Musawa : Jurnal Studi Gender dan Islam
Musãwa Journal of Gender and Islamic Studies was first published in March 2002 by PSW (Pusat Studi Wanita) Sunan Kalijaga Yogyakarta under contribution with the Royal Danish Embassy Jakarta. In 2008, published twice a year in collaboration with TAF (The Asia Foundation), namely January and July. Musãwa Journal is a study of gender and Islam especially on gender mainstreaming and child rights both in the study of texts in the Qur’an and Hadith, figures and thoughts, history and repertoire, classical and contemporary literature as well as socio-cultural studies. All concentrations are in the context of Indonesia and other countries in Southeast Asia within the framework of unified NKRI, based on Pancasila. Musãwa Journal has been published by PSW UIN Sunan Kalijaga Yogyakarta since 2002. Initiated by lecturers, gender activists and Islamic studies scholars of PTKI ( Higher Education of Islamic Religion) Musãwa has regularly published academic works and researches on gender and Islam for almost two decades. Now, the Journal extends its studies with Children and Human Rights (HAM). All studies are still in the context of gender and its mainstreaming. Through the studies hopefully, the Musawa journal can be part of the implementation of gender mainstreaming in the context of Indonesian society.

Abstract

Menstruation - called haid in Islamic fiqh, is not seen as merely physical, biological function of women's bodies. According to most traditional societies, this very exclusive women's experience is apparently perceived to be a symbol signifying specific meaning and myth. Unsurprisingly almost all societies have conceptualized what so called menstrual taboo in an anthropological tradition within their cultural systems. One of the major implications of these ideas of menstrual taboos is the emergence of devices signifying the event of menstruation, such as cosmetics, high heel footwear, and jilbab. Another significant impact is the restriction of women's social role and engagement. This article is addressing these two mythical and social implications of menstrual taboos and compare them with Islamic doctrines of haid.

Abstract

This article discuss on body as reality subject. Awareness of body as subject is awareness of existed, placed and different. But as object, body is battle field for many ideologic interests. Those ideologic interests are competing to determine the body. Therefore body emerge as false body, an exhibit for many ideologic interests. Those ideologic interests could enter through sign consumption practice on body. The needs of body for many consumptions is stimulated by many pleasures provided by media. Sign consumption for body and body mediated by media are actually bodies that are imprisoned.Those bodies are watched, arranged, and being disciplined so they can reach the desirable body image condition. Body image that is mediated by media through many sign consumptions can be seen as a symptom of the death of human as subject. This symptom is part of dehumanisation as the result of global media industry. Through media persuasion, the process of the death of the body felt so smooth, relax, entertaining, flattering, and happy. Anyone who caught into the trap will not realise it and will become addicted and in the end he/she will experience decentering of the subject.[Artikel ini mendiskusikan studi tentang tubuh sebagai subjek realitas (khalifah). Kesadaran tubuh menjadi subjek ini adalah kesadaran menjadi ada, berada dan berbeda. Namun sebagai objek, tubuh merupakan ruang pertarungan bagi berbagai kepentingan ideologis. Berbagai kepentingan tersebut saling berlomba mendeterminasi tubuh. Sehingga tubuh yang hadir adalah tubuh palsu sebagai ruang pamer berbagai kepentingan ideologis. Kepentingan ideologis tersebut masuk melalui praktek konsumsi tanda pada tubuh. Kebutuhan tubuh terhadap berbagai konsumsi tersebut dirangsang melalui berbagai kenikmatan yang dijajakan oleh media. Konsumsi tanda bagi tubuh dan tubuh yang termediasi oleh media sesungguhnya adalah tubuh-tubuh yang dipenjara. Tubuh-tubuh tersebut diawasi, diatur dan didisiplinkan agar sampai pada satu kondisi body image yang diinginkan. Body image yang termediasi melalui media lewat berbagai konsumsi tanda dapat dilihat sebagai suatu gejala kematian manusia sebagai subjek. Gejala kematian ini bagian dari dehumanisasi sebagai dampak dari industri media global. Melalui rayuan media, proses kematian tubuh tersebut begitu cair, rileks, menghibur, menyanjung dan menyenangkan. Hingga tanpa terasa bagi siapa saja yang masuk dalam perangkap hasrat tubuh tersebut akan ketagihan hingga akhirnya mengalam decentering of the subject.]

Abstract

This article discusses about woman sexual exploitation according to the Qur'an. The study focuses on the general Qur'anic massages on human and women's rights, and, more specifically, an-Nur: 33. It is obvious that since the beginningof its revelation, the Qur'an has been strongly against woman sexual exploitation. It, gradually and proportionallyacknowledges women's rights. Woman trafficking is in opposition to the spirit and elan vital of the Qur'an.

Abstract

Penelitian ini dilatarbelakangi oleh adanya sebuah pemikiran tafsir dalam tradisi Jawa yang menempatkan perempuan dalam posisi yang lebih banyak bergerak di wilayah domestik. Karena persepsi mufassir yang melihat kedudukan laki-laki lebih berpotensi daripada perempuan, maka perempuan kurang diberi ruang dalam sektor publik. Di dalam salah satu karya tafsir dari tradisi Jawa yakni al-Iklil fi Ma’ani al-Tanzil karya Misbah Mustafa, ditemukan pemahaman bahwa peran laki-laki lebih utama daripada perempuan melalui serangkaian tafsir terhadap ayat-ayat gender. Melalui analisis struktur sosial terhadap beberapa tema gender seperti asal-usul penciptaan manusia, poligami, dan kepemimpinan laki-laki ataupun perempuan, pemikiran Misbah Mustafa terpola dengan jelas. Dengan menggunakan metode deskriptif-analitis, hasil penelitian menunjukkan bahwa pemikiran Misbah Mustafa dalam tafsir al-Iklil cenderung mengulang-ulang, menukil dan melegitimasi pendapat para ulama tradisional normatif yang kebanyakan mensubordinasikan kedudukan perempuan. Tulisan ini merefleksikan ke-arah bagaimana konstruksi sosial dan budaya mempengaruhi pola penafsiran Misbah Mustafa dalam karyanya tafsir al-Iklil.[This research is motivated by an interpretive thought in the Javanese tradition that places women in a position that is more engaged in domestic sphere. Because the perception of mufassir who see the position of men has more potential than women, women are less given space in the public sector. In one of the interpretations of Javanese tradition, al-Iklil fi Ma’ani al-Tanzil by Misbah Mustafa, it is found that the role of men is more important than women through a series of interpretations of gender verses. Through the analysis of social structure on several gender themes such as the origin of human creation, polygamy, and male or female leadership, Misbah Mustafa’s thoughts were clearly patterned. By using a descriptive-analytical method, the results of the study show that Misbah Mustafa’s thinking in the interpreting the Quran tends to repeat, copy and legitimize the opinions of traditional normative scholars who mostly subordinate the position of women. This paper also shows how social and cultural construction influence Misbah Mustafa’s interpretation patterns in his work, al-Iklil.]

Abstract

Maqashid Asy-Syari’ah is an extraordinary method to view and develop Islamic ideas and spirit in many circumstances. It is often used as an analytical knife to solve problems and the application of Islamic law. This Article will attempt to read and analyze the Draft Law on Gender Equality through this method. The existence of this yet unsanctioned law has raised controversy. But such controversies should instead be used as materials to revise and perfect the draft law instead of a reason to reject it outright. The result of the analysis of the draft law shows that it generally contains the values of Islamic law. However, it is undeniable that there are several mistakes and errors which must be discussed to be perfected. The decision  whether to issue the law should depend on a costbenefit analysis.

Abstract

The curriculum, both in religious and secular educations, generally tends to emphasize men's role in public spheres and highlights women's role in domestic arena. The content of curriculum, for instant, contains gender biased pictures, sentences or illustrations. The curriculum in religious education is also similar: there is an obvious tendency to maintain gender bias due to the authors' conviction that the books they refer to (fiqih books) are sacred, already final and unchangeable. Religious text books, thus, tend to maintain women subordination. In order to develop gender sensitive religious understanding, then, there is a need to revise religious text books that include gender bias. The revision is important because this gender biased religious understanding has become common understanding in society. This is because Muslim society attempt to understand their religious teachings dogmatically. They do not use a critical approach in understanding religious norms particularly the ones they accommodate in the text books related to women's status and role.

Abstract

In the current phase of modernity, according to observation, the condition of women is still positioned as a subordinate being and is only for domestic "use". This vulnerable and dangerous position has made women into the object of releasing violence in many aspects of life not excluding the aspect of industrializing science and technology. This condition is an empiric-visual shape which indicates that patriarchal culture still reigns in life and has infected its way to education. If discussed and understood, this condition is very reflective of true Islamic teachings. By looking at such conditions, this text tries to re,discuss the spirit of Islamic teaching in the context of developing science that is based on equality.

Abstract

In the Indonesian Code of Criminal Law (KUHP) abortus provocatus criminalis is forbidden and subject to a criminal punishment regardless of the circumstances under which it is conducted. This punishment applies both to the person who undergoes the abortion and also to those persons who assist. This is regulated in passages 346, 347, 348 and 349 of the Criminal Code. Meanwhile in Law No. 23 of 1992, passage 15 in conjunction with passages 80, 81 and 82 which concern health, an exception is made concerning abortion for medical reasons, also known as abortus provocatus medicinalis. The legal sanctions applied to people who have abortions vary from fines to imprisonment. Imprisonment is set out in terms of the maximum, not minimum sentence, so that in practice the court sentence is often very light compared to the legal sanctions listed in the criminal code. In terms of fines, the criminal code itself does not sanction fines for those persons who have abortions, but this matter is further regulated in Law No. 23 of 1992 concerning health, which stipulates a maximal fine of Rp. 500.000.000,- (Five hundred million rupiah).

Abstract

On the issue of women as imams, traditional Islamic discourses severely limits the chance of women to be leaders of a prayer, even in cases where the women are clearly the most competent, for reasons that are related to gender. A peculiar new view on such discourse is given; basing itself came from the hadith of Ibnu Waraqqah, it stands as a shahih hadith through an analysis of its sanad and matan. This new view expands the chances for women by allowing them to become imams. Though this view is currently considered deviant, its existence must be publicized as a branch of development of fiqh as a whole.

Abstract

The idea of the inclusion of mahram for women travelling is an alternative and necessary instrument for the safety and comfort of women. This article anlayzes the concept ogf mahram from a sociological perspective. Socio. historically argue that the hadits of mahram was produced by the Prophet to guarantee the safety of women while they travelling. Mahram here functions like the security guard for the women. In understanding the hadith in our today's context, the rationale or "illah" of this hadits should be taken into account. Sociologically we might find significances of re-eaxamining the concept of mahram and women travelling. At least two significances arise: 1) Changes in women's capacity and roles; 2) Development of the security system, from one which based on human person to regulationas and advancement of transportation technology.
