This paper distinguishes first of all between Islam as a system of valueâtranscendental Islam that isâand Islam as socio-cultural phenomenonâsociological Islam that is. The former is about religion as a given system of belief, while the latter is about religious way of life. While touching briefly on the former, the paper will focus a great deal on the latter. It will focus as such on the âconstructed Islamâ by the Javanese Muslim santris. Employing the social constructive theory, the paper assumes that these santris are active agents in building their own religiosity through what may be called a dialectical moment. Hence, the paper refuses the commonly believed understanding that social facts are completely outside individual awareness in the process of religious construction. By this, the paper attempts to show that Javanese Islamâsociologically speakingâis none other than the product of santriâs cultural and social upbringing.

This study discusses the concept of multiculturalism according to the santris and its relation to their religiosity. Santris are those who study at the pesantren, the indigenous form of education in Indonesia. The paper offers a descriptive elaboration of what these santris think of multiculturalism and how they relate it to their belief and religious tradition. It argues that multiculturalism has been the very character of the pesantren in which santris of various cultural background stay to study. How thismulticulturalism works and how it influences the santris in the way they look at the idea of nation-hood is the question that needs to be explored. And this paper aims at doing just that. Nation-hood is just another form of multiculturalism. While the santris are used to a life of a multicultural nature, the question of how they adapt to the national culture on the one hand, and how religion shapes the way they behave on the other becomes of particular interest. This paper will show that religion and nationalism are two sides of the same coinâas it wereâin the life of the santris.

Modern science requires that dialectic between induction and deduction should take place so that development of knowledge and its promotion may be acquired. In modern sciences in other words, such dialectic constitutes the very condition for the creation and invention of new theories, discoveries and fields of knowledge. This paper is trying to argue that as a science, fiqh in one way or another has appropriated a similar route of using these two methods of induction and deduction in its process to extrapolate religious laws and rules.We argue that in fiqh induction produces norms that may serve as the foundation for the deductive method. We contend that induction is a general rule extracted directly from the first source of Islamic law, namely revelation, whereas deduction is the legal principles (alqawaâid al-fiqhiyyah) that the ulama formulated on the basis of their understanding on the contents of revelation.

This paper is aimed at discussing the notion of endowment as a means to increase the economic prosperity of the Muslim society in Indonesia. It argues that the Muslims of Indonesia have enough endowed properties but lack a proper management in running them. This leads to the misuse of the properties on the one hand, and to the failure to achieve the proposed aims for which these properties are endowed. This paper suggests ways to run the properties properly and the reasonable objectives for which the endowment may be aimed at.

The texts of the Qurâân may be understood as a collection of symbols, and cannot be interpreted in isolation from the context as their background. If semiotics is a science of symbols, then the texts of the Qurâân must be the fertile object for the study of semiotics. In the science of semiotics, texts are deemed to have no end in themselves, meaning that we must not acknowledge them as having ended or being finalized at some point. Some philosophers such as Jacques Derrida have underscored this, and maintained that language is a metaphor. A meaning that we assume resulted from our use of language is in fact the product of the metaphorical exchange. Hence, a meaning will change as soon as the subject of the metaphorical exchange changes. Meaning in other words is both dynamic and relational because it is based on an endless source.

In this paper we are concerned with elaborating the critiques of Ibn Jawzi against the ulama of his time in his Talbis Iblis. By the ulama Ibn Jawzi means the learned in any field of knowledge such as Qurâânic reading (qiraâah), prophetic tradition (hadith), jurisprudence (fiqh), language, letter, and the art of speech (khitabah). We will analyze the motif behind Ibn Jawziâs warning to the ulama that they can âby virtue of their knowledge- be manipulated by the Satan. Not all knowledge is therefore good. Hence, we are interested in exposing the nature of knowledge in Ibn Jawziâs concept and what are the kinds of knowledge that may lead to Satanic manipulation. The paper will also discuss Ibn Jawziâs advice to the ulama so that they may not fall victim in the trap of the Satan.

This paper deals with the development of the term madhhab in the history of Islamic law. As a vital concept in Islamic law, the meaning of madhhab has undergone several changes. At first, it was related only to a personal opinion of a mujtahid. Then it was related to a view of ulama belonging to a particular school of thought, and finally it is understood as a doctrinal opinion with distinctive legal concepts and methodologies controlled by the authority of the ulama who occupy the axis of the madhhab hierarchy. Some madhhabs have gone extinct due to their irrelevant concepts, but some others managed to survive due to their ability to make a âgreat synthesisâ between reason and revelation, text and context. Some of these surviving madhhabs have even become the official madhhab of a Muslim state and made obvious contribution in the formation of Islamic law in that particular country. It is to this issue that this paper is mainly concerned with.

The aim of this paper is simply to describe the content of a book by Abu Bakr Muhammad Ibn Ishaq Ibn Khuazaymah al-Nisaburi al-Shafiâi called Sahih Ibn Khuzaymah. The book deals mainly with the tradition of the prophet. A deeper analysis on the book however reveals that it also contains a fairly good exposition of fiqh and its general rules. In this paper we would try to unlock this aspect of the book and find out how the discursive interaction between hadith and fiqh takes place in it. Our approach is critical in that it will question the validity of some hadith under investigation. We believe that not all hadiths in the book are valid and authentic.

Sufi orders have been instrumental in the life of the Sufis as centers for spiritual training and education. In these centers the Sufis can elaborate their ideas, and apply them in real life. In the passages of time however, these orders were no longer considered simply as religious centers but also as social groupings consisting of people committed not only to practice the teaching of their religion but also to get involved in social problems. There are indeed many Sufi orders with different character and upbringing. But as a whole, a Sufi order is mechanism for the spiritual survival of its fellows. This paper tries to look at the other side of the matter and argues that a Sufi order is not only spiritual in its nature but is also social. It treats Sufi orders as a social body that functions socially to help the murids to survive socially and not spiritually. We believe that the extinction of some Sufi orders is due mainly to their inability to curb with social issues and not because of the nature of their spiritual teaching. The survival of any Sufi order in other words depends very much on its social mechanism and not on the strength of its spiritual dictum.

Sharîâah has always been deemed as an integral part of Muslims life. As a binding and commanding divine law, Sharîâah has in other words been internalized in the being and existence of Muslims through their obedience and regular practice. The question that this paper tries to answer is whether Sharîâah is divine and transcendent, or is it evolving from being transcendent to becoming mere ideas and legal dictum of the ulama? To delve on this question the paper begins by saying that any legal formulation does stem from observation of social reality. Given the changing nature of social reality âwe argue- the product of legal extrapolation does exhibit some form of evolution. We further argue that so long as the heart of the divine law is human interest (maÅlahah) both worldly and heavenly, Sharîâah cannot escape from the law of evolution considering that the interest of the vast span of humanity differs from one setting to another. That is why many jurists speak of the Maqasid al-Sharîâah (the aims of Sharîâah) implying that Sharîâah does evolve given the multiplicity of these aims. Simply speaking, the paper is directed toward proving that Sharîâah cannot be seen as stagnant and that it is subjectedâlike any other forms of knowledgeâto the law of evolution.
