Abstract

This article deals with the issue of homosexuality from the perspective of human rights international law and Islamic law, particularly in the view of Mashood Baderin. The result of understanding towards human rights international law as well as towards Islamic law as the blessings for the universe places human beings in the most respected position. However, there emerge the phenomenon of non-mainstream sexual orientation, such as lesbian, gay, bisexual and transgender (LGBT). In the perspective of Mashood Baderin, who portrays human rights international law and Islamic law on the principles of equality and justice, these LGBTs have their rights, as they are also human beings that should be respected due to their human dignity. It is inhumane to discriminate and condemn them. They should receive proportional treatment from the state so that their civil rights are guaranteed. However, with regard to their sexual orientation Islamic law prohibits the same sex marriage or other forbidden sexual relations

Abstract

This article deals with Penjara Nagari as a place to quarantine a couple who committed an adultery or fornication in Nagari Tigo Jangko. The study attempts to explore the reasons of the people to build a jail, regardless the existing government?s jails. The research found that the Penjara Nagari was built based on the decision of the kerapatan adat to anticipate and educate people to avoid adultery and fornication which were forbidden by Islamic law and Minangkabau tradition. The people caught the couple directly at the location. They screamed, humiliated and hit them. Then they brought the couple to the Penjara Nagari and few of people interrogated the couple and let the other people saw them in the jail. The prisoning of the couple had continued until kerapatan adat had made a decision which contained some punishments for the couple. Usually the prisoning occurred all night long till morning. Penjara Nagari in Islamic and Indonesian legal perspective was not real jail, since the real jail was built for prisoners who got a justice procedure and punishment from the court.

Abstract

This article discusses the thought of Abdulkarim Soroush on the relation between the truth claim of religious understanding and the emergence of religious authoritarianism. Truth claim can raise the tyranny of religion when there is an attempt at the ideologization of a religious understanding to political and power sphere. Some questions to be answered here include: why does religious truth claim emerge, and how does Soroush deconstruct religious truth claim? Why does Soroush reject the paradigm of religious ideologization, and how does he promote the democratization of the relation between religion and politics? This article reveals that religious truth claim emerge due to the absence of consciousness to distinguish between religious understanding which is temporal and profan and the very religion which is eternal and sacred.? Attempts at ideologizing religion represent the lack of consciousness to distinguish between religion and politics, as this lack can degrade the divine value of religion to its worldly and human character. The ideologization of religion can result in tyranny in the name of religion, and accordingly give the monopoly of power to a certain religious understanding while rejecting others.

Abstract

This paper attempts to closely portray interreligious harmony, especially between Muslim and Hindu community in Tengger, East Java. Tengger community are ingrained with their own culture and practicing their unique tradition. Through symbolic-interactionist approach, this paper supposes that this reality represents a cultural process which is simultaneously and flexibly flowing and growing. In the name of brotherhood and humanity, Tengger people are running their daily activities, discounting subjective differences among them. Sociologically, they are focusing on facing the reality as objective necessities where the self and the other are mutually understanding and complementing each other. In this regard, they have improved the way of interaction, from saya-and-mereka perspective to kami-andkita approach. Social activities and religious/cultural rites symbolically become communicative device of inter-relation among the people. Muslim and Hindu harmony in this community denotes multicultural interaction that entails social involvement of members of community. Tengger people, as an animal symbolicum, strive to construct, expand and (re)interpret the symbols for building harmony.

Abstract

The construction of Hamka?s sufistic thought is significant for the world today, not only to reform Islamic thought but also to reconstruct modern spirituality. Modern society is now trapped by rational model and pattern of thought, discarding inner or spiritual dimension, thus resulting in a materialistic and hedonistic lifestyle. As a result, there emerges value crisis of humanity marked by the crisis of spirituality. Hamka?s sufistic thought as a form of human spiritual reconstruction is relevant to be deeply studied. This article aims to prove that spirituality constitutes human potential which is impossible to vanish in whatever situation, although human being has has arrived at the peak of rationality. Hamka?s sufistic thought is active, dynamic and progressive, emphasizing the necessity of one?s engagement in society more actively than in old sufism. Moreover, sufism has to become agent of social change from all types of life decadence. For Hamka, spirituaity is an infinite idea inherent in the totality of humanity. To deny it means to negate the selfhood of human being. Therefore, sufism is the best way to present the transcendent, because it becomes a necessity for human at the time of sorrow.

Abstract

The purpose of this study is to explore the idea of Islamization of counter accounting principles. Such an Islamization is necessary because counter accounting princip-les are formulated by using the philosophy of punk from the western society which has different beliefs. In addition, the idea of Islamization in this study shows that Islamic knowledge can indeed be developed continuously. Therefore, the claim that there is no development inside this knowledge, and that it cannot be categorized as science, willl no longer exist. This study reveals the findings that the wisdom from argumentation which constructs the principles of counter accounting is parallel with the wisdom from Islamic values as interpreted by experts of Islamic accounting. The Islamiza-tion of counter accounting principles confirms the truth of belief in the existence of Allah and His revelation.

Abstract

This article attempts to describe the implementation of ḥalâl certification in Indonesia prior to the Law of Halal Product Assurance (Undang-Undang Jaminan Produk Halal/UU JPH), and identifies the governance of ḥalâl certification according to the law. The results of this study state that prior to the application of UU JPH, the ḥalâl certification was under the authority of Majelis Ulama Indonesia (MUI), through the Lembaga Pengkajian Pangan, Obat, dan Kosmetika (LPPOM) in the process of sertification and control product. The fatwa commission of MUI has the authority to determine the ḥalâl products and the Badan Pengawasan Obat dan Makanan (BPOM) issues the ḥalâl label. This institutional dualism makes the position of LPPOM weak. The organization does not have the authority to force manufacturers to certify, because the halal certification is voluntary, not mandatory. Similarly, the function of oversight and enforcement was weak because there is no legal provision which obliges company to certify its product. In addition, the UU JPH removes the dualism of ḥalâl certification institutions under the authority of the Ministry of Religious Affairs. The fusion of ḥalâl certification system provides the legal basis for the ḥalâl certification obligations for products and firmness in the monitoring and surveillance systems of ḥalâl products.

Abstract

This article examines power struggle in the discourse of Islam Nusantara which becomes very popular in contemporary Indonesian Islam. The idea of Islam Nusantara is not different from Islam in general, but with distinctive charactericstics, such as tawâzun, i‘tidâl, and tawassut}. The proponents of this idea claim that their intellectual framework is based on the principle of maslah}ah mursalah, istih}sân, and ‘urf. Using critical discourse analysis, this article attempts to see the other side of Islam Nusantara discourse. This study is based on an assumption that language and discourse are not only an instrument to convey ideas, but also a means to construct social reality. Social activities are always related to and constructed by their social settings. This article argues that the discourse of Islam Nusantara emerges as a part of struggle for influence between mainstream Islamic movements, such as Nahdlatul Ulama and Muhammadiyah, and new transnational Islamic movements, such as Tarbiyah, Hizbut Tahrir, and Salafis. The use of the term Islam Nusantara is indeed the effort of mainstream Islamic movements to create the image of indigenous Islamic movements, different from the newly imported Islamic movements. However, the discourse of Islam Nusantara seems to be reductionist and monolithic in perceiving diverse realities of Islam in Nusantara.

Abstract

The article examines the local wisdoms of ethnic Malay in the district of Batu Bara as a reference for their individual and social interactions with special focus on interethnic relationships, particularly within socio-religious realm. The study finds that ethnic diversity in the district of Batu Bara is not an obstacle to create a harmonious relation in social, economic, political, and religious activities among the people. It means that the Malays in Batu Bara have virtuous interaction with other ethnicities in the region. They, for an instance, are able to build mutual trust with other ethnicities in economic activities. In addition, they are able to work hand-in-hand with other people in many areas of social aspects. It is also found that the Malays of Batu Bara treat other ethnicities as equal in terms of providing an individual his/her social stratum to be, for an example, a prominent figure of society. They also give other people from other ethnicities chance of being political elites or leaders of mass organizations. The study finds that, however, the Malays of Batu Bara tend to choose the local (indigenous) person as their leader.

Abstract

This article examines the gender mainstreaming in Islamic education policy for 2010-2014 adopted by the Ministry of Religious Affairs of the Republic of Indonesia. Using a qualitative descriptive approach, this article explores the extent of the strategic plan of the Ministry of Religious Affairs in 2010-2014, especially policies that are gender neutral and gender responsive policies. The author under-lines that the government needs to undertake the planning policies or programs that are more responsive to gender. One of the strategies adopted to fulfill the practical and strategic needs in this context is through Gender Mainstreaming which is implemented in relevant and signifi-cant programs. The author also asserts that Gender Mainstreaming in Islamic education is very necessary. Norms that have been frequently used as a reference for the gender policy should be reconsidered. This is to ensure that policies are drawn right on target, though—all parties must realize that—the uniform policy cannot necessarily be applied because of gender roles, however, differ both between places, time and socio-economic class.
