan sederhana (small claim court), menjadi mekanisme untuk menyelesaiakan sengketa secara lebih cepat, efisien dan efektif sebagai pola penyelesaian sengketa melalui jalur litigasi bagi para pencari keadilan. Hasil dari artikel ini menegaskan bahwa mekanisme tahapan penyelesaian sengketa dengan pola gugatan sederhana di peradilan diselesaikan dengan tata cara dan pembuktiannya yang sederhana. Gugatan sederhana diajukan terhadap perkara cidera janji atau wanprestasi dan perbuatan melawan hukum dengan jangka waktu penyelesaian gugatan sederhana paling lama 25 (dua puluh lima) hari sejak hari sidang pertama.

Abstract

Early menarche or first menstruation in women earlier than usual is an interesting problem to be studied and investigated further. Changes in life style and increase in social welfare impact on rapid physical growth of children and then result on the shift of age of menarche. Physically, they have growth like adult but psychologically they are children. In another word, they are children trapped in the body of adult. In the perspective of Islamic law, women experiencing menstruation is considered entering the age of maturity. As adult, she imposes religious obligation and is responsible for her acts while in fact she is a child. This is among problems of women and their feminine problem. Allegedly, many people do not understand this matter and thus allowing confusion. Therefore, this issue needs to be discussed form Islamic point of view.Keyword: menarche, menstruation

Abstract

This study was conducted to discuss the concept of taklid in the religiousactivity in the perspective of Ushul Fiqh in four madhhab, with theconsideration that at the level of implementation, the concept was stillproblematic, so the consequence  was cause someone can easily fall into thetrap of fanaticism that leads to radicalism, as a result of the weakening ofcritical reason-related the quality of the received religious information-and thebarrenness of the creative power-related to the application of Islamicteachings in the reality of national and state life.

Abstract

This article is based on field research among Baha‟i community in Pati, Central Java. According to Penpres No 1/PNPS/1965 there is no limitation of religion in Indonesia. However, some of regional officers in Pati still believe that there are only six official religions in Indonesia in which Baha‟i is excluded. Consequently, Baha‟i people who want to register their marriage is refused by the officials in the office of Civil Registration.

Abstract

Formation of the Omnibus Law, There are at least two basic reasons for the name many overlapping regulations and many regulations that are allegedly hampering investment so that the establishment of the Omnibus Law is expected to be able to overcome these two problems. The purpose of writing the article is to explain Omnibus Law in the system in Indonesia, the strategy and model of Omnibus Law in structuring regulations in Indonesia, and the challenges of Omnibus Law in structuring regulations. This article can be categorized as a type of normative juridical research using a qualitative approach. The source of data in writing this article uses secondary data consisting of primary legal materials in the form of Omnibus Law, secondary legal materials in the form of journal articles, law books, magazines and so on, and tertiary legal materials in the form of legal dictionaries, legal encyclopedias and others. . The results of the study indicate that the regulatory structuring strategy through the Omnibus Law can be carried out by establishing the basic and legal politics of the Omnibus Law, absorbing aspirations, coordinating with the regions, acceleration, transparency and accountability. The regulatory arrangement model through the Omnibus Law can be done with the regulation formation model, namely IRR. Meanwhile, the challenges of the Omnibus Law in structuring regulations are in the form of current and future challenges. In the formation of the Omnibus Law, the community is expected to participate in conducting supervision.Pembentukan Omnibus Law saat ini setidaknya ada dua alasan mendasar yakni banyak regulasi yang tumpang tindih dan banyak regulasi yang disinyalir menghambat investasi, sehingga dengan dibentuknya Omnibus Law nantinya diharapkan dapat mengatasi kedua permasalahan tersebut. Tujuan penulisan artikel yaitu menjelaskan tentang strategi dan model Omnibus Law dalam penataan regulasi di Indonesia, dan tantangan Omnibus Law dalam penataan regulasi. Artikel ini dapat dikategorisasikan sebagai jenis penelitian yuridis normatif dengan menggunakan pendekatan kualitatif. Sumber data dalam penulisan artikel ini menggunakan data sekunder yang terdiri dari bahan hukum primer berupa Omnibus Law, bahan hukum sekunder berupa artikel jurnal, buku-buku hukum, majalah dan lain sebagainya, dan bahan hukum tersier berupa kamus hukum, ensiklopedi hukum dan lain-lain. Hasil penelitian menunjukkan bahwa Strategi penataan regulasi melalui Omnibus Law dapat dilakukan dengan pembentukan dasar dan politik hukum Omnibus Law, penyerapan aspirasi, koordinasi dengan daerah, akselerasi, transparansi dan akuntabilitas. Model penataan regulasi melalui Omnibus Law dapat dilakukan dengan model pembentukan regulasi yaitu IRR. Sedangkan tantangan Omnibus Law dalam penataan regulasi berupa tantangan saat ini dan masa mendatang. Dalam pembentukan Omnibus Law masyarakat diharapkan turut serta dalam melakukan pengawasan.

Abstract

In the current democratic system in Indonesia, the discourse on abstentions rises exceeding the number of votes in the general election. Religion has contributed to the succession in Indonesia since the end of representative democracy. The Council of Indonesian Ulama has released fatwa on the prohibition of abstention. To what extent does the fatwa correspond to situation in Indonesia? How is MUI legal reasoning to prohibit abstention? How was the fatwa born? How was public response to the fatwa? Through the perspective of sociology of Islamic law, this paper tries to reconstruct the position of fatwa in front of Qur’an and Hadith prescriptions on unlawful leadership.

Abstract

This article aims to describe some questioned points of political roles of santris seem like; the understanding of social transformation and its regulatory process inside government, how they articulated, participated, and sounded their ambitions become a regulation, then the last is how they build the dialog beyond political and social interests between both process. This research took places in Jember Region. One of small-town in East Java which Santri and Nahdlatul Ulama’ had significant roles, weather in social and political conducts. In the end, this article conclude that; first there are tree missions how santri articulate their understanding of Islamic point of view to become substance regulation aspect, in term; conservatism, progressivism, and moderate. Second, modes of participations are based on al Maslahah al Ummah (common good) as main orientation, were not just becoming intellectual mouth-pieces of government. Third, ideologically, the relation and dialectical tension beyond santri and government were criticism. It means santris were becoming the critical partner of government to formulate the public policy.
