Musawa : Jurnal Studi Gender dan Islam
Musãwa Journal of Gender and Islamic Studies was first published in March 2002 by PSW (Pusat Studi Wanita) Sunan Kalijaga Yogyakarta under contribution with the Royal Danish Embassy Jakarta. In 2008, published twice a year in collaboration with TAF (The Asia Foundation), namely January and July. Musãwa Journal is a study of gender and Islam especially on gender mainstreaming and child rights both in the study of texts in the Qur’an and Hadith, figures and thoughts, history and repertoire, classical and contemporary literature as well as socio-cultural studies. All concentrations are in the context of Indonesia and other countries in Southeast Asia within the framework of unified NKRI, based on Pancasila. Musãwa Journal has been published by PSW UIN Sunan Kalijaga Yogyakarta since 2002. Initiated by lecturers, gender activists and Islamic studies scholars of PTKI ( Higher Education of Islamic Religion) Musãwa has regularly published academic works and researches on gender and Islam for almost two decades. Now, the Journal extends its studies with Children and Human Rights (HAM). All studies are still in the context of gender and its mainstreaming. Through the studies hopefully, the Musawa journal can be part of the implementation of gender mainstreaming in the context of Indonesian society.

Abstract

People in Indonesia pay more attention to children issues nowadays The Government has made many efforts to anticipate the problems, primarily by issuing the regulations. The newest regulation issued by the Government is regulation number 23 year 2002 on Children Protection. The regulation, which has 14 chapters and 93 articles, includes many important points and one of them is on the principles and goals of children protection, in article 2 and 3. This article shows that within an Islamic perspective the content of those articles is in line with Universal Islamic Norms.

Abstract

Tulisan ini mencoba menjelaskan fenomena keterpinggiran kaum perempuan Minangkabu di Sumatera Barat. Beberapa konsep teoritik feminis digunakan untuk menganalisis bagaimana konstruksi sistem sosial masyarakat memposisikan perempuan dalam realitas kehidupannya. Lalu, membaca posisi ketertindasan perempuan dalam kemiskinannya atau kemiskinan perempuan dalam ketertindasannya. Pembahasan ini menjadi penting disebabkan fakta menunjukkan betapa banyak kaum perempuan Minang berjuang melawan kemiskinan yang sering terlihat melawan kodratnya. Pada posisi ini, pembahasan ini diharapkan dapat membuka pemahman atas dominasi perempuan dalam kultur Minangkabau, Sumatera Barat. Kajian ini menggunakan pendekatan deskriptif­fenomenologis, sebagai usaha ekplorasi dan klarifikasi yang kemudian menjelaskan fenomana pemiskinan kaum perempuan sebagai realitas sosial. Belenggu kemiskinan perempuan dalam studi ini dilatari oleh dua hal yaitu ketidakberdayaannya dalam melawan kultur yang bersifat paternalistik dan hambatannya dalam menemukan akses ekonomi yang lebih baik untuk kehidupan yang lebih bermartabat.[This article explains the phenomenon of marginalization on Minangkabau women in West Sumatra. The author uses some feminist theoretical concepts to analyze how social construction puts women in their reality of life. Then, to read the position of women oppression in their poverty, or women’s poverty in their oppression. This research is important because the facts show that many Minangkabau women struggle against poverty which often seems to be against their nature. In this position, this research is expected to reveal the understanding of women’s dominance in Minangkabau culture, West Sumatra. This research uses a descriptive-phenomenological approach as an exploration and clarification effort, then explains the phenomenon of women’s impoverishment as a social reality. The poverty shackles of women in this research are based on two things, namely their inadequacy against the paternalistic culture and its obstacles to find better economic access for a more dignified life.]

Abstract

This article discusses of KKG in theological perspective al-din al-Qayyim in alQuran. In this case, this perspective is something new developed. The old conception that developed in the community is always viewed from the perspective of law or jurisprudence. Theological concept that carried the authors in this case done in depth through the verses found in the Qur'an in the context of al-din al-Qayyim. Jurisprudence approach commonly used for this are not able to address the true essence of the problem. Such an approach makes fiqh not able to uncover the goals and ideals of the Qur'an in realizing real goodness in all areas of life, including the nine areas set out in the Bill. Through theological approach al-din al-Qayyim can manifest a new enlightenment.

Abstract

Since last decades gender issue has been a debatable issue in Indonesia, particularly in the field of education. Men generally have access to all stages or levels of education, while women are mostly left behind. Gender equality has been declared nowadays. Women, however, are still discriminated in the field of education. This article offers some important alternatives to solve the problem of gender inequality in education. One of important strategies to deal with the problem is developing an inclusive educational system. This model of education includes six steps: first, revising the language and content of text books which have gender bias; second, encouraging female students to express their cultural differences; third, giving opportunity to female students to be able to access to and participate in all programs and departments in every educational stages, especially the programs that generally are dominated by male students, by developing a new student recruitment system that considers gender balance; fourth, integrating gender equality paradigm in every subject matter and increasing the gender awareness of both teachers and students; fifth, developing extra programs periodically and giving the women an opportunity to be the leader of the program; sixth, making gender balance between the number of male and female teachers and giving them same access and participation in the process of decision making. The strategy, nevertheless, is not enough merely by transforming the educational system and program. The paradigm, more over, has also to be changed. Thus, the writer proposes what so~call humanity educational paradigm; the educational system which not only rejects gender inequality, but also makes an effort to eliminate all kinds of humanity based,discrimination and exploitation. The strategy focuses primarily on the empowerment of students. It includes three important parts: power-to, power-with, and power within. By employing this strategy, education will become the most effective medium to eradicate all gender inequality problems and, at the same time, create equality for both women and men in education.

Abstract

A child’s right to education within the family according to Imam Syafi’i and its significance for early childhood  education in Indonesia This research is based on library research on the rights of the child to education within the family from the viewpoint of Imam Shafi’i, and the impact of his teachings on early childhood education in Indonesia. The study is interesting because the first schools to appear in Indonesia were of the Syafi’i tradition. Imam Syafi’i jurists and ushuliyyin have collections of poems that express the need to develop education in early childhood. Despite this, the theory of children’s education in the school of Imam Syafi’i is under researched. This study examines three research questions. First, how does one undertake a  biography of the thought of Imam Syafi’i and Imam Syafi’i school of thought. Second, what is the concept of children’s rights in the family in the view of Imam Syafi’i. And third, is there reference to  early Childhood education that implies the concept of children’s rights to education in the view of Imam Syafi’i. This study concludes that Imam Syafi ‘i in scientific rihlah is purely academic. Imam Syafi’i also elicits several important ideas on a child’s rights within the family, the right to education and the right to self-expression. Imam Syafi’i schools are relevaant to early childhood education in Indonesia in which these (religious education) schools are widespread.

Abstract

The debate on whether or not a wali is required in a marriage contract has been a long standing issue among Muslim jurists, particularly during the formation of madzahib (schools of thought). The mainstream view held by Indonesian Muslims who are mostly adhered to the Syafi'i madzhab is that the presence of a wali becomes a criteria for the validity of a marriage. However, if the issue of wali is being re-examined by using historical and Islamic jurisprudence approach it is found that the presence of wali is not required in all marriage contracts of all women. A woman may become a wali and may marry off herself without a wali if she fulfils the requirement of being a wali, namely intelligent, sound of judgment, mature and independent. Such a view is held by scholars from the Hanafi school of law. Nevertheless, the concept of wali is not merely a legal issue; it is a meant for guaranteeing the wellbeing of a woman upon entering her marriage. The Prophet is therefore suggested that wali should be presented in a marriage contract.

Abstract

In this article Dadi shows that there are dozens of hadith concerning abortion, most of which are valid From the analysis of these it appeals that people who abort a foetus must pay a fine, which could be in the form of freeing a slave, paying with five camels or one hundred sheep or paying a cash equivalent to this price. Nevertheless, this article states that although in the hadith abortion is regarded as a crime, it is not considered murder because the foetus is not yet "separated" from its mother. As such the punishment for abortion is not the same as the punishment for murder.

Abstract

"No ... of a man and a woman except if their mahram, and no travellingfor a woman except with her mahram"This long sentence is now decoratingmany public space in Aceh, including on ther tree trunks in the city gardens where young unmarried couples might be interested in enjoying. This propaganda is based on the province Qanun (regulation) No 14/2003 about prohibition of kludwat (...). This paper will not deal with the Qanun per-se, rather with the underlying arguments used by the proponents of the articulation of the Qanun by local intellectuals. My discussion to the issue begins with the examination of the social context within which the hadits aboui mahram is conceptualized, then followed by a deep analysis on the formulation of Fiqh (Islamic law) as well as gender analysis on the impact of mahram concept to women's mobility. At the end present my recommendation in applying transformative understanding on the mahram concept.

Abstract

Within the world of patriarchy, it is very important to examine the issue of the leadership of women. This very issue, which was latent within the Islamic tradition, reappears in line with the emerging awareness on the needs of women to gain wider roles in the public sphere. The issue of women leadership is responded by various individuals and institutions. Amongst the institutions concern with the issue is the Majelis Tarjih and the division of the Development of Islamic Thought of the Muhammadiyah, These institutions pay special attention to the issue of the leadership of women within the areas of mu 'amalah and 'ibadah, One proof of the appreciation of the Majelis Tarjih on this issue is their attempts to examine various religious issues within the frame of gender analysis.

Abstract

Paper ini mengkaji implementasi kesetaraan gender dalam pembinaan karakter santri Perempuan di Pondok Pesantren DDI Mangkoso Kabupaten Barru Sulawesi Selatan. Paper terfokus pada implementasi kesetaraan dalam pendidikan karakter di Pondok Pesantren DDI Mangkoso pada nilai-nilai kesetaraan gender dalam perspektif pendidikan karakter, faktor penghambat dan pendukung penerapan nilai-nilai kesetaraan, dan implementasi kesetaraan di pesantren. Tiga hal tersebut telah diterapkan dengan relevansi pendidikan karakter pada kesetaraan gender di pesantren. Berdasarkan bentuk data dan karakter objek yang diamati, penelitian ini tergolong penelitian survei. Masyarakat Pondok pesantren diantaranya Kyai, guru dan santri memiliki pemahaman yang cukup baik tentang gender. Siswa perempuan memandang persepsi gender sebagai sifat. Hal tersebut terejahwantakan dalam kegiatan ekstra di pesantren yang tidak membeda-bedakan siswa laki-laki dan perempuan.[This paper examines the implementation of gender equality in fostering the character of female students at the DDI Mangkoso Islamic Boarding School, Barru Regency, South Sulawesi. The paper focuses on implementing equality in character education at the Islamic Boarding School DDI Mangkoso on the values of gender equality in the perspective of character education, inhibiting and supporting factors for the application of equality values, and the implementation of equality in Islamic boarding schools. These three things have been applied with the relevance of character education to gender equality in pesantren. Based on the form of data and the character of the object being observed, this research is classified as survey research. The Pondok Pesantren community, including kyai, teachers, and students, have a relatively good understanding of gender. Female students view gender perceptions as traits. This is manifested in extra activities at the pesantren that do not differentiate between male and female students.]
