Ijtimaiyya journal is a journal which is managed by the Programme Pascasarajana (PPs) Universitas Islam negeri Raden Intan Lampung. First published in 2008 and regularly published two (2) times a year, in May and in November. Since 2014 this journal began in the online. The script that is loaded is the original manuscript, not yet published in any publication. Scripts can be articles, research results, scientific ideas as well as book reviews. Editors receive from the author of the Madrasah, universities, research institutions and other agencies concerned with the Islamic Community Development.

Abstract

During the 20th century, a combination of the unprecedentedchallenges-secularized authoritarian state structures, aWestern-inspired rationalist discourse and Islamicfundamentalist critique since the second half of the 19thcentury-led to a decline in traditional forms of Sufism. Thereconstruction of Sufism teachings which is relevant to thetimes is a necessity. The changing times have an impact on thevalues that led to a moral crisis. Although this century isknown as the victory for the religion, that able to provide ananswer to the crisis of modern man, but it is not in the formof deeds, which tend formalitistic. That need is the spiritual,giving peace and tranquility of spiritual aridity, and also peaceof mind. That can be found in Sufism. However, that hastransformed the paradigm, which is not only a spiritualdimension, however, a social one, or called Social Sufism.

Abstract

The phenomenon of the rise of the spiritual and thedecline of traditional religion become a global trend,not only in Indonesia, but also in many othercountries. While there may be an increase in thenumber of avowed atheists and agnostics, there is alsoas “spiritual but not religious.” Spiritualism becamethe answer to the mental and psychological excesses ofmodern people especially those living in urban areas.In addition, a number of sects and schools of thoughtwhich later became the foundation of many spiritualeducations began to emerge, or at least have a lot ofnew findings and approaches as a result of the findingsof modern science, to develop spiritual dimension.This article will discuss further abaut thatphenomenon.

Abstract

Ash-Shiddieqy’s introduction of term Indonesian fiqhwas a compromise between Indonesian nationalismand Muslim reformism. By turning Indonesiancustoms into one of the sources of Indonesian fiqh.His conceptualization of an ‘Indonesian fiqh’, throughhis immersion in both classical Arabic texts and thewritings of later reformists from the Middle East, andHazairin’s stress on the role of particular culturalcircumstances in shaping the Islamic content ofIndonesian law, both foreshadowed comparableinitiatives in the 1980s and 1990s, such as MunawirSjadzali’s Reaktualisasi Agenda. All theses initiativescontinue to form the background of discussions anddebates on law among Indonesian Muslim intellectualsat the beginning of the twenty-first century.

Abstract

One of the important teachings in Islam is themarriage. Marriage is a Sunnah of the Prophet andrecommended in Islam when someone has meetvarious requirements. The importance of the doctrineof marriage is that in the Qur'an there many verses,either directly or indirectly, addressed the issue ofmarriage. Marriage or paired an ordinance of Allah tohis creatures. It is repeatedly emphasized by Allah inthe Qur'an. Marriage in the Qur'an is a suggestion thata full requirements so that the goals of marriage ismentioned explicitly in the Qur'an, despite its generalnature. In the Qur'an there are two key words thatindicate the meaning of marriage, namely zawwaja andnakaha, which is in use, can be defined by marriage.The Qur'an uses these two words because it makes amarriage partner, conjugal relations lawfullyaccompanied by ijāb and qabūl.

Abstract

A legal act that is causing the joint property is marriage,whether marriage is governed by article 26 KUHPdt andso on, as well as marriage as stipulated in UU No. 1/1974about marriage. Breakup of marriage either through deathor divorce (divorce to sue or divorce divorce), oftencause a secondary effect that is often not resolved well,aside from the determination of the status of childcustody, subsistence, also on the division of jointproperty, which is also often a trigger the new conflictbetween husband and wife after the divorce. How the lawof community property in a marriage based approachIslamic law and positive law of Indonesia became a staplein the study of this article.

Abstract

There are clear differences in meaning of the Prophetictraditions (hadith) among the Islamic scholars. Accordingto scholars of Hadith (muhaddits), everyting that comesfrom the Prophet, in the form of words, deeds, taqrir,physical and non-physical, since before his apostleshipand after it, is a Hadith or Sunnah, which should befollowed. As for the scholars of fiqh (fuqaha), hadith islimited on words, deeds, and taqrir taht only has a legalimplications. The deeds of the Prophet which isperformed for the basic needs as human beings, thedeeds that was done by accident, physical form, are nothadith. Among Muslims, Tablighi Jamaat is thecommunity that tends to the defination the scholars ofhadith, so they practices and strives for such outwardappearance of the Prophet. Tablighi Jamaat are generallytextual. It can be seen from the practice of the sunnahsthat related to worship, manners or appearance, such ashow to dress, wearing a cap and turban, siwak,lengthening the beard and shaving the mustache, eatingand drinking, and others. For them, the Prophet was sentas an example for humanity, so that everything thatcomes from him should be followed

Abstract

Education in the context of Islam is regarded as aprocess that involves the complete person, including therational, spiritual, and social dimensions, all entwined inunified perceptual framework and relying, entirely, in itsfundamentals and morals on the Holy Quran and theProphet‟s Sunnah. Through Islamic education,individuals are educated and cultured following an allencompassing method that involves all aspectsmentioned, without compromising any, or giving primacyof one over the other. So, Islamic education is uniquelydifferent from other types of educational theory andpractice largely because of the all-encompassing influenceof the Holy Quran and the Prophet‟s Sunnah. Bothserves as a comprehensive blueprint for both theindividual and society and as the primary source ofknowledge.

Abstract

Professional zakat is kind of zakat that be paid fromprofessionals‟ fees after certain nisab. In term ofprofessional zakat, a profession is classified into twocatagories which are: first, personal private profession;and second, the profession that depend on otherpeople or institution. It formulation is referredlogically to a common conduct of agricultural zakat;which is type of zakat that farmers paid after theirharvest without any waiting times‟ requirement. Fromthis common practice, some peoples do an analogicaleffort to convert it to be a new form of zakat. A newterminology of zakat which is „professional zakat‟ thatreally close to agricultural zakat in term of it laws‟,purposes and requirement. Beginning here thecontroversies came up. These mentioned issues will bediscussed further on the writing.

Abstract

Baznas (the National Alms Agency) will design as thecoordinator and supervisor of zakat collection anddistribution activities in Indonesia, the world‟s largestMuslim country. This role, he said, would help thegovernment integrate the zakat management system inIndonesia which had been organized independently bycountless registered and unregistered zakat collectionorganizations scattered around the country, and ensurethat the zakat funds would also be used to empowerthe poor. According to the new alms law, the public isstill allowed to establish zakat collection agenciesunder Baznas supervision as long as they meet alladministrative requirements, including the possessionof a recommendation from Baznas and technicalability to run their alms collection and distributionprograms.

Abstract

Maqâshid Syari‟ah refers to an act of achieving andprotecting the benefits and good (masalih) for the sake ofhuman beings. In fulfilling the maqâshid al Syari‟ah, maninadvertently fulfills not only his social and ethical needsbut also his commercial needs as well. There lies thewisdom of Muslims having to “fulfill all obligations” as indoing so mankind is fulfilling one another‟s needs andobligations, hence a win-win for all. The current practiceof Islamic banks needs to incorporate maqâshid al-Syari‟ahinto their management strategy to ensure its sustainabilityto serve mankind in the future, in confirmation to therequirement of Syari‟ah. Though profitability is essentialand must be achieved, but it is not the main objective. InIslam, the ultimate objectives of any activities includingbusiness activities are ultimately with the aim of achievingobjectives of Syari‟ah or maqâshid al-Syari‟ah.
