Abstract

This article explores the culture of music in the tradition of Shalawat Emprak in Pesantren Kaliopak Yogyakarta from the perspective of Sufism. Essentially, Shalawat Emprak is similar to the Sufi tradition of listening to music (samâ‘) as one of the media to draw closer to God. The music is, however, regarded merely as a medium, but it is not a primary mean. Shalawat Emprak is different from classical Sufism, which emphasizes personal behavior towards God. In the context of Sufi thought, Emprak seems more like a Sufi order (tarekat), in which an activity carried congregation. The process towards God congregation in Emprak is reinforcing efforts and build resonance, so as to strengthen each individual and accelerate the process toward God. Every soul can actualize the unique path to God, one of them through tradition of Shalawat Emprak. This is because the path to God is not only found in the mosque or other places of worship, but also in the human’s soul. Therefore, it is an important matter to create conditions, pre-conditions, and social relationships which stimulate and encourage a person to find a way to God.

Abstract

Within Islamic philosophy, the implementation of punishment for those who commit a crime (jarîmah) is a form of prevention and retaliation (al-rad‘ wa al-zajr) as well as correction and education (al-islâh} wa al-tahdhîb). The implementation of imprisonment in Islam is categorized as ta‘zîr, since there is no any stipulation in the Qur’an which regulates about imprisonment. Departing from this paradigm, this study concludes that the implementation of punishment in the form of imprisonment corresponds with the aim of punishment itself within Islamic criminal laws. However, the writer argues that the implementation of imprisonment in Indonesia should be seriously enforced in order to obtain its main objective. This is because the society tends to put a negative stigma upon those who have imprisoned. Therefore, the government, penitentiary officers, and the society should work together to help and educate the convicts. Moreover, the government should be responsible for providing the penitentiary adequate facilities to support the process of education and its effectiveness

Abstract

This article explores the views and criticism Yûsuf al-Qaradâwî against Western views (secularism) about science. He provides awareness that religion and science have a relationship of mutual need. Religion needs science to explain the scientific facts that exist in nature. On the contrary, On the contrary, science requires religion in providing the moral basis for the application and usefulness of this science for human life and the environment. Happiness in the world is a prerequisite for achieving happiness in the hereafter, because religion is a source of knowledge and science is a means to apply everything contained in religious teachings. Both of these will reinforce each other and work together, so as to produce individuals who are devout in religion and progressive in developing science. Besides humans consists of two elements, physical and spiritual. Both of these elements has its own needs. Physical needs can be met by science, whereas the spiritual needs met by religion. If both of these needs are met, happiness in this world and in the hereafter will be achieved.

Abstract

The article deals with K.H. Hasyim Asy’ari’s thought of character education. The result of the study indicates that according to K.H. Hasyim Asy’ari the characters of teachers and students in his work Adab al-‘Âlim wa al-Muta’allim can be classified into three parts, are mentality or character, which should be possessed by teachers and learners: attempts to be done in order to become characterized teachers and learners, and: teaching strategies employed by educators and learning strategies used by learners. These three parts have compatible indicators with the competence of educators stated in UU Sisdiknas (The Legislation of National Educational System) year 2003 along with 18 values of character promulgated by Pusat Kurikulum Pengembangan dan Pendidikan Budaya dan Karakter Bangsa. Moreover, according to K.H. Hasyim Asy’ari, the relevance of character education with the context of character education in Indonesia consists of a number of character education elements, namely the meaning and goal of character education, the values of character for both teachers and students, the rationale of character education, the method of character education, the media of character education, and the evaluation of character education

Abstract

The article tries to redefine the meaning of sakînah family by emphasizing the importance of understanding the essence of marriage and domestic violence, which leads to criminal action, for spouse. Marriage is a social contract and agreement between a man and a woman, which aims at legalizing sexual interaction, making familial relationship through marriage, ensuring one’s descendant, making a family, and living life together. Criminal action within marital relationship is any action committed by each spouse over another that violates laws, any action that harms his/her spouse physically, physiologically and economically, and/or a spouse who ignores his/her responsibility over another and over his/her children in the domestic sphere. Sakînah family is a family which build on the basis of faith and piety upon God, a family whose breadwinner is able to fulfill the needs of family members based on his ability, a family which lives harmoniously and peacefully, a family which possesses ability and capability to overcome any conflicts among its members, a family with no violence and domestic crime, and a family whose members play their role respectively.

Abstract

The article discusses the mechanism of foreign exchange through what so-called Forex teamster. The study concludes that trading, viewed from the aspect of goods exchanged, consists of three kinds, namely barter, buying and selling of goods with money, and money exchange. It is allowed to use broker’s service in money exchange activity. It has been even a compulsory (wâjib ‘ayn) for a trader to select and chose a legal and trusteed broker in order to assure and secure his money. The reason is that a broker becomes not only wakîl (a trustee or an agent) of trader to proceed the transaction of the trader into the market, but also plays role as a responsible person who guarantees the trustiness of market over the trader. In other words, a broker has to make the market trusts every trader’s transaction. The transaction has to cover all benefits and risks. It can be understood, therefore, that non-dealing desk broker is a person who meets the requirements of wakâlah and d}amân contacts implemented within Forex transaction.

Abstract

The study deals with the discussion about the validity of hadîth about “the most despised matter by God is divorce” and its invalidity as well as the implication of each status of sahîh and da‘îf which rests in the hadîth towards the concept of lawfulness and detestation of divorce. For certain group of people this hadîth might seem wise, since it would be able to significantly decrease the number of divorce or to be a sort of “an ultimate weapon” for judge or parents to give advice for spouse who experience domestic rift. However, for other people the hadîth seems inconsistent. They argue that it is impossible for God to hate a lawful matter. Therefore, the hadîth is unique, since it is validated by a number of prominent Muslim scholars on one hand. On the other, there are also a number of noticeable Muslim scholars who believe the hadîth as da‘îf. Each group, however, build their argument on a common ground, i.e. conventional science of the critique of hadîth.

Abstract

Dengan membawa perspektif “sejarah sebagai interpretasi yang terus berkembang”, kertas kerja ini meninjau kembali sejarah penjajahan di Indonesia. Pendidikan menjadi diskusi utama pada bahasan ini karena perkembangannya telah memberikan sumbangsih terhadap terbentuknya identitas budaya masyarakat Indonesia. Terbatasnya akses pendidikan ala Eropa di masa itu telah memposisikan Pendidikan Islam beriringan dengan pola pendidikan arus-utama saat itu. Politik dan kebijakan pemerintah kolonial berpengaruh terhadap implementasi pendidikan ala Eropa bagi pribumi setelah politik etis diberlakukan. Di sisi lain, Pendidikan Islam mulai meneguhkan posisi oposisinya. Setelah tahun 1900-an, akulturasi situasi kolonial, Islamisme, dan ideologi lainnya membentuk secara jelas identitas kultural baru Pendidikan Islam di dalam ruang kelas sekolah dan pada superstruktur pemerintahan kolonial untuk merespons penindasan dalam beberapa cara tertentu.

Abstract

The article seeks to discuss the concept of education based on “the Golden Generation” promulgated by M. Fethullah Gulen in creating the best next generation. The study shows us that education is undisputedly the sole pivotal way to nurture the noble values of humanism upon the pupils. Gulen’s Golden Generation is a pure generation which is able to put themselves as an example and possess great motivation to the values of humanism to serve other people. The aim of the creation of the Golden Generation is to generate welfare for every nation and light its way to reach both physical and spiritual wellbeing. At this point, a school can be regarded as a laboratory, which offers “an efficacious medicine” to heal social pathos and those who possess knowledge and wisdom to formulate such medicine are teachers. Family, on the other side, plays indubitably important role to support and motivate the children to develop their abilities and skills for the sake of themselves and other people. In this context, family along with society also take a pivotal part to establish what so-called “a new strong pillar” for the nation.

Abstract

The article discusses Muhammad Natsir’s concept of democracy of Islamic education. Assessing democracy and Islamic education is inevitably important particularly when the modern people deal with such densely complicated problems within their life as they will lose a control upon the values of humanism. Therefore, emphasizing the values of humanity in their appropriate place within educational realm (in this context is Islamic education) is unquestionably pivotal matter. The study finds that democracy of Islamic education in Natsir’s perspective can be noticeably observed in his notions on integral, harmonious and universal education. Moreover, the author would argue that Natsir’s perspective of democracy within educational sphere has found its significance to the contemporary Indonesia’s national educational system. It can be visibly seen, among others, in efforts to inhabit and cultivate the values of democracy, which have been firmly itemized in the Act of National Educational System. In this context, Islamic educational institutions have also take part and put great priority in cultivating such values within their all formal educational levels.
