Abstract

Negara Indonesia ialah negara hukum, ketentuan ini dijamin dalam Undang- Undang Dasar Negara Republik Indonesia Tahun 1945 (UUD NRI Tahun 1945), pada Pasal 1 ayat (3). Sebagai negara hukum Indonesia memiliki kewajiban untuk melindungi segenap rakyat Indonesia, termasuk mengatur kemanfaatan semua aspek kehidupan agar mampu memberikan kemakmuran bagi seluruh rakyat Indonesia. Pada penjelasan Pasal 33 ayat (4) disebutkan bahwa: “...Khusus tempat pemakaman, tempat yang dianggap suci dan tanah milik masyarakat adat, sebelum dikeluarkan izin dari instansi Pemerintah yang berwenang perlu mendapat persetujuan dari masyarakat setempat.” Ketentuan ini menganulir larangan penggunaan tanah masyarakat adat untuk usaha Migas dan Pertambangan. Dengan kata lain, kegiatan Migas dan Tambang dapat dilakukan di atas tanah masyarakat adat setelah mendapatkan persetujuan dari masyarakat adat. Persetujuan masyarakat adat tersebut dilakukan dalam bentuk penyelesaian secara musyawarah dan mufakat untuk mendapatkan keputusan mengenai cara jual beli, tukar-menukar, ganti rugi yang layak, pengakuan atau bentuk penggantian lain kepada pemegang hak atas tanah.

Abstract

In relation with the coal mining business growth in Indonesia for the past 10 years, than it must also supported with the fulfillment of the applicable Laws, than the purpose of this disertationare, first, to know and to find the Laws which specifically regulates the expansion buoying of Group Company especially in coal mining sector.Second, to know about the implementation of Group Company expansion in coal mining sector. Third, to know, analyze, and to find the implication of Group Company expansion in mining sector toward monopoly practice and unfair business competition. The results of this research are, First, that the Law No. 4 Year 2009 regarding Mineral and Coal Mining regulates about the buoying of group company, mentioning that the IUP and IUPK owners are banned from involving their sister company and/or their affiliation in mining service industry located in their mining area, except they have the Minister’s License. Meanwhile maximum area ownership of IUP in group company is not restricted. Second, the most common group expansion in coal mining industry are by establishing holding company, acquisition and joint venture. The principal motive of these actions are economy and psychology. Third, group company expansion in coal mining industry implicates on abuseof dominant position and market control. The consequence are the addition of several new companies and also directly implies the ownership of the subsidiary's shares by the parent company. Of the 5 (five) coal mining companies studied when doing corporate actions, so that into 1 (one) group companies, the amount of coal production does not reach 50%. It is not proven to be denied Article 17 of Law no. 5 of 1999.

Abstract

The RESD principle is relevant for protecting the sovereignty of the Indonesian state in BIT negotiations, formulations and implementation. This relevance is based on the willingness and ability of the Indonesian state to exercise its sovereign authority responsibly in managing foreign investment. Accountability of sovereignty functions in the context of foreign investment can be proven through the willingness and ability of the functions it carries to ensure the availability of political good and public good to all parties who invest in their jurisdiction. Proving the country can be done through three main principles of the implementation of state sovereignty, namely responsibly, in accordance with good governance, and international standards of civilization. These three principles are manifested in the country's willingness and ability to guarantee political good in carrying out foreign investment relations with foreign investors and partner countries. Political good in this context is democratic governance (rule of law), good governance (anti-corruption). The implication of this legitimacy is that the state is spared or even cannot be interfered by other authorities, because it has a bargaining position. Keywords: Right to Economic Self-Determination (RESD), Bilateral Investment Treaty (BIT), Sovereignty.

Abstract

Protection of the marine environment within the framework of international law is actually an accumulation of The Principle of National Sovereignity and The Freedom of High Sea. The International Maritime Organization (IMO) states that "a right on the part of an astat threatened with the environmental injury from sources beyond its territorial jurisdiction, at least where those sources are located on the high seas, to take reasonable action to prevent or abate that injury ". The general principle of good neighbor liness can be found in international customary law as well as in Article 74 of the UN Charter. This principle is reflected in several international treaties and is supported by the country's main practices in dangerous and emergency activities. Cooperation is contained in the 24th Principle of the Stockholm Declaration and the 27th Principle of the Rio Declaration which states that countries must cooperate in the principles of good faith and the spirit of partnership as efforts to protect the environment. Keywords: protection of the marine environment, principles of good faith, International Maritime Organization (IMO)

Abstract

The threat of capital punishment is seen as an appropriate type of crime threatened against narcotics offenders with the qualifications of producers and dealers, because narcotics is a serious crime and the nature of the offenders who have a network to produce and circulate narcotics for business or economic purposes only so that their actions can cause great danger or have a profound effect on human life and national life in the political, economic, social, cultural and national defense sectors. In the end the deterrent effect with a very severe sentence, including the threat of capital punishment, became the target to achieve the goal of enacting Law Number 35 Year 2009 on Narcotics in addition to providing narcotics for health needs and scientific development, also intended to reduce the quantity of perpetrators of abuse and circulation dark narcotics. Although it is realized that with the enactment of this law, the number of drug abuse and distribution by the perpetrators does not deter and can educate producers and distributors of the sentences not proportional to their actions compared to the consequences suffered by victims. In other words, the target of the regulation of death penalty in this law is not only for death row inmates, but also for potential perpetrators who have not yet been sentenced to death. Therefore, the threat of capital punishment aims to suppress the high crime rate, which in the end the community becomes orderly, peaceful and safe. Keywords: narcotics, capital punishment, punishment

Abstract

Since 1997 until now, forest and land fires (Karhutla) in Indonesia occur almost every year. The 2015 Karhutla incident is believed to have burned 2.61 million hectares of forest and land. In 2016, even though Indonesia was hit by La Nina, forest and land fires continued to burn forest and land area of 14,604.84 hectares. Forest and land fires have a detrimental impact on the environment, social and economy. Even the problem of fires in Indonesia has caused smoke problems for neighboring countries, especially in the Southeast Asia region. The government has tried to deal with the forest and land fires both in the form of regulations and programs, but the forest fires still occur. Several studies have shown problems in handling forest and land fires, including difficulties. The government itself is aware that forest and land fire is a multidimensional problem that requires cross-sectoral coordination to deal with it. Keywords: forest fires, Indonesia, policy

Abstract

Border governance is a necessity for Indonesia as an archipelagic country bordering maritime and / or land with other countries. Indonesia is located geographically between two continents and two oceans and no less than 17,504 islands. the border region has a very strategic multifunctionality. Politically, border areas provide legal certainty for internal and external sovereignty, both in the context of managing government administration and applying national law and in engaging with other countries. The existence of clarity of this border region will also provide legal certainty for a country for the utilization and management of natural resources contained in its territory for the benefit of the prosperity of the whole community. Border management must also be aimed at the prosperity of the people, especially those living on the border. The development of socio- economic activities to improve the socio-economic well-being of people at the border is very important because it will directly and indirectly strengthen the security aspects at the border. Abstract

Aparatur Sipil Negara yang kita kenal dengan sebutan ASN merupakan Ujung tombak Pemerintahan terhadap masyarakat yang bertujuan melaksanakan tugas pemerintahan baik yang ada di pusat maupun di daerah seluruh wilayah Negara Republik Indonesia. Sebagai penyelenggara pemerintahan, ASN bertanggungjawab secara menyeluruh untuk memenuhi kebutuhan kehidupan dalam bermasyarakat.Guna mencapai tujuan nasional bangsa Indonesia tersebut diperlukan ASN yang professional, bebas dari intervensi politik, bersih dari praktik korupsi, kolusi dan nepotisme sehingga mampu untuk menyelenggarakan pelayanan publik bagi masyarakat serta mampu untuk melaksanakan peran sebagai perekat persatuan dan kesatuan bangsa berdasarkan Pancasila dan UUD Negara Republik Indonesia Tahun 1945.  Penelitian   ini  merupakan     penelitian yuridis normatif dengan spesifikasi penelitan kepustakaan   (Library Reasearch)   yang bertujuan untuk menjelaskan tentang pemahaman   terhadap   tanggungjawab,   Hak dan Kewajiban ASN    pada kewajiban dalam melaksanakan pekerjaan yang menjadi tanggungjawabnya yang sesuai dengan peraturan perundangan yang telah ditentukan.  Pemahaman ASN terhadap Tanggungjawab,  Hak dan Kewajiban ASN sebagaimana yang   telah   diatur dalam Undang-undang Nomor 5 Tahun 2014   tentang   ASN  merupakan   upaya dalam mewujudkan ASN yang profesional dalam   menjalankan   fungsi   serta  tugasnya   untuk   menyelenggarakan pemerintahan yang berwibawa dan bertanggungjawab kepada seluruh rakyat Indonesia yang telah digariskan oleh  Pendiri negara (The Founding Fathers) Republik Indonesia.   Hasil   penelitian    ini   mendiskripsikan   bahwa   ASN  merupakan Pelaksana    penyelanggara   Pemerintahan Negara Republik Indonesia yang bekerja secara Professional   berdasarkansystem merit(cakap dan ahli) di bidang masing-masing.    Setiap ASN   mampu  untuk    memahami  tanggungjawab,   Hak dan Kewajiban bagi dirinya dan berupaya untuk melaksanakannya.    ASN   memahami tanggungjawab, hak dan kewajiban berdasarkan  ketentuan UU no. 5 Tahun 2014 tentang Aparatur Sipil Negara membuktikan bahwa  melaui ASN inilah Pemerintah telah berupaya untuk mewujudkan tujuan Nasional bangsa   Indonesia   melalui  ASN   yang   bekerja  dan   melakukan    kewajiban dalam melaksanakan tugas dan tangungjawab kepada seluruh rakyat. Kata Kunci: Pemahaman ASN, tanggungjawab hak dan kewajiban.

Abstract

Children are heir of a nation’s future. Therefore, they ought to be comprehensively prepared both physically and psychologically in order to reach desired adulthood. Parents, trustee, and teachers together play important roles in this regard. To reach impeccable adulthood, fulfilling certain education extenthas been serving obligatory purpose since long time ago. Generally, one child’s education and well-being have been parent’s responsibility. However, stateguarantees every child access to proper education fulfillment, as it is written on UUD 1945 article 28 C, which ensures citizen development via basic physical needs fulfillment, including getting education and benefit from science, art, and cultural advantages in order to improve quality life. Yet in the middle of the process, sometimes they face obstacles in form of physical and psychological harassment. It can be, they find it delivered through playing groups, teaching teams, or surrounding adults. The complication has to be ignorance to education in general and school reluctant specifically. If the effect carries over they would eventually loss the opportunity of getting education rights served right.This paper aims to study access to education in general, harassment in school environment, and children-friendly school as an effort to fulfill education rights.According to the study the author concludes that education rights serve as one of human rights. Consequently, government guarantee its access to ensure education rights served right, including carrying out feasible actions and countermeasure to prevent and resolve problems in the society. The author would like to suggest children-friendly schooling in every city or regency in Indonesia.Key words: children rights, education rights, children-friendly school

Abstract

Sistem peradilan pidana anakwajib menggunakan pendekatan keadilan restoratif dengan melalui diversi. Diversi dalam penyelesaian perkara anak adalah proses peradilan pidana yang dialihkan ke proses di luar peradilan pidana. Jurnal ini difokuskan pada bentuk penerapan mediasi penal sekaligus pembatasan pemberlakuannya dalam sistem peradilan pidana anak yang diatur dalam Undang-Undang Nomor 11 Tahun 2012 Tentang Sistem Peradilan Pidana Anak. Metode pendekatan yang digunakan adalah yuridis normatif, dengan spesifikasi penelitian deskriptif. Hasil penelitian ini adalahbahwa sistem peradilan pidana anak mengandung pengertian bentuk mediasi penal, dengan dua pendekatan yakni victim offender mediationdan restorative conferencing yangmeliputi family group conference.Kata Kunci:mediasi penal, keadilan restoratif, diversi.
